I. GENERAL INFORMATION OF THE PROJECT 1.1. Context and Project Implementation Progress 1. The Socialist Republic of Viet Nam has applied for a loan from the Asian Development Bank (ADB) for the co-financing with Agence Francaise de Developpment (AFD) towards the cost of the Power Transmission Investment Program, Tranche 2. Part of the proceeds of the loan will be applied for the construction of the Pleiku - My Phuoc - Cau Bong 500 kV transmission line. The National Power Transmission Corporation (NPT) is the investor and its executing agency. As that the Central Vietnam Power Project Management Board (CPMB) acted as the management and implementing agency for the project. The Pleiku - MyPhuoc - Cau Bong 500kV transmission line is a high priority project and is one of several projects for construction to meet its target of connecting 90% of the population to electricity by 2020 and 100% by 2025. The TL will meet the energy demand in the southern part of Vietnam growing at 14% per year and up to 25% in 2015. The TL constructed together along with the expansion of Pleiku substation will enhance power supply reliability for the rapid development in the southern . 2. The Pleiku - My Phuoc - Cau Bong 500 kV transmission line has 437 km in length and traverses crossing 5 provinces (Gia Lai, Dak Lak, Dak Nong, Binh Phuoc and Binh Duong) and . The line did not cross or intrude into any buffer areas or any possible planned future extension of conservation areas (Figure 1).

3. During the project preparation phase, the policy of construction safety for the project has been implemented by PECC4. The Resettlement Action Plan of (RAP) has been developed and submitted in March 3/2011. The Consultatants on Technical Assistance of Tranche 1 has considered and required an additional investigation and assessment to ensure the RAP document in compliance with the requirements of Policy of Asian Development Bank. In Oct. 2011, PECC4 has submitted 2nd Draft of RAP which was updated from the results of a survey with the replacement cost, socio-economic surveys and community consultations. Up to Sep. 2011, technical assistance for Tranch 2 (TA7742-VIE) was mobilized to support the NPT and the PPMB in preparing the project for Tranche 2. The social safeguard and the social consultant conducted a social assessment with a field work in Nov. 2011 to review of CPMB activities in the preparation of documents for social safeguard of Pleiku-My Phuoc - Cau Bong project. After a field work, the team had a meeting with ADB's social safety specialist and established 06 social safety documents for 06 project provinces. Because the project affecting ethnic minority communities in 4 provinces of Gia Lai, Dak Lak, Dak Nong and Binh Phuoc, therefore there are 04 Resettlement and Ethnic Minority Development Plan (REMDP) were developed. In Binh Duong and Ho Chi Minh City, the land acquisition affects only the Kinh, so safe construction document prepared for the Binh Duong province and HCM city are two action plans of the Land Acquisition and Resettlement (LARAP) they are both based on the social safety document (RP) was developed by PECC4 from Oct.2010.

4. The Project acquired permanently land area: 371,167.1 m2. This area is now permanently acquired for the construction of 926 towers, stations, roads etc. Actually, the land affected within the RoW is 11,011,339 m2. Actual temporary borrowing land area for the construction of road and material yard is 90,472 m2 (see table 3). The affected land types are agricultural land for cultivating rice and cassava and forest land and housing land. - Gia Lai 5. The total land area was permanently acquired for the construction of the project in the province is 79,108 m2. This area was permanently acquired for the construction of 173 towers and the operational road. The borrowing land area for road construction, the material yard is 13,376 m2. The total land area was affected that need to change the land purpose in a corridor in Gia Lai province is 2,528,415 m2. - Dak Lak 6. The perpament land acquisition area in the project for the construction is 28,612 m2 to locate 163 towers. The temporary borrowing land area for road construction and materials yard is 6,288 m2. Total land area affected that needed to change land purpose in a corridor in Dak Lak province is 831,838 m2. - Dak Nong 7. The permanent land acquisition area of the project is 88,033 m2, this area was permanently acquired for the construction to locate 237 towers. The temporary borrowing land area for road construction, material yard is 14,476 m2. Total land area was affected to change the land purpose in a corridor in Dak Nong Province is 2,963,193 m2.

- Binh Phuoc 8. The permanent land acquisition area of the project with a total area of 77,757.62 m2 for the construction. The temporary borrowing land area for road construction, material yard is 14,360 m2. Total land area was affected to change the land purpose in a corridor in Binh Phuoc province is 2,872,805 m2. - Binh Duong 9. The permanent land acquisition area of the project is 27,700 m2 for the construction of location of 99 towers. The temporary borrowing land area for road construction, material yard is 15,948 m2. Total land area was affected to change the land purpose in a corridor in Binh Duong province is 1,344,687 m2. - Ho Chi Minh 10. The permanent land acquisition area of the project is 19,649 m2 for the construction 54 towers. The borrowing land area for the road construction and material yard is 26,024 m2. Total land area was affected to change the land purpose in a corridor in the HCM city is 470,400 m2. b. Affected trees 11. The total numbers of affected trees were 471,825 trees in falling, including 94.5% of industrial plants and the like such as rubber, cashew, the fruit trees accounted for 2.9% and the remaining are other fallen plants sharing 2.6%. The affected trees are split in groups of industrial plants (including cashew, coffee and rubber). The remaining trees are all kinds of fruit trees and forest trees, timber trees, shade trees.

The number of industrial trees were greatly influenced in Gia Lai province with 171,142 falling trees; the coffee trees are majority (nearly 100 thousand trees), the coffee trees has the biggest affection figure in Dak Nong province with about 182,000 trees in falling. The rubber trees are mostly affected in Binh Phuoc province with over 70,000 trees fallen, and the second rank is in Binh Duong province with having 50,000 cutting rubber trees. All rubber trees in these two provinces have been in harvested; some of them are starting for a harvest. So the lost is high at farmer side.

c. Impacts on houses and buildings 13. The safety corridor line with the 32 m width along with a permanent land acquisition to build the tower set, therefore the project has required the permanent land with removing 340 houses out of the corridor described as follows: (Table 5). Apart from the displaced houses, the transmission line also affected permanently 413 architectural works like the kitchen, courtyard, temporary shelters and camp, bath/toilet or barn of households. The determination of these houses affected is complied with Decree No.106/ND-CP and Decree No.81/ND-CP of the provisions protecting the safety corridors of transmission line of electrical project. 1.3. The affected households and severely affected households 15. Up to date, there are total 11,712 households have been affected by the project including there are 985 households affected from the permanent land acquisition and 10,387 affected households are under the safety corridor, 340 households with displaced houses are permenantly affected (see Table 6). It is shown that there are 132 households eligible for vulnerable households as defined by REMDPs including the elderly householder households, women single headed households and the poor. 17. The severely affected households are defined in according to LARAPs/REMDPs with over 10% producton land are lost. As that permanent acquisition land has severely affected to 92 households. The number of severely affected households by province listed as follows:

Up to date, there is a total of 92 households were severely affected due to land acquisition over 10% of production land, there are 68 HHs are belonged to ethnic minority people, there are over 30% of these severely affected households are the ethnic minorities of Jarai, Stieng and Nung, Tay. 1.4. Impacts on ethnic minorities 19. The total ethnic minority households affected by the project are 520 HHs; they are Jarai, Stieng, Ede in which Gia Lai province has 346 households belonging to ethnic minorities with Gia Rai: 315, Tay: 23, Nung: 8. In Dak Lak province, there are 174 households belonged to ethnic minority groups with Dao: 72, Nung: 47, Tay: 34, E De: 21. 20. There are four provinces such as Gia Lai, Dak Lak, Dak Nong and Binh Phuoc province having ethnic minority households were affected by the project. Ethnic minority groups were affected including Gia Lai, E De and the ethnic minority communities migrated from the north to such as ethnic minority group of Nung and Tay.

II. PROGRESS OF THE PROJECT IMPLEMENTATION 21. The project transmission line 500kV Pleiku - My Phuoc - Cau Bong began performing in 2012 and it has completed the construction and put into operation since May 2014. The project has complied with the provisions of ADB and Vietnam Law on planning for land acquisition and resettlement and ethnic minority development. REMDPs and LARAPs were built on a harmony between safeguard policies of the ADB and the Government of Vietnam in the involuntary land acquisition, policies for ethnic minorities, gender strategy and policy of communication and information dissemination. There were 6 safeguard documents for the 6 provinces of the project, including 4 Resettlement and Ethnic Minorities Development Plans (REMDPs) and two Land Acquisition and Resettlement Action Plans (LARAPs) were built on the compromise between safeguard policies of the ADB and the Government of Vietnam. There are 04 REMDPs plan for 4 provinces of Daklak, Dak Nong, Gia Lai, Binh Phuoc and 02 LARPs for 02 provinces of Binh Duong and HCMC is appropriate. Because that the project line that affects to the ethnic minority communities in four provinces of Gia Lai, Dak Lak, Dak Nong and Binh Phuoc, so there are 04 Resettlement Ethnic Minority Development Plans (REMDP) were developed. In Binh Duong province and Ho Chi Minh City, the land acquisition affects only the Kinh people, so the action plans for these two provinces are the land acquisition and resettlement action plans (LARAP) based on a social safety document (RP) was developed by PECC4 in 10/2010. 22. It is showed that the REMDPs and LARAPs were developed and submitted in 3/2011. During the design process of the investor, the technical consultants were working in a collaboration with local authorities to design the power line going parallel with the existing 500kV line. Therefore, the land acquisition for tower construction did not influence the household. Also, it did not affect to the basic infrastructure of the communes. It reduced the resettlement for households. Beside that the technical consultants in supporting Tranche 1 was considered and given the additional requirements of investigation and assessment to ensure that RAP documents complied with the requirements of ADB Policy. By May 10/2011, PECC4 submitted the draft 2nd RAP, which was updated by the results from the survey for the replacement cost and socio-economic surveys and community consultations. By 9/2011, the technical assistance (TA7742-VIE) for Tranche 2 was mobilized to support the CPMB and the PPMBs in preparing projects for Tranche 2. The social resettlement consultant team conducted field works with a trip in May 11/2011 for social assessment and review CPMB activities in the preparation of social safeguard documents for transmission line project Pleiku - My Phuoc - Cau Bong. The team conducted fieldwork activities and had meetings with ADB specialist and they agreed to develop 6 social safeguard documents for 06 project provinces as mentioned. 23. The implementation of REMDPs and LARAPs in 6 project provinces is so far unfinished until 30/12/2015. At present, the compensation and assistance for the impact of the project on land acquisition and resettlement have been carried out reaching up to 99.73% and it still continues to be implemented by CPMB and DCARBs in the coming time.

III. SAFEGUARD POLICY AND HUMAN RESOURCES

24. Related to the project policy and compliance with GoV’s regulation and ADB’s requirement, there is a need to address the discrepancies between ADB Safeguard Policy and relevant GoV regulations, the subprojects’ principles on resettlement policy are (i) Meaningful consultations have been carried out with the APs and concerned groups and ensure participation from planning up to implementation. The comments and suggestions of the APs and communities have been taken into account; (ii) The REMDPs/LARAPs is disclosed to APs in a form and language that understandable to them; (iii) Involuntary resettlement and impacts on land, structures and other fixed assets are avoided or minimised where possible; (iv) Compensation and assistance is based on the principle of replacement cost; (v) Severely affected household is entitled when they are losing 10% or more of the household’s productive land; (vi) Special assistance has been incorporated in the resettlement plan to protect socially and economically vulnerable groups such as households headed by women, children, disabled, the elderly, landless and people living below the provincial poverty line; (vii) Gender concerns are incorporated through RP implementation; (viii) Reporting and independent monitoring is defined as a part of the subproject management system. Periodically independent monitoring on implementation of RP has been implemented. 25. The DDRs of 06 provinces were re-established in August 2015. 26. There are many decisions issued immediately from Provincial People Committees on compensation, assistance and resettlement of Gia Lai, Dak Lak, Dak Nong and Binh Phuoc, Binh Duong and Ho Chi Minh City. 27. The investigation reports on replacement cost of Gia Lai, Dak Lak, Dak Nong and Binh Phuoc, Binh Duong, HCM were properly and independently established. The reports of replacement cost were prepared by the independent parties; the services were provided by private companies independently for these investigations on the market prices for specific market places. 29. The Boards of Compensation and Land Clearance of districts continued to conduct compensation and assistance to solve ultimately shortcomings of the project. During the report period of the last 6 months in 2015, the activities continued mainly to complete the compensation and assistance for affected households, so the HHs numbers accounted up to date in 12.30.2015 was 11,712 households with exact amount of compensation and assistance reached: VND 862,386,186,730. In particular, there are 1,813 households who received the compensation and assistance in Gia Lai with the amount of VND 80,382,030,863. There are 928 households in Dak Lak received a total amount of VND 34,922,084,757. There are 3,837 households in Dak Nong received a total VND 97,643,439,024. There are 2,525 households in Binh Phuoc received VND 222,884,902,111. There are 1,530 households in Binh Duong received a total amount of VND 287,643,008,513. There are 1,079 households in HCM city received a total amount of VND 138,910,721,462 (see Table 10).

So far, the implementation of compensation and assistance was almost completed, the total amount was spent by up to date December 31th, 2015 were: VND 862,386,186,730. At present, there are still a number of activities for compensation and assistance are being continued to implement in 6 participating provinces. 31. Up to date 30/12/2015, total land area was acquired in the project is 320,860 ha. The land area affected under the safety corridor is 2,528,415 ha. The temporary borrowing land area for road construction, materials yard is 13,376 ha (see Table 11 for detail). 32. During the report period, the gender issues continued to be paid high attention in the process of project implementation. The consultation of women continued to be the focus of the consultations of the Boards of Compensation and Land Clearance for solving grievances, complaints as well as doing assistance activities. There are some opinions from women groups who wanted addtional compensation and additional support, they also suggested a loan with lower interest rates for their production development.

33. During the report period, the poor continued to receive assistance from the project accordance to the project policy, the gaps and problems involving people whose land acquired which are detected in DDRs has been concretely resolved. An example: the case of Mr. Tuat who was wounded during the war, but lost his land, so he has received the assistance from project support in 9/2015. 34. Most of the outstanding gaps and problems existed and recoded in the prior report period of first 6 months in 2015 which are continued to be detected in the DDRs have been focused to implement during this report period. However, the resolution has not completely stopped the problems in some cases. Such so far, the assistance of 25% of rice acquired land has not been resolved. A household was reported as Mr. Bien Truc (Truc Son commune, Cu Jut district) has yet to be fully resolved up to now, so he did not dismantle his old house because he did not receive VND 113 Mil. in cash assistance (though he already received VND 1.02 Billions). There are 35 HHs in Cu Chi district, Ho Chi Minh City have not yet received the compensation, the reason is caused by certificates of land use rights have been mortgaged at commercial Banks, so they are not eligible to receive full compensation. Besides, there are 26 land parcels where are absent of land owners, the Board of Compensation and Land Clearance has found 03 households, but there are remains of 23 households are missing, so they have not paid as yet to figure out the land onwers. 35. In the report period of last 6 months in 2015, the gaps and problems exists on complaints, grievances were discovered in the first 6 months has been resolved. As a result, up to date of 30/12/2015, the complaints have been sufficiently resolved. However, there are some households who still have not agreed to receive additional compensation who continues to have a complaint. The cases need to be resolved before 3/2016.

V. MONITORING 36. The CPMB has established concrete systems for internal and external monitoring and evaluation. The main purpose of the monitoring and evaluation programme is to ensure that resettlement and acquisition of land and properties has been implemented in accordance with the policies and procedures of the RP. For external monitoring and evaluation, in particular, has focused on social impacts on DPs and whether or not DPs have been able to restore a standard of living equal to, if not better than, that which they had before the subproject. 37. The objectives of the monitoring and evaluation programme are to (i) ensure that the standard of living of DPs is restored or improved; (ii) monitor whether the time lines are being met; (iii) assess if compensation, rehabilitation measures and social development support programmes are sufficient; (iv) identify problems or potential problems; and (v) identify methods of responding immediately to mitigate problems. a. Internal monitoring

38. The CPMB conducted the internal monitoring of RP implementation to identify as early as possible the activities achieved and the cause(s) of problems encountered so that arrangements in RP implementation can be adjusted. Results of the internal monitoring are to be reported quarterly to NPT and ADB. The semi-annual report is also prepared to summarize all activities relevant to the implementation of RP done during six months. 39. This semi-annual monitoring report for the second half of year 2015 has been prepared in compliance with the ADB requirements. This report incorporated monitoring results from July to December of year 2015 in purpose to show how the tasks have been implemented during 6 months and the works taken to improve the situation, if needed. Relevant information has been collected monthly from the field to assess the progress of RP implementation and then consolidated. 40. Based on the RF, the main indicators that regularly monitored in this period include (i) Public consultation and information dissemination procedures to the new affected households arise; (ii) Payment of compensation AHs; (iii) Adherence to grievance procedures. 41. Moreover, the field surveys were carried out twice respectively in July 2015 and December 2015 by team with the support of the employed safeguard consultant. At each survey, the team has cooperated with contractor in charge of clearance site, contractor of construction, local government, and local community to maintain RPs’ implementation in adequate process. 42. The monitoring work was done by working with stakeholders such as CPC, DLFDC, PECC3 and in-depth interview APs has been applied to achieve the monitoring target. b. Monitoring the compliance of RP implementation 43. The general objective of the external monitor is to provide an independent verification of the CPMB’s monitoring information through the conducting of a periodic review and assessment of achievement of resettlement objectives, the changes in living standards and livelihoods, restoration of the economic and social base of the affected people, the effectiveness, impact and sustainability of entitlements, the need for further mitigation measures if any, and to learn strategic lessons for future policy formulation and planning. 44. The fourth external monitoring mission is conducting to (i) ensure that livelihoods and living standards of affected people are restored or improved; (ii) monitor that the overall project and resettlement objectives are being met in accordance with the resettlement plans, and if not recommend corrective action measures; (iii) assess if rehabilitation and compensation measures are sufficient and in compliance with the resettlement plans and ADB's Safeguard Policy Statement; (iv) identify deviations and issues that may arise in the course of implementation and recommend actions for mitigation. 45. Additionally, CPMB had worked with ADB’s team during ADB’s mission organized in December 2015 to check whether the implementation of LARAPs and REMDPs have been done in compliance with the safeguard policy on land acquisition, compensation and resettlement.

VI. CONCLUSION AND PLAN FOR NEXT STEP 46. So far, the activities in the implementation REMDP/LARAP have almost completed; the operational activities of compensation, assistance and resettlement are done in full compliance to the ADB policy and GoVN Law. The activities of public consultation and information dissemination procedures to arising affected households, all activities of the payment of compensation and assistance to affected households are carried out in a compliance with procedures for resolving complaints and grievances of ADB's social safeguard policy and the GoVN Law. 47. These gaps and problems were detected in the report period of first 6 months and DDRs have been properly resolved, however, there are still existing of some gaps need to be continued to address as detected and recorded in this monitoring report of the report period of last 6 months which highlights the gaps and arising problems. 48. These gaps and problems need to be solved before 03/2016 to ensure completion report acting as the Final Report will be shortly carried out after. It is expected that the Final Report will be submitted in late 4/2016.
