RULES OF COURT Amending the Juries Rules 1996 Amendment No. 1 to the Juries Rules 1996 BY virtue and in pursuance of section 89 of the Juries Act 1927, and all other powers us thereunto enabling, We, the Chief Justice of the Supreme Court of South Australia and the Chief Judge of the District Court, do hereby make the following rules: 1. These Rules may be cited as the ‘Juries Rules 1996, Amendment No. 1’. 2. The Juries Rules 1996, as amended by these rules, may be cited as the ‘Juries Rules 1996’. 3. In Rule 5 (2) ‘criminal trial’ is to be substituted for ‘criminal inquest’. 4. A new Rule 6A is to be inserted after Rule 6 as follows: ‘6A (1) The cards of the jurors empanelled for a criminal trial are to be kept apart until a verdict has been given or until such jurors have been discharged. (2) A ballot required to be held in accordance with section 6A (2) of the Act must be conducted by drawing at random the number of cards necessary to reduce the number of jurors to 12 from those cards kept apart in accordance with this rule.’ 5. A new Rule 10A is to be inserted after Rule 10 as follows: ‘10A An election for trial by Judge alone made by counsel under section 269W (2) of the Criminal Law Consolidation Act 1935, can be made by filing at the Registry of the Court within the same time limits as apply for a notice under Rule 8 a document to that effect signed by counsel and no certificate under Rules 8 and 10 is required’. 6. Rule 11 is amended by inserting ‘or Rule 10A’ after ‘Rule 8’. 7. Each of Rules 12 and 13 are amended by substituting ‘, 9 and 10A’ for ‘and 9’ in each rule. DATED 12 December 2000. J. SUBORDINATE LEGISLATION ACT 1978 DISTRICT COURT ACT 1991 Report to the Legislative Review Committee, Parliament House, Adelaide I PRESENT the following report pursuant to the Subordinate Legislation Act 1978 concerning the District Court Rules 1992, Amendment No. 31. 1. The Amendment No. 31 is made pursuant to section 51 of the District Court Act 1991. 2. Supreme Court Rules 1987, Amendment No. 81 introduced new Rules 64.03 and 64.04 into the Supreme Court Rules. By virtue of the general adoption of the Supreme Court Rules by Part II of the District Court Rules 1992, the new Supreme Court Rules 64.03 and 64.04 will apply to the District Court unless they are excluded. Their exclusion is necessary because the subject matter of those Supreme Court Rules is already dealt with by DCR 64.01 and DCR 64.02. The amendment merely provides for this exclusion.
