Under the new state law that went into effect July 1, smokers are no longer able to indulge their habit in restaurants and bars which receive more than 10 per- cent of their revenue from food. That virtually elimi- nates every establishment on Sanibel and Captiva. But the American Legion, and a few other select places, have been exempted from the law. According to the Sanibel and Captiva Multiple Listing Service closed sales statistics for 2002, there was very little change in sales throughout the year. Real estate sales for the seasonal months of January through June totaled 100 condo units, 137 homes and 37 vacant lots. The sales during the - off-season months of July 2002 through January 2003 Humphrey totaled 100 condo units, 142 homes and 28 vacant lots. "It's a myth that real estate only sells during sea- son," said Robin Humphrey, a broker associate for VIP Realty. Due to the high volume rental activity during sei son, Humphrey said, some realtors might say th they do make more sales during season.
