# Item Who Council 1 Apologies received from Pinewood and Burstall. 2 East Bergholt – Judicial Review: At the time of the meeting Paul Ireland East Bergholt the official decision has not been published however the judge ruled in East Bergholt’s favour citing BDC’s definition of local, lack of clarity of BDCs policies (CS2, 8 & 11) and lack of weight given to the AONB criteria. It was suggested that parishes should do a local needs survey to determine what their parish required (EB to send SPC a copy of their housing needs survey). BDC completed a district wide survey but the results were averaged over the district so not specific to an area which may be very different to another area. BDC cannot appeal this decision but can go to the Supreme Court. This ruling potentially has implications for local government funding in that the new homes bonus is reduced. BDC have also pulled the planning application for the 144 houses. The costs of the legal action to BDC is unknown, however 2 barristers do not come cheap! JF has been monitoring another application where the council had also approved an application that did not meet a number of their policies. This application was challenged and came down to the definition of a highway and what can be built within a certain distance from the highway. It may be more effective to focus on 1-2 points when challenging an application than multiple points. Within BDC policy CS111 is significant. The new local plan is expected to be available for

# Item Who Council public consultation in Q1’17 – BAPTC could consider working together on this and lobbying as a body – dividing up the document for review would avoid parish councils reinventing the wheel. 4 Membership: Burstall, Sudbury and Conard have expressed Helen Davies Sproughton an interest. PI is contacting . It was proposed and agreed that BAPTC should hold meetings every other month, create working groups as necessary. Each member parish council has a vote. Sproughton agreed to host the meetings for 2017. It was suggested that a contribution of £100 from each parish council would pay for admin support. Chair to be rotated round attendees. 5 Devolution: may devolve on its own. SCC voted 56 All Standing yes, 7 abstentions SCC now need to do more work on this Agenda Item and come back to the county. SCC have allegedly said that that no one is against this however SALC voted against this. (Councils to ask their CC’s how they voted) SSC are expected to do more work on this and come back with their proposals. 6 Strategic Housing Land Availability & Assessment (SHLAA): All Standing Neither the SHLAA or SHELAA (Strategic Housing & Economic Agenda Item Land Availability Assessment) appear to have been published for public consultation. Next steps tbd 7 District Plan: It is thought that a first draft is coming out in All Standing January. It was suggested we meet with BDC for them to go Agenda Item through the new plan. Hadleigh have requested a meeting with them regarding their plans for several Hadleigh sites but have had no luck in setting a date. PI attempted to get Jenny Jones to attend an EB meeting – failed. (All Councils to ask their DC’s what they know about the district plan) Nick Ridley (SPC DC) has said that enough land is needed for a 5yr land supply. Planning permission for 1890 houses already given (why haven’t they been built??) Change in structure of BDC proposed from portfolio holders to a cabinet & a leader (up to 10 conservatives) – currently balanced but won’t be if 10 conservatives are in the cabinet. Scrutiny Committee under the cabinet is a statutory requirement.

(HD to determine a set of dates) 9 AOB All How should this forum be managed going forward – see #4. PI asked if there were any specific improvements needed for the website to please let him know. Hadleigh TC have complained about the planning part of the BDC website as it is difficult to find the documents.
