REPORT TO THE , LORN AND THE ISLES AREA COMMITTEE 02/00120/DET : JOHN F AND CATHERINE M PATERSON ALTERATIONS AND EXTENSION TO DWELLINGHOUSE AND OUTBUILDING AND ERECTION OF A NEW DOUBLE GARAGE AT THE FORMER MANSE OF GLENORCHY AND INNISHAIL, DALMALLY FROM THE DIRECTOR OF DEVELOPMENT AND ENVIRONMENT SERVICES

(A ) INTRODUCTION

This application was submitted to the Council on 23rd January 2002 and approved by the Council, under delegated procedures, on the 25th July 2002, subject to condition. On the 19th July 2002 the applicants appealed to the Scottish Ministers against the Council’s non-determination of this application within the statutory time period.

Although the Council issued the consent soon after the appeal was lodged the appellants indicated they wished to pursue the appeal as they were unhappy with one of the conditions attached to the consent notice.

This appeal has now been determined, and the decision is below for Members to note.

(B ) DECISION OF THE INQUIRY REPORTERS UNIT

The Reporter concluded as follows:

Allow the appeal and grant planning permission for the proposed works to the former manse, for the erection of a garage block, for the renovation of the outbuilding to form a shed, conservatory and greenhouse, for the siting of a private burial ground and for the temporary location of a mobile home at the former manse, Glenorchy and Innishail Parish Church, Dalmally. This planning permission is subject to the plans and other details submitted with the application dated 23 January 2002, Council reference number 02/00120/DET, and the conditions attached as Appendix 2.

Appendix 2

1. The development hereby permitted shall be commenced within 5 years of the date of this letter.

Reason : to accord with section 58 of the Town and Country Planning () Act 1997.

2. Notwithstanding the details of the proposed garage doors shown on the plans, the installation of the roller shutter doors proposed is not approved. Prior to work commencing on the garage block, details of vertically boarded timber doors or an acceptable alternative shall be submitted for the written approval of the Council. Thereafter, the approved doors shall be implemented during the course of works to construct the garage block.

Reason : to ensure that the materials of the garage block, which is located so that it is part of the setting of the listed building, are appropriate to the archaeological character of the listed building.

3. Unless the results of an archaeological field evaluation prove to the satisfaction of the Council, in consultation with the West of Scotland Archaeology Service and Historic Scotland, that no remains of archaeological importance lie within the site, the developer shall secure the implementation of an archaeological watching brief during ground disturbance work, to be carried out by an archaeological organisation acceptable to the council. The retained archaeological organisation shall be afforded access at all reasonable times and allowed to record and recover items of

interest and finds. Terms of Reference for the watching brief will be supplied by the council, in consultation with the West of Scotland Archaeology Service. The name of the archaeological organisation shall be given to the planning authority and to the West if Scotland Archaeology Service not less than 14 days before ground disturbance work commences.

Reason : to ensure that any items of archaeological interest in this archaeologically rich area that might be damaged or disturbed by the development are suitably recorded and recovered as necessary for the benefit of the nation.

4. The mobile home permitted to be located adjacent to the site of the proposed outbuilding shall be removed from the site once the former manse is capable of being occupied.

Reason : to ensure that the mobile home remains on site for the minimum required period in the interests of visual amenity and the preservation of the setting of the listed building.
