2 RATIONALE The subject lands fall within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for 2016-2020. Through the review of Consent Application B 004-17 to accommodate an existing residential dwelling, TRCA staff established the limits of the conservation easement land which is located within the Regional Storm flood plain and Regulated Area of a headwater tributary of the Humber River as well as an Environmentally Significant Area.

TAXES AND MAINTENANCE The lands subject to the conservation easement will stay in private ownership. As such, the owner will be responsible for taxes and maintenance.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT approval be granted to enter into a Services Agreement with The Regional Municipality of Peel (the Region) for the design and implementation of water and wastewater infrastructure in support of the Bolton Camp Redevelopment Project;

THAT authorized Toronto and Region Conservation Authority (TRCA) officials and staff be directed to take all necessary actions to implement the foregoing, including the signing of agreements, amendments or other legal documents deemed necessary to undertake the Project;

THAT the Region provide all procurement services with the bid evaluations to be done in conjunction with TRCA staff to recommend a qualified low bid contractor who in turn will enter into a contract with TRCA;

THAT the Chief Executive Officer and Chair of the Authority be authorized to award the construction contract for the installation of the water and wastewater services, if staff is unable to report to the Executive Committee or Authority as per TRCA Purchasing Policy due to timing constraints;

AND FURTHER THAT staff report back to the next Authority as required after award of contracts. CARRIED BACKGROUND Bolton Camp opened in 1922, acting as a Fresh Air Camp for mothers with small children and boys and girls from low income families. It was operated by The Neighborhood Workers Association of Toronto and spanned over 92 acres of hillside and wooded glen. In its first year it is estimated that 160 city children and their mothers traveled from Toronto to the Bolton Camp site. During the great depression of the late 20’s and 30’s this camp was a bright place for many disadvantaged kids to escape the heat and extreme poverty of the city. The camp was available free of charge to many families (on a case by case basis) through the Fresh Air Fund. During this time, there were a total of four separate camps which shared property and resources - Rotary, Sherbourne, Hastings and Howell.

As WWII began, Bolton Camp served as a Cadet Training Centre for the Oakville High School Cadet Corps. After the war ended, the site continued to operate as a camp for underprivileged youth with approximately 169 buildings and serving more than 5,500 campers at its peak. An outdoor education and conference centre was added in 1972, and the Ruth Atkinson Hindmarsh Family Lodge in 1984 to accommodate new programming and provide services for a wider audience. However, the camp closed its doors in 1999 after 77 years of operation and has remained mostly closed since that date, with Toronto Montessori operating a school on the conference centre portion in the early 2000's.

At Authority Meeting #5/10, held on June 25, 2010, Resolution #A102/10 was approved, in part, as follows:

THAT a partial taking containing 105.6 hectares (260.91 acres), more or less, consisting of an irregular shaped parcel of land improved with in excess of 30 buildings and a private water system and sewage system including two sewage lagoons, said lands being Part of Lots 7, 8, 9 and 10, Concession 8, Albion, Town of Caledon, in the Regional Municipality of Peel, municipally known as 13540-13650 Caledon-King Townline South, be purchased from the Hi-Lands of Bolton Corp.;…

Since the purchase of the property, TRCA staff has been consulting with municipal partners and community groups on redevelopment of the property and what it should ultimately be used for. Through this process, staff has developed a concept plan for re-purposing Bolton Camp from its previous use as an overnight summer camp for youth and families of Toronto to an outdoor centre for participants of all ages. Proposed programming at the renewed Bolton Camp may include adventure, sports and fitness activities, baseball diamond, community art and culture programs, outdoor education and training, leadership development and social entrepreneurship opportunities.

Staff envisions that this new facility will be a place where people come together to learn, live, play and share in experiences. The new Bolton Camp is proposed to have sports fields, a gymnasium, pool, green fitness equipment, yoga classes, running clinics, an outdoor community kitchen, smoothie or coffee bar, tree-top tours/canopy tours, ropes courses, theatre and art spaces, retail or market space and outdoor classrooms/collaboration and innovation spaces, amongst others. A key, and unique, aspect of the Bolton Camp plan is to allow and support a wide range of business models, including social enterprises, co-operatives, not-for profits, and others, that provide youth, community members, service club and local entrepreneurs the opportunity to take an active role in creating, developing and implementing programs, services and activities, while improving employment and economic outcomes in the region.

RATIONALE TRCA staff is currently engaged in a Site Plan Approval process with the Town of Caledon for the redevelopment of the Bolton Camp property. As part of this process, site plan control requires studies and plans that consider the location of buildings, landscaping, traffic and pedestrian safety, drainage, parking lot layouts and utility infrastructure. The Bolton Camp property was previously serviced by well and septic systems; the introduction of water and wastewater is imperative to the future programming and site amenities as well as in attaining full site plan approval.

In both 2015 and 2016, the Region had contributed $1.25 million in capital funds toward the site servicing at Bolton Camp. At that time, TRCA staff engaged the Region’s Public Works staff to provide their knowledge and expertise based on their extensive experience in implementing infrastructure projects of similar nature. As TRCA staff progressed with the envisioning and site development, the Region became more involved in the site servicing design phase. As the detailed design progressed, the estimated costs increased and additional capital funds were being requested from the Region in the amount of $2.6 million. With the Region’s increased capital funding and a vested interest in the project, an understanding between TRCA and the Region was made to formally provide all required services. The Region will be assisting TRCA with the following services.  detailed design;

9  permits and approvals;  procurement of a qualified contractor;  contract administration;  commissioning;  certifying substantial performance;  project budget; and  post construction deliverables.

The design consists of approximately 1.2km of water and sanitary force mains including an on-site pumping station. The water main will provide both domestic potable and fire flow to satisfy Ontario Building Code requirements for occupancy and on-site fire suppression, respectively. The sanitary force main will allow for future connections to washroom buildings throughout the property including the baseball diamond that is currently being constructed and schedule to be used this summer. The alignment of the site servicing and location of the pumping station is being designed to mitigate disturbance to the sensitive areas within Bolton Camp and the construction methodology will include measures to protect the surrounding environment.

DETAILS OF WORK TO BE DONE TRCA is hoping to obtain Site Plan Approval in early March 2018. A request has been made to the Town of Caledon for a phased approval on the site servicing submission in order to proceed with building permits to meet the Region’s schedule to tender in late March or early April. The results of the tender process are expected to be reported to the Authority on April 20, 2018.

FINANCIAL DETAILS Fees, excluding applicable taxes, paid to the Region since the commencement of planning for the project have been $105k in 2015, $157k in 2016 and $63k in 2017. Funds required to complete this project are available from the Region of Peel Capital Funding within account code # 433-01.

CARRIED BACKGROUND At Authority Meeting #5/05, held on June 24, 2005, staff was requested to report to the Authority on contracts executed by TRCA in excess of $10K. Pursuant to this resolution, the summary of awarded contracts subject to the Purchasing Policy and are included in Attachment 1. Any revisions to these contracts are recorded in Attachment 2. Excluded from the summary report are Schedule ‘B’ items (these items are listed in Attachment 4) which are defined items within the Policy and are exempt from the approval requirements.

At Authority Meeting #6/13, held on July 26, 2013, the existing Purchasing Policy was approved, including changes to approval thresholds and purchasing methods (Attachment 3). As permitted under the approved Policy, the Chief Executive Officer has designated senior staff to approve purchases up to $10K which are not included in this summary report. Attachment 5 includes the criteria (as per Sections 9.2 and 9.3 of the Purchasing Policy) for non-competitive procurement.

FINANCIAL DETAILS The total value of procurements for TRCA in 2017, in excess of $10K approved by the Chief Executive Officer or Designate, Executive Committee or the Authority, was approximately $54.6M ($27.9M in 2016), including contingencies and contract revisions. The increase in the total value of approved procurements in 2017 can be attributed to a two primary factors. Firstly, the approval of procuring goods and services for several multi-year projects, such as preliminary work for TRCA’s new Administrative Office ($5.1M), certain Kortright municipal servicing work ($746K), aspects of the East Don Trail ($717K), and 111 Whitburn Crescent Slope Stabilization ($2.0M). Secondly, several large value Vendors of Record arrangements were established. The value of these arrangements was estimated based on known expenditures in previous years and a forecast of future expenditures over a single or multiple year contract term.

DETAILS OF WORK TO BE DONE At Authority Meeting #6/13, held on July 26, 2013, it was resolved that the Purchasing Policy would be reviewed in five years. As such, the Finance section will lead the review and update of the Policy in 2018. The Policy will be reviewed with the intent to increase transparency and examine opportunities to improve efficiencies while ensuring the Policy is compliant with applicable regulations and legislation. It will also take into consideration industry best practices on topics such as sustainable procurement, social procurement (including community benefits), approval authorities and thresholds, and co-operative purchasing.

CARRIED BACKGROUND The Living City Policies for Planning and Development in the Watersheds of the Toronto and Region Conservation Authority states that, “TRCA staff obtain authorization from TRCA’s Authority Board/Executive Committee to appear before tribunals on planning and development matters” (Policy 7.5.2 p). Staff is seeking authorization to appear before the OMB, and if needed, retain legal counsel on an appeal within the TRCA jurisdiction.

Municipal applications for Official Plan Amendment (OP.13.013) and Zoning By-Law Amendment (Z.13.036) were appealed to the OMB by the applicant (Islamic Shia Ithna-Asheri Jamaat of Toronto) based upon the failure of the municipality to render a decision on the applications within the prescribed timeline. TRCA staff is seeking "Party" status regarding Islamic Shia Ithna-Asheri of Jamaat of Toronto’s appeal for the lands located at 9000 Bathurst Street, City of Vaughan, because TRCA has an interest from a policy and regulatory perspective, and has been assisting TRCA's municipal partner in the review of the applications.

RATIONALE The subject lands are located to the North of Highway 407, South of Rutherford Road, west of Bathurst Street and east of Dufferin Street and are legally described as Lot 14, Concession 2; Parts 1, 2 & 3, Reference Plan 65R-5630 & 65R-31556, City of Vaughan in the Regional Municipality of York.

A portion of the subject lands are regulated by TRCA due to a valley corridor associated with the East Don River which traverses the eastern portion of the site and an unevaluated wetland feature that is located within the valley.

The subject lands are currently designated ‘Low Rise Residential” in the City of Vaughan Official Plan VOP 2010. Furthermore, the lands are zoned “A” Agriculture Zone (tableland) and “OS1” Open Space Conservation Zone (Valleylands) by By-Law 1-88.

87 The applicant submitted an Official Plan Amendment Application proposing to re-designate the subject lands to a High-Rise Mixed Use land designation. The applicant also submitted a Zoning By-Law Amendment application proposing to rezone the property to Multiple Residential (RM1 & RM2), Apartment Residential (RA3), Agriculture (A) and Open Space Conservation Zone (OS1). The purpose of the above-noted applications is to permit an eight-storey residential apartment building, a six-storey seniors residential building, 42 three-storey street townhouses on a public road, 18 common element condominium units on a private road, a 5,234 sq. m. institutional building (private school), a three-storey parking garage structure, associated public and private roads, surface parking areas and a pedestrian trail along the valley corridor.

The Official Plan Amendment and Zoning By-Law Amendment Applications were appealed by the applicant for lack of municipal decision. A pre-hearing has been scheduled for March 27, 2018.

TRCA’s key interests in these applications have been the accurate delineation of natural hazard and natural heritage limits, stormwater management design at a functional level and the completion of an Environmental Impact Study to assess the existing conditions, environmental constraints, effects of the proposed development and appropriate mitigation measures. TRCA staff has been actively working with City staff and the applicant’s consultants to ensure TRCA’s policy requirements are addressed through the application review process. At this point in the review process the majority of TRCA’s interests have been, or are in the process of being, addressed.

As such, staff is requesting authorization to appear before the OMB for this appeal to ensure TRCA interests in the site, as noted above, are carried forward.

FINANCIAL DETAILS Account Code 110-99-316 has been established to provide for TRCA’s legal services fees related to Planning and Development matters.

DETAILS OF WORK TO BE DONE Staff will continue to represent the interests of TRCA during any mediation and scoping processes. Should the need arise, TRCA staff is requesting authorization of the Executive Committee to retain legal counsel to ensure TRCA's interests, as identified above, are protected and addressed. CARRIED BACKGROUND In June 2017, a large slope failure occurred along the western side of Grey Abbey Ravine measuring approximately 9 metres high and 14.5 metres wide. The failure extends from the base of the ravine to the top of the slope behind 136 and 138 Greyabbey Trail and is believed to have been caused by a broken municipal outfall that was undermined by severe channel downcutting, resulting in discharge flowing directly onto the slope. TRCA and have partnered to address this issue due to the risk to both private property and municipal infrastructure from erosion.

On July 20, 2017, based on the Emergency Work Protocol, City of Toronto, Toronto Water issued a memo stating that:

“…it is the City of Toronto’s declaration that ‘The project is to be carried out in response to an emergency and carrying out the project forthwith is in the interest of preventing damage to property or the environment or is in the interest of public health and safety’”.

From July 21 to July 26, 2017, Toronto Water implemented interim emergency works at the site by installing temporary piping that was successful in conveying stormwater discharge away from the immediate slope failure.

90 On August 9, 2017, TRCA retained Terraprobe Inc. with Aquafor Beech Ltd. as a subcontractor, through preferred source procurement Contract #10005682 to develop a slope stabilization design for the failure area and repair of the failed storm sewer outfall, with the understanding that the City of Toronto would develop a long-term solution to stabilize the channel downstream of the emergency works at a later date. During the preliminary development of the slope and localized channel stabilization designs, Aquafor Beech Ltd. flagged that a large knickpoint in the channel downstream of the project site was progressively moving upstream, and expressed concern that any localized slope stabilization works would be susceptible to being undermined over the short-term, recommending that a more comprehensive solution be considered.

RATIONALE The initial preferred source contract awarded to Terraprobe Inc. was limited in scope to localized slope stabilization works and the connection of municipal stormwater infrastructure to the base of the ravine at the failure location. On December 1, 2017 the project team held a meeting where it was determined that the scope of work was insufficient to satisfactorily address the migrating knick-point, and that the project area would need to be extended upstream and downstream of the immediate failure to provide long-term protection.

As the expanded scope of work is predominantly a water resources and civil engineering exercise, the project team recommended that Aquafor Beech Ltd. submit a Workplan and Costing Proposal outlining the discussed scope of work and the associated costs. The followsing is a summary of the key deliverables and total cost for each from the proposal:

Staff contends that the proposal submitted by Aquafor Beech Ltd. is reasonable, and that given the emergency nature of the work and intimate knowledge of the site conditions, staff recommends the award of Contract #10007202 to Aquafor Beech Ltd. on a preferred source basis in accordance with Section 9.2.2 of TRCA’s Purchasing Policy which states:

“The goods and services are required as a result of an emergency, which would not reasonably permit the use of the regular procurement methods.”

And Section 9.3.3 of TRCA’s Purchasing Policy which states:

“The required goods and services are to be supplied by a vendor or supplier having specialized knowledge, skills, expertise or experience that cannot be reasonably provided by any other supplier.

The impact of implementation to the public is anticipated to be minor as an agreement is being drafted to access the site through the private Rohm & Haas property, and the ravine itself is not widely accessed recreationally. Project updates, including construction start date, duration and any delays will be communicated to the primary stakeholders, such as the City Councillor, Parks Supervisor and local property owners along Greyabbey Trail through on-going email correspondence, and to a broader audience through project signage with contact information.
