ORDINANCE NO. 2013-

AN ORDINANCE AMENDING AND REORGANIZING CHAPTERS 1, 5, 8, 10, 14, AND 21 OF THE CITY CODE PERTAINING TO THE CITY’S TRAFFIC CODE, VEHICLE REGULATIONS, AND PARKING REGULATIONS.

The City Council of the City of Bloomington, ordains:

Section 1. That Chapter 1 of the City Code is hereby amended by deleting those words that are contained in brackets [ ] and adding those words that are underlined, to read as follows:

PUBLIC FACILITIES AND PROPERTY

SEC. 5.21. REGULATIONS. The following regulations shall apply to all City parks:

(2) Parking - (A) No person shall park any motor vehicle in any place in public parks between the hours of 10:00 p.m. and one hour before sunrise. During the hours when parking is permitted, said vehicles must be parked only in designated parking areas. Any unoccupied vehicle found in violation of park regulations may be removed and impounded by any police officer or duly authorized person in accordance with Chapter 8, Article III, Division B, of this Code.

TRAFFIC, VEHICLES, AND PARKING [TRAFFIC]

ARTICLE I. [TRAFFIC REGULATIONS] GENERAL PROVISIONS

Division A. [Traffic at Fires] Findings and Purpose

SEC. 8.01. [FOLLOWING EQUIPMENT] FINDINGS AND PURPOSE. [No unauthorized person shall ride upon, race with, trail or follow within 600 feet any apparatus of the Fire Department when actively responding to a fire alarm.] This Ordinance is enacted to establish standards for the regulation of traffic, vehicles and parking in the City of Bloomington to protect the health, safety, and general welfare of the public. The principle objectives of this Chapter of City Code are: (1) To provide traffic codes and regulations consistent with and supplemental to Minnesota Statute Chapters 168B and 169; (2) To prevent blight, and nuisance conditions associated with the storage of abandoned, junk, inoperable and/or unauthorized vehicles; and (3) To provide standards for the regulation of parking and no-parking zones within the City of Bloomington.

SEC. 8.02. [DRIVING OVER HOSE] ORDERS OF POLICE OR ENFORCEMENT OFFICERS. [No person shall drive any vehicle over a fire hose except upon specific orders from the Chief of the Fire Department, and then only with due caution.] (1) No person shall disobey any lawfully issued order of the Hennepin County Commissioners, the Bloomington City Council, the Police Department or of any police officer, reserve officer or Explorer, relative to the movement of traffic or parking of vehicles in the City. (2) In accordance with 1.06 of this City Code, City Enforcement Officers have authority to issue ordinance civil administrative citations or tags pursuant to Section 2.99 of this City Code for violations of this Chapter relating to the storage of abandoned, junk or inoperable vehicles and the illegal parking of vehicles on private property in the City.

[SEC. 8.03. VEHICLES AT FIRES. No person shall park any vehicle of any description or place any material or obstruction within 30 feet of the entrance to any fire station or within 15 feet of any fire hydrant or fire cistern, nor park any vehicle within 300 feet of a fire, or driveway or service drive upon premises where fire occurs or adjacent thereto.]

Division B. [Truck Traffic and Traffic on Boulevards] State Laws Adopted by Reference

[SEC. 8.04. TRUCK TRAFFIC.] SEC. 8.03. STATE STATUTES INCORPORATED BY REFERENCE. [It is unlawful to drive any truck, except City maintenance vehicles and except for the purpose of making a local delivery, and then for as short a distance as is possible, on any street so designated by this Section and which are properly sign-posted; said streets being the following: (1) Nesbitt Road between Old Shakopee Road and 102nd Street. (2) 106th Street between West Bloomington Freeway and Xerxes Avenue. (3) Bryant Avenue between 90th Street and 93rd Street. (4) West 92nd Street between East Bloomington Freeway and Aldrich Avenue. (5) West 84th Street between France Avenue and Penn Avenue.] (1) For the purpose of prescribing regulations governing vehicles, traffic, and streets, the City of Bloomington hereby adopts the following rules and statutes: (a) Minnesota Statutes, Chapter 168B (b) Minnesota Statutes, Chapter 169 (c) Minnesota Statutes, Chapter 65B (d) Minnesota Statutes, Chapter 84 (e) Federal Commercial Truck Regulations (2) For the purposes of this Chapter, the definitions used in Minnesota Statutes, Chapters 168, 168B, and 169, are hereby adopted; however, if there is a conflict between the statutorily defined terms and the defined terms set forth in Article I, Division C herein, as specifically used in this Chapter of the City Code, the defined terms set forth in this Article I shall control. All statutory references in this Chapter include future amendments thereto, as well as recodifications.

[SEC. 8.05. TRAFFIC ON BOULEVARDS. As used in this Division, the word "boulevard" shall mean that portion of any street between the curb and the right-of-way line of such street or in the case of uncurbed streets that portion between the shoulder of the road and the right-of-way line. It shall be unlawful for the operator of any motor vehicle or bicycle to drive or park upon the boulevard adjoining any public street.]

Division C. [Traffic on School Grounds] Definitions

SEC. [8.06] 8.04. DEFINITIONS. The following words and terms, when used in this [Division] Chapter shall have the following meanings, unless the context clearly indicates otherwise: [Motor vehicles and motorcycles - shall have the same meaning as set forth under the definitions contained in the Minnesota Highway Traffic Regulation Act, Minnesota Statutes Annotated 169.01. School - Public schools as defined by Minnesota Statutes Annotated 120.05. and 130.] Abandoned Vehicle – (1) A motor vehicle, as defined herein, that: (A) has remained parked or stored: (i) for a period of more than 48 hours on any property owned or controlled by a unit of government, or more than four (4) hours on that property when it is properly posted; or (ii) on private property for a period of time, as set forth in Minnesota Statutes, Section 168B.04, Subdivision 2, without the consent of the Owner or Occupant of the private property; or, (B) lacks Vital Component Parts, does not have attached to it a current license plate or tabs as required by state law or is an Inoperable Vehicle, unless it is kept in an enclosed garage or storage building. (2) A classic car or pioneer car, meeting the requirements of Minnesota Statutes, Section 168.10, is not considered an abandoned vehicle. (3) A vehicle stored on the premises of a junk yard or automobile graveyard as defined, maintained, and licensed in accordance with the State Junk Yard Act, Minnesota Statutes Section 161.242, and where the junk yard or automobile graveyard is licensed and maintained in accordance with this City Code and zoning regulations, is not considered an abandoned vehicle. (4) A vehicle being held for storage by agreement or being held under police authority or pursuant to a writ or court order is not considered an abandoned vehicle, nor may it be processed as an abandoned vehicle while the police hold, writ, or court order is in effect. City Enforcement Officers – Those City employees authorized under City Code Section 1.06 (b) or Section 2.99 to issue citations or tags for violations of City Code pursuant to Sections 1.11 or 2.99. Impound – To take and hold a vehicle in legal custody. There are two types of impounds, public and nonpublic. Impound Lot Operator or Operator – A person who engages in impounding or storing, usually temporarily, unauthorized or abandoned vehicles. “Operator” includes an operator of a public or nonpublic impound lot, regardless of whether tow truck service is provided. Inoperable Vehicle – Any motor vehicle that is no longer capable of being driven or propelled under its own power from place to place or regularly used for transportation purposes in its existing condition or which cannot be driven or propelled under its own power from place to place or regularly used for transportation purposes in a safe manner because of its wrecked, junked, or partially dismantled condition. Issuing Authority - the City of Bloomington License Section, Building & Inspection Division, Environmental Services Division, or City Fire Marshal. Junk Vehicle – A vehicle that (1) is three years old or older; (2) is extensively damaged, with the damage including such things as broken or missing wheels, motor, drive train, or transmission; (3) is apparently inoperable; (4) does not have a valid, current registration plate; and (5) has an approximate fair market value equal only to the approximate value of the scrap in it. Motor Vehicle – A machine propelled by power other than human power designed to travel along the ground by use of wheels, treads, runners or slides and transport persons or property or pull machinery and shall include, without limitation, automobiles, trucks, trailers, motorcycles, tractors, and wagons. “Motor Vehicle” does not include electric personal assistive mobility devices, personal recreational vehicles or snowmobiles. Nonpublic Impound Lot – An impound lot that is not a public impound lot. Off-road Vehicle – Any self-propelled vehicle, power assisted vehicle, and any vehicle propelled or drawn by a self-propelled vehicle powered by a motor having a piston displacement capacity of over 25 cubic centimeters or an electric motor that is capable of propelling the vehicle at a speed in excess of 20 miles per hour on a flat surface, including but not limited to all-terrain vehicles, hovercrafts, or motor vehicles licensed for highway operation which is being used for off-road recreational purposes. Over-Dimensioned Vehicle – A motor vehicle or combination of motor vehicles that exceed the height, width or load limitations set forth in Minnesota Statutes Sections 169.80 – 169.88. Over-Dimensioned Vehicle Permit – A permit issued by the City, pursuant to the authority set forth in Minnesota Statutes Sections 169.86, as may be amended from time to time, authorizing the applicant to move an Over-Dimensioned Vehicle upon any highway or roadway under the City’s jurisdiction and for the maintenance of which the City is responsible. Owner or Occupant - The person in control of private real property by ownership, lease, management agreement, or other written document entitling the individual to the lawful occupancy and control of the premises. Parked Vehicle - A vehicle that is not in operation and temporarily placed on-street or off-street for a period of less than 48 hours. Vehicles parked for more than 48 hours in the same location will be subject to the regulations set forth in this City Code applicable to exterior storage. Personal Recreational Vehicle – Any self-propelled vehicle, power assisted vehicle, and any vehicle propelled or drawn by a self-propelled vehicle powered by a motor having a piston displacement capacity of over 25 cubic centimeters or an electric motor that is capable of propelling the vehicle at a speed in excess of 20 miles per hour on a flat surface, including but not limited to trail bikes, mini-bikes, go-carts, motorized scooters, or motorized skateboards (also known as ‘powerboards’). Motorized golf carts operated on property principally used as a golf course are exempt from the regulations of this Chapter. Public Impound Lot – An impound lot contracting with the City pursuant to this Chapter of the City Code. Towing Authority – A private towing company authorized by contract with the City for the towing, impoundment and storage of abandoned, inoperable, junk or unauthorized vehicles at the direction of the City. Unauthorized Vehicle – A vehicle that is subject to removal and impoundment pursuant to Minnesota Statutes, Section 168B.04, Subdivision 2, or Minnesota Statutes, Section 169.041, but is not a junk vehicle or an abandoned vehicle. Vehicle Owner – The person or persons legally entitled to possession, use, and control of a motor vehicle, including a lessee of a motor vehicle if the lease agreement has a term of 180 days or more. There is a rebuttable presumption that a person registered as the owner of a motor vehicle according to the records of the Department of Public Safety is the legal owner. For purposes of this Chapter, if a motor vehicle is owned jointly by two or more people, each owner's interest extends to the whole of the vehicle and is not subject to apportionment. Vital Component Parts – Those part of a motor vehicle that are essential to the mechanical functioning of the vehicle, including such things as the motor, drive train, and wheels.

[SEC. 8.07. MOTOR VEHICLES AND MOTORCYCLES. Every motor vehicle or motorcycle as defined in this Division shall be permitted only in the parking lots and access roads of the school property and then only for the purpose of temporarily parking thereon and shall depart by the most direct route.

SEC. 8.08. DISTURBANCE OR HAZARD. The creation of a disturbance by use of said motor vehicle or motorcycle by reason of noise or otherwise, or using said motor vehicle on said premises in such a manner as to create a hazard to others is specifically prohibited.

SEC. 8.09. PENALTY. Violation of any provision of this Division shall be a misdemeanor.]

SEC. [8.10] 8.05. [reserved] PENALTIES AND SEVERABILITY. A violation of this Chapter of the City Code, unless specifically stated otherwise, shall be a petty misdemeanor under Minnesota law. Violations may, at the sole discretion of the City Enforcement Officer, be alternatively or additionally subject to civil penalties, that are subject to assessment against the Owner or Occupant’s private property pursuant to Section 12.15 of the City Charter and Section 1.19 of this City Code. Nothing in this Section shall be construed to limit the City’s other available legal remedies for any violation of the law, including licensing sanctions, criminal, civil, and injunctive actions. If any section, subsection, sentence, clause, or phrase of this Chapter of the City Code is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Chapter. The City Council hereby declares that it would have adopted the Chapter in each article, section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more articles, sections, subsections, sentences, clauses, or phrases be declared invalid.

SEC. 8.21. ENTERING THROUGH STREETS. The streets named in Section 8.22 of this Chapter are designated as "through streets" in the City, and all vehicles shall come to a full stop prior to entering or crossing such streets and shall yield the right- of-way to other vehicles which have entered the intersection or which are approaching so closely thereto as to constitute an immediate hazard.

SEC. 8.23. STOP AND YIELD RIGHT-OF-WAY SIGNS. (a) The driver of a vehicle shall stop in obedience to a stop sign erected in the locations set forth in Section 8.24(a) of this Chapter prior to entering the intersections named therein, and shall proceed cautiously, yielding the right of way to other vehicles not so obliged to stop which are within the intersection or which are approaching so closely thereto as to constitute an immediate hazard. (b) The driver of a vehicle approaching a yield right-of-way sign erected in the locations set forth in Section 8.24(b) of this Chapter shall slow to a speed that is reasonable for conditions of traffic and visibility, and stop if necessary, and yield the right of way to any pedestrian legally crossing the roadway on which he is driving, and to all vehicles on the intersecting street or highway which are so close as to constitute an immediate hazard.

Unless official signs are erected stating that such movement is prohibited the driver of a vehicle, after stopping as close as practicable at the entrance to the crosswalk on the near side of the intersection or, if none, then at the entrance to the intersection in obedience to a red or stop signal, may make a right turn if he first yields the right-of-way to pedestrians and other traffic lawfully proceeding through the intersection.

SEC. 8.27. SCHOOL CROSSING SIGNS. All vehicles shall stop in compliance with school crossing signs when such stop is indicated by such signs, which signs are located at places designated in Section 8.28 of this Chapter. SEC. 8.28. SCHOOL CROSSING DESIGNATED. SEC. 8.29. INTERSECTION MOVEMENT REGULATIONS. All vehicles approaching an intersection shall proceed in compliance with signs erected indicating allowable or prohibited movements at the intersection. (1) Right-turn only intersection movements are permitted at the northbound Aldrich Avenue approach to West 98th Street. (2) Right-turn movements from eastbound West 78th Street to southbound Ensign Road are prohibited for through traffic on Ensign Road between the hours of 4:00 p.m. and 6:00 p.m. on Monday through Friday. (3) Left-turn movements to and from American Boulevard W. at Vincent, Upton and Thomas Avenues are prohibited between the hours of 4:00 p.m. and 6:00 p.m. (4) Left-turn movements from northbound Normandale Boulevard to westbound Southwood Drive, Northwood Ridge, and Mt. Normandale Drive are prohibited between the hours of 7:00 a.m. to 9:00 a.m. Monday through Friday. (5) No right turn movements from eastbound American Boulevard W. to southbound Sheridan Avenue between the hours of 7:00-9:00 a.m. Monday thru Friday and 3:30-6:30 p.m. Monday thru Friday. (6) No left turn movements from northbound Sheridan Avenue to westbound American Boulevard W. between the hours of 3:30-6:30 p.m. Monday thru Friday. (7) Eastbound and westbound 92nd Street vehicles approaching Portland Avenue are required to turn either left or right and are not permitted to continue across Portland Avenue on 92nd Street. (8) Left turn movements from southbound Normandale Boulevard to eastbound Toledo Road are prohibited between the hours of 7:00 - 9:00 a.m. and between the hours of 4:00 - 6:00 p.m. on Monday through Friday. (9) No right turn for trucks from northbound Bloomington Freeway to eastbound 92nd Street.

SEC. 8.30. PRIVATE DRIVEWAYS ENTERING PUBLIC STREETS. (a) It shall be unlawful for any vehicle entering a public street from a private driveway to turn left where signs are posted providing "No Left Turn". (b) It shall be unlawful for any vehicle to enter a public street from a private driveway where "Do Not Enter" signs are posted in an official manner and design as approved by the City Council. (c) It shall be unlawful for any vehicle entering a public street from a private driveway to turn right where signs are posted providing "No Right Turn".

SEC. 8.31. REGULATORY SIGNS. Proper regulatory signs shall be erected at the places designated in the foregoing sections.

SEC. 8.32. ORDERS OF POLICE. No person shall disobey any lawfully issued order of the Hennepin County Commissioners, Hennepin County Highway Commission, the Police Department or of any police officer relative to the movement of traffic in the City.

SEC. 8.33. EMERGENCY REGULATIONS. The Chief of Police by and with the approval of the City Traffic Engineer is hereby empowered to make and enforce temporary regulations necessary to cover emergencies or special conditions. No such temporary regulation shall remain in effect for more than 60 days, unless authorized by the Chief of Police with the approval of the City Traffic Engineer. Such regulations may include the designation of stop intersections, no parking zones, yield intersections and such other traffic regulations as may be reasonably necessary to cover the emergency or special condition.

SEC. 8.33.01. ONE-WAY STREETS. The following streets are hereby designated as one-way streets: Street From To Direction E. Bloomington Freeway 82nd Street 80 1/2 Street North 80 1/2 Street (South E. SEC. 8.34. CONTROLLED ACCESS ROADWAYS. (a) No person shall climb over, across, through, or under any fence to cross or gain access to or leave any controlled access roadway. (b) No person shall clip, cut, or otherwise damage fences along controlled access roadway. (c) No person shall disobey the restrictions stated on official signs erected and maintained on controlled access roadways prohibiting the use thereof by pedestrians, bicycles, or other nonmotorized traffic. (d) For the purpose of this section, State Highway 36 between 86th Street and U.S. Interstate Highway 494, U.S. Interstate Highway 35W are designated controlled access roadways.]

ARTICLE II. [VEHICLE REGULATIONS] TRAFFIC CODE

[Division A. Storage of Abandoned and Inoperative Vehicles as Public Nuisances

SEC. 8.35. DECLARATION OF STORAGE OF ABANDONED AND INOPERATIVE VEHICLES AS PUBLIC NUISANCES. The presence, accumulation, or improper storage of abandoned motor vehicles on real property is hereby found to create an unsightly condition tending to reduce the value of real property, to invite plundering, to create fire and safety hazards, and to constitute an attractive nuisance creating a hazard to the health and safety of minors. The accumulation and outside storage of such motor vehicles is further found to promote blight and deterioration in the community; to violate the zoning regulations of the City in many instances, particularly where such motor vehicles are maintained in required setback areas of residential property. It is further found that such abandoned motor vehicles are often in the nature of rubbish, litter, and unsightly debris in violation of the health and sanitation laws. Therefore, the accumulation and storage of such motor vehicles on real property is hereby declared to constitute a public nuisance which may be abated as such, which remedy shall be in addition to any other remedy provided in this or other ordinances of this City or by State law.

SEC. 8.36. DEFINITIONS. The following words and terms when used in this Division, shall have the following meanings, unless the context clearly indicates otherwise: Abandoned vehicle - Any motor vehicle which is determined by the Director of Community Development or the Chief of Police or their agents to be an inoperative vehicle as herein defined or to which the last registered owner of record has relinquished dominion and control or which does not have attached to it current license plates or tabs as required by State law, and which is not stored or screened in accordance with this Code. Inoperative vehicle - Any motor vehicle which cannot be driven or propelled under its own power in its existing condition or which cannot be driven or propelled under its own power in a safe manner because of its wrecked, junked, or partially dismantled condition. Motor vehicle - A machine propelled by power other than human power designed to travel along the ground by use of wheels, treads, runners or slides and transport persons or property or pull machinery and shall include, without limitation, automobiles, trucks, trailers, motorcycles, tractors, wagons and snowmobiles. Real property - Any land within the City which is not a public street, highway, or right-of-way.

SEC. 8.37. OPEN STORAGE OF ABANDONED VEHICLES PROHIBITED. No person shall store or leave or permit the storing or leaving of any abandoned vehicle upon any real property, including private property, within the City for a period of seven (7) successive days, unless such vehicle is completely enclosed in a building or unless such vehicle is so stored on private property in connection with a duly licensed business or commercial enterprise operated and conducted pursuant to law when such storing of vehicles is necessary to the operation of the business or commercial enterprise.

SEC. 8.38. NOTICE TO REMOVE. (a) Notice on Vehicle. Whenever the Director of Community Development or the Chief of Police or their agents ascertain that an abandoned vehicle is present on real property within the City, the Director shall cause notice to be placed upon such abandoned vehicle or posted in a conspicuous place near the vehicle if unable to place upon the abandoned vehicle using substantially the following words: Notice to the owner and all persons interested in the attached motor vehicle and to the owner or person(s) in lawful possession or control of this land: "This vehicle (setting forth a brief description), located at (setting forth a brief description of the location), is improperly stored, and its present storage will be in violation of Section 8.37 of the City Code on (setting forth a date seven (7) days from the date of this notice) unless such vehicle is removed and stored within a building pursuant to Section 8.37. Failure to remove and store said vehicle is a misdemeanor. In addition, this vehicle will be removed and disposed of in accordance with the provisions of Division B, Article II of Chapter 8 of the City Code." (b) Size of Notice on Vehicle. The notice set forth in subsection (a) of this Section shall not be less than eight (8) inches by ten (10) inches and shall be sufficiently weatherproof to withstand normal exposure to the elements. (c) Notice Mailed to Vehicle and Property Owners. In addition to the notice placed on or near the vehicle, the City shall, within two (2) working days of the notice placed on or near the vehicle, give notice by mail to the registered owner.

SEC. 8.39. FAILURE TO REMOVE. Failure by the owner of the motor vehicle or owner or person in lawful possession of the real property upon which the vehicle is located to remove and store the motor vehicle after notice has been given and the seven-day period has expired, shall constitute a misdemeanor. Each day such abandoned vehicle remains improperly stored after the seven-day period shall constitute a new violation and may be prosecuted as such.

SEC. 8.40. ABATEMENT, REMOVAL AND DISPOSITION. (a) Abatement and removal by City. If the registered owner of any motor vehicle which is in violation of this Division or if the owner or person in lawful possession or control of the property upon which such vehicle is located shall fail, neglect, or refuse to remove or house such vehicle in accordance with the notice, the motor vehicle shall be deemed abandoned and the Director of Community Development or the Police Chief or their agents may remove and dispose of such vehicle. (b) Removal and disposal of abandoned vehicles. The removal and disposal of said vehicles shall be made in accordance with the provisions set forth in Division B of this Article. The notice provisions of Division B of this Article shall apply once the vehicle is taken into custody. (c) Allowing access to remove abandoned vehicles. The City’s contracted agent shall be allowed access to the abandoned vehicles, or be allowed to reasonably clear obstructions to gain access to abandoned vehicles, and to tow or using other methods, remove the abandoned vehicles.

Division B. Custody and Impoundment of Abandoned Vehicles, Junk Vehicles, and Unauthorized Vehicles

SEC. 8.44. PURPOSE. It is the purpose of this Division to establish a means by which the City of Bloomington can remove abandoned vehicles, junk vehicles, and unauthorized vehicles by providing a means for accomplishing towing, storage and disposition of such vehicles through a contractual arrangement with a person, firm or corporation.

SEC. 8.45. DEFINITIONS. The following words and terms, when used in this Division, shall have the following meanings unless the context clearly indicates otherwise. Abandoned Vehicle - (1) A motor vehicle, as defined herein that: (A) has remained illegally; (i) for a period of more than 48 hours on any property owned or controlled by a unit of government, or more than four (4) hours on that property when it is properly posted; or (ii) on private property for a period of time, as determined under Minnesota Statutes, Section 168B.04, Subdivision 2, without the consent of the person in control of the property; and (B) lacks vital component parts or is in an inoperable condition such that is has no substantial potential for further use consistent with its usual functions, unless it is kept in an enclosed garage or storage building. (2) A classic car or pioneer car, as defined in Minnesota Statutes, is not considered an abandoned vehicle. (3) Vehicles on the premises of junk yards and automobile graveyards that are defined, maintained, and licensed in accordance with state law, or that are licensed and maintained in accordance with this Code and zoning regulations, are not considered abandoned vehicles. (4) A vehicle being held for storage by agreement or being held under police authority or pursuant to a writ or court order is not considered abandoned, nor may it be processed as abandoned while the police hold, writ, or court order is in effect. Impound - To take and hold a vehicle in legal custody. There are two types of impounds, public and nonpublic. Impound Lot Operator or Operator - A person who engages in impounding or storing, usually temporarily, unauthorized or abandoned vehicles. "Operator" includes an operator of a public or nonpublic impound lot, regardless of whether tow truck service is provided. Junk Vehicle - A vehicle that: (1) is three years old or older; (2) is extensively damaged, with the damage including such things as broken or missing wheels, motor, drive train, or transmission; (3) is apparently inoperable; (4) does not have a valid, current registration plate; and (5) has an approximate fair market value equal only to the approximate value of the scrap in it. Motor Vehicle - Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wire. "Motor vehicle" does not include a vehicle moved solely by human power. Net Proceeds - The sales price less any costs of handling, storing or sale of said vehicle. Nonpublic Impound Lot - An impound lot that is not a public impound lot. Official garage - A towing operator other than a City employee who has entered into a contract with the City to provide towing and storage services to the City. Public Impound Lot - An impound lot contracting with the City pursuant to this Division of the City Code. Unauthorized Vehicle - A vehicle that is subject to removal and impoundment pursuant to Minnesota Statutes, Section 168B.04, Subdivision 2, or Minnesota Statutes, Section 169.041, but is not a junk vehicle or an abandoned vehicle. Vital Component Parts - Those part of a motor vehicle that are essential to the mechanical functioning of the vehicle, including such things as the motor, drive train, and wheels.

SEC. 8.46. ABANDONED VEHICLES. (a) Custody and Impoundment of Abandoned Vehicles. The City of Bloomington may take into custody and impound abandoned vehicles as defined in this Division of the City Code. (b) Notice of Taking and Sale of Abandoned Vehicles. (1) Notice Within Ten (10) Days. When an abandoned vehicle is taken into custody, the City shall give notice of the taking within ten (10) days. (2) Contents of Notice. The notice shall: (A) set forth the date and place of the taking, the year, make, model and serial number of the abandoned vehicle if such information can be reasonably obtained, and the place where the vehicle is being held; (B) inform the owner and any lienholders of their right to reclaim the abandoned vehicle under state law and Section 8.46(c) of this Division of the City Code; and (C) state that failure of the owner or lienholders to exercise their right to reclaim the vehicle and contents within the appropriate time allowed under state law and Section 8.46(c) of this Division of the City Code shall be deemed a waiver by them of all right, title, and interest in the vehicle and contents and a consent to the transfer of title to a disposal or sale of the vehicle and contents pursuant to state law and Section 8.46(c) of this Division of the City Code. (3) Notice by Mail or Publication. The notice regarding abandoned vehicles shall be sent by mail to the registered owner, if any, and to all readily identifiable lienholders of record. If it is impossible to determine with reasonable certainty the identity and address of the registered owner and all lienholders, the notice shall be published once in a newspaper of general circulation in the City. Published notices may be grouped together for convenience and economy. (c) Reclaiming Abandoned Vehicles; Sale After Fifteen (15) Days. An abandoned vehicle is eligible for disposal or sale fifteen (15) days after notice to the owner. The owner or any lienholder of an abandoned vehicle shall have a right to reclaim the vehicle from the City and impound lot operator upon payment of all towing and storage charges resulting from taking the vehicle into custody within fifteen (15) days after the date of the notice to the owner. (d) Sales Receipt for Purchase of Abandoned Vehicles. If an abandoned vehicle and contents taken into custody by the City is not reclaimed properly, it may be disposed of or sold at auction or sale. The purchaser shall be given a receipt in a form prescribed by the registrar of motor vehicles which shall be sufficient title to dispose of the vehicle. The receipt shall also entitle the purchaser to register the vehicle and receive a certificate of title, free and clear of all liens and claims of ownership. Pursuant to state law, before such a vehicle is issued a new certificate of title it must receive a motor vehicle safety check. (e) Unsold Abandoned Vehicles. Abandoned vehicles not sold by the City shall be disposed of in accordance with state law.

SEC. 8.47. JUNK VEHICLES. (a) Custody and Impoundment of Junk Vehicles. The City of Bloomington may take into custody and impound junk vehicles as defined in this Division of the City Code. (b) Notice of Taking and Sale of Junk Vehicles. (1) Notice Within Ten (10) Days. When a junk vehicle is taken into custody, the City shall give notice of the taking within ten (10) days. (2) Contents of Notice. The notice shall: (A) set forth the date and place of the taking, the year, make, model and serial number of the junk vehicle if such information can be reasonably obtained, and the place where the vehicle is being held; (B) inform the owner and any lienholders of their right to reclaim the junk vehicle under state law and Section 8.47(c) of this Division of the City Code; and (C) state that failure of the owner or lienholders to exercise their right to reclaim the vehicle and contents within the appropriate time allowed under state law and Section 8.47(c) of this Division of the City Code shall be deemed a waiver by them of all right, title, and interest in the vehicle and contents and a consent to the transfer of title to a disposal or sale of the vehicle and contents pursuant to state law and Section 8.47(c) of this Division of the City Code. (3) Notice by Mail or Publication. The notice regarding junk vehicles shall be sent by mail to the registered owner, if any, and to all readily identifiable lienholders of record. If it is impossible to determine with reasonable certainty the identity and address of the registered owner and all lienholders, the notice shall be published once in a newspaper of general circulation in the City. Published notices may be grouped together for convenience and economy. (c) Reclaiming Junk Vehicles; Sale After Fifteen (15) Days. A junk vehicle is eligible for disposal or sale fifteen (15) days after notice to the owner. The owner or any lienholder of a junk vehicle shall have a right to reclaim the vehicle from the City and impound lot operator upon payment of all towing and storage charges resulting from taking the vehicle into custody within fifteen (15) days after the date of the notice to the owner. (d) Sales Receipt for Purchase of Junk Vehicles. If a junk vehicle and contents taken into custody by the City is not reclaimed properly, it may be disposed of or sold at auction or sale. The purchaser shall be given a receipt in a form prescribed by the registrar of motor vehicles which shall be sufficient title to dispose of the vehicle. The receipt shall also entitle the purchaser to register the vehicle and receive a certificate of title, free and clear of all liens and claims of ownership. Pursuant to state law, before such a vehicle is issued a new certificate of title it must receive a motor vehicle safety check.

SEC. 8.48. UNAUTHORIZED VEHICLES. (a) Immediate Custody and Impoundment of Unauthorized Vehicles. The City of Bloomington may, in its discretion, take into custody and impound any unauthorized vehicle upon the representation of the owner or agent of the owner of the private property on which the vehicle is situated that the vehicle’s presence on the property is unauthorized in the following cases: (1) an unattended vehicle that is on private property: (A) that is a single-family or duplex residential property; or (B) that is private, nonresidential property that is properly posted; or (C) that is a residential property that is properly posted. (2) an unattended vehicle on public property not governed by Minnesota Statutes, Section 169.041 and is located so as to constitute an accident or traffic hazard to the traveling public, as determined by a peace officer. (b) Other Custody and Impoundment Requirements of Unauthorized Vehicles. A vehicle may also be impounded after it has been left unattended in one of the following locations for the indicated period of time: (1) in a public location not governed by Minnesota Statutes, Section 169.041: (A) on a highway and properly tagged by a peace officer -- four (4) hours; (B) that is a parking facility or other public property owned or controlled by the City that is properly posted -- four (4) hours. (2) on private property that is private, nonresidential property, not posted -- twenty-four (24) hours. (c) Notice of Taking and Sale of Unauthorized Vehicles. (1) Notice Within Ten (10) Days. When an unauthorized vehicle is taken into custody, the City shall give notice of the taking within ten (10) days. (2) Contents of Notice. The notice shall: (A) set forth the date and place of the taking, the year, make, model and serial number of the unauthorized vehicle if such information can be reasonably obtained, and the place where the vehicle is being held; (B) inform the owner and any lienholders of their right to reclaim the unauthorized vehicle under state law and Section 8.48(d) of this Division of the City Code; and (C) state that failure of the owner or lienholders to exercise their right to reclaim the vehicle and contents within the appropriate time allowed under state law and Section 8.48(d) of this Division of the City Code shall be deemed a waiver by them of all right, title, and interest in the vehicle and contents and a consent to the transfer of title to a disposal or sale of the vehicle and contents pursuant to state law and Section 8.48(d) of this Division of the City Code. (3) Notice by Mail or Publication. The notice regarding unauthorized vehicles shall be sent by mail to the registered owner, if any, and to all readily identifiable lienholders of record. If it is impossible to determine with reasonable certainty the identity and address of the registered owner and all lienholders, the notice shall be published once in a newspaper of general circulation in the City. Published notices may be grouped together for convenience and economy. (4) Second Notice. If an unauthorized vehicle remains unclaimed after thirty (30) days from the date the notice was sent under this Division and state law, a second notice shall be sent by regular mail, to the registered owner, if any, of the unauthorized vehicle and to all readily identifiable lienholders of record. (d) Reclaiming Unauthorized Vehicles; Sale After Forty-five (45) Days. An unauthorized vehicle is eligible for disposal or sale forty-five (45) days after the second notice to the owner. The owner or any lienholder of an unauthorized vehicle shall have a right to reclaim the vehicle from the City and impound lot operator upon payment of all towing and storage charges resulting from taking the vehicle into custody within forty-five (45) days after the date of the second notice to the owner. (e) Sales Receipt for Purchase of Unauthorized Vehicles. If an unauthorized vehicle and contents taken into custody by the City is not reclaimed properly, it may be disposed of or sold at auction or sale. The purchaser shall be given a receipt in a form prescribed by the registrar of motor vehicles which shall be sufficient title to dispose of the vehicle. The receipt shall also entitle the purchaser to register the vehicle and receive a certificate of title, free and clear of all liens and claims of ownership. Pursuant to state law, before such a vehicle is issued a new certificate of title it must receive a motor vehicle safety check.

SEC. 8.49. SALE PROCEEDS BY CITY OR PUBLIC IMPOUND LOT. From the proceeds of a sale under this Division of the City Code and state law by the City or the public impound lot of an abandoned, junk or unauthorized motor vehicle, the City shall reimburse itself of the cost of towing, preserving and storing the vehicle, and all administrative, notice and publication costs incurred in handling the vehicle pursuant to this Division of the City Code and state law. Any remainder from the proceeds of a sale shall be held for the owner of the vehicle or entitled lienholder for ninety (90) days and then shall be deposited in a fund in the police department established to cover the costs of notices and other expenses mandated by this Division of the Code and state law.

SEC. 8.50. SALE PROCEEDS BY NONPUBLIC IMPOUND LOTS. The operator of a nonpublic impound lot may retain any proceeds derived from a sale conducted under the authority of state law. The operator may retain all proceeds from sale of any personal belongings and contents in the vehicle that were not claimed by the owner or the owner's agent before the sale, except that any suspected contraband or other items that likely would be subject to forfeiture in a criminal trail must be turned over to the appropriate law enforcement agency.

SEC. 8.51. IMPLIED CONSENT TO SELL. A registered owner who fails to claim the impounded vehicle within the applicable time period allowed under Minnesota Statutes, Section 168B.051 is deemed to waive any right to reclaim the vehicle and consents to the disposal or sale of the vehicle and its contents and transfer of title.

SEC. 8.51.01. AUTHORITY TO CONTRACT FOR TOWING SERVICES. (a) Contract. The City may enter into a contract on behalf of the City with any person, firm or corporation who will obtain or provide adequate facilities to handle the tows and the storage of vehicles requested by the City Police Department and other City officials. (b) Bond. Every towing operator to whom a contract is awarded for towing and storage shall, upon the execution of such contract, file with the City Clerk a bond approved by the City Attorney in such amount as may be determined by the contract. Such bond shall be conditioned that the principal will indemnify any and all persons, firms or corporations, including the City of Bloomington and the County or other governmental agencies of this State, for any loss sustained by any unlawful or unauthorized damage to a vehicle which it towed at the request of the City or stored by said towing operator, pursuant to the provisions of this Division and any contract entered into where the City of Bloomington is a party thereof. (c) Statements. Every towing operator who has entered into a contract pursuant to this Division shall forward to the Chief of Police a copy of each bill or statement prepared for each owner of a vehicle towed or stored at the request of the City. (d) Exclusion. Nothing contained in this Division shall be deemed to prohibit, limit or restrict the use or operation of towing equipment or storage facilities by the City, County or School District.

Division C. Snowmobiles

SEC. 8.52. INTENT. It is the intent of this Division to supplement the laws of the State of Minnesota, Chapter 84, Minnesota Statutes, with respect to the operation of certain motor vehicles commonly called snowmobiles. This Division is not intended to allow what the State statutes prohibit nor to prohibit what the State statutes expressly allow.

SEC. 8.53. DEFINITIONS. The following words and terms, when used in this Division shall have the following meanings unless the context clearly indicates otherwise: Operate - To ride in or on and control the operation of a snowmobile. Snowmobile - A self-propelled vehicle designed for travel on snow or ice or a natural terrain steered by wheels, skis, or runners.

SEC. 8.54. REGULATIONS. (a) Prohibition. It shall be unlawful for any person to operate a snowmobile on publicly or privately owned property within the City. (b) Exceptions. This prohibition shall not apply to: (1) The loading of snowmobiles upon a trailer or the removal therefrom; (2) the use of a snowmobile for a rescue, emergency, or law-enforcement purpose, or (3) the use of snowmobiles for park maintenance.

Division D. Personal Recreational Motor Vehicles

SEC. 8.64. PURPOSE AND INTENT. The purpose of this Division is to provide reasonable regulations for the use of personal recreational motor vehicles, off-road vehicles and certain vehicle regulated by state law on public and private property in the City. This Division is not intended to allow what the Minnesota Statutes prohibit nor to prohibit what the Minnesota Statutes expressly allow. It is intended to protect public safety and to prevent the use of these vehicles in a manner that constitutes a public nuisance.

SEC. 8.65. DEFINITION. The following words and terms when used in this Division shall have the following meanings unless the context clearly indicates otherwise: Off-road vehicle - Any self-propelled vehicle, power assisted vehicle and any vehicle propelled or drawn by a self-propelled vehicle powered by a motor having a piston displacement capacity of over 25 cubic centimeters or an electric motor that is capable of propelling the vehicle at a speed in excess of 20 miles per hour on a flat surface, including but not limited to all-terrain vehicle, hovercraft, or motor vehicle licensed for highway operation which is being used for off-road recreational purposes. Personal recreational motor vehicle - Any self-propelled vehicle, power assisted vehicle and any vehicle propelled or drawn by a self-propelled vehicle powered by a motor having a piston displacement capacity of 25 cubic centimeters or less or an electric motor that is incapable of propelling the vehicle at a speed in excess of 20 miles per hour on a flat surface, including but not limited to trail bike, mini-bike, go- cart, motorized scooter, or motorized skateboard (also known as 'powerboard'). Motorized golf carts operated on property principally used as a golf course are exempt from the regulations of this Division. Vehicles regulated by state law - Unless specifically set forth herein, this Division does not apply to snowmobiles as defined in Section 8.53 of this Code and Minn. Stat. Sec. 84.81 and regulated by Minn. Stat. Sec. 84.81, et. seq.; licensed mopeds; motorized bicycles, as defined by Minn. Stat. Sec. 169.01, subd. 4a and regulated by Minn. Stat. Sec. 169.222-.223; electric personal assistive mobility devices (also known as 'Segways'), as defined in Minn. Stat. Sec. 169.01, subd. 90 and regulated by Minn. Stat. Sec. 169.212; or electric assisted bicycle, as defined in Minn. Sec. 169.01, subd. 4b and regulated by Minn. Stat. Sec. 169.222-223, or motorized scooters, as defined in Minn. Stat. Sec. 169.01, subd. 4c and regulated by Minn. Stat. Sec. 169.225.

SEC. 8.66. PROHIBITED AREAS AND ACTS. It is unlawful for any person to operate a personal recreational motor vehicle, vehicle regulated by state law or off-road vehicle: (1) On private property of another without specific written permission of the owner of said property. Written permission may be given by a posted notice of any kind or description, so long as it specifies the kind of vehicles allowed, that the owner, occupant, or lessee prefers such as by saying "Recreational Vehicles Allowed," "Trail Bikes Allowed," "All-Terrain Vehicles Allowed," or words substantially similar. (2) On publicly owned land, that is not a dedicated street or road, including school grounds, park property, playgrounds, recreation areas and golf courses, except where permitted by this Division. (3) In a manner so as to create a loud, unnecessary, or unusual noise which disturbs, annoys, or interferes with the peace and quiet of other persons. The characteristics and conditions set forth in Section 10.30 of this Code shall be considered in determining whether a noise constitutes a public nuisance. (4) On a public sidewalk or walkway provided or used for pedestrian travel. (5) At any place while under the influence of intoxicating liquor or narcotics or controlled substances as defined by state law. (6) At a rate of speed greater than reasonable or proper under all the surrounding circumstances and in no case at a speed in excess of 25 miles per hour. (7) To operate or halt the vehicle in a careless, reckless, or negligent manner so as to endanger or be likely to endanger any person or property or to cause injury or damage thereto. (8) On any public street, highway, or right-of-way, unless licensed pursuant to Minnesota law or specifically exempt from licensing. (9) To intentionally drive towards, chase, run over, or kill any animal, wild or domestic.

SEC. 8.67. STREET CROSSINGS. No person under 14 years of age operating the vehicles regulated herein shall make a direct crossing of any street, highway, or public right-of-way.

SEC. 8.68. HOURS FOR USE. The hours for use of vehicles regulated herein are 8:00 A.M. to 10:00 P.M.

SEC. 8.69. MINIMUM EQUIPMENT REQUIREMENTS. The following requirements apply to personal recreational vehicles, off road vehicles and vehicles regulated by state law: (a) Standard mufflers shall be properly attached and in constant operation to reduce the noise of operation of any gasoline motor on the vehicle to the minimum necessary for operation. No person shall use a muffler cutout, by-pass, straight pipe, or similar device on the gasoline motor of the vehicle and the exhaust system shall not emit or produce a sharp popping or crackling sound or other sound likely to annoy, disturb, injure or endanger the comfort, repose, health, peace or safety of a reasonable person of ordinary sensibilities in its vicinity. (b) Brakes shall be adequate to control the movement of the vehicle and to stop and hold the vehicle under any conditions of operation. (c) At least one clear lamp shall be attached to the front with sufficient intensity to reveal persons and vehicles at a distance of at least 100 feet ahead during the hours of darkness under normal atmospheric conditions. Such head lamp shall be so aimed that glaring rays are not projected into the eyes of an oncoming vehicle operator. It shall also be equipped with at least one red tail lamp having a minimum candlepower of sufficient intensity to exhibit a red light plainly visible from a distance of 500 feet to the rear during the hours of darkness under normal atmospheric conditions. This equipment shall be required and shall be in operating condition when the vehicle is operated between the hours of one-half hour after sunset to one-half hour before sunrise or at times of reduced visibility.

SEC. 8.70. DESIGNATION OF PUBLIC AREAS FOR USE. (a) The Council may designate areas for use of personal recreational motor vehicles, vehicles regulated by state law and off-road vehicles by approval of a majority of the members of the City Council. The areas designated may be changed from time to time by the City Council. Any area designated shall be published in the official newspaper of the City in a conspicuous place after such approval. If an area is changed, such change shall be published in like manner in the official newspaper of the City. An up-to-date map of designated park areas open for personal recreational motor vehicle or off-road vehicle use shall be kept on file in the office of the City Clerk; and, the City Manager shall provide, on request, a copy of such map together with the applicable rules, regulations, and this Division to each person requesting such information from the City. (b) Unless designated by the City Council as an area for personal recreational motor vehicles, vehicles regulated by state law or off-road vehicles, the use on City park property shall be unlawful. Further, the use in City parks designated by the City Council shall be in accordance with all of the applicable provisions of this Division and the rules and regulations of the Director of Park and Recreation.

SEC. 8.71. PENALTY. Any person violating Section 8.66, subdivisions 5, 7, 9 or 10 of this Division shall be guilty of a misdemeanor, all other violations of this Division shall be punishable as a petty misdemeanor.]

SEC. 8.06. TRAFFIC AND PARKING ON BOULEVARDS. As used in this Section, the word “boulevard” shall mean that portion of any street section between the curb and the right-of-way line of such street or in the case of uncurbed streets that portion between the shoulder of the road and the right-of-way line, excluding the driveway approach area or any approved turnarounds or hammerheads. It shall be unlawful for the operator of any motor vehicle to drive, stand, or park upon the boulevard adjoining any public street.

SEC. 8.07. EXCESS DIMENSION, WEIGHT, OR LOAD. (a) An Over-Dimensioned Vehicle Permit is required for movement of any Over-Dimensioned Vehicle upon streets and highways under the jurisdiction of the City. (b) The application for an Over-Dimensioned Vehicle Permit must be completed in writing on a form provided by the City and specifically describe: (1) the Over-Dimensioned Vehicle by type, weight, and dimensions; (2) the contents, weight and dimensions of the load to be moved, including a description of any hazardous materials within the load; (3) the route over which the Over-Dimensioned Vehicle and load will travel, specifically identifying the particular highways and roadways; (4) the date and times of the Over-Dimensioned Vehicle movement; (5) the names and addresses of each owner of the Over-Dimensioned Vehicle, as well as its load; (6) the full name, address and date of birth of each operator of the Over-Dimensioned Vehicle, including the operator’s driver’s license number; (7) proof of adequate liability insurance, or a bond affording substantially the same coverage with respect to injury to persons or damage to property, as is required for proof of financial responsibility under Minnesota Statutes Chapter 65B; and (8) Such other information as the City Council or Issuing Authority shall require. (c) The City Engineer or designee is authorized to issue or withhold an Over-Dimensioned Vehicle Permit at his or her discretion; or if the permit is issued, to limit or prescribe conditions of operation of the Over-Dimensioned Vehicle, when necessary to assure against undue damage to the road foundations, surfaces or structures, and may require additional safety provisions or other security as may be deemed necessary to compensate for any injury to any roadway or road structure. (d) The operator or Vehicle Owner of the Over-Dimensioned Vehicle must maintain proper insurance or security listed as on the written application in the amount deemed adequate by the Issuing Authority, including any additional security required as a condition of the permit’s issuance. (e) Every Over-Dimensioned Vehicle Permit must be carried in the Over-Dimensioned Vehicle to which it applies and must be presented for inspection upon the demand of any police officer or authorized agent of the Issuing Authority. (f) Violation of any of the terms or conditions of an Over-Dimensioned Vehicle Permit, or the provisions of this Section shall be punishable as a misdemeanor.

SEC. 8.08. PARKING, STOPPING, OR STANDING. No person may stop, stand, or park a vehicle except when necessary to avoid conflict with other traffic or in compliance with the specific directions of a police officer or traffic control device in any of the following places: (a) within any fire lane posted with signs or pavement markings; (b) within five (5) feet of the edge of a driveway as measured from the end of the wing of the driveway, or the end of the driveway curb return; (c) within five (5) feet of the intersection of any public or private driveway or alleyway with any street or highway; (d) within five (5) feet of a mailbox; (e) within any public alleyway, as marked; or (f) except as parallel to the curb or roadway edge, unless perpendicular parking has officially been established along the curb or roadway edge, as evidenced by white transverse parking lines or signage erected by the authority.

SEC. 8.09. TEMPORARY OR EMERGENCY REGULATIONS. The Chief of Police, by and with the approval of the City Engineer or the Engineer’s designee, is authorized to make and enforce temporary traffic regulations necessary to cover emergencies, authorized special events or special conditions. No temporary regulation shall remain in effect for more than 60 days, unless authorized by the Chief of Police with the approval of the City Engineer, or the Engineer’s designee. Temporary or emergency regulations may include the designation of stop intersections, no parking zones, yield intersections, and other traffic regulations as may be reasonably necessary to cover the emergency, special event or special condition.

SEC. 8.10. CONTROLLED ACCESS HIGHWAY. (a) No person may climb over, across, through, or under any fence erected by the City, County, State or Federal authorities adjacent to a controlled access highway, as defined in Minnesota Statutes Section 160.02, where the fence appears to be designed and placed so as to prohibit access to or from any controlled access highway. (b) No person may clip, cut, or otherwise damage fences along any controlled access highway. (c) No person may disobey the restrictions stated on official signs erected and maintained on controlled access highways prohibiting the use thereof by pedestrians, bicycles, or other non- motorized traffic.

SEC. 8.11. UNREASONABLE ACCELERATION OF MOTOR VEHICLES. No person may drive or operate a motor vehicle on any public or private roadway, sidewalk path or property within the City in a manner that creates or causes unreasonable acceleration. Prima facie evidence of such unreasonable acceleration shall be unreasonable squealing or screeching sounds emitted by the tires or unnecessary skidding or sliding upon acceleration or both.

SEC. 8.12. OPERATION AND REGULATION OF MOTORIZED GOLF CARTS. (a) Operation. Persons who are physically disabled, as defined in Minnesota Statues Chapter 169, are authorized to operate motorized golf carts on designated roadways or portions thereof within the City. (b) Permit Required. No person may operate a motorized golf cart without first obtaining a permit as provided herein. (c) Application. Every application for a permit shall be made on a form supplied by the City and must contain the following information: (1) The name and address of the applicant. (2) The nature of the applicant’s physical disability or verification by a physician that the applicant is physically disabled as defined in Minnesota Statutes. (3) The roadways or portions thereof on which the motorized golf cart will be operated. (4) The time of operation of the motorized golf cart. (5) Such other information as the Issuing Authority may require. (d) Permit Fee. The annual fee for a Motorized Golf Cart Permit shall be as set forth in Section 14.03 of this Code. (e) Term of Permit. Permits shall be granted for a period of one year and may be renewed annually. (f) Conditions of Permit. No permit shall be granted unless the following conditions are met: (1) The applicant fulfills the definition of a “physically disabled person” as defined in Minnesota Statutes, Chapter 169. (2) The applicant must submit a certificate signed by a physician that the applicant is able to safely operate a motorized golf cart on the roadways designated. (3) The applicant must provide evidence of insurance in compliance with the provisions of Minnesota Statutes, Chapter 169. (g) Designation of Roadways. The Chief of Police or his or her designee shall work in conjunction with the City Engineer or his or her designee to designate City roadways or portions thereof upon which motorized golf carts will be permitted to operate. (h) Times of Operation. Motorized golf carts may only be operated on designated roadways from sunrise to sunset. They shall not be operated in inclement weather or when visibility is impaired by weather, smoke, fog, or other conditions, or at any time when there is insufficient light to clearly see person or vehicles on the roadway at a distance of 500 feet. (i) Slow Moving Vehicle Emblem. Motorized golf carts must display the slow moving vehicle emblem provided for in Minnesota Statutes, Chapter 169, when operated on designated roadways. (j) Crossing Intersecting Highways. The operator of a motorized golf cart may cross any street or highway intersecting a designated roadway. (k) Application of Traffic Laws. Every person operating a motorized golf cart under permit on designated roadways has all the rights and duties applicable to the driver of any other vehicle under the provisions of Minnesota Statutes, Chapter 169, except when those provisions cannot reasonably be applied to motorized golf carts and except as otherwise specifically provided in Minnesota Statutes, Chapter 169. (l) Suspension or Revocation of Permits. The Chief of Police or his or her designee may suspend or revoke a permit granted hereunder upon a finding that the holder thereof has violated any of the provisions of this Section or Minnesota Statutes, Chapter 169, or if there is evidence that the permittee cannot safely operate the motorized golf cart on the designated roadways. The suspension or revocation may be appealed by the service of a written notice of appeal served upon the Issuing Authority within 30 days of the issuance of the suspension or revocation. Thereafter, the Issuing Authority will schedule the appeal for hearing pursuant to the procedures set forth in Section 1.17 of this Code.

SEC. 8.13. BICYCLE AND PEDESTRIAN REGULATIONS. (a) Prohibited Activity on Pedestrian Pathways and Bikeways. No person may operate a bicycle on any pathway posted or otherwise designated for pedestrians only; and no person may walk, jog, or run on any bikeway posted or otherwise designated for bicycles only. (b) Bicycles on Sidewalks. Pursuant to Minnesota Statutes, Chapter 169, and unless otherwise posted, persons may ride a bicycle upon a sidewalk in the City of Bloomington, but must yield right-of-way to any pedestrian on the sidewalk. Yielding the right-of-way shall mean leaving the sidewalk if necessary.

SEC. 8.14. CONDITION OF UNATTENDED MOTOR VEHICLE; OPEN IGNITION. No person shall leave a motor vehicle unattended in the City unless the keys to the vehicle are removed from the ignition and are otherwise not visible from the exterior of such motor vehicle. This provision is not applicable if the windows are closed and the doors are locked or if the motor vehicle is inside of a building.

ARTICLE III. [PARKING] VEHICLE REGULATIONS

Division A. [Parking on Private Property] Storage of Abandoned, Junk, and Inoperable Vehicles as Public Nuisances

[SEC. 8.72. PERMISSION REQUIRED. (a) No person shall park a vehicle in any private driveway or on private property or parking area on private property without the direct or implied consent of the owner or person in lawful possession of such property. (b) It shall be unlawful for any person to park or store a motor vehicle advertised "for sale" on public or private property without the express consent of the owner of such property. Any motor vehicle found parked or stored in violation of this ordinance may be towed and impounded in accordance with the procedures set forth in this Chapter.

SEC. 8.73. NO PARKING SIGNS. Whenever the owner of property used for or in connection with business purposes is required by ordinance, by the conditions precedent or applicable to the issuance of a use or occupancy permit, or by written order of the Fire Marshal or the Chief of Police to maintain driveways, access lanes, or other areas unobstructed by parked or stopped vehicles for the purpose of insuring access or egress for police, fire, and emergency vehicles, the owner or person in lawful possession of such property shall place or cause to be placed a sign or signs as follows: (1) The sign shall be placed in such a position that it is visible to anyone attempting to use the way or area for parking, and the sign shall display the international symbol for no parking or the international symbol for no parking and the words "Fire Lane". In lieu of the international symbol for no parking, the sign may state: "No Stopping or Parking - Violators Tagged and Towed by Order of the City Council," or "No Parking - Fire Lane". (2) The signs shall be permanent, nonportable signs, except when temporary signs are approved by written order of the Fire Marshal or Chief of Police. (3) The signs shall be placed at appropriate locations under the supervision of the City. (4) At the entrance to a business or an establishment where such signs have been placed as set forth in this Section, exception may be made for persons who let passengers off from their vehicle at such an entrance.

SEC. 8.74. VIOLATIONS. Failure of such owner or person in lawful possession of property to place or post such signs and to maintain such signs is a misdemeanor. Parking in violation of such signs or removal or defacing of any sign or signs required by this Division shall constitute a misdemeanor.

SEC. 8.75. NOTICE; IMPOUNDING. When any motor vehicle is found parked in violation of this Division, the Fire Marshal, Chief of Police, or their authorized agent finding such vehicle shall take its registration number and may take any other information displayed on the vehicle which may identify its user and shall conspicuously affix to such vehicle a notice in writing on a form provided by the City requiring the driver to answer the charge against him within such time during the hours and at the place specified in the notice. The Fire Marshal, Chief of Police, or their authorized agent shall send one copy of such notice to the Division of Traffic of the Police Department and one copy to the Traffic Violations Bureau. Such vehicle may be removed and impounded and kept in custody under the direction of the Police Chief. Such vehicle may be recovered by the owner when he has furnished evidence of his identity and ownership, has signed a receipt, and has paid a removal charge of $10.00, plus $.50 a day, or fraction thereof, for each day such vehicle has been kept in the custody of the Police Chief. The payment of such removal and storage charges shall not release the owner or driver of such vehicle from any other penalty imposed for the violation of this Division. At any time that a member of the Fire Department of the City is on call to a fire and finds a motor vehicle parked contrary to the provisions of this Division, such member of the Fire Department may cause to have such motor vehicle impounded in the same manner as described in this Section.

SEC. 8.76. PROSECUTION. (a) If a violator of the restriction on parking under this Division does not appear in response to such notice affixed to a motor vehicle within the time specified, the Traffic Violations Bureau or the Chief of Police shall send to the record owner of the motor vehicle to which the notice was affixed a letter informing him of the violation and warning him that in the event such letter is disregarded for a period of five days a complaint may be filed and a warrant of arrest issued. (b) In any prosecution charging a violation of this Division, proof that the particular vehicle described in the complaint was parked in violation of this Division, together with proof that the defendant named in the complaint was at the time of such parking the registered owner of such vehicle, shall constitute a prima facie presumption that the registered owner of such vehicle was the person who parked or placed such vehicle at the point where such violation occurred.]

SEC. 8.15. DECLARATION OF STORAGE OF ABANDONED, JUNK, AND INOPERABLE VEHICLES AS PUBLIC NUISANCES. The presence, accumulation, or improper storage of abandoned, junk, or inoperable motor vehicles on real property is hereby found to create an unsightly condition tending to reduce the value of real property, to invite plundering, to create fire and safety hazards, and to constitute an attractive nuisance posing a hazard to health and safety. The accumulation and exterior storage of abandoned, junk or inoperable motor vehicles is further found to promote blight and deterioration in the community; to violate the zoning regulations of the City, particularly where such motor vehicles are maintained in required setback areas of residential property. It is further found that abandoned, junk, or inoperable motor vehicles are often in the nature of rubbish, litter, and unsightly debris in violation of the health, safety, and nuisance laws. Therefore, the presence, accumulation or improper storage of abandoned, junk, or inoperable motor vehicles on real property is hereby declared to constitute a public nuisance subject to abatement and other remedies as set forth in this Article, Chapter 12 of this City Code, as well as the provisions of State law.

SEC. 8.16. OPEN STORAGE OF ABANDONED, JUNK, AND INOPERABLE VEHICLES PROHIBITED. No person may store, leave, or permit the storing or leaving of any abandoned, junk, or inoperable vehicle upon any real property, including private property, within the City unless the vehicle is completely enclosed in a building or unless the vehicle is stored on private property in connection with a duly licensed business or commercial enterprise operated and conducted pursuant to state law and Chapters 19 and 21 of this City Code and where the storing of abandoned, junk or inoperable vehicles is an essential portion of that lawful business or commercial enterprise.

SEC. 8.17. NOTICE TO REMOVE. (a) Notice on Vehicle. Whenever the appropriate City Enforcement Officer ascertains that an abandoned, junk, or inoperable vehicle is present on real property within the City, the City Enforcement Officer shall cause notice to be placed upon the abandoned, junk, or inoperable vehicle or posted in a conspicuous place near the vehicle if unable to place upon the abandoned, junk, or inoperable vehicle, using substantially the following words: “Notice to the owner and all persons interested in the attached motor vehicle and to the owner or person(s) in lawful possession or control of this land: This vehicle (setting forth a brief description), located at (setting forth a brief description of the location including street address), is improperly stored, and its present storage is in violation of Section 8.16 of the City Code unless such vehicle is removed and stored within a building pursuant to Section 8.16. Failure to remove and properly store this vehicle is a misdemeanor that is additionally subject to civil administrative penalties pursuant to Section 1.13 of this City Code. In addition, this vehicle will be removed and disposed of by the City or its designated contractor in accordance with the provisions of Division B, Article III of Chapter 8 of the City Code within seven (7) days from the date of this notice.” (b) Size of Notice on Vehicle. The notice set forth in subsection (a) of this Section shall not be less than eight (8) inches by ten (10) inches and shall be sufficiently weatherproof to withstand normal exposure to the elements. (c) Notice Mailed to Vehicle and Property Owners. In addition to the notice placed on or near the vehicle, the City shall, within two (2) working days of the notice placed on or near the vehicle, give notice by regular mail to the Vehicle owner and the Owner or Occupant of the real property upon which the vehicle is located.

SEC. 8.18. FAILURE TO REMOVE. Failure by the Vehicle Owner or Owner or Occupant of the real property upon which the vehicle is located to remove and store the motor vehicle after notice has been given and the seven day period has expired, shall constitute a misdemeanor. Each day such abandoned, junk, or inoperable vehicle remains improperly stored after the seven day period shall constitute a new violation and separately subject to prosecution or civil administrative penalties pursuant to Section 1.13 of this City Code citation.

SEC. 8.19. ABATEMENT, REMOVAL, AND DISPOSITION. (a) Abatement and Removal by City. If the Vehicle Owner of any motor vehicle which is in violation of this Division, or the Owner or Occupant of the property upon which such vehicle is located, fails, neglects, or refuses to remove or properly house the abandoned, junk or inoperable vehicle in accordance with the notice, the motor vehicle shall be deemed to be in violation of this Article of City Code and the City Enforcement Officer may cause the removal and disposal of the vehicle. (b) Removal and Disposal of Abandoned, Junk, or Inoperable Vehicles. The removal and disposal of abandoned, junk or inoperable vehicles must be in accordance with the provisions set forth in Division B of this Article. The notice provisions of Division B of this Article shall apply once the vehicle is taken into custody. (c) Allowing Access to Remove Abandoned, Junk, or Inoperable Vehicles. The Owner or Occupant of the real property upon which the vehicle is located must facilitate access by the City’s contracted agent to the abandoned, junk, or inoperable vehicles, or allow the City’s contracted agent to reasonably clear obstructions to gain access to the abandoned, junk, or inoperable vehicle, and to tow or otherwise remove the abandoned, junk, or inoperable vehicle. Failure to facilitate the removal of a junk, abandoned or inoperable vehicle is a misdemeanor, additionally subject to civil administrative penalties pursuant to Section 1.13 of this City Code.

Division B. [Parking on Registered Private Property] Custody and Impoundment of Abandoned, Junk, Inoperable, and Unauthorized Vehicles

[SEC. 8.77. PARKING PROHIBITED. It shall be unlawful for any person to park, or permit to be parked any motor vehicle upon any lot or area within the City except in conformance with the applicable provisions of Chapters 19 or 21 and Article IV of Chapter 14 (relating to licensing of open air parking lots) of this Code.

SEC. 8.78. RESPONSIBILITIES OF OWNER. (a) The record owner of any lot or area shall be held responsible for enforcement of the provisions of this Division. (b) After a lot has been registered under this Division, the record owner thereof shall not be subject to any penalty under the provisions of this Division or any other ordinance of the City for parking thereon of any motor vehicle except those owned by such owner.

SEC. 8.79. REGISTRATION. The record owner of any vacant lot or area in the City may register such lot or area on forms to be provided by the License Division making the City his agent with full power to prevent the parking of motor vehicles on such registered property and to impound any motor vehicles parking thereon.

SEC. 8.80. FEE. At the time of registration such record owner shall pay to the License Division a fee as set forth in Section 14.03 of this Code to defray the cost of making and placing a sign upon such property showing that the same has been registered under this Division.

SEC. 8.81. INSTALLATION OF SIGN. Upon registration and payment of the required fees, the Traffic Division shall place a sign or signs on the lot or area in such a position that it is visible to anyone attempting to use the area for parking showing that the same has been registered under this Division, that the parking on such lot or area would be a violation of this Division, and that any motor vehicle found thereon may be impounded.

SEC. 8.82. RESERVED.

SEC. 8.83. CITATIONS OF VEHICLES. When any motor vehicle shall be found parked in violation of this Division, the officer finding such vehicle shall take its registration number and may take any other information displayed on the vehicle which may identify its user and shall conspicuously affix to such vehicle a notice in writing on a form provided by the City for the driver to answer to the charge against him within such time and during such hours at the place specified on the notice. The officer shall send one copy of such notice to the Ordinance Violations Bureau of the City. The officer may also remove and impound such vehicle and keep it in custody. Such vehicle may be recovered by the owner when he has furnished evidence of his identity and the ownership, has signed a receipt, and has paid a removal charge for the vehicle. The payment of such removal and storage charges shall not release the owner or driver of such vehicle from any other penalty imposed for violation of this Division.

SEC. 8.84. VIOLATIONS. In any prosecution charging a violation of this Division, proof that the particular vehicle described in the complaint was parked in violation of this Division, together with proof that the defendant named in the complaint was at the time of such parking the registered owner of such vehicle shall constitute prima facie evidence that the registered owner of such vehicle was the person who parked or placed such vehicle at the point where such violation occurred.

SEC. 8.85. RESERVED.]

SEC. 8.20. PURPOSE. It is the purpose of this Division to establish a procedure by which the City of Bloomington, or its Towing Authority can remove abandoned, junk, inoperable, or unauthorized vehicles by towing or other means and thereafter store and dispose of such vehicles through a contractual delegation of authority to a person, firm, or corporation.

SEC. 8.21. ABANDONED, JUNK, OR INOPERABLE VEHICLES. (a) Custody and Impoundment of Abandoned, Junk, or Inoperable Vehicles. The City of Bloomington, or its Towing Authority, may take into custody and impound abandoned, junk, or inoperable vehicles as defined in Section 8.04 of the City Code. (b) Notice of Taking and Sale of Abandoned, Junk, or Inoperable Vehicles. (1) Notice Within Ten (10) Days. When an abandoned, junk, or inoperable vehicle is taken into custody, the City shall give notice of the taking within ten (10) days. (2) Contents of Notice. The notice shall: (A) set forth the date and place of the taking, the year, make, model, and serial number of the abandoned, junk, or inoperable vehicle if such information can be reasonably obtained, and the place where the vehicle is being held; (B) inform the Vehicle Owner and any lienholders of their respective rights to reclaim the abandoned, junk, or inoperable vehicle under state law and Section 8.22(c) of this Division of the City Code; and (C) state that failure of the Vehicle Owner or lienholders to exercise their right to reclaim the vehicle and contents within the 15-day waiting period set forth in Minnesota Statutes Section 168B.051 and Section 8.22(c) of this Division of the City Code shall be deemed a waiver by them of all right, title, and interest in the vehicle and its contents and a consent to the transfer of title to a disposal or sale of the vehicle and contents pursuant to state law and Section 8.22(c) of the City Code. (3) Notice by Mail or Publication. The notice regarding abandoned, junk, or inoperable vehicles shall be sent by mail to the registered owner, if any, and to all readily identifiable lienholders of record. If it is impossible to determine with reasonable certainty the identity and address of the registered owner and all lienholders, the notice shall be published once in a newspaper of general circulation in the City. Published notices may be grouped together for convenience and economy. (c) Reclaiming Abandoned, Junk, or Inoperable Vehicles; Sale After Fifteen (15) Days. The Vehicle Owner or any lienholder of an impounded motor vehicle shall have such rights to reclaim the impounded vehicle and retrieve its contents from the Public Impound Lot as set forth in Minnesota Statutes Section 168B.07. The failure of the Vehicle Owner or lienholder to exercise the right to reclaim the vehicle or its contents before the expiration of the 15 day waiting period set forth in Minnesota Statutes Section 168B.051 constitutes a waiver of all right, title and interest in the vehicle, as well as its contents, and a consent to the transfer of title to, and disposal or sale of the vehicle. An abandoned, junk or inoperable vehicle is eligible for disposal or sale 15 days after the notice to the Vehicle Owner. The Vehicle Owner or lienholder shall have a right to reclaim the abandoned, junk, or inoperable vehicle from the Impound Lot Operator upon payment of all towing and storage charges resulting from the impoundment of the vehicle within 15 days of the notice to the Vehicle Owner. (d) Sales Receipt for Purchase of Abandoned, Junk, or Inoperable Vehicles. If an abandoned, junk, or inoperable vehicle and its contents taken into custody by the City or its Towing Authority is not properly reclaimed, it may be disposed of or sold at auction or sale by the City or its agent. The purchaser shall be given a receipt in a form prescribed by the registrar of motor vehicles which shall be sufficient title to dispose of the vehicle. The receipt shall also entitle the purchaser to register the vehicle and receive a certificate of title, free and clear of all liens and claims of ownership. Pursuant to state law, before such a vehicle is issued a new certificate of title it must receive a motor vehicle safety check. (e) Unsold Abandoned, Junk, or Inoperable Vehicles. Abandoned, junk, or inoperable vehicles not sold by the City or its agent shall be disposed of in accordance with state law.

SEC. 8.22. UNAUTHORIZED VEHICLES. (a) Immediate Custody and Impoundment of Unauthorized Vehicles. The City of Bloomington may, in its discretion, take into custody and impound any unauthorized vehicle upon the representation of the Owner or Occupant of the private property on which the vehicle is situated that the vehicle’s presence on the property is unauthorized in the following cases: (1) an unattended vehicle that is on private property: (A) that is a single-family or duplex residential property; or (B) that is private, nonresidential property that is properly posted with signs prohibiting public parking; or (C) that is a residential property that is properly posted with signs prohibiting public parking. (2) an unattended vehicle on public property not governed by Minnesota Statutes, Chapter 169 and is located so as to constitute an accident or traffic hazard to the traveling public, as determined by a peace officer. (b) Other Custody and Impoundment Requirements of Unauthorized Vehicles. A vehicle may be impounded after it has been left unattended in one of the following locations for the applicable period of time: (1) in a public location not governed by Minnesota Statutes, Section 169.041 Chapter 169: (A) on a highway and properly tagged by a peace officer – four (4) hours; (B) that is a parking facility or other public property owned or controlled by the City that is properly posted with signs prohibiting public parking – four (4) hours. (2) on non-residential private property that is not posted – twenty-four (24) hours. (c) Notice of Taking and Sale of Unauthorized Vehicles. (1) Notice Within Ten (10) Days. When an unauthorized vehicle is taken into custody, the City shall give notice of the taking within ten (10) days. (2) Contents of Notice. The notice shall: (A) set forth the date and place of the taking, the year, make, model, and serial number of the unauthorized vehicle if such information can be reasonably obtained, and the place where the vehicle is being held; (B) inform the Vehicle Owner and any lienholders of their right to reclaim the unauthorized vehicle under state law and Section 8.23(d) of this Division of the City Code; and (C) state that failure of the Vehicle Owner or lienholders to exercise their right to reclaim the vehicle and contents within the 45-day period set forth in Minnesota Statutes Section 168B.051 and Section 8.23(d) of this Division of the City Code shall be deemed a waiver by them of all right, title, and interest in the vehicle and contents and a consent to the transfer of title to a disposal or sale of the vehicle and contents pursuant to state law and Section 8.23(d) of the City Code. (3) Notice by Mail or Publication. The notice regarding unauthorized vehicles shall be sent by mail to the registered owner, if any, and to all readily identifiable lienholders of record. If it is impossible to determine with reasonable certainty the identity and address of the registered owner and all lienholders, the notice shall be published once in a newspaper of general circulation in the City. Published notices may be grouped together for convenience and economy. (4) Second Notice. If an unauthorized vehicle remains unclaimed after thirty (30) days from the date the notice was sent under this Division and state law, a second notice shall be sent by regular mail, to the registered owner, if any, of the unauthorized vehicle and to all readily identifiable lienholders of record. (d) Reclaiming Unauthorized Vehicles; Sale After Forty-five (45) Days. The Vehicle Owner or any lienholder of an impounded motor vehicle shall have such rights to reclaim the impounded vehicle and retrieve its contents from the Public Impound Lot as set forth in Minnesota Statutes Section 168B.07. The failure of the Vehicle Owner or lienholder to exercise the right to reclaim the vehicle or its contents before the expiration of the 45 day waiting period set forth in Minnesota Statutes Section 168B.051 constitutes a waiver of all right, title and interest in the vehicle, as well as its contents, and a consent to the transfer of title to, and disposal or sale of the vehicle. The vehicle is eligible for disposal or sale forty-five (45) days after the second notice to the Vehicle Owner. The Vehicle Owner or any lienholder of an unauthorized vehicle shall have a right to reclaim the vehicle from the City and Impound Lot Operator upon payment of all towing and storage charges resulting from taking the vehicle into custody within 45 days after the date of the second notice to the Vehicle Owner. (e) Sales Receipt for Purchase of Unauthorized Vehicles. If an unauthorized vehicle and contents taken into custody by the City or its Towing Authority is not properly reclaimed, it may be disposed of or sold at auction or sale. The purchaser shall be given a receipt in a form prescribed by the registrar of motor vehicles which shall be sufficient title to dispose of the vehicle. The receipt shall also entitle the purchaser to register the vehicle and receive a certificate of title, free and clear of all liens and claims of ownership. Pursuant to state law, before such a vehicle is issued a new certificate of title it must receive a motor vehicle safety check.

SEC. 8.23. SALE PROCEEDS BY CITY OR PUBLIC IMPOUND LOT. The City shall be reimbursed for its cost of towing, preserving and storing the vehicle, and all administrative notice and publication costs incurred in handling the vehicle, pursuant to this Division of the City Code and state law, out of the gross proceeds from the sale of abandoned, junk, inoperable, or unauthorized motor vehicle conducted by the City, its agent or the Public Impound Lot and held according to this Division and state law. Any remainder from the proceeds of the sale shall be held for the Vehicle Owner or entitled lienholder for ninety (90) days and then shall be deposited in a fund in the police department established to cover the costs of notices and other expense mandated by this Division and state law.

SEC. 8.24. SALE PROCEEDS BY NONPUBLIC IMPOUND LOTS. The operator of a Nonpublic Impound Lot may retain any proceeds derived from a sale conducted under the authority of state law. The operator may retain all proceeds from sale of any personal belongs and contents in the vehicle that were not claimed by the Vehicle Owner or the owner’s agent before the sale, except that any suspected contraband or other items that likely would be subject to forfeiture in a criminal trial must be turned over to the appropriate law enforcement agency.

SEC. 8.25. IMPLIED CONSENT TO SELL. A registered owner who fails to claim the impounded vehicle within the applicable time period allowed under Minnesota Statutes, Chapter 168B is deemed to waive any right to reclaim the vehicle and consents to the disposal or sale of the vehicle and its contents and transfer of title.

SEC. 8.26. AUTHORITY TO CONTRACT FOR TOWING SERVICES. (a) Contract. Every Towing Authority for the City must enter into a contract obligating the Towing Authority to obtain and maintain adequate facilities for the towing, impoundment and storage of vehicles requested by the City Police Department and other City Enforcement Officers. (b) Bond. Every Towing Authority to whom a City contract is awarded for towing and storage shall, upon the execution of such contract, file with the City Clerk a bond approved by the City Attorney in such amount as may be determined by the contract. Such bond shall be conditioned that the principal will indemnify any and all persons, firms, or corporations, including the City of Bloomington and the County or other governmental agencies of this State, for any loss sustained by any unlawful or unauthorized damage to a vehicle which it towed at the request of the City or stored by said towing operator, pursuant to the provisions of this Division and any contract entered into where the City of Bloomington is a party thereof. (c) Statements. Every Towing Authority under contract with the City pursuant to this Division shall forward to the Chief of Police a copy of each bill or statement prepared for each Vehicle Owner of a vehicle towed or stored at the request of the City. (d) Exclusion. Nothing contained in this Division shall be deemed to prohibit, limit, or restrict the use or operation of towing equipment or storage facilities by the City, County, or School District.

SEC. 8.86.01. (RESERVED).

SEC. 8.87. PARKING. (a) Regulatory signs. The provisions of Section 8.86 of this Article regulating parking shall be effective only after proper signs are erected designating the areas as no parking areas or upon painting of the adjacent curb yellow, and the parking restrictions contained in said Section shall be effective only in those areas where such signs are so erected or such curbs are so painted. (b) Types of Regulatory Signs. The No Parking Signs referred to throughout this Article shall display the international symbol for no parking or other appropriate word messages or a combination thereof in conformance with the manual on Uniform Traffic Control Devices for Streets and Highways. (c) Limited parking zones. No person shall park any vehicle for a longer period than is designated on the signs marking such zone in any limited parking zone established by the City Council except on Sundays and legal holidays. (d) Time limit on consecutive parking. No person shall park a vehicle or permit it to stand upon any public right of way for more than 24 consecutive hours. (e) Emergency parking restrictions. The Director of Public Works or the Police Department may temporarily prohibit vehicular parking or traffic on any public right-of-way at such times as the Public Works Department is performing maintenance to such public rights-of-way or at such times that a public safety emergency exists on or near such public right-of-way. (f) Impounding. Any unoccupied vehicle found in violation of the provisions of this Division may be immediately removed and impounded by any police officer or duly authorized person in accordance with this Code. (g) Greasing. No person shall grease or repair such vehicle upon a public right-of-way except when such repairs are necessary because of an emergency. (h) No person shall park a motor vehicle advertised "for sale" on any public property, public right-of- way, or railroad right-of-way without the express consent of the owner of such property. Any motor vehicle found parked in violation of this provision may be towed and impounded in accordance with the procedures set forth in this Chapter. (i) Penalty. Unless another penalty is expressly provided by law, a violation of any provisions of this Division shall be a misdemeanor. (j) Applicability. The provisions of this Division relating to no parking shall not be applicable to police vehicles while performing official duties.

SEC. 8.87.01. REGULATION OF PARKING AT CITY HALL. (a) No person shall park a vehicle in violation of an official sign or signs regulating a designated parking area of the City of Bloomington Civic Plaza, 1800 West Old Shakopee Road. (b) A violation of this Section shall be a petty misdemeanor.

SEC. 8.88. ORDERS OF POLICE. No person shall disobey any lawfully issued order of the Hennepin County Commissioners, Hennepin County Highway Commission, the Police Department, or of any police officer relative to the parking of vehicles in the City.]

SEC. 8.27. PURPOSE AND INTENT. It is the intent of this Division to supplement Minnesota Statutes, Chapter 84, with respect to the operation of certain motor vehicles commonly called snowmobiles. This Division is not intended to allow what the State statutes prohibit or to prohibit what the State statutes expressly allow.

SEC. 8.28. DEFINITION AND REGULATIONS. (a) Snowmobile Definition. A self-propelled vehicle designed for travel on snow or ice or a natural terrain steered by wheels, skis, or runners. (b) Prohibition. It shall be unlawful for any person to operate a snowmobile on publicly or privately owned property within the City. (c) Exceptions. This prohibition shall not apply to: (1) The loading or unloading of snowmobiles from a trailer or motor vehicle used to transport them; or (2) The use of a snowmobile for a rescue, emergency, or law-enforcement purpose; (3) The use of snowmobiles for park maintenance.

Division D. [Handicapped Parking] Personal Recreational Vehicles

[SEC. 8.88.01. DEFINITIONS. The following words and terms as used in this division shall have the following meanings unless the context clearly indicates otherwise. Identifying Certificate - The certificate or insignia issued to physically handicapped persons by the Minnesota Department of Public Safety pursuant to M.S.A. S 169.345, Subd. 2. Physically Handicapped - Any person who has sustained an amputation or permanent material disability of either or both arms or legs or who has been otherwise permanently disabled in any manner rendering it difficult and burdensome for him to walk.

SEC. 8.88.02. PARKING RESTRICTIONS. (a) The following parking restrictions shall apply to both public and private property, the restrictions shall apply to parking spaces designated and reserved for physically handicapped persons by state and local law and to those spaces created through the action of persons who own or are in lawful possession of the subject property. (b) No person shall park a motor vehicle in parking spaces designated and reserved for the physically handicapped unless: (1) That person is physically handicapped or is operating the vehicle under the direction and for the use of a physically handicapped person, and (2) such vehicle visibly bears or contains a proper identifying certificate. (c) Failure to obey the above provisions shall constitute a petty misdemeanor. Vehicles in violation may be removed, impounded, and kept in custody under the direction of the Police Chief. (d) In any prosecution charging a violation of the above provisions, proof of the identity of the registered owner of the particular vehicle described in the citation or complaint at the time of the violation shall create a prima facie presumption that that individual was the person who parked such vehicle at the point where the violation occurred.

SEC. 8.88.03. DESIGNATION OF LOCATION AND DESCRIPTION OF SIGNS. (a) The location of parking spaces reserved for physically handicapped persons shall be designated according to provisions of the Uniform Building Code as incorporated by Section 15.01 of this Code. (b) Notice of such designation of handicapped parking spaces shall be given by the posting of permanent, nonportable signs. Such signs shall be designed in accordance with the requirements of the manual of the Commissioner of Public Safety on uniform traffic control devices. (c) No person shall cause to be erected signs reserving or designating parking spaces for physically handicapped persons unless the location, number, and method of signing of such spaces is first approved by the Director of Community Development or an appointed representative.]

SEC. 8.29. PURPOSE AND INTENT. The purpose of this Division is to provide reasonable regulations for the use of Personal Recreational Vehicles, Off-Road Vehicles and certain other vehicles, other than Motor Vehicles, regulated by state law on public and private property in the City. This Division is not intended to allow what the Minnesota Statutes prohibit nor to prohibit what the Minnesota Statutes expressly allow. It is intended to protect public safety and to prevent the use of these vehicles in a manner that constitutes a public nuisance.

SEC. 8.30. PROHIBITED AREAS AND ACTS. It is unlawful for any person to operate a Personal Recreational Vehicle, other vehicle regulated by state law, or Off-Road Vehicle: (1) On private property of another without specific written permission of the Owner or Occupant of said property. Written permission may be given by a posted notice of any kind or description, so long as it specifies the kind of vehicles allowed, that the Owner or Occupant of the property, prefers such as by saying "Recreational Vehicles Allowed," "Trail Bikes Allowed," "All-Terrain Vehicles Allowed," or substantially similar words. (2) On publicly owned land, that is not a dedicated street or road, including school grounds, park property, playgrounds, recreation areas and golf courses, except where permitted by this Division. (3) In a manner creating loud, unnecessary, or unusual noise which disturbs, annoys, or interferes with the peace and quiet of other persons. The characteristics and conditions set forth in Section 10.30 of this Code shall be considered in determining whether a noise constitutes a public nuisance. (4) On a public sidewalk or walkway provided or used for pedestrian travel. (5) At any place while under the influence of intoxicating liquor, narcotics, or controlled substances as defined by state law. (6) At a rate of speed greater than reasonable or proper under all the surrounding circumstances and in no case at a speed in excess of 25 miles per hour. (7) To operate or halt the vehicle in a careless, reckless, or negligent manner endangering, or be likely to endanger, any person or property or to cause injury or damage thereto. (8) On any public street, highway, or right-of-way, unless licensed pursuant to Minnesota law or specifically exempt from licensing. (9) To intentionally drive towards, chase, run over, or kill any domestic, wild, or farm animal.

SEC. 8.31. STREET CROSSINGS. No person under 14 years of age operating the vehicles regulated by this Division shall make a direct crossing of any street, highway, or public right-of-way.

SEC. 8.32. HOURS FOR USE. The hours for use of vehicles regulated by this Division are 8:00 A.M. to 10:00 P.M.

SEC. 8.33. MINIMUM EQUIPMENT REQUIREMENTS. The following requirements apply to Personal Recreational Vehicles, Off Road Vehicles and vehicles, other than Motor Vehicles regulated by state law: (a) Standard mufflers shall be properly attached and in constant operation to reduce the noise of any gasoline motor on the vehicle to the minimum necessary for operation. No person shall use a muffler cutout, by-pass, straight pipe, or similar device on the gasoline motor of the vehicle and the exhaust system shall not emit or produce a sharp popping or crackling sound or other sound likely to annoy, disturb, injure or endanger the comfort, repose, health, peace or safety of a reasonable person of ordinary sensibilities in its vicinity. (b) Brakes shall be adequate to control the movement of the vehicle and to stop and hold the vehicle under any conditions of operation. (c) At least one clear lamp shall be attached to the front with sufficient intensity to reveal persons and vehicles at a distance of at least 100 feet ahead during the hours of darkness under normal atmospheric conditions. Such head lamp shall be so aimed that glaring rays are not projected into the eyes of an oncoming vehicle operator. It shall also be equipped with at least one red tail lamp having a minimum candlepower of sufficient intensity to exhibit a red light plainly visible from a distance of 500 feet to the rear during the hours of darkness under normal atmospheric conditions. This equipment shall be required and shall be in operating condition when the vehicle is operated between the hours of one-half hour after sunset to one-half hour before sunrise or at times of reduced visibility.

SEC. 8.34. DESIGNATION OF PUBLIC AREAS FOR USE. (a) The Council may designate areas for use of Personal Recreational Vehicles, vehicles regulated by state law, other than Motor Vehicles and Off-Road Vehicles by approval of a majority of the members of the City Council. The areas designated may be changed from time to time by the City Council. Any area designated shall be published in the official newspaper of the City in a conspicuous place after such approval. If an area is changed, such change shall be published in like manner in the official newspaper of the City. An up-to-date map of designated park areas open for Personal Recreational Vehicle or Off-Road Vehicle use shall be kept on file in the office of the City Clerk; and, the City Manager shall provide, on request, a copy of such map together with the applicable rules, regulations, and this Division to each person requesting such information from the City. (b) Unless designated by the City Council as an area for Personal Recreational Vehicles, vehicles regulated by state law, other than Motor Vehicles or Off-Road Vehicles, the use on City park property shall be unlawful. Further, the use in City parks designated by the City Council shall be in accordance with all of the applicable provisions of this Division and the rules and regulations of the Director of Park and Recreation.

SEC. 8.35. PENALTY. Any person violating Section 8.31, subdivisions 5, 7, 9 or 10 of this Division shall be guilty of a misdemeanor.

[Division E. Winter Parking Restrictions

SEC. 8.88.04. AUTOMATIC PARKING BAN AFTER SNOWFALL. No person shall park any motor vehicle on any public right-of-way in the City or permit any motor vehicle to remain on any public right-of-way in the City for a period of forty-eight (48) hours commencing immediately after the National Weather Service has announced that three (3) inches or more of snow has continuously fallen, or until snow removal comprising the full width of the public right-of-way has been completed, whichever occurs first.

SEC. 8.88.05. REMOVAL OF ILLEGALLY PARKED VEHICLES. Any motor vehicle parked in violation of this Code is deemed to be a nuisance that interferes with snow removal from public rights-of-way. Any law enforcement officer or Public Works employee engaged in snow removal may remove any such vehicle by means of towing or other means in order to facilitate proper snow removal. The removal of illegally parked vehicles shall not preclude prosecutions for violations of any provision of this Division.

SEC. 8.88.06. PENALTY. A violation of this Division shall be a petty misdemeanor.]

ARTICLE IV. [TRAFFIC CODE] PARKING

[SEC. 8.89. STATE STATUTES INCORPORATED BY REFERENCE. The regulatory provisions of Minnesota Statutes 1957, Ch. 169, as amended by laws 1959, 1961, 1963, 1965, 1967, 1969, 1971, 1973, 1974, 1975, 1976, 1977, 1978, 1979, and 1980 are hereby adopted as a Traffic Code within the City and are hereby incorporated in and made a part of this Code as completely as if set out herein in full.

SEC. 8.90. VIOLATION. Any violation of the Statutes adopted by reference in Section 8.89 of this Code is declared to be a violation of this Code when it occurs within the City, and shall constitute a misdemeanor or a petty misdemeanor as defined by Statute. Upon conviction of such violation, the penalty shall be the penalty prescribed in said Statutes, and in the event that no penalty is prescribed in the Statutes hereby incorporated, the person so convicted shall be punished as prescribed in Chapter 1 of this Code.

SEC. 8.91. CANCELLED, SUSPENDED, OR REVOKED LICENSE. Any person whose driver's license or driving privilege has been cancelled, suspended, or revoked as provided in Minnesota Statutes, 1957, Chs. 169, 170, or 171, as amended by Laws 1959, 1961, 1963, 1965, 1967, 1969, 1971, 1973, 1974, 1975, 1976, 1977, 1978, 1979, and 1980, who operates any motor vehicle, the operation of which requires a driver's license under state law, upon streets or highways within the City while such license or privilege is cancelled, suspended, or revoked is guilty of a misdemeanor or petty misdemeanor as defined by Statute.

SEC. 8.92. RESTRICTED LICENSE. Any person who operates any motor vehicle, the operation of which requires a driver's license under state law, within the City in violation of any restrictions or limitations imposed on said license, as provided in Minnesota Statutes 1957, Chs. 169, 170, or 171, as amended by Laws 1959, 1961, 1963, 1965, 1967, 1969, 1971, 1973, 1974, 1975, 1976, 1977, 1978, 1979, and 1980, is guilty of a misdemeanor or a petty misdemeanor as defined by Statute.

SEC. 8.93. UNLAWFUL ACTS. It shall be unlawful for any person: (1) To display or cause or permit to be displayed or have in his possession, any cancelled, revoked, suspended, fictitious or fraudulently altered driver's license; or (2) to lend his driver's license to any person or knowingly permit the use thereof by another; or (3) to display or represent as one's own any driver's license not issued to him; or (4) to fail or refuse to surrender to the department, upon its lawful demand, any driver's license which has been suspended, revoked, or cancelled; or (5) to use a false or fictitious name in any application for a driver's license or to knowingly make a false statement, or to knowingly conceal a material fact, or otherwise commit a fraud in any such application; or (6) to alter any driver's license, or to counterfeit or make any fictitious license; or (7) to take any part of the driver's license examination for another or to permit another to take the examination for him.

SEC. 8.94. UNREASONABLE ACCELERATION OF MOTOR VEHICLES. (a) No person shall drive a motor vehicle on any public or private way within the City in such a manner that creates or causes unreasonable acceleration. Prima facie evidence of such unreasonable acceleration shall be unreasonable squealing or screeching sounds emitted by the tires or unnecessary skidding or sliding upon acceleration or both. (b) Penalty. Any person violating any of the provisions of this Section shall be guilty of a petty misdemeanor.

SEC. 8.95. OPERATION AND REGULATION OF MOTORIZED GOLF CARTS. (a) Operation. Persons who are physically handicapped as defined in Minnesota Statutes, Section 169.345, Subdivision 2, are authorized to operate motorized golf carts on designated roadways or portions thereof within the City. (b) Permit Required. No person shall operate a motorized golf cart without obtaining a permit as provided herein. (c) Application. Every application for a permit shall be made on a form supplied by the City and shall contain the following information: (1) The name and address of the applicant. (2) The nature of the applicant's physical handicap. (3) The roadways or portions thereof on which the motorized golf cart will be operated. (4) The time of operation of the motorized golf cart. (5) Such other information as the City may require. (d) Permit Fee. The annual permit fee shall be as set forth in Section 14.03 of this Code. (e) Term of Permit. Permits shall be granted for a period of one year and may be renewed annually. (f) Conditions of Permit. No permit shall be granted unless the following conditions are met: (1) The applicant must demonstrate that he is a physically handicapped person as defined in Minnesota Statutes, Section 169.345, Subdivision 2. (2) The applicant must submit a certificate signed by a physician that the applicant is able to safely operate a motorized golf cart on the roadways designated. (3) The applicant must provide evidence of insurance in compliance with the provisions of Minnesota Statutes, Section 65B.48, Subdivision 5. (g) Designation of Roadways. The Chief of Police or his representative shall designate City roadways or portions thereof upon which motorized golf carts will be permitted to operate. (h) Times of Operation. Motorized golf carts may only be operated on designated roadways from sunrise to sunset. They shall not be operated in inclement weather or when visibility is impaired by weather, smoke, fog or other conditions, or at any time when there is insufficient light to clearly see persons and vehicles on the roadway at a distance of 500 feet. (i) Slow Moving Vehicle Emblem. Motorized golf carts shall display the slow moving vehicle emblem provided for in Minnesota Statutes, Section 169.522, when operated on designated roadways. (j) Crossing Intersecting Highways. The operator of a motorized golf cart may cross any street or highway intersecting a designated roadway. (k) Application of Traffic Laws. Every person operating a motorized golf cart under permit on designated roadways has all the rights and duties applicable to the driver of any other vehicle under the provisions of Chapter 169 of Minnesota Statutes, except when those provisions cannot reasonably be applied to motorized golf carts and except as otherwise specifically provided in Minnesota Statutes, Section 169.045, Subdivision 7. (l) Suspension or Revocation of Permits. The City Council may suspend or revoke a permit granted hereunder upon a finding that the holder thereof has violated any of the provisions of this Section or Chapter 169 of Minnesota Statutes, or if there is evidence that the permittee cannot safely operate the motorized golf cart on the designated roadways. The hearing procedures set forth in Chapter 14, Article I of this Code shall apply. (m) Penalty. Any person violating any of the provisions of this Section shall be guilty of a petty misdemeanor.

SEC. 8.96. BICYCLE AND PEDESTRIAN REGULATIONS. (a) State Traffic Regulations. Every person operating a bicycle within the City shall adhere to the traffic regulations applicable to bicycles in Minnesota Statutes Chapter 169. (b) Prohibited Activity on Pedestrian Pathways and Bikeways. (1) No person shall operate a bicycle on any pathway posted or otherwise designated for pedestrians only; and no person shall walk, jog or run on any bikeway posted or otherwise designated for bicycles only. (2) Any person violating this Section shall be guilty of a petty misdemeanor. (c) Bicycles on Sidewalks. (1) Pursuant to Minnesota Statutes Section 169.222, Subdivision 4(d), and unless otherwise posted, persons may ride a bicycle upon a sidewalk in the City of Bloomington but must yield right-of-way to any pedestrian on the sidewalk. Yielding the right-of-way shall mean leaving the sidewalk if necessary. (2) Any person violating this sub-section shall be guilty of a petty misdemeanor.

SEC. 8.97. CONDITION OF UNATTENDED MOTOR VEHICLE; OPEN IGNITION. No person shall leave a motor vehicle unattended in the City unless the ignition thereof is in the locked position and the keys are removed therefrom and not visible from the exterior of such motor vehicle. This provision is not applicable if the windows are closed and the doors are locked or if the motor vehicle is in a building.]

Division A. Parking on Private Property

SEC. 8.36. PERMISSION REQUIRED. (a) No person shall park a vehicle on any private driveway, private property, or parking area on private property without the direct or implied consent of the Owner or Occupant of such property. (b) It shall be unlawful for any person to park or store a motor vehicle advertised "for sale" on public or private property without the express consent of the Owner of such property. Any motor vehicle found parked or stored in violation of this ordinance may be towed and impounded in accordance with the procedures set forth in this Chapter. (c) It shall be the responsibility of the Owner or Occupant of such property to tow or otherwise remove unwanted or unpermitted motor vehicles at their expense.

SEC. 8.37. NO PARKING SIGNS. Whenever the Owner or Occupant of property used for or in connection with business purposes is required by ordinance, by the conditions precedent or applicable to the issuance of a use or occupancy permit, or by written order of the Fire Marshal or the Chief of Police, to maintain driveways, access lanes, or other areas unobstructed by parked or stopped vehicles for the purpose of insuring access or egress for police, fire, and emergency vehicles, the Owner or Occupant of such property shall place or cause to be placed a sign or signs as follows: (1) The sign shall be placed in such a position that it is visible to anyone attempting to use the way or area for parking, and the sign shall display the international symbol for no parking or the international symbol for no parking and the words "Fire Lane". In lieu of the international symbol for no parking, the sign may state: "No Stopping or Parking - Violators Tagged and Towed by Order of the City Council," or "No Parking - Fire Lane". (2) The signs shall be permanent, nonportable signs, except when temporary signs are approved by written order of the Fire Marshal or Chief of Police. (3) The signs shall be placed at appropriate locations approved by the City. (4) At the entrance to a business or an establishment where such signs have been placed as set forth in this Section, exception may be made for persons who let passengers off from or pick passengers up with their vehicle at such an entrance.

SEC. 8.38. VIOLATIONS. Failure of such Owner or Occupant of property to place or post and maintain such signs in violation of this Division is a petty misdemeanor. Violations may, at the sole discretion of the City Enforcement Officer, be alternatively subject to civil penalties that as subject to assessment against the Owner or Occupant’s property pursuant to Section 12.15 of the City Charter and Section 1.19 of this City Code. Parking in violation of such signs or removal or defacing of any sign or signs required by this Division shall constitute a petty misdemeanor.

SEC. 8.39. NOTICE; IMPOUNDING. When any motor vehicle is found parked in violation of this Division, the appropriate City Enforcement Officer shall take its license plate number and any other information displayed on the vehicle that may identify its user and shall conspicuously affix to such vehicle a notice in writing on a form provided by the City requiring the driver to answer the charge against him within such time during the hours and at the place specified in the notice. The City Enforcement Officer shall send one copy of such notice to the Traffic Division of the Police Department and one copy to the Hennepin County District Court Traffic Violations Bureau.

Division B. No Parking Zones

SEC. 8.40. ZONES DESIGNATED. (a) The City Engineer or designee is hereby authorized to determine and designate by proper signs, places not exceeding 100 feet in length in which the stopping, standing, or parking of vehicles is prohibited for the convenience of the public or to minimize traffic hazards and preserve a free flow of traffic. (b) The City Engineer or designee is hereby authorized to temporarily determine and designate, by proper signs, zones exceeding 100 feet in length where prohibiting such stopping, standing, or parking of vehicles is in the best interest of the public. Such temporary zone shall not exist for longer than three hundred sixty five (365) days unless made permanent by City ordinance. (c) No Parking Zones Map. The location and boundaries of no parking zones shall be described in a resolution adopted by the City Council. Such descriptions shall be reflected in an official “No Parking Zones” map that is established and maintained as provided herein. (i) No Parking Zones. The location and boundaries of no parking zones established by this Chapter of the City Code shall be set forth on the No Parking Zones Map of the City of Bloomington in accordance with the ordinances describing those zones. The No Parking Zones Map and all notations, references, and other information shown thereon is hereby made a part of this Chapter by reference and shall have the same force and effect as if such map and all notations, references, and other information shown thereon were fully set forth or described in this Chapter. The format of the No Parking Zones Map shall be determined by the Director of Public Works or designee. (ii) Location of No Parking Zones Map. The No Parking Zones Map shall be kept permanently on file in the office of the Department of Public Works of the City of Bloomington and shall be available for inspection by the public during normal business hours. (iii) Amendments to the No Parking Zones Map. Amendments to the locations and boundaries of any devices and zones as shown in the No Parking Zones Map shall be by resolution adopted by the City Council. (iv) No Parking Zones. The Director of Public Works or designee shall be responsible for maintaining and updating the No Parking Zones map. Any amendments to the No Parking Zones Map shall be recorded on the appropriate map(s) within thirty (30) days of adoption by the City Council.

SEC. 8.41. PARKING. (a) Regulatory signs. Parking regulations shall be effective only after proper signs are erected designating the areas as no parking areas or upon painting of the adjacent curb yellow, and the parking restrictions contained in this Section shall be effective only in those areas where such signs are so erected or such curbs are so painted. Whenever official No Parking Signs are placed in position approximately conforming to the requirements of Minnesota Statutes Chapter 169, such devices shall be presumed to have been so placed by the official act or direction of lawful authority. (b) Types of Regulatory Signs. The No Parking Signs referred to throughout this Article shall display the international symbol for no parking or other appropriate word messages or a combination thereof in conformance with the current version of the Minnesota Manual on Uniform Traffic Control Devices (MMUTCD) for Streets and Highways. (c) Limited Parking Zones. No person shall park any vehicle for a longer period than is designated on the signs marking such zone in any limited parking zone established by the City Council except on Sundays and legal holidays. (d) Time Limit on Consecutive Parking. No person shall park a vehicle or permit it to stand upon any public right of way for more than 24 consecutive hours. (e) Emergency Parking Restrictions. The Director of Public Works or designee or the Police Chief or designee may temporarily prohibit vehicular parking or traffic on any public right-of-way at such times as the Public Works Department is performing maintenance to or construction within such public rights-of-way or at such times that a public safety emergency exists on or near such public right-of-way. (f) Impounding. Any unoccupied vehicle found in violation of the provisions of this Division may be immediately removed and impounded by any police officer or duly authorized person in accordance with this Code. (g) Greasing. No person shall grease or repair such vehicle upon a public right-of-way except when such repairs are necessary because of an emergency. (h) For Sale. No person shall park a motor vehicle advertised "for sale" on any public property, public right-of-way, or railroad right-of-way without the express consent of the Owner or Occupant of such property. Any motor vehicle found parked in violation of this provision may be towed and impounded in accordance with the procedures set forth in this Chapter. (i) Penalty. Unless another penalty is expressly provided by law, a violation of any provisions of this Division shall be a petty misdemeanor. (j) Applicability. The provisions of this Division relating to no parking shall not be applicable to police vehicles or other emergency vehicles while performing official duties.

SEC. 8.42. REGULATION OF PARKING AT CITY OWNED FACILITIES. (a) No person shall park a vehicle in violation of an official sign or signs regulating a designated parking area of the City of Bloomington or other City owned facility, including Civic Plaza, 1800 West Old Shakopee Road.

Division C. Parking Designated for Disabled Persons

SEC. 8.43. PARKING RESTRICTIONS. (a) The following parking restrictions shall apply to both public and private property, the restrictions shall apply to parking spaces designated and reserved for physically disabled persons by state and local law and to those spaces created through the action of persons who own or are in lawful possession of the subject property. (b) No person shall park a motor vehicle in parking spaces designated and reserved for the physically disabled unless: (1) That person is physically disabled or is operating the vehicle under the direction and for the use of a physically disabled person, and (2) such vehicle visibly bears or contains a proper identifying certificate. (c) Vehicles in violation may be removed, impounded, and kept in custody under the direction of the Police Chief. (d) In any prosecution charging a violation of the above provisions, proof of the identity of the registered owner of the particular vehicle described in the citation or complaint at the time of the violation shall create a prima facie presumption that that individual was the person who parked such vehicle at the point where the violation occurred.

SEC. 8.44. DESIGNATION OF LOCATION AND DESCRIPTION OF SIGNS. (a) The location of parking spaces reserved for physically disabled persons shall be designated according to provisions of the Uniform Building Code as incorporated by Section 15.01 of this Code. (b) Notice of such designation of disabled parking spaces shall be given by the posting of permanent, nonportable signs. Such signs shall be designed in accordance with the requirements of the manual of the Commissioner of Public Safety on uniform traffic control devices and in accordance with Minnesota Statutes Chapter 169. (c) No person shall cause to be erected signs reserving or designating parking spaces for physically disabled persons unless the location, number, and method of signing of such spaces is first approved by the Director of Community Development or designee.

Division D. Winter Parking Restrictions

SEC. 8.45. AUTOMATIC PARKING BAN AFTER SNOWFALL. No person shall park any motor vehicle on any public right-of-way in the City or permit any motor vehicle to remain on any public right-of-way in the City for a period of forty-eight (48) hours commencing immediately after the National Weather Service has announced that three (3) inches or more of snow has continuously fallen, or until snow removal comprising the full width of the public street has been completed, whichever occurs first.

SEC. 8.46. DECLARED SNOW EMERGENCY. No person shall park any motor vehicle on any public right-of-way in the City or permit any motor vehicle to remain on any public right-of-way in the City for a period of forty-eight (48) hours commencing immediately after the City has declared a snow emergency and provided public notice of the same on the City of Bloomington website and on the City’s Snow Emergency Hotline, or until snow removal comprising the full width of the public street has been completed, whichever occurs first.

SEC. 8.47. REMOVAL OF ILLEGALLY PARKED VEHICLES. Any motor vehicle parked in violation of this Code is deemed to be a nuisance that interferes with snow removal from public rights-of-way. In accordance with the Bloomington Police Department Manual, Patrol Procedures 306 and 316, any law enforcement officer may follow the Orange Tag Procedure to cause the removal of any such vehicle by means of towing. The removal of illegally parked vehicles shall not preclude prosecutions for violations of any provision of this Division.

Vehicles temporarily parked at the residence for visitation or business service reasons, Class I recreational vehicles (as defined in Section 19.50.03 of this Code), or any vehicle parked or stored within a garage shall not be counted for the purposes of this numerical limitations. All other vehicles, whether screened or not, including “abandoned vehicles”, [and] “junk vehicles”, “inoperable vehicles” as defined in Section [8.45] 8.04 of this Code shall be counted as vehicles for purposes of determining the number of vehicles parked or stored outside of a garage or on the street. Nothing in this Section shall be interpreted as permitting the storage of vehicles if such storage is not otherwise permitted by this Code. Only one vehicle per unit may be a vehicle with a snowplow attached or other Type II vehicle. Type II vehicles will be counted as a vehicle for the purposes of this section.
