ANORDINANCE TOREPLACE SECTION 18 224- OF THE TOWN OF SNOWMASS VILLAGE MUNICIPAL CODE

WHEREAS,the Town Council supports andpromotes energy conservation and theuseofenergyefficientbuildingpracticeswithintheTownofSnowmassVillage,and

WHEREAS, the Town Council supports and promotes renewable energy generation within the Town ofSnowmass Village,and

WHEREAS, the Town Council finds itnecessary and beneficial toestablish buildingefficiencystandardsthatexceedthoserequiredundertheTown'sEnergy ConservationCode,and

WHEREAS,the TownCouncilfindsitnecessaryandbeneficialtorequireon site- orcommunity sited renewable energy generation tooffset theenergy demand ofoutdoor amenitiessuchaspools,hot tubs,snowmelt systemsandheatedgarages,and

WHEREAS,the TownCouncilfindsitnecessaryandbeneficialtoestablishin- lieufeeoptionsforpropertyownersthatchoosenottoemployenergyefficientbuilding practices,or thatwishtobuildhighly energy consumptive outdoor amenities,and

WHEREAS,the revenuesderivedfromsuchin lieu- feeswillestablishafunding mechanismtofacilitatethedevelopment ofrenewableenergygenerationprojectsand programs toenhance energy efficiency throughout the Village,and

WHEREAS,the TownCouncilfindsthattheadoptionofthisOrdinanceisinthe bestinterestoftheTownandisreasonablynecessarytopromoteandpreservethepublic health,safety andwelfare.

NOW,THEREFORE, BE IT ORDAINED by the Town Council ofthe Town of Snowmass Village,as follows:

1.Residential Construction

ThisSectionshallapplytoallnewresidentialconstruction regulatedbytheInternational ResidentialCodeincludingadditionsof1,000squarefeetormore.Compliance withthis SectionwillrequirethesubmissionofaHomeEnergyRatingSystem HERS)( rating in conjunctionwiththeBuildingPermitapplication. PriortoreceivingaCertificateof OccupancyorCompletionafinalHERSratingcertificate,based uponfieldinspections andtestingdoneduringandattheendofconstruction,shall besubmittedtotheBuilding Departmenttoverifycompliance.

ThisSectionshallapplytointeriorenergyusesonly. Forexteriorenergyuses,see Section Three.

2.Commercial Construction

ThisSectionshallapplytoallnewcommercial construction regulatedbythe International BuildingCode includingadditionsof1,000 square feet or more. CompliancewiththisSectionrequiresthedocumentationofeitherCOMcheckorDOE 2- simulated energy performance aslistedinTable2.This simulated energy performance criteriashallexceedtherequirements oftheInternational EnergyConservation Codeor ASHRAE90.1, whichever isapplicable,by atleast15%

ThisSectionshallapplytointeriorenergyusesonly. Forexterior energy uses,see Section Three.

3.Exterior EnergyUses

ThisSection shallapply toexterior energy usesincluding,but notlimited to,outdoor poolsandspas,snowmelt systemsandheatedgarages.Applicants shallhavethree options,or combinationthereof,available tosatisfytherequirementsoftheREOP MitigationObligation.

Options Mitigate50%ofthe project'sREOPMitigationObligation see( 1 2 Table3)with on site- renewableenergysystem,or, with offsite - renewableenergysystemthathasbeenapprovedbytheChief BuildingOfficial.Such mitigationsystemsormethods,when investingincommunitybasedsystems,shall includeonly permanent systems orinvestments. Off site- systems mayonlybe utilizedwhenlocatedwithintheboundariesofthelocalutility.

4.Commercial and residential spas not more than 64SFinsurface area or 3square feet per dwelling unit,whichever isgreater.

canonlybeappliedtowardsaninstallationofexteriorenergyonthe sameparcel.The calculation ofthecreditshallbebasedonTable4of thisSection.An energycostanalysisoftheexistingsystemcompared totheproposedsystemwillberequiredtosatisfythisexemption.

6.Repairs. Repairs tobuildingcomponents,systems orequipment whichdonotincrease theirpreexisting energy consumption neednot complywiththisSection.All replacement equipmentshallbesubject tocurrent code provisions.

7.Appeals. An applicationforappealoftheChiefBuildingOfficial's final decision shall be based on aclaim that the true intent of this code orthe rules legally adopted thereunder have been incorrectly interpretedortheprovisionsofthiscodedonotfullyapply. Theapplicantmay,under thesecircumstances,appeal totheBuilding Department Board ofAppeals forahearing.

4.Energy CodeReviewFee

AnEnergy Code Review feeof 1,000 $ or10%ofthe project's building permit fee, whichever isless,shall bepaid prior toissuance ofthe main building permit.This fee willcovertheadministrative costsassociated withtheplanreview andfieldinspections toverifycompliancewiththisSection. 11 02- ORD Page 6of8

5.Fee Collection

FeeswillbecollectedbytheTownofSnowmassVillageBuildingDepartmentpriorto issuanceofthemainpermitfortheproject.Collected feesshallberetainedinaseparate account classified asthe Town ofSnowmass Village Renewable Energy Offset Program.

AbuildingprojectwillnotbeeligibletoreceiveaBuildingPermituntilthePermit ApplicanthasdemonstratedcompliancewiththisSectionbymeetingtheapplicable energyefficiencystandardsorpayingthefeesinlieu.

6.Management andAppropriation ofREOPFunds

FeescollectedandretainedintheREOPaccountaretobemanagedbytheTown Manager,or their designee andsuch designee may bedetermined byResolution ofthe TownCounciloftheTownofSnowmassVillage.

Expenditures ofREOP fundsshallbeusedforthefollowing purposes:

a.Planning, design andimplementationofrenewableenergygenerationprojects.

b.Purchase ofrenewable energy offsets credits).(

c.Providing acommunitygrantand or/ rebateprogramforenergyefficiency enhancementsorrenewableenergygenerationprojects.

d.Funding other resources and administrative costs associated with green buildingandenvironmentalsustainabilityorientedefforts.

ExpendituresshallbeconsistentwiththeRenewableEnergyOffsetProgramprotocols;as such protocols shall bedescribed and approved byResolution oftheTown Council ofthe TownofSnowmassVillagepriortotheeffectivedateofthisOrdinance.

7.Effective DateandApplicability

ThisOrdinanceshallbecomeeffectiveonJune1,2011 andshallapplytoallBuilding Permitapplicationsreceivedafterthatdate.

8.Waivers

Applicantsmaysubmitwrittenrequestsforwaiversofanyoralloftheprovisionsof REOPtotheBuildingDepartmentforconsiderationonacasebycasebasisbytheTown Council.All such waiver requests must besubmitted andconsidered byTown Council priortoapplicationforaBuildingPermit.Such waiversmaybegrantedbyResolutionof 11 02- ORD Page 7of8 theTownCounciluponfindingsmadebyTownCouncilbasedoncredibleevidence presentedbyApplicantinthefollowingcategories:

a) benefit; b)Public safety need; c)Unique site considerations onthe property that cause ademonstrable reductioninsafetyforusersoftheproperty;or d)Unique siteconsiderationsonthepropertythatcauseunduehardshipto mitigate energy useon site- duetounfavorable solaraccess oradverse effects i.e.glare, noise, smell orothernuisance)to adjacentproperty.

TownCouncilshallconsiderthetotalityofthecircumstancesincludingtheevidence presentedpursuanttothecategoriesabovewhenmakingdecisionsregardingwaivers.

9.Severability

Ifanyprovision ofthisOrdinance orapplication hereof toanyperson orcircumstance is heldinvalid,the invalidityshallnotaffectanyotherprovisionorapplication ofthis Ordinance which can begiven effect without the invalid provision orapplication, and,to thisend,the provisionsofthisOrdinanceareseverable.
