Section 2 – PSV Operator Licensing

Inspection of licence applications can be requested under the provisions of Regulation 4 of the Public Service Vehicles (Operators’ Licences) Regulations 1995 by anybody who holds statutory objector status. Applications may be inspected free of charge at the traffic area office in Leeds by any person who carries written authorisation to act in that capacity.

Objections against applications for licences must be made in writing by a Chief Officer of Police or by a local authority within 21 days of the date on which notice of an application is published in Notices and Proceedings. Objections must be made on the grounds that one or more of the requirements mentioned in Sections 14(1) and (3) of the Public Passenger Vehicles Act 1981 are not satisfied in relation to the application. A copy of the objection must be sent by the objector to the applicant at the same time that it is sent to the Traffic Commissioner. The onus of proof in terms of the grounds on which an objection is lodged lies with the objector. There is no right of objection against an application for a special licence submitted under Section 12 of the Transport Act 1985.

Classification of Operator Licences – There are four classes of licence:

 A Standard International (SI) licence authorises the use of any description of public service vehicle on both national and international operations;  A Standard National (SN) licence authorises the use of any description of public service vehicle on national operations;  A Restricted licence (R) authorises the use of: a) public service vehicles not adapted to carry more than eight passengers and; b) those not adapted to carry more than sixteen passengers when used otherwise than in the course of a business of carrying passengers or by a person whose main occupation is not the operation of public service vehicles adapted to carry more than eight passengers;  A Special Restricted (SR) licence, issued under Section 12 of the Transport Act 1985, authorises the holder of a taxi or private hire vehicle licence to operate local services.

Appeals in connection with PSV Operator Licences must be lodged with the Upper Tribunal – Administrative Appeal Chamber (Transport), 7th Floor, Victory House, 30-34 Kingsway, London, WC2B 6EX not later than 28 days after the date of the letter conveying the Traffic Commissioner’s (or Deputy Traffic Commissioner’s) decision. Appellants can obtain guidance on lodging appeals, including downloading the appeal form, from the website: www.administrativeappeals.tribunals.gov.uk

Section 3 – Registration of Local Bus Services

When an application is sent to the traffic area office, a copy of all application forms and supporting documents must also be sent to each of the county councils and unitary authorities in whose area the service will operate. Failure to do so may delay acceptance of the application.

Some of the periods of notice applicable before the operation of registered services, including variations or cancellations, are at the discretion of the Traffic Commissioner. In such cases the application must be accompanied by a written explanation of why a short notice period is required.

Any registration may be inspected at the traffic area office in Leeds during public business hours. Copies of registrations can be sent by post or fax to any interested party upon prior receipt of a written request together with a fee of £3.00 per copy for posted copies or £5.00 per copy for faxed copies.

21 Section 4 – Traffic Regulation Conditions

Section 4.1 – Requests

The variation to the requested Traffic Regulation Condition has been agreed in Oxford City Centre.

Traffic Commissioner has not received any requests for a public inquiry. The Traffic Regulation Condition will now come into force with immediate effect.

Central Oxford Low Emission Zone Traffic Regulation Condition

Streets affected

Botley Road east of Earl Street, Frideswide Square, Hollybush Row, Park End Street, Hythe Bridge Street, Worcester Street, George Street, Gloucester Green Bus Station, Beaumont Street, Magdalen Street West, Magdalen Street East, Broad Street, St Giles, New Road, Queen Street, Castle Street, Old Greyfriars Street, Speedwell Street, Thames Street, St Aldates, High Street, Longwall Street, the Plain, St Clements Street and Cowley Road north of Circus Street (in the City of Oxford).

Condition 1 (applicable from 1 January 2014):

All local services which enter, leave or operate within the streets affected must be operated exclusively by buses whose engines have been either:

a) type approved as meeting at least the Euro V standard for all emissions; OR

b) certified by Oxford City Council as being fitted with an exhaust treatment device which ensures that, in urban operating conditions, the emissions of NOx are reduced to a level comparable to Euro V.

Condition 1: notes

Buses used on services subject to Condition 1 may be monitored – this may include the use of traffic enforcement cameras. This monitoring may lead to enforcement action if a bus is observed, by camera or on-street observation, which does not comply with Condition 1.

Condition 1: exemptions

Exemption 1a (continues indefinitely):

22 Very low frequency services are exempt. To qualify for this exemption, a service must pass no point in the streets affected more than 25 times a week in any one direction and must not be a service operated primarily for the purposes of tourism. It must be a genuinely stand-alone service, defined as one on which less than 50% of the operating mileage is over the same roads as another service of the same operator.

Exemption 1b (applicable until 31 May 2014 only):

If a service is run commercially during July 2013, but is then withdrawn before Condition 1 comes into effect, any subsidised replacement service shall be exempt until 31 May 2014, to allow time for procurement of Euro V vehicles.

Exemption 1c (applicable until 1 January 2016):

A bus with an engine type-approved as meeting the Euro IV standard for all emissions may continue to be used on services in the streets affected until 1 January 2016 only if Oxfordshire County Council has certified that the bus was already in use on services in the streets affected between 22nd October 2012 and 22nd January 2013.

To qualify for this exemption, operators must have nominated buses for exemption in writing to Oxfordshire County Council no later than 19th February 2013. Operators may be asked to provide written records or other evidence to satisfy county council officers that each bus was in use on services in the streets affected during the qualifying period. Operators may nominate buses at any time before 19th February 2013 and are encouraged to do so sooner rather than later.

Exemption 1d: (applicable until 4 June 2016):

If a service is run commercially, using Euro IV buses under exemption 1c, during July 2015, but is then withdrawn before Exemption 1c ceases, any subsidised replacement service shall be exempt until 4 June 2016, to allow time for procurement of Euro V vehicles.

Condition 2 (applicable immediately):

At any bus stop, bus stand or layover place in the streets affected, the driver should switch off the engine upon arrival and not restart it until ready to depart, and will be in breach of this condition if the bus stands for over 60 seconds with the engine running AND either:

a) the bus arrives more than one minute before it is scheduled to depart OR b) there are more than 20 persons waiting at the stop at the time of arrival of the bus OR c) the bus is stationary for more than one minute without boarding or alighting passengers.

23 Condition 2: notes

For the avoidance of doubt, all local bus services operating within the affected streets shall be subject to Condition 2 from the date on which this Traffic Regulation Condition is introduced, irrespective of frequency or engine type.

The delay until 2014 and the exemptions applicable to Condition 1 shall not apply to Condition 2.



Note: anyone wishing to attend a public inquiry is advised to contact the Office of the Traffic Commissioner on 0117 900 8525, the day before the inquiry, to avoid unnecessary travel should the inquiry be adjourned for any reason.

A transcript of the taped proceedings of public inquiries (either in full or in part) may be ordered from the Office of the Traffic Commissioner. The cost of the transcript varies according to demand and size of content and the office will be able to advise on the scale of charges when an order is placed.
