NOTICE OF INVITATION FOR OBJECTION UNDER SECTION 34G This notice serves to notify the general public and customary landowners within the Ahi Rural Local Level Government (LLG) that Luhu Incorporated Land Group (ILG) is intending to conduct a survey to register their Land known as Abongtu within Lae District, Morobe Province.

The Department now invites any person who may have an interest in the designated land area to access the sketch survey plan from the Office of the Surveyor General, Regional Surveyor's Office and Office of the Director Customary Land Registration.

APPROVAL AND ESTABLISHMENT OF A TRUST ACCOUNT

I, HON. RAINBO PAITA, MP, Minister for Finance, pursuant to Section 15 of the Public Finance (Management) Act 1995:

Approval & Establishment 1. Approve the establishment of a Trust Account to be known by the name stated in Point 1 of the attached Trust Account Schedule and hereby establish the Trust Account by the execution of this Trust Instrument, which has been approved by the State Solicitor, that specifies the operational terms and conditions of the Trust Account 2. This Trust account shall be controlled by the controlling public or statutory body of the Trust Account stated in Point 2 of the attached Trust Account Schedule. Trust Account Purpose 3. The purpose of the Trust Account shall be to receive, hold and expend moneys on trust in order to meet the purposes stated in Point 3 of the attached Trust Account Schedule. Payments into Trust Account 4. Subject to the following sub-Clauses, pursuant to Section 16 of the Public Finance (Management) Act 1995 (as amended), the only moneys that shall be paid to the credit of the Trust Account are: (a) public moneys appropriated for the purpose of this Trust Account; and (b) moneys received from any dealing with any articles purchased or produced, or for work paid for, with moneys standing to the credit of this Trust Account; and (c) moneys paid by any person for the purposes of this Trust Account; and (d) public moneys appropriated as a Government contribution to the project which is partly funded by an international agency, whether by way of loan or grant.

Approval and Establishment of a Trust Account— continued 4.1 Transfers of funds into the Trust Account contrary to Clause 4 immediately revokes this Trust Account and all funds standing to the credit of the Trust Account shall be immediately transferred to the Consolidated Revenue Fund by the Finance Secretary. 4., Transfers of funds from the Consolidated Revenue Fund to this Trust Account are prohibited unless a special transfer is authorized by the Appropriation Act. 5. Public money, within the meaning of the Public Finance (Management) Act 1995 (as amended), other than moneys referred to in Clause 4(a)-(d), shall not be paid into this Trust Account. Specifically, all: (a) taxes, fees, levies, royalties or other charges; (b) receipts from the sale of bonds, debentures, shares, securities, term-deposits or any other investments; (c) proceeds from the sale or lease of any real or personal property; (d) grants, loans, donations or gifts other than moneys paid by any person for the express purposes of this Trust Account; or shall be paid only to a bank account to the credit of the Consolidated Revenue Fund and to no other bank account. 5.1 Payment of public money or transfer of funds into the Trust Account, other than moneys referred to in Clause 4(a)-(d), contrary to Clause 5 immediately revokes this Trust Account and all funds standing to the credit of the Trust Account shall be immediately transferred to the Consolidated Revenue Fund by the Finance Secretary.

Payments out of Trust Account 6. Money shall be paid out this Trust Account only for the purposes of this Trust Account or as authorized by law. Salaries and wages shall not be paid out of this Trust Account unless they are specifically authorized by a project document annexed to this Trust Instrument and with the express written authorization and approval of the Finance Secretary. 6.1 Payment of funds out of the Trust Account contrary to Clause 6 immediately revokes this Trust Account and all funds standing to the credit of the Trust Account shall be immediately transferred to the Consolidated Revenue Fund by the Finance Secretary.

Bank Accounts 7. A bank account shall be opened with any approved bank, within the meaning of the Public Finance (Management) Act 1995, to be named or entitled with the name stated in Point 1 of the attached Trust Account Schedule. 8. With the written approval of the Finance Secretary, subsidiary bank accounts for use in the provinces of Papua New Guinea may be opened with any approved bank, within the meaning of the Public Finance (Management) Act 1995, to be named or entitled with the name stated in Point 1 of the attached Trust Account Schedule and the words — Subsidary Bank Account and the name of the Province (if applicable). 9. With the written approval of the Finance Secretary, if an international agreement requires, a bank account may be opened to separately hold donor funds with any approved bank, within the meaning of the Public Finance (Management) Act 1995, to be named or entitled with the name stated in Point I of the attached Trust Account Schedule and the words — Donor Funds Account. 10. Subject to the expiry provisions, two (2) signatories are required on all cheques and transfers from a bank account of a Trust Account, one is a mandatory signatory and the other is a countersigning signatory as stated in Point 4 of the attached Trust Account Schedule.

Records, Reports etc 11. The Departmental Head of the controlling public or statutory body of this Trust Account shall—

(a) maintain all records relating to the operations of this Trust Account, as required by the Public Finances (Management) Act 1995, using the financial management, accounting and information systems as may be directed by the Finance Secretary by a Finance Instruction or otherwise; (b) deliver, as required by the Public Finances (Management) Act 1995, to the Secretary of Finance:

(0 within seven (7) days from the end of each month bank statements and reconciliations for this Trust Account along with a statement of transactions against this Trust Account.

(ii) annual estimates of receipts and expenditure for this Trust Account, as and when directed by the Finance Secretary by a Finance Instruction or otherwise; and

(iii) within seven (7) days from the end of the fiscal year, provide a statement of the account for the preceding year. 11.1 Failure to comply with Clause 11 immediately revokes this Trust Account and all funds standing to the credit of the Trust Account shall be immediately transferred to the Consolidated Revenue Fund by the Finance Secretary.

Expiration

12. This Trust Account expires; Refer to the Item 5 of the Trust Account Schedule

(a) on the date stated in Point 5 of the attached Trust Account Schedule and shall be no more than 3 years from the date of the execution of this Trust Instrument; or

(5) in the case of a Trust Account established for the purpose of holding donor funds, the Trust Account expires in accordance with the terms of the loan or grant agreement between the donor and the Independent State of Papua New Guinea.

13. On reaching the expiration date, unless extended prior to the expiration by another Trust Instrument, the balance standing to the credit of the bank account of the Trust Account shall be paid: (a) to the Consolidated Revenue Fund, after all liabilities relating to the Trust Account have been settled; or

(5) in the case of a Trust Account established for the purpose of holding donor funds, the Trust Account expires in accordance with the terms of the loan or grant agreement between the donor and the Independent State of Papua New Guinea. No. G25-20th January, 2020 4 National Gazette

NOTICE OF INTENTION TO DECLARE GOODS UNSAFE (FOOD PRODUCT LABELLING REQUIREMENTS) I, PAULUS AIN, Commissioner & Chief Executive Officer, by virture of the powers conferred by Section 114(1) of the Independent Consumer and Competition Commission Act 2002 hereby propose to publish in the National Gazette a notice under Section 108(5) of the Independent Consumer and Competition Commission Act 2002 in substantially the same form and substance as indicated in the draft below, declaring the goods described in the Notice to be unsafe in Papua New Guinea.

SECTION 108(5) DECLARATION (FOOD PRODUCT LABELLE':rG REQUIREYFFNTS) I, PAULUS AIN, Commissioner & Chief Executive Officer, by virture of the powers conferred by Section 108(5) of the Independent Consumer and Competition Commission Act 2002 and all other enabling powers, hereby declares as unsafe in Papua New Guinea, the following goods (and similar products) that fail to comply with these labellino- requirements under the Food Sanitation Regulation 2007, Food Sanitation Act 1991 and the Packaging Act 1974:

1. Any word, statement, information or direction that is required to appear as a label on a package or apparatus shall— (a) in the case of infant formula requiring reconstitution, be in English; (1) any imported food specifically packaged for export to Papua New Guinea, be in English; (c) in the case of imported food and food additives other than those prescribed in Paragraph (a) and (b), be in English.; and in the case of food and food additives produced, prepared, manufactured, processed or packed in Papua New Guinea, be in English;

A packer who packs an article shall ensure the pack containing the article is marked in the prescribed manner with a statement in English of the true weight or measure of the article. 3. Any package or apparatus containing food or food additives for sale shall bear on or attached to it a label containing a statement in English that identifies the country in which the food or food addictive was made or produced; and

4. Any package or apparatus containing food or food additives for sale shall bear on or attached to it a label containing a description in English of the same and address of the vendor, manufacturer, packer or importer that includes the name, road or street, road or street number, locality and country, and business hours telephone contact number. All labelling requirements mentioned above must be present on the label of any package or apparatus containing food products. Partial non-compliance of this Notice is deemed as non-compliance.

Nothing in this Notice shall limit the product labelling and other requirements under Section 12(1)(a) to (i) and Section 12(3) to (11) of the Food Sanitation Regulation 2007, the Food Sanitation Act 1991 and the Packaging Act 1974, and the obligations of the supplier of goods to comply with them.

Exemptions:

(a) Provided labelling complies with the above, labelling in other languages may also appear on packaging or apparatus.

(b) Food that is prepared or offered for immediate consumption in catering establishments, restaurants, canteens, schools, hospitals and other institutions where the product is accompanied by sufficient information in English in relation to that product to enable the purchaser to determine the content of that particular product before purchasing it.

(c) Provided labelling complies with the above, labelling in the form of a sticker placed on the product to reflect any one or more of the labelling requirements not stated on the product packaging or apparatus is adequate for the duration of this Notice.

Summary of Reasons:

Products that are incorrectly labelled may pose a risk to the safety of consumers. Consumers may not recognize ingredients that may cause an allergic reaction or may misinterpret warnings or instructions that accompany the products. Also they may not understand directions for food preparations or storage that appear on the packaging or apparatus.

Subject to the above, any person or persons supplying food products that do not comply with the above labelling requirements may be in breach of this Notice and Section 108(1) of the Independent Consumer and Competition Commission Act 2002, and may be liable to a penalty of up to K100, 000.00 or imprisonment of up to 2 3 ears, if found guilty by the court. Further, pursuant to Section 111(1) of the Independent Consumer and Competition Commission Act 2002, action maybe taken by the Independent Consumer and Competition Commission to recall these products. The Independent Consumer and Competition Commission therefore advises that these products should not be supplied in Papua New Guinea.

SECTION 108(5) DECLARATION (CERTAIN UNSAFE BABY WALKERS)

I, PAULUS AIN, Commissioner & Chief Executive Officer, by virtue of the powers conferred by Section 108(5) of the Independent Consumer and Competition Commission Act 2002 and all the enabling powers, hereby declares as unsafe in Papua New Guinea baby walkers of the type described in this Notice. A baby walker for the purpose of this Notice is an infant and nursery product which consists of a frame on wheels designed to support a child whilst the child's feet are touching the ground for infants and babies who are learning to walk. The product is propelled by the movement of the child on the wheels or castors.

Such baby walkers cannot be supplied in PNG unless the baby walker:

1. is stable; 2. has an adequate braking mechanism (and in assessing 1 and 2 we will have regard to the product standard specification ASTM F977 - 12); 3. carries the following warning labels:

3.1 The warning must be visible to the consumer when placing the child in the walker. 3.2 The safety alert symbol and the word 'WARNING' must be: in black lettering; on an orange background; and surrounded by a black border The rest of the words must be black lettering on a white background.

3.3 Parking Brakes

If the walker has a parking brake, it must also be labelled with this warning:

• WARNING: Parking brake use does not totally prevent walker movement.

Always keep child in view when in the walker, even when using the parking brakes (only for baby walkers equipped with a parking brake).

3.4 The word 'WARNING' must be: • in black lettering; • on an orange background; and • surrounded by a black border

4. Carries additional safety alert warnings that address the following:

• use only on flat surface free of objects that could cause the walker to tip over; and • to avoid burns, keep the child away from hot liquids, ranges, radiators, space heaters, fireplaces, etc.

Note: The safety alert symbol is not required for the additional warnings and the wording does not have to be exactly as it appears above. However, the wording in the additional warnings must be:

In constrasting colours; Permanent; Conspicuous; and In sans serif style font.

Summary of Reasons

Such baby walkers create instances of injury or death where:

the baby walker falls down stairs or off an elevated area, resulting in possible head injuries; the baby walker is unstable and tips over also resulting in potential injury; the child in the baby walker gains access to hazardous areas, products or objects which can cause injuries such as burns, electrocution, cuts and other wounds; and • the child can potentially be able to get out of the baby walker resulting in possible falls anywhere, and have the potential to be unsafe.

Subject to the above, any person or persons supplying baby walkers with unsafe features described in this Notice shall be in breach of this Notice and Section 108(1) of the Independent Consumer and Competition Commission Act 2002, and may be liable to a penalty of up to K100,000 or imprisonment of up to 2 years, if found guilty by the court. Further, pursuant to Section 111(1) of the Independent Consumer and Competition Commission Act 2002 action may be taken by the Independent Consumer and Competition Commission to recall these products. The Independent Consumer and Competition Commission therefore advises that these products should not be supplied in Papua New Guinea.

Such a bunk bed cannot be supplied in Papua New Guinea: if it has sharp edges or points; if it has protrusions of more than 8mm capable of catching in clothing; if the materials used in construction or the design_ is not sufficiently strong to support the weight of a person who would normally occupy such a bed; where the minimum access openning (if provided) for the upper bunk is less than 300mm or greater than 400mm in width, unless the opening is between 300mm and 400mm; and where the gaps in the guard rails, for the upper bunk, are greater than 95mm and less that 230= excluding the access opening to the upper bunk. Exemptions. This declaration does not apply to bunk beds that, without breaching the above prohibitions or requirements: 1. have adequate/permanent guard rail protection around all four sides that are not detachable without significant force;

2. have adequate and safe means of accessing the upper bunk; and

D. DESCRIPTION OF LAND: To be used only when NOT in response to an advertisement A brief description giving area and locality is required. A sketch plan should be provided on an attachment Where possible the land parcel should be identified on a map published by the Department of Lands & Physical Planning. In the case of Tenders or an advertisement of land available for leasing the description is to be inserted in the column provided under the heading "Tender or Land Available Preference".

E. TENDER OF LAND AVAILABLE PREFERENCE: The preference should be clearly indicated. In cases where there are more than 20 preferences the additional preferences may be shown on attachment. (4) Every person resident in Papua New Guinea whose total income from all sources, both in and out of Papua New Guinea (other than repatriation, age and invalid pensions and other exempt income as defined in the Act), including income derived by way of salary or wages where that salary or those wages were not subject to salary or wages tax in accordance with the Act and the Income Tax (Salary or wages Tax) (Rates) Act 1979 as amended. (5) Every person resident in Papua New Guinea who derived a captial amount, being an allowance, gratuity, compensation or distribution from a superannuation fund, which is deemed to be salary or wages in whole or in part because that allowances, etc, was paid in consequence of retirement from or the termination of, an office or employment. (6) Every person resident in Papua New Guinea who derived a housing allowance or any other allowance not fully taxed, which was deemed to be salary or wages subject to salary or wages tax in accordance with the Act and the Income Tax (Salary or Wages Tax) (Rates) Act 1979 as amended. (7) (a) Every person resident in Papua New Guinea, whose total income from all sources, both in and out of Papua New Guinea (other than income specifically exempted from tax in the Act) consists of or includes income derived by way of investment, or income so deemed by virtue of the Act, including rent, interest, annuities, dividends, or income by way of royalties or other income from any source which is not otherwise specified in this Gazette, where that income (when taken together with any other income in this Gazette and income derived by way of salary or wages, whether or not subjected to salary or wages tax in accordance with the Income Tax (Salary or Wages Tax) (Rates) Act 1979 as amended, was in excess of K12,500.00.

(b) However, a person resident in Papua New Guinea who derived income other than salary or wages, described in this item as investment income, where that income is gross before allowance or any deductions, rebates or credits, and does not exceed K100.00, is not required to lodge a return of income unless especially requested to do so by the Commissioner General. (8) Every person resident in Papua New Guinea whose total income from all sources both in and out of Papua New Guinea, derived wholly or partly from personal exertion (other than in the capacity of an employee) from a source which is a business in the ordinary acceptation of that term or within the ordinary meaning of that term, including a professional business, where that income (when taken together with any other item of income in this Gazette and income derived by way of salary or wages, if any, whether or not subjected to salary or wages tax in accordance with the Income Tax (Salary or Wages Tax) (Rates) Act 1979 as amended, was in excess of K12,500.00. (9) (a) Every partnership is required to lodge a return showing the income of the partnership by the partner resident in Papua New Guinea or by any one of them. (b) Where there is no partner resident in Papua New Guinea, the return is required to be fiimisled by the agent in Papua New Guinea for the partnership. (12) Every trust estate or trustee of a trust estate, including a Papua New Guinea trust estate or the trusteee thereof, which is or has been resident in Papua New Guinea, whose total income derived from all sources in and out of Papua New Guinea was in excess of K1.00. (13) (a) Every trust estate, or foreign trust estate, or the trustee thereof, which is not a resident of Papua New Guinea whose total income derived from all sources in Papua New Guinea was in excess of K1.00. A return of the total income of every trust is required to be furnished by the trustees thereof resident in Papua New Guinea or by any one of them. (ii) Where there is no trustee resident in Papua New Guinea, the return is required to be furnished by the agent in Papua New Guinea for the trustee. (14) A return is required to be furnished by the master of a ship or the agent or other representative in Papua New Guinea , of the owner of a ship belonging to or chartered by a person whose principal place of business is out of Papua New Guinea, showing the amounts paid or payable in or out of Papua New Guinea during the year ended 31st December, 2019 in respect of the carriage of passengers, livestock, mails or goods shipped in Papua New Guinea in a ship belonging to or chartered by a person whose principal place of business is out of Papua New Guinea as required by Section 191 of the Act. (15) Every agent for a principal, whether resident or non-resident, is required to furnish a return demanded by the principal. (16) Every person or institution holding money lodged at interest in Papua New Guinea is required to furnish, in addition to their return of income, a statement showing the name and address of each depositor, whether a resident or non-resident of Papua New Guinea, to whom interest in excess of K1000 was paid or credited and including the actual amont of interest paid or credited to each such depositor during the year ended 31st December 2019. (17) Every provident, benefit or superannuation fund being a resident in Papua New Guinea whose total income derived from all sources in or out of Papua New Guinea, or where a non-resident fund, whose total income derived from all sources in Papua New Guinea, in each case, exceeds K2.00. (18) Every public authority for the purposes of Section 24(3) of the Act, prescribed by the Regulation as being taxable, whose total income derived from all sources exceeds K2.00. (19) Every provincial authority, local government and local level government body, by whatever name known, whose income from any business or commercial undertaking or activity, other than from the provision of normal council services, exceeds K2. (20) Every religious and charitable body whether or not exempt from income tax, whose income fromr any business or commercial undertaking in or out of Papua New Guinea exceeds K2.00. (21) Every taxpayer with an approved substituted accounting period granted under Section 12A of the Act. (22) Every tax agent duly registered pursuant to Part VIII of the Act. Note: Where a taxpayer has an approved substituted accounting period, the final day of that substituted accounting period should be understood, for the purposes of this Gazette, as applying wherever this Gazette uses the words "31st December, 2019".

The information to be furnished must be on such forms as provided for the purposes as are applicable, containing the information and particulars required in the relevant forms and must be verified by such declarations as set forth therein, and accompanied by all such balance sheets, profit and loss accounts, statements and any other documents as are mentioned in the forms or as are required. General requirements for all corporate taxpayers Every company is required to furnish in addition to the return of income, separate statements to accompany the return showing where every appliable:- (a) the name and address of each company, whether resident or non-resident, to which dividends, royalties, management fees and/or interest was paid or credited, and the amount paid or credited during the period covered by the return. (b) the name and address of each individual taxpayer, whether resident or non-resident, to whom dividends, royalties, management fees, and/or interest in excess of K1000 were paid or credited, and the amount paid or credited to each during the period covered by the return. (c) the total amount of interest paid or credited, during the period covered by the return, to debentures holders who are not residents of Papua New Guinea on money secured by debentures of the company, and used in Papua New Guinea, or used in acquriring assets for use or disposal in Papua New Guinea, and to depositors who are not residents of Papua New Guinea on money lodged at interest in Papua New Guinea with the company. (d) the total amount of interest paid or credited during_ the period covered by the return, in respect of debentures payable to bearer, the names and addresses of the holders of which are not supplied to the Commissioner General. (e) the name and address of each non-resident insurance company or insurer with whom an insurance contract has been entered into and the amount of the insurance premium paid to them during the period covered by the return. (f) fully completed International Dealings Schedule and Losses Schedule. (i) International Dealings Schedule is to be completed by companies who conducted businesses with related or associated companies. The Losses Schedule is to be completed by all taxpayers that have losses brought forward or incurred loss. (iii) The Losses Schedule must also be completed by individual taxpayers and sole traders as the case may be. (g) in the case of insurance companies re-insuring with non residents, the following additional details:- (i) the name and address of the non resident re-insurer, (ii) the amount of the premiums paid or credited to each such insurer during the period covered by the return, and indicate whether an election in terms of Section 209 (2) of the Act is enclosed.

(a) An Ultimate Parent Entity of a NINE Group within the meaning of Part III Division 16A of the Income Tax Act 1959 as amended, that is resident for tax purposes in Papua New Guinea shall file a notification conforming to the requirements of that Division. (b) A Constituent Entity within the meaning of Part HI Division 16A of the Income Tax Act 1959 as amended, which is not the Ultimate Parent entity of the NNE Group shall file a notification conforming to the requirements of that division. E. Due dates for lodgment of tax returns. Categories of persons required to furnish income tax returns Due Date to lodge tax return* 1 Categories 1 to 14 and 18 to 19 on or by 28th February 2019 or such later date as provided under a tax agent lodgement extension program 2 Categories 15, 16, 17 and 20 on or by 30th April 2019 C,1 Category 21 on or by the expiry of two months after the end of the relevant substituted accounting period 4 Category 22 on or by 1st April 2019

F. Penalty for failure to furnish return A person that is required in this Gazette to furnish a return of income and who fails to lodge a tax return within the time reqired, commits an offence within the meaning of Section 313 of the Income Tax Act and is liable to be prosecuted and adjudged a penalty of no less than K500.00 and up to K5000.00 as decided by the Court plus an additional fine of K50.00 for each day that the return is not lodged. G. Place of lodgement of the return. Consistent with Section 24 of the Income Tax Regulation, all returns of income shall be furnished to the Commissioner General of the approrate forms at any Tax Centre, Tax processing Centre or IRC Officer nationwide.
