JP BLEIJIE (Kawana—LNP) (Attorney-General and Minister for Justice) (8.46 pm): I move— That the bill be now read a second time. I thank the Legal Affairs and Community Safety Committee for its consideration of the bill. The committee tabled its report on 3 February 2014. The committee made one recommendation. The government welcomes the recommendation that the bill be passed. The bill introduces a legislative mechanism into the Penalties and Sentences Act 1992 that allows for an annual increase in the value of the penalty unit. The penalty unit is the basic measure for most fines and penalty infringement notices, commonly called tickets, and is currently $110 for most state laws. Where legislation prescribes a monetary penalty for an offence, it is usually expressed as a certain number of penalty units. For example, the penalty for an offence may be two penalty units.

    No.983 24 August 2018 To the Members Australia - Increased fines for marine polluters The Club has received the following update from our correspondent in Australia, HWL Ebsworth Lawyers, regarding the above-mentioned matter. ///QUOTE/// A new financial year brings with it an increase in the fines for those polluting Australian waters. Ship owners, charterers, masters, operators and their insurers should be aware of potential liabilities for fines in Australia on top of pollution clean up and damage claims. As at 1 July 2018, a majority of States (and the Northern Territory) have increased their penalty unit value in accordance with their annual indexation adjustments. The Commonwealth has also completed its three year increase of the applicable penalty unit in accordance with the Consumer Price Index. Click here for a table of the applicable fines across Australia. The State and Territory legislation and penalties apply to oil spills that are within, or migrate to within, 3 nautical miles of the coast. Beyond 3 nautical miles the Commonwealth legislation will apply. The discharge of oil in Commonwealth, State or Territory waters is a strict liability offence for Owners and Masters and potentially crew members and those involved in the operation and maintenance of the ship. The Commonwealth legislation expressly includes Charterers in the list of those strictly liable. These penalty unit increases mean that the maximum fine for a spill in Commonwealth waters has increased to $4.2 million for a Master and $21 million for a corporate Owner or Charterer. Both AMSA and the relevant State regulators and port authorities continue to police this area strictly.

    Road Traffic Code 2000 – Review of Penalties 2019 1 Executive Summary This report reviews key road safety related offences imposed under the Road Traffic Code 2000 (RTC) to determine the appropriateness and consistency of penalties, in particular, monetary modified penalties (MP), in Western Australia (WA). The purpose of the report is to advise of potential areas for reform of existing penalties under the RTC. The report contains an interjurisdictional comparison of approximately 1,300 road traffic offence provisions across eight Australian jurisdictions, with reference to the following categories: Speeding Keep left, merging and lane offences Failure to give way at intersections Special traffic lane offences Failure to give way to vulnerable road Roundabout offences users Turning offences Failure to give way offences U-Turn offences Disobeying access control signs Obstruction offences Keep left and overtaking offences Obedience to Authorised Persons Following too closely offences offences Seatbelt offences Level crossing offences In-vehicle distraction offences Comparisons of these provisions have been undertaken with reference to the following principles. The severity of the penalty should reflect the road safety risk associated with the offence (i.e. the relative risk of a crash occurring and relative risk of injury in a crash). There should be consistency in the severity of penalties for different offences under each broad offence type. There should be consistency in the severity of the penalties with those imposed for a range of other traffic offences under the Australian Road Rules. Penalties imposed in WA should be consistent with those imposed for similar offences in other Australian jurisdictions. In addition to RTC offences, general consideration has been given to a variety of other matters relevant to penalties under the RTC, mainly around the use of penalty units and the application of counting rules to certain offences.

The bill proposes amendments to the Penalties and Sentences Act 1992 to introduce a legislative mechanism to index the value of the penalty unit. The penalty unit is the basic measure for most fines and penalty infringement notices—commonly called tickets—and is prescribed in section 5 of the Penalties and Sentences Act as $110 for most state laws. When legislation creates offences with a monetary penalty, the penalty is usually expressed as a certain number of penalty units. For example, the fine for an offence may be prescribed in the legislation as two penalty units. This would equate to a $220 fine. The penalty for an offence is set at a level that reflects the seriousness of the offence and provides the level of deterrence or punishment that is considered necessary. Unlike Victoria, the Northern Territory and Tasmania, the value of the penalty unit in Queensland is not indexed. Without periodic increases in the value of the penalty unit, the intended deterrent or punishment effect of monetary penalties reduces.

Thank you for the opportunity to provide a submission to the Senate Education and Employment Reference Committee (the Committee) regarding its review into the framework surrounding the prevention, investigation and prosecution of industrial deaths in Australia (the Review). 2. The Law Council acknowledges the assistance of its National Criminal Law Committee, the Industrial Law Committee of the Federal Litigation and Dispute Resolution Section, the Queensland Bar Association and the Queensland Law Society in the preparation of this submission. 3. The Law Council has limited its comments to the issue of industrial manslaughter offences and the harmonisation of workplace safety legislation between the states, territories and Commonwealth (Term of Reference (a)) and jurisdictional issues surrounding workplace investigations which cross state and territory boundaries (Term of Reference (b)). 4. The Law Council is a strong advocate for consistent and effective work health and safety (WHS) laws that promote safety and prevent workplace injuries. Nationally consistent laws based on the Model WHS Laws were developed in 2011 by Safe Work Australia and have been enacted with only minor changes by the Commonwealth, New South Wales, the Northern Territory, and Tasmania. Queensland and the Australian Capital Territory (ACT) also have Acts that reflect the Model WHS Laws, although, in a manner that is not consistent with those laws, those jurisdictions also have industrial manslaughter offences, as described below.

The Customs Act 1901 (Cth) contains penalties for other offences which may be relevant, for example child pornography and child abuse material, that the table does not cover. The attachment also contains a table outlining penalties under State and Territory classification enforcement legislation for distributors and sellers who distribute and sell unclassified literature, publications or titles that, if classified, may be restricted or even refused classification .
