Jerusalem Talmud, Bava Metzia 2:5 Shimon ben Shetah was dealing with flax [as his profession]. His students said to him: ‘Master, leave it behind and we will buy you a donkey and you won’t need to work so much,’ and they bought him a donkey from an Arab, and it had a jewel hanging from it[s neck]. They came to him and said him: ‘from now on you won’t have to work again.’ He said to them: ‘why?’ They said to him: ‘ We bought you a donkey from an Arab and it had a jewel hanging from it[s neck]!’ He said to them: ‘Did the owner know?’ They said to him: ‘no.’ He said to them: ‘go return it.’ [Later students objected to this story:] But didn’t Rav Huna Bibi bar Gozlon say in the name of Rav, said they responded before Rabbi, even according to the one who says an item stole from a gentile is prohibited, all agree that an item lost by a gentile is permitted!?’ ‘What, do you think Shimon ben Shetah is a barbarian? Shimon wished to hear ‘blessed be the God of the Jews’ more than all the wages of this world!’ Where did he [Shimon ben Shetah] know this from? Rabbi Hanina was dealing with the following situation: The elderly rabbis bought a kri of wheat from certain soldiers, and found inside it a sack of gold coins and returned it to them. They said: ‘Blessed be the God of the Jews!’ Abba Oshayah of Turaya [was in a similar situation where he found jewels in the queen’s wash] and she said: ‘They are yours. What are they worth to me? Babylonian Talmud, Tractate Hullin 7a If the animals of the righteous, the Holy One, blessed be He, does not bring about a problem through them, certainly the righteous [themselves] all the more so!... What is [the case of] the animals of the righteous? Rabbi Pinhas ben Yair was going to redeem captives, and he ran into the Ginai River. He said to it: “Ginai, split your water for me so that I can pass through you.” He said to him: “You are going to do the will of your Creator and I am going to do the will of my Creator. You may or may not succeed while I will certainly succeed.” [Rabbi Pinhas ben Yair responded] “If you do not split, I will decree upon you that water never pass through you again!” [The river] split for him. Another man was carrying wheat for Pesah [nearby]. He [R. Pinhas ben Yair] 1 [email protected] said to [the river]: “Split for him as well, because he is dealing with a Mitzvah!” It split for him. There was an Arab [trader] who had joined along with him. He [R. Pinhas ben Yair] said to [the river]: “Split for him as well, so that they don’t say “so one does for one’s fellow traveler.” It split for him. Rav Yosef said: This man is so much greater than Moshe and the sixty myriads, because there [the water split] one time, and here [it split] three times! Maybe here too it only split one time!? Sifrei Devarim 79 “For you will do what is good and right” – good in the eyes of Heaven and right in the eyes of humanity’ – the words of Rabbi Akiva. And similarly it says “And find grace and good reason in the eyes of God and humanity” (Prov. 3:4). Rabbi Yishmael says: “what is right in the eyes of Heaven.” 6. דברים ו:יח וְׁעָׁשִִׂ֛יתָׁהַיָׁשֶָׁׁ֥רוְׁהַטִ֖ ֹוב ע בְׁ ינֹ֣י יְׁקֹוָׁ ק לְׁמַעַן יִֹ֣יטַ בלֵָׁ֔ ְך ובָָּׁ֗אתָׁ וְׁיֶֶָּֽׁ֑רַשְׁ תָׁ אֶּת־הָׁאָֹׁ֣רֶּ ץהַטֹבֵָׁ֔ ה אֲשֶּר־ נִשְׁבֶַׁ֥עיְׁקֹוִָׁ֖ק לַאֲבֹתֶֶּֽ יך: 6. Devarim 6:18 And you shall do the right and the good in the eyes of God, so that He shall do well with you, and you shall come and inherit the good land that God promised to your ancestors. 7. רמב"ן על דברים ו:יח ועשית הישר והטוב בעיני ה - על דרך הפשט יאמר תשמרו מצות השם ועדותיו וחקותיו ותכוין בעשייתן לעשות הטוב והישר בעיניו בלבד ולמען ייטב לך, הבטחה, יאמר כי בעשותך הטוב בעיניו ייטב לך, כי השם מטיב לטובים ולישרים בלבותם ולרבותינו בזה מדרש יפה, אמרו זו פשרה ולפנים משורת הדין והכוונה בזה, כי מתחלה אמר שתשמור חקותיו ועדותיו אשר צוך, ועתה יאמר גם באשר לא צוך תן דעתך לעשות הטוב והישר בעיניו, כי הוא אוהב הטוב והישר : וזה ענין גדול, לפי שאי אפשר להזכיר בתורה כל הנהגות האדם עם שכניו ורעיו וכל משאו ומתנו ותקוני הישוב והמדינות כלם, אבל אחרי שהזכיר מהם הרבה, כגון לא תלך רכיל )ויקרא יט טז(, לא תקום ולא תטור )שם פסוק יח(, ולא תעמוד על דם רעך )שם פסוק טז(, לא תקלל חרש )שם פסוק יד(, מפני שיבה תקום )שם פסוק לב(, וכיוצא בהן, חזר לומר בדרך כלל שיעשה הטוב והישר בכל דבר, עד שיכנס בזה הפשרה ולפנים משורת הדין, וכגון מה שהזכירו בדינא דבר מצרא )ב"מ קח(, ואפילו מה שאמרו )יומא פו( פרקו נאה ודבורו בנחת עם הבריות, עד שיקרא בכל ענין תם וישר 7. Ramban on Devarim 6:18 “And you shall do the right and the good in the eyes of God”: Plainly, this means that you shall observe God’s commands, statutes, and laws, and intend in doing so to do what is good and right in God’s eyes alone, “and to benefit you,” as a promise, for in doing the good in God’s eyes it will be good for you, for God acts kindly with the good and upright in their hearts. But our sages have a nice teaching, that this [verse] refers to arbitration and acting within the line of the law, meaning that originally God said to observe the laws and statutes as 2 [email protected] commanded, and now it says that even regarding that which God did not command you, be sure to do what is good and right in God’s eyes, for God loves the good and the right.

    Jews, Gentiles, and the Modern Egalitarian Ethos: Some Tentative Thoughts David Berger The deep and systemic tension between contemporary egalitarianism and many authoritative Jewish texts about gentiles takes varying forms. Most Orthodox Jews remain untroubled by some aspects of this tension, understanding that Judaism’s affirmation of chosenness and hierarchy can inspire and ennoble without denigrating others. In other instances, affirmations of metaphysical differences between Jews and gentiles can take a form that makes many of us uncomfortable, but we have the legitimate option of regarding them as non-authoritative. Finally and most disturbing, there are positions affirmed by standard halakhic sources from the Talmud to the Shulhan Arukh that apparently stand in stark contrast to values taken for granted in the modern West and taught in other sections of the Torah itself. Let me begin with a few brief observations about the first two categories and proceed to somewhat more extended ruminations about the third. Critics ranging from medieval Christians to Mordecai Kaplan have directed withering fire at the doctrine of the chosenness of Israel. Nonetheless, if we examine an overarching pattern in the earliest chapters of the Torah, we discover, I believe, that this choice emerges in a universalist context. The famous statement in the Mishnah (Sanhedrin 4:5) that Adam was created singly so that no one would be able to say, “My father is greater than yours” underscores the universality of the original divine intent. While we can never know the purpose of creation, one plausible objective in light of the narrative in Genesis is the opportunity to actualize the values of justice and lovingkindness through the behavior of creatures who subordinate themselves to the will 1 of God.

Paying special attention to the discursive forms of the Talmud, I show how juxtapositions of narrative and legal dialectics cooperate in generating the Talmud's distinctive ethics, which I characterize as an attentiveness to the “exceptional particulars” of life. To demonstrate the features and rewards of a literary approach, I offer a sustained reading of a single tractate from the Babylonian Talmud, ʿAvoda Zara (AZ). AZ and other talmudic discussions about non-Jews offer a rich resource for considerations of ethics because they are centrally concerned with constituting social relationships and with examining aspects of human experience that exceed the domain of Jewish law. AZ investigates what distinguishes Jews from non-Jews, what Jews and non- Jews share in common, and what it means to be a human being. I read AZ as a cohesive literary work unified by the overarching project of examining the place of humanity in the cosmos.

    Article Gulliver and the Rabbis: Counterfactual Truth in Science and the Talmud Menachem Fisch The Cohn Institute for History and Philosophy of Science and Ideas, Tel Aviv University, Tel Aviv 6997801, Israel; [email protected] Received: 3 March 2019; Accepted: 23 March 2019; Published: 26 March 2019 Abstract: The paper presents Jonathan Swift’s Gulliver’s Travels as the first systematic attempt to claim that the normal methods of testing belief and opinion for clarity, consistence, coherence, and how they stand to the facts are powerless when applied to deep-seated normative commitments, or what Wittgenstein dubbed “framework truths.” To subject our norms to normative critique requires a measure of self-alienation that cannot be achieved merely by looking hard at or thinking hard about our world and ourselves. However, by closely examining the contrived counterfactual scenarios (or, as I have shown in former work, by exposure to the normative critique of significant others), that Swift is shown to claim, such normative framework assumptions can be challenged to great effect! The standard epistemologies of his day—Baconian empiricism and Cartesian rationalism—fiercely ridiculed in the course of Gulliver’s third voyage are cruelly dismissed as powerless to change the course of science and keep it in normative check. The transformative effect of the clever thought experiments presented in the three other voyages (of imagining London shrunk to a twelfth of its size and enlarged to giant proportions, and a more responsible and intelligent race of beings inserted above (normally sized) humans) enable Swift to obtain critical normative distance from several major assumptions about politics, religion, aesthetics, ethics, and much more, including the limits of the thought experiment itself.

    Nomos and Narrative Before Nomos and Narrative Steven D. Fraade* I imagine that when Robert Cover's Nomos and Narrative essay' first reached the editors of the Harvard Law Review, their befuddlement derived not so much from Cover's framing of his review of the 1982 Supreme Court term with a philosophically opaque discussion of the interdependence of law and narrative, but from the illustrations that he drew from biblical and rabbinic texts of ancient and medieval times. For Cover, both intellectually and as a matter of personal commitment, these ancient texts evoke a "nomian world," rooted more in communally shared stories of legal origins and utopian ends than in the brutalities of institutional enforcement, one from which modem legal theory and practice have much to learn and to emulate. Since my own head is buried most often in such ancient texts, rather than in modem courts, I thought it appropriate to reflect, by way of offering more such texts for our consideration, on the long-standing preoccupation with the intersection and interdependency of the discursive modes of law and narrative in Hebrew biblical and rabbinic literature, without, I hope, romanticizing them. Indeed, I wish to demonstrate that what we might think of as a particularly modem tendency to separate law from narrative, has itself an ancient history, and to show how that tendency, while recurrent, was as recurrently resisted from within Jewish tradition. In particular, at those cultural turning points in which laws are extracted or codified from previous narrative settings, I hope to show that they are also renarrativized (or remythologized) so as to address, both ideologically and rhetorically, changed socio-historical settings.2 I will do so through admittedly * Steven D.

Teshuvah: How a Dishwasher operates This Teshuvah only deals with home dishwashers where hot and cold water enter the dishwasher separately. A general overview of how a dishwasher operates is helpful to understanding the kashering process.2 In a home dishwasher3 hot and cold water enter the tub separately. In a normal dishwashing cycle, the water is kept at a temperature of 120-140 degrees Fahrenheit. The water collects at the bottom of the tub but does not cover the dishes. A pump then circulates the water through holes in the rotating arms, which sprays the water onto the dishes. While this is being done the detergent is released into the tub and is sprayed over the dishes. Dirt from the dishes is disposed of at the bottom of the tub. Depending on the model, larger pieces of food are either ground up and sent through the drain or are collected in a filter that needs periodic cleaning.

    Chapter Three Halakha Shmuel Safrai General Characteristics DEFINITION AND SIGNIFICANCE One of the most important elements of Jewish literature in the period under discussion is what is known as il.:J'il halakha, that is to say, the sum total of rules and laws - derived from the Bible, from religious thought and teaching, from jurisprudence and custom- that govern all aspects of Jewish life. As is the case with with other technical terms, nowhere in rabbinic literature from the talmudic period do we find any attempt to define, or even to interpret, the word halakha. It is only in the Arukh, the eleventh century talmudic lexicon compiled by R. Natan of Rome, that two definitions are suggested: 'something that goes on (holekh u-ba) from beginning to end'; and, 'that in which Israel goes'. 1 Modern scholars have proposed to trace the word to the Aramaic administra­ tive term l'il halakh (Ezra 4:13) or .K.:J'il halkha, meaning a (land) tax. Our 'halakha' would then originally have the same meaning as the Latin regula (whence the modern 'regie', 'Regel', 'rule') which also could denote a fixed land tax. In effect, the prime meaning of halakha would be 'fixed rule'. 2 Whatever the original meaning may have been, the wider phenomenon of halakha encompasses both: 'that in which Israel goes', i.e., the ways of life of the Jewish people, and the fixed laws which emerged from the thought and study of the Pharisaic Sages and other circles within Jewish society. Therefore an adequate understanding of the literature of halakha cannot be derived merely from the literary form in which it was eventually fixed and preserved, but requires an insight into the nature and historical development of halakha.

WRITTEN LAW The Mosaic law was re-accepted on the Babylonian exile as binding law, and the group that returned from the exile based their regime on it : "For Ezra had set his heart to seek the law of the Lord, and to do it, and to teach in Israel statutes and ordinances" (Ezra VII 10). There were thus two things that engaged him : to seek, to expound the law for himself, and to do it and, teach it to the others. This teaching refers of course to religion but it no doubt included the precepts of law and adjudication as well. Besides the study required in the process of settling disputes, it was also customary to read the Torah on various occasions, in the fashion described in Neh VIII 8 : "And they read in the book, in the Law of God, distinctly : and they gave the sense, and caused them to understand the reading". Reading the Torah included interpretation and Aramaic translation (TB Megilla 3a) ;1 and in order to spread knowledge of the Torah and make it readable, Ezra went so far as to sanctify the books written in Aramaic (Assyrian) script, and perhaps even the translation into Aramaic (TB Sanhedrin 2lb).2 Among the important laws which were expounded on the basis of the Torah waa the commandment regarding the Feast of Tabernacles (Neh VIII. 14), but it may be assumed that in the course of public reading many matters were revived. The feeling was thus implanted in the people that they must alter their ways, and that among other things they must put away their foreign wives, "and let it be done according to the law" (Ezra X 3).

    Kabbalah and the Subversion of Traditional Jewish Society in Early Modern Europe David B. Ruderman Most discussions about notions of authority and dissent in early mod- em Europe usually imply those embedded in Christian traditions, whether Protestant or Catholic. To address these same issues from the perspective of Jewish culture in early modem Europe is to consider the subject from a relatively different vantage point. The small Jewish com- munities of the fifteenth through seventeenth centuries were shaped in manifold ways by the norms and values of the Christian and Moslem host civilizations to which they belonged. Yet, they were also heirs to powerful rabbinic religious and political traditions that structured their social relationships and shaped their attitudes towards divine law, human responsibility, communal discipline, and authority. To examine their uni- verse of discourse in its proper context is to view it both in its own cul- tural terms and in its dialogue and negotiation with the non-Jewish world. No period in Jewish cultural history has undergone more radical refor- mulation and revision by recent scholarship than the early modem; though to what extent conventional schemes of periodization like "early modern," "Renaissance," or "baroque" can be meaningfully applied to the Jewish cultural experience is a question which still engenders much discussion and debate.'
