BACKGROUND INFORMATION

As part of the application, the applicant must submit the names and addresses of property owners of all property adjacent (including across the street/alley) to the subject property on gummed labels. Applicant must also submit the following information: 1) notarized signature, 2) a site plan prepared by a map maker (see Planning Department for map maker's list), 3) one 4 by 6-inch picture of the property from each side of the site, and 4) a copy of all previous building permits for the site (Room 101, 201 North Figueroa Street). When you meet with ABC to get the crime and license concentration information for your site, you must bring back the ABC information (on the ABC form) to the City Clerk.

This is a full service market consisting of approximately 25,000 square feet. The items made available to the public includes produce, meets, dairy, canned foods, sundry items, a host of varying ethnic products, etc.

Approximately 250 square feet of display area and 100 square feet of storage within a designated area not open to the public.

7. Hours of Operation:

a. What are the proposed hours of operation and which days of the week will the establishment be open?

This market currently maintains the hours of operation in which it is open to the public, between 9:00 am through 7:00 pm daily. This is a seven day-a-week schedule The granting of this conditional use will not alter the hours or days of operation.

Yes, there are 175 on-site parking spaces. The January 17, 1952 Certificate of Occupancy is silent as to the number of required and/or provided parking spaces; however, the site plan indicates there are 158 required parking spaces with 175 provided. There has been no permits issued since the 1952 C of 0 which would cause an adjustment to the required parking.

No. This Applicant does not have an ABC licence within County.

10. Will video game machines or pool or billiard table be available for use on the subject property and if so, how many?

Yes. This establishment currently enjoys a total of four game machines. There is no intent to alter this number of video game machines.

11. Will you have signs visible on the outside which advertise the availability of alcohol?

No. The primary function of ths market is the sale of meat, fish, produce, dairy, packaged foods, can goods etc. The inclusion of alcoholic beverages is secondary to the main thrust and alcohol related signage is not requested.

12. How many employees will you have on the site at any given time?

There are 60 employees during the hours that this market is open.

13. Will all employees who sell alcohol attend the local State ABC training class on how to properly sell alcohol?

Yes.

a. Posting of rules and regulations on the premises to prevent such problems as gambling, loitering, theft, vandalism and truancy.

ABC rules and regulations will be posted within the market. In addition, a copy of the Zoning Administrators grant will be maintained on the premises and available for review with the asking.

b. Will security guards be provided and if so, when and how many?

Yes. There is a full time guard stationed within the south parking lot and will ensure there will be no consumption of alcoholic beverages on-site.

15. Will there be minimum age requirements for patrons? If so, how will this be enforced?

No. This is a full service market that caters to families. As such, customers often bring their children with them to shop for groceries. The Applicant will not preclude any person from entering this market, but will maintain compliance with the legal age requirement when selling alcoholic beverages.

16. Are there any other alcoholic beverage outlets within a 600-foot radius of the site? Provide names and addresses of such business and type of business.

No. The adjacent alley is shared with the neighboring apartment complex. The rear parking lot portion of the sites enclosed with a solid wall; however, the front parking area is not a secured area. The building is well secured during closing hours.

19. Will the exterior of the site be illuminated with security lighting bright enough to see patrons from the street?

B. THE FOLLOWING QUESTIONS ARE TO BE ANSWERED WHERE ONLY THE OFF-SITE SALE OF ALCOHOLIC BEVERAGES IS SOUGHT:

1. Will the gross sale of alcohol exceed the gross sale of food items on a quarterly basis?

No. The sale of alcoholic beverage is expected to be a small portion of gross revenue derived from the total sales. Again, it is the purpose and desire of the Applicant to obtain a competitive equality with the four existing off-site outlets within this census tract and best serve the needs and desires of the customers.

2. Will cups, glasses or other similar containers be sold which might be used for the consumption of liquor on the premises?

Yes. As a part of the product line, the Applicant sells glassware, picnic and paper supplies, which includes cups and glasses. However, these are sole in packages as provided by the manufacturers. Packaging will not be broken and individual units are not for saie andior they are not available at this market.

3. Will beer and wine coolers be sold in single cans. or will wine be sold in containers less than 1 liter (750 ml)?

Beer or wine coolers will not be sold in single cans, but only as packaged by the respective manufactures. Wine will be sold in containers as provided by the respective bottlers. All alcoholic beverages will only displayed within a non-refrigerated area near the check-out kiosks and will be sold only at room temperature.

-5- 4. Will "fortified" wine (greater that 16o/o alcohol) be sold?

No. Only ceremonial, ethnic and standard wines will be offered.

C. THE FOLLOWING QUESTIONS ARE TO BE ANSWERED WHERE ONLY THE ON-SITE SALE OF ALCOHOLIC BEVERAGES IS SOUGHT:

1. What is the occupancy load as determined by the Fire Department (number of patrons)?

2. What is the proposed seating in all areas?

3. Is there to be entertainment such as a piano bar, juke box, dancing, live entertainment, movies, etc.? (Specify.)

4. If a cocktail lounge is maintained incidental to a restaurant, the required floor plans must show details of the cocktail lounge and the separation between the dining and lounge facilities.

5. Food Service

a. Will alcohol be sold without a food order?

b. Will there be a kitchen on the site as defined in the Los Angeles Municipal Code?

6. Will discount alcoholic drinks or a "Happy Hour" be offered at any time?

Provide a copy of the proposed menu if food is to be served.

D. PUBLIC CONVENIENCE AND NECESSITY EVALUATION

The City of Los Angeles is very concerned if a new request to sell alcohol is subject to one of the conditions below. There is a strong likelihood that the City will deny your "public convenience or necessity" application if one of the above listed conditions apply to your site. It is strongly suggested that you contact your Council Office and discuss your project. If the Council Office does not oppose your project, you should then check with your local area police vice unit as well as the Planning Department Public Counter at (213) 482-7077 for the determination of whether the determination of the proposed site is within a Specific Plan area, and the Community Redevelopment Agency (CRA) project staff at (213) 977-1682 or 977-1665, to determine if your site is in a CRA Project Area. If any of the five conditions listed below apply to your site, you should carefully consider whether you want to file for a Public Convenience or Necessity finding.

1. The proposed site is in an area with a long-term level of undue concentration of alcoholic beverage outlets.

No. The Alcoholic Beverage Control [ABC] has arbitrarily determined that Census Tract No. 1323.00 should have 5 on-sale and 4 off-sale licences. This is based on the volume of residents and does not consider visitors and the working population. In this case, there is a large adjacent industrial park as well as a nearby industrial community with an unknown number of workers; an athletic club/fitness center within 600 feet enjoying

-6- a huge membership and also a host of varying commercial uses adjacent and nearby. Accordingly, the daily population is far greater than indicated by the ABC and the number of allowed licences is not reflected by the area's daily population. As is determined by the ABC, four-off-sale licenses are permitted and issued. With factoring in the uncounted population, the four allowed licenced permitted within this geographical area constitutes an under-concentration of the type [21] ABC licences as is herein requested. The subject site has a large customer base and is in need of obtaining this type licence in order to avert the continuing monopoly by others and ensure there is no longer a compromise of the Applicant's ability to enjoy a competitive equality. The addition of this additional off-sale licence to this Census Tract, will not in fact cause an over concentration of licences when factoring in the total daily population. Furthermore, as previously stated, there are neighboring Census Tracts that have an under­ concentration of licences because these census tracks lack the zoning and/or land use to include markets and stores selling alcoholic beverages for off-site consumption.

2. The geographic area is the target of special law enforcement activity, i.e. police task force is working on reducing vice in the area, or eliminating juvenile crime (such as cruising or graffiti) or gang activity.

Over the years, the Applicant has consistently contributed money and food items to worthy causes, which include charities, schools, civic functions and anti-gang activities. Please see a sampling of thank you letters from benefitting recipients.

3. The proposed site is in close proximity to sensitive uses, including schools, parks, churches, youth activities, homeless shelters, mental health or alcohol or drug treatment centers.

No. There is a church approximately 600 feet south of the subject site. However, the City has granted permission for an identical type market to sell a full line of alcohol to another market directly across the street from this church and also the subject site. In addition, there is a liquor store enjoying a full line of alcohol and only provides minimal food products. This liquior store is only 400 feet from the church. Both of these establishments maintain hours of operation much longer than Valley Produce. There are no schools, parks, youth activities, homeless shelters, mental health, alcohol or drug treatment centers or any other sensitive uses in this immediate vicinity.

4. The geographic area has elevated levels of alcohol-related crimes, including but not limited to: public intoxication, driving under the influence, assault, vandalism, prostitution, drug violations, loitering.

This community is similar to many other neighborhoods, in that it is within a higher than average crime area. However, this is a full service market and will not sell alcoholic beverages for consumption on the premises and no beverages will have been refrigerated at the time of sale. Additionally, beer ans wine chillers will only be sold in the packaging originating from the company. Packaging will not be broken and therefore single cans or bottles will not be available at this location. Inasmuch as all alcoholic beverages sold will be at room temperature, the likelihood of alcohol related crimes, including but not limited to: public intoxication, driving under the influence, assault, vandalism, prostitution, drug violations, loitering is remote, as the customer would want to chill the beverage prior to consumption.

5. The proposed site is located in a Specific Plan or Community Redevelopment Agency Project area which specifically includes a policy to control future alcoholic beverage sales.

The Reseda-West Van Nuys Community Plan is an element of the General Plan of the City of Los Angeles. This Community Plan designated the subject property as "Community Commercial", with corresponding zones of CR, C2, C4, RAS3, RAS4, P and PB. The Applicant has no interest in changing the zone or the approved occupancy of this site. Inasmuch as the subject property is currently fully developed with commercial uses, is zoned [Q] C2-1 L-CDO and [Q] P-1 L-CDO, and will continue unchanged; the property in question will remain consistent and harmonious with the General Plan of the City and more specifically the Reseda-West Van Nuys Community Plan. This site is not situated within an adopted specific plan area or Community Redevelopment Agency Project area.

E. If the project site is not subject to one of the above criteria, your project will be evaluated by the City Council with consideration given to the following possible beneftis and detriments to the community:

1. Possible Benefits

Would the business:

a. Employ local residents (how many) The Applicant employs a high percentage from within the community. This market is located within a highly populated area and it is a a source of a quality employment base.

b. Generate taxes (provide estimate) It is anticipated the annual gross sales of alcohol will reach $150,000. This will generate additional tax revenue to the City, State and Federal jurisdictions.

c. Provide unique goods and services (which ones) This market serves a variety of ethnic groups which include Hispanic, Asian, Jewish, Muslin and Anglo. The inventory of foods provided includes a wide range of ethnic foods and products that are necessary to preserving these cultures. There is no other market in this region that is so community conscious.

d. Result in an aesthetic upgrade to the neighborhood (in what exact way) There will be no exterior modifications to this property. There will be minor alteration to the interior to accommodate the proposed display area.

e. Contribute to the long term economic development (how) Valley Produce has been a long standing establishment within this community and provides desired items that are not available elsewhere in this neighborhood. As such, Valley Produce is a magnet that attracts customers from a large area. This is and has been an economic phenomenon that is long standing.

f. Provide a beneficial cultural/entertainment outlet (specify) This Market provide a host of food items and products that serve their multi­ ethnic customers. This is culturally beneficial, inasmuch as there are no other establishment in this region, providing the variety of ethnic items. The alcoholic beverages to be offered will in part also continue this policy.

2. Possible Detrimental Impacts

Is the immediate area in which the license is sought subject to: (Check with your local Police Department area "Senior Lead Officer")

a. Excessive calls to the Police Department

This type of market caters to families and does no attract an element that taxes the local police authorities. There has been no police assistance required and with the type of customers that frequent Valley Produce, the likelihood of police intervention is remote when alcohol is introduced.

b. Police resources being already strained

The local police station is slightly over one-half mile west of the subject site. The inclusion of alcoholic beverages into the product line of Valley Produce, will not place added strain onto the existing police force.

c. High rates of alcoholism, homeless ness, etc.

The community of Reseda has a large population, some of which are alcohol dependent. However, Valley Produce caters to families and has not attracted homeless people more so than other markets and does not anticipate inclusion of alcoholic beverages into the product line of Valley Produce, will alter this fact. With on-site employees during business hours and security gates encompassing all openings to the building during the hours of closing, the people with this unfortunate element of our population.

d. Large "youth" (under 21) population

Valley Produce is located within a populated area with large apartment complexes ans many single family homes. These types of residential developments are designed to include families, many of which have children under 21 years of age. With the variety of products and the fair pricing, is the primary reason that Valley Produce has such a large following. The inclusion of alcoholic beverages into the product line of Valley Produce, will not increase its customer base, but will provide another item that will provide a convenience to the community.

3. With regard to the operation of the proposed business. explain:

a. The method of business operation: (large volume of alcohol to food sales,

-9- "late" hours (after midnight), high o/o unskilled (no ABC training class) staff, high % of underage (under 21) staff, etc.)

This is a family oriented market that has existed for a number of years and has served the region without causing problems. The primary thrust of Valley Produce is to provide a variety of quality food items and ethnic products that serve the residential, business and visiting population that are common to this immediate area. The inclusion of alcoholic beverages into the product line of Valley Produce, is a convenience to the large variety of the different ethnic groups that depend on this market. As such the volume of alcohol sold will be a small percentage of the overall sales. With limited hours of operation, the inclusion of alcoholic beverages into the product line of Valley Produce, will not attract an undesirable element to this property. Valley Produce will comply with all conditions imposed within the conditional use grant, the laws of the City and State and good business practices. Valley Produce does not want to argue with success and create community problems that will compromise all that has been accomplished.

b. Would the business duplicate a nearby business already in existence?

On the contrary, there is no other market in the region that provides the assortment of food items that serves such a variety of ethnic groups. This is even the case with the market across the street that is a part of one of the largest food chains in the City.

c. Other non-alcohol sales business options available so alcohol does not have to be sold, e.g., more specialty products, broader range of items like fresh meats or fruits and vegetables, etc.

Again, Valley Produce is a full service market that has historically offered all the food needs desired by its large customer base. The product line includes both ethnic and non-ethnic items which includes but is not limited to produce, fruits, meat, dairy, cheeses, canned goods, deserts, non-alcoholic beverages. The items offered are directed to many different ethnic groups and are not otherwise locally available.

The City Council will evaluate these factors and make a decision on the overall merits of your request. Therefore, you should answer below as to why you believe any of these above listed beneficial or detrimental conditions apply to your project and provide any documented proof to support your belief.**

Valley Produce has been a long standing part ofthe San Fernando Valley and has continuously provide a wide variety of food items and products to its many regular customers without creating any difficulties. This is the only establishment that brings the many different ethnic groups together under one roof, that are often at odds, and harmony prevails. This is not the type of business that causes people to hang around and look for ways to cause trouble. All customers, with and without children present, are at Valley Produce to obtain their groceries and return home to prepare a meal for their family and/or lunches for their taking to work or school.

The event was held on December 4, 2004, at Hjelte Park and was a tremendous success. It is only through the development of community partnerships that we can all come together to enjoy a community free of crime and the fear of crime.

Hello! My name is Michelle Chevalier, I am writing on behalf of the Sylmar Girl's Basketball Team. I have just completed my third season of coaching at Sylmar and I am very proud of our 22-8 finish. Your Lady Spartans won their second straight Valley Mission League Championship and advanced to the L.A. City-Section Finals. Sylmar also qualified for the schools first ever state play-off birth and lost to Lynwood, the #2 ranked team in the country. It was another wonderful season for the Lady Spartans!

My vision for Sylmar is not merely counting victories; it is simply providing young ladies with the opportunity to obtain valuable life skills by doing what they love .. playing basketball. As an experienced Division I scholarship athlete, I acquired have and developed many strong qualities that have attributed to my success not only in basketball but in my life as well. In my program, student-athletes learn the importance of academic success, time management, commitment, work ethic and teamwork to name a few! These attributes will be the building blocks used to mold and shape them as they become productive members of society.

Through my athletic experience, I have also grown to know the importance of community involvement and support. There is something special about playing for pride and representing your community! We are reaching out to you in hopes that you would like to be a part of this exciting program. We are seeking sponsors to assist in our effort to purchase the necessary equipment to improve our skills. Financial assistance will also allow our teams to travel and play in highly competitive tournaments were they gain exposure to college coaches, thus improving their chances of playing at the next level! We have four major tournament trips scheduled from now through December they include; Tempe Arizona, Salt Lake City Utah, San Antonio Texas and Ptloenix Arizona.

Donations in any amount are greatly appreciated; we would even appreciate products that could be used for raffles, silent auctions or stocking the snack bar. The possibilities are endless; there are many vvays to support our growing program. We will gladly hang you advertising banner in our gymnasium to promote your business for one full year with any donation of $500.00 or more. Several clubs and organizations utilize our facility during the course of the year other than Sylmar.
