Public Notice PUBLIC NOTICE Released: February 8, 2000 STATEMENTS OF ELIGIBILITY FOR CLASS A LOW POWER TELEVISION STATION STATUS TENDERED FOR FILING On November 29, 1999, the Community Broadcasters Protection Act of 1999 was signed into law. That legislation provides that a low power television licensee may convert the secondary status of its station to the new Class A status, provided it can satisfy certain statutorily- established criteria. To become eligible for a Class A certificate of eligibility, the licensee’s station must, during the 90-day period ending November 28, 1999, have: (1) broadcast a minimum of 18 hours per day; (2) broadcast an average of at least three hours per week of programming produced within the market area served by the station or by a group of commonly-controlled low power television stations; and (3) been in compliance with the Commission’s regulations applicable to the low power television service. In the event that a low power television licensee is not able to satisfy the foregoing criteria, the Commission is empowered by the legislation to issue a certificate of eligibility if it determines that the public interest, convenience and necessity would be served thereby. The legislation also provided that licensees intending to seek Class A designation file a certification of eligibility with the Commission no later than January 28, 2000. The next generation of wireless technology promises to be a significant driver of economic growth and opportunity in a variety of industrial sectors and will change nearly every aspect of our daily lives. Repurposing part of the C-band for wireless broadband services while balancing the need to support incumbent operations is key to capturing the enormous value that 5G will bring to American businesses and consumers alike. This proceeding will help position the United States as the global leader in the race to 5G. With initial aspirations to “serve[] the interests of all stakeholders” in the C-band, Intel and Intelsat began this proceeding on the right track.1 That initial momentum has been slowed by disagreements among stakeholders, causing the proceeding to effectively stall. This is due to a basic failure of the C-Band Alliance (“CBA”) to recognize that other stakeholders have legitimate interests in what is really a “shared use” band and that any viable solution for repurposing part of the C-band must facilitate significant spectrum clearance.
