It is the policy of the General Land Office to promote and encourage contracting and subcontracting opportunities for State of Texas certified Historically Underutilized Businesses (HUBs) in compliance with Texas Government Code, Statute §2161.001-253 and TAC Rule §20.285. Respondents are encouraged to become HUB certified. A HUB Subcontracting Form must be completed and returned with any bid, offer or proposal to be considered responsive. If your response to this solicitation does not include a completed HUB Subcontracting Plan, your response shall be rejected as a material failure to comply with advertised specifications. If a properly submitted HUB subcontracting plan contains minor deficiencies (e.g., failure to sign or date the plan, failure to submit already- existing evidence that three HUBs were contacted), the agency may contact the respondent for clarification to the plan if it contains sufficient evidence that the respondent developed and submitted the plan in good faith. HUB Subcontracting Plan Revisions

After an award is made, any modifications to the HSP must be submitted to the GLO for prior approval. A HUB Subcontracting Plan Change Order is attached for submitting any changes to your HSP. If the HSP is modified without the GLO’s prior approval, you will be in breach of contract and subject to any remedial actions provided by Chapter §2161 of the Tex. Government Code. You will be required to submit monthly compliance reports (see the attached HUB Subcontracting Plan (HSP) Prime Contractor Progress Assessment Report) to the GLO, specifying the use, including expenditures to HUB subcontractors, if applicable.

REMINDER: As specified in SECTION 4 of the completed HSP form, if you (respondent) are awarded any portion of the requisition, you are required to provide notice as soon as practical to all the subcontractors (HUBs and Non-HUBs) of their selection as a subcontractor. (Attachment B) Rev. 1/17 HUB Subcontracting Opportunity Notification Form In accordance with Texas Gov’t Code, Chapter 2161, each state agency that considers entering into a contract with an expected value of $100,000 or more shall, before the agency solicits bids, proposals, offers, or other applicable expressions of interest, determine whether subcontracting opportunities are probable under the contract.
