    Columbia University Graduate School of Arts and Sciences Human Rights Studies Master of Arts Program Silencing “Breaking the Silence”: The Israeli government’s agenda respecting human rights NGOs activism since 2009 Ido Dembin Thesis Adviser: Prof. Yinon Cohen Submitted in partial fulfillment of the requirements for the degree of Master of Arts 12 September, 2018 Abstract This research examines a key aspect in the deterioration of Israeli democracy between 2009-2018. Mainly, it looks at Prime Minister Benjamin Netanyahu's Right-wing governments utilization of legislative procedure to limit the right to free speech. The aspects of the right to free speech discussed here pertain to dissenting and critical activism against these government’s policies. The suppression of said right is manifested in the marginalization, delegitimization and ultimately silencing of its expression in Human Rights NGOs activism. To demonstrate this, the research presents a case study of one such NGO – “Breaking the Silence” – and the legal and political actions designed to cause its eventual ousting from mainstream Israeli discourse. The research focuses on the importance and uniqueness of this NGO, as well as the ways in which the government perceives and acts against it. First, it analyzes the NGO’s history, modus operandi and goals, emphasizing the uniqueness that makes it a particularly fascinating case. Then, it researches the government’s specific interest in crippling and limiting its influence. Finally, it highlights the government’s toolbox and utilization thereof against it. By shining a light on this case, the research seeks to show the process of watering down of a fundamental right within Israeli democracy – which is instrumental to understanding the state’s risk of decline towards illiberal democracy.

    Project Democracy: Fighting for the Ground Rules Chapter 4: Freedom of Speech, Dissent, and Political Activity Freedom of speech is a basic human right and an essential component of any democracy. It is this freedom that enables citizens to exchange views and information, to protest against injustice, to influence the public discourse, and to criticize the actions of the government. As such, freedom of speech represents a necessary condition for the informed and effective political participation of a country's citizenry. Restrictions on free speech cause harm to democratic life and stands in contradiction to the fundamental principles of democracy – that government should impose no more than the necessary minimum of restrictions on individuals, especially regarding their basic rights. The safeguarding of free speech is especially critical for defending the rights of minority groups. Minorities often suffer from limited political influence and limited access to the corridors of power, and so the arena of public expression is where they are best able to give voice to their positions, to protest, and to influence public opinion. In numerous and unrelenting rulings and legal decisions, Israel's Supreme Court has defended freedom of speech, calling it “the lifeline of democracy.” In these principled rulings, time after time the justices have affirmed that the true test of freedom of speech is not the defense of commonly accepted statements – which no one seeks to limit anyway – but of statements considered irritating, extreme, and unexceptional. Over the last two years, we have witnessed increasing threats in Israel to freedom of speech and those freedoms which derive from it: The right to demonstrate, freedom of the press, academic freedom and freedom of political activity.

    Israel and Overseas: Israeli Election Primer 2015 (As of, January 27, 2015) Elections In Israel, elections for the Knesset are held at least every four years. As is frequently the case, the outgoing government coalition collapsed due to disagreements between the parties. As a result, the Knesset fell significantly short of seeing out its full four year term. Knesset elections in Israel will now be held on March 17, 2015, slightly over two years since the last time that this occurred. The Basics of the Israeli Electoral System All Israeli citizens above the age of 18 and currently in the country are eligible to vote. Voters simply select one political party. Votes are tallied and each party is then basically awarded the same percentage of Knesset seats as the percentage of votes that it received. So a party that wins 10% of total votes, receives 10% of the seats in the Knesset (In other words, they would win 12, out of a total of 120 seats). To discourage small parties, the law was recently amended and now the votes of any party that does not win at least 3.25% of the total (probably around 130,000 votes) are completely discarded and that party will not receive any seats. (Until recently, the “electoral threshold,” as it is known, was only 2%). For the upcoming elections, by January 29, each party must submit a numbered list of its candidates, which cannot later be altered. So a party that receives 10 seats will send to the Knesset the top 10 people listed on its pre-submitted list.

    NO. 41 OCTOBER 2018 Introduction Israel’s Nation-State Law Netanyahu Government Lays the Foundations for a Majoritarian System Peter Lintl and Stefan Wolfrum On 19 July 2018, the Israeli parliament passed legislation known as the nation-state law. It is highly controversial in Israel as well as internationally, although strictly speaking there is little new contained in it. Its advocates emphasise that it merely gives expression to existing realities. Critics argue that the law discriminates against minorities, runs counter to democratic values and, in particular, undermines the principle of equality. The debate reveals the social tension in Israel between its ‘Jewish’ and ‘democratic’ identity. In addition, it becomes clear that the main sup- porters of the law on the government side have more far-reaching intentions than its wording suggests. Their aim is to place Jewish collective rights above individual rights and freedoms. The law is, therefore, also a manifestation of current govern- ment policy aimed at leading Israel away from a more liberal democracy and towards a majoritarian democracy. In particular, this policy affects the Supreme Court as a defender of liberal principles.     Reprieve in Bedouin removal plan? Having narrowly passed the first of three parliamentary “readings” (debates & votes), the Prawer-Begin Bill had been wending its gradual way through the Knesset approval process. As a law, it would forcibly relocate 30-40,000 Negev Bedouin (all citizens of Israel) from about 25 unrecognized villages into seven Bedouin towns and possibly other locations in the Negev. About two weeks ago, thousands of Bedouin and their supporters (including Palestinians in the territories and Jewish-Israeli activists) demonstrated in a “Day of Rage” against the pending legislation. Benny Begin PPI has been involved in this issue, and some of us have spent the last week formulating additional measures to oppose Prawer-Begin. The other day, we suddenly learned from an article in Haaretz that Israel’s governing coalition is likely to withdraw the bill, ostensibly because Benny Begin (son of Menachem Begin and a former Likud MK and cabinet minister) has revealed that he did not consult with Bedouin community leaders on the final format of the bill, as people had previously believed. This episode in Israel’s dealings with its Bedouin citizens in the Negev has been a public relations disaster, but the scrapping of this bill does not necessarily mean a more positive turn in Jewish-Bedouin and Jewish-Arab relations within the country.     Adalah's Post-Election Commentary: In Israel's elections, racism is the winning ballot The 2015 Israeli elections saw an unprecedented level of racist incitement against Palestinian Arab citizens of Israel, which played a critical part in the election's events and results. Regardless of the debates that will unfold in the follow-up to this election, it is clear that racism was the most victorious ballot. 23 March 2015 The elections for the 20th Israeli Knesset was not lacking in drama: media ploys, political realignments, and several surprises as the right-wing Likud party, contrary to many expectations, defeated the Zionist Union, considered to be a center-left party in Israel. The elections also saw an unprecedented level of racist incitement against Palestinian Arab citizens of Israel, a fifth of the population, which played a critical part in the election's events and results. This series of threats, intimidations, and attempts to delegitimize Arab citizens and their political participation, which occurred throughout the process, did not end until the polls closed on 17 March. The Prime Minister announced the latest election after the dissolution of the 19th Israeli Knesset in December 2014. During that government's term (2013-2014), the Knesset amended the Election Law, which raised the threshold required to enter the parliament from 2% to 3.25%. The goal behind this new law was to substantially weaken or exclude the three main Arab political parties, which ran separately for the Knesset, with each attaining 3 to 4 seats. In response to the new law, the Arab parties decided to run together as a single slate – called the Joint List (al-Qa'imah al-Mushtarakah) in Arabic) – despite their political and ideological differences.

Hendel Abstract: The petition challenged the authority of the Prime Minister to serve simultaneously as a minister responsible for a ministry under Basic Law: The Government. The Petitioners argued that the Basic Law does not empower the Prime Minister to serve simultaneously as a minister, due to the omission of sec. 33(d), which was part of the prior Basic Law: The Government of 1992, from the current Basic Law established in 2001 (hereinafter: the current Basic Law). The said provision expressly stated that “The Prime Minister may also function as a Minister appointed over an office”. The Petitioner also pointed to sec. 24 of the current Basic Law, which provides for situations in which the Prime Minister may temporarily serve as an acting minister. The High Court of Justice (President Naor, with Deputy President Rubinstein and Justices Joubran and Hendel concurring, and Justice Melcer dissenting) denied the Petition, holding: Per President Naor: Purposive interpretation of the current Basic Law shows that the Prime Minister has the authority to serve simultaneously as a minister.
