Are investments and profits earned in India repatriable? 06 Yes, investments are freely repatriable (net of taxes) except if there is a sector specific lock in period and if the investment is in non- repatriable schemes. Where is this proposed bill applicable? 01 It extends to the whole of India and the exclusive economic zone of India including the off-shore platforms, ships and vessels under Indian flag in high seas, aircrafts and other air-borne vehicles registered in India and the space objects of Indian origin in outer space and the space objects which are registered under the register of space objects maintained by the Central Government.

To whom it’s applicable? 02 Applicable to every citizen of India in India or outside India and every legal or juridical person, including Governmental, non- Governmental or private sector agency, company, corporate body registered or incorporated in India who are engaged in any space activity in India or outside India.

How does bill define space activities? 03 It means the launch of any space object, use of space object, operation, guidance and entry of space object into and from outer space and all functions for performing the said activities including the procurement of the objects for the said purposes.

How does bill define space objects? 04 It refers to a) any object launched or intended to be launched, on an orbital trajectory around the earth or to a destination beyond the earth orbit; b) any device, the purpose of which is to launch an object on a trajectory even when such a device is operated without payload for the purpose of its development and validation phase; and c) any constituent element of an object referred in

What is the Regulatory mechanism for space related activities as per the Bill? 05 It will rest with the Central Government or any agency authorized by it which will broadly include activities like: i) framing of policies; ii) grant, transfer, vary, suspend or terminate license to any person; iii) provide authorization to launch or operate space object; iv) supervision of space activities and ensure safety requirements & safety measures; v) testing and examination of licensee’s facilities and vi) calling for information and investigating incidents related to operation of space activities

What is the procedure to acquire a licensee from the central government for space activities? 06 The Central Government shall formulate, establish and notify the appropriate mechanism for licensing and procedures including eligibility criteria, and fees for license and conduct of any commercial space activity in compliance with any international treaty on outer space activity, for which India is a State Party.

Who are eligible to apply for license? 07 Person(s) eligible to apply for the licensee in the bill is defined as an individual, Hindu Undivided Family, company, trust, partnership, limited liability partnership or any other entity established under any law for the time being in force.

Key terms and condition for the licensee to abide by? 08 i) advance intimation regarding the date, territory and location of launch and the basic orbital parameters, including nodal period, inclination, apogee and perigee and such other information; ii) prevent contamination of outer space or adverse damage to earth’s environment; iii) avoid any breach if India’s international obligations; iv) preserve the public health, sovereignty and integrity of India, security of State and friendly relation with foreign states; and v) licensee to appropriately insure himself against any liability incurred as a result of any activity authorized by the license. 39 Proposed Space Activities Bill 2017 – Must Know Facts (3/3)

What is the condition on Liability for any damages arising out of commercial space activity carried out by licensee? 09 Licensee shall indemnify the central government against any claims brought against the government in respect of any damage or loss arising out of a commercial space activity or in relation to a space object covered under the licensee.

Does the bill grant protection of intellectual property rights? 10 Yes, any invention or other form of intellectual property rights such as patents, copyrights, trademarks or such other rights, developed, generated or created during the course of any space activity shall be protected. And any form of intellectual property right developed, generated or created onboard a space object in outer space, shall be deemed to be the property of the Central Government.

Does this bill prescribe any penalties and what are the activities than can draw the same? 11 Yes, activities like undertaking commercial space activity without authorization or license, furnishing of false information, suppression of factual information, causing damage or pollution, disclosing of restricted information, and accessing prohibited areas. Quantum of punishment varies from a minimum of imprisonment for a period of one year to a maximum of three years or with fine which can be minimum of fifty thousand rupees to a maximum of one crore rupees or with both.

Does this bill provide for the administration of Factories Act, 1948? 12 Notwithstanding anything contained in the Factories Act, 1948, (Act No.63 of 1948) the authority to administer the said Act and to do all things for the enforcement of its provisions, including the appointment of inspecting staff and the making of rules thereunder, shall vest in the Central Government 40 Welcome to the God’s Own Country God’s Own Space Park Thank you
