1 Brief Introduction 1.1 Project Introduction

The overall planning of the first-period project of urban and rural infrastructure construction supported by ADB loan in Chongqing (below called the first-period project or project of ADB loan in Chongqing) is the demonstration project by Chongqing government in the overall planning of urban and rural infrastructure construction field, covering eight poor districts and counties. The contents of project include newly building or expanding country road and constructing drinking water supply system, aiming at improving the development of infrastructure construction, public health and environment. Thus, it can enhance the local economy development and alleviate poverty, and narrow unbalanced status of economic and social development between urban and rural areas.

From this project, the number of direct beneficial population can reach 375,800. This project includes the construction of country road in Qianjiang , Xiushan County, , , Wushan County, and , and the construction of water supply system in Youyang County, Yunyang County, Fengjie County, and Chengkou County.

Parts of the project apply for exiting from the ADB loan and use domestic capital to construct the two water supply systems connecting the Houba of to the Huangxi road, Youyang county’s three country roads, Yunyang County’s four country roads and to Fengyang County. The basic status of projects is shown as Table 1-1. The location of the projects can be seen in chart 1-1.

The first-period project of ADB loan in Chongqing has been included in 2010 fiscal year project planning in ADB loan since 2008, and started consulting technical assistance in the beginning of 2009. In May 2010, the loan negotiations were reached, and in October, the government officially signed Loan Agreement and Project Agreement. Then, the construction started in 2011. Please refer to Table 1-2 for the specific construction progress.

The first-period project of ADB loan in Chongqing has improved 37 villages and towns in all districts and counties. According to the research, the estimated amount of direct benefit population has reached 375,800.

Independent monitoring and evaluation mainly monitor the construction of the resettlement implementation institutions during the implementation process, the basic policies and compensation standard of the land acquisition and demolish, house reconstruction and restoration, information disclosure and appeals and so on. Sampling survey on the affected households will be conducted after negotiation and discussion with the owners, Land and Resources Department, governments of towns and counties and village cadres in order to know the basic information, income and expenses condition, family property and the resettlement aspirations of the affected households. The external monitoring report will be compiled on the basis of the survey data which have been gathered, analyzed and processed. 2.1 Survey Objective

The external independent monitoring survey can dynamically evaluated the suitability of The Resettlement Plan and provide decision support for the project owner, the resettlement implementation institutions and CPMO. This survey can also make sure that the evaluation of the resettlement implementation is objective and find out whether the implementation is in line with The Resettlement Plan. If the implementation disobeys The Resettlement Plan or is deficient, this survey can provide remedial suggestions. Evaluations of the income restoration of the affected persons, the realization situation of the resettlement objectives and the work efficiency of the resettlement institutions can help find out the existing and potential problems and provide suggestions and early warnings, so that the affected persons’ living standard and livelihood will not be inferior to the original ones before the resettlement because of the deficient Resettlement Plan or the implementation deviation. 2.2 Survey Scope

The monitoring scope covers 79 villages in 37 townships, among which there are 9 subcomponents in 5 water supply subprojects and 19 subcomponents in 8 rural road subprojects. The whole project covers 79 villages or communities in 43 towns or townships (or streets) of 8 districts and counties. The land acquisition (occupation) area is 2750.83 mu. Four subprojects involved house demolition. The demolition area is 15460.64m2. The project has affected 12,715 people from 3,080 households. The specific situation is available in Table 2-1. 2.3 Survey Content

The main content of the survey is:

① land acquisition, demolition and resettlement implementation progresses; ② the distribution and use of the resettlement compensation;

③ the livelihoods resettlement;

④ the operation and benefit analysis of the resettlement institutions; ⑤ the satisfaction degree of the affected persons on resettlement; ⑥ the appeal mechanism and problem solving situation; ⑦ the public participation situation; ⑧ the main existing problems and suggestions; ⑨ the problems solving situation of the last monitoring report and so on. 2.4 Survey Time

This survey lasts for more than 8 months from the end of December 2015 to the end of June 2016. 2.5 Survey Methods

(1)Literature Research. Conduct systematic and targeted collection of all literature related to the resettlement implementation (such as documents from the owner of the local implementation institutions, statistical material, compensation agreements and other related agreements). (2)Internal Monitoring Report Analysis. Read the internal monitoring report to get a preliminary understanding of the resettlement implementation progress and the existing problems, make a corresponding monitoring and evaluation survey plan and adopt the appropriate monitoring and evaluation methods.

(3)Interviews with the Project Owner and All Levels of Resettlement Implementation Institutions. By interviewing all levels of resettlement implementation institutions, verify the relevant content in the internal monitoring report, check whether the personnel of the institutions are qualified and well-arranged for the job, find out whether the essential working conditions in the institutions meet requirements, check whether the institutions are familiar with the resettlement implementation progress in their responsible areas, know the institutions problem solving situation in their responsible areas and find out the resettlement information maintenance, management and renewal situation in institutions’ responsible areas. (4)Interviews with Households. Carry out face-to-face interviews with the affected households to know the resettlement implementation situation. The main purpose of doing this is to get information on the socio-economic situation of the affected persons and households, the resettlement policy implementation situation, compensation standards and payment situation, living and livelihood resettlement situation, information disclosure and transfer situation, public participation situation, the affected persons’ complaints and appeals situation and the relevant problem solving situation.

3. LA Status

In the first phase (June 2012-Decmenber 2012), the completion of LA is 39.43mu, the HD is 700 m2; the temporary occupant is 64.73mu, affected 231 people in 58 households. In the second phase (Jan 2013-June 2013), the completion of LA is 603.15mu, the HD is 6958.3 m2, the temporary occupant is 630.76mu, affected 3636 people in 844 households. In the third phase (July 2013-Oct 2014), the completion of LA is 742.27mu, the HD is 346.46 m2, the temporary occupant is 51.433mu, affected 3345 people in 758 households. In the fourth phase (Nov 2014-June 2015), the completion of LA is 359.25 mu, the HD is 449.5 m2, the temporary occupant is 51.43mu, affected 1745 people in 410 households. In this phase (July 2015-June 2016), the completion of LA is 188.65mu, the HD is 4692.48 m2,, affected 1007 people in 258 households.

By the end of June 2016, the total completion amount of LA (occupation) is 2750.83mu, the HD is 15460.63 m2, the temporary land occupant is 991.4mu, respectively. The details are in the Table 3-1.

4 A Brief Introduction to The Monitoring And Evaluation

The monitoring and evaluation mainly monitor the resettlement implementation institutions during the implementation process, the resettlement implementation progress, the basic policies and compensation standard of the land acquisition and demolish, house reconstruction and restoration, information disclosure and appeals and so on. 4.1 Resettlement Implementation Agency

By the end of June 2016, most of the ADB loaned Chongqing phase I subprojects have completed the construction, and only the following 5 subcomponents are still under construction or closed to completion: Xiushan road subcomponent, Youyang Mawang water supply subcomponent, Fengjie pingqu road, Wushan Guihua bridge to

Shilongping road and Chengkou road. The local government and IA for each subproject have entrusted the related agencies to conducted the LA activities including information disclosure, DMS, compensation fund distribution, e.g. by now, staffs of each subproject all come to the position as planned. The details see in Table 4-1.

4.2 Monitoring for the Resettlement Policy and Standard

4.2.1 Compensation Policies

In 2009 during the RP preparation stage, RP for each subproject was compiled on the basis of the land acquisition compensation policy of Chongqing YFF [2008] 45 in that year. In 2013, Chongqing government has updated the land acquisition compensation policy (YFF [2013] 58) and regulated that the compensations of the subprojects which were implemented after January 1, 2013 should conform to the new policy. Due to the different implementation progresses and construction progresses of the subprojects, some subprojects have applied the old standard and the others have updated the compensation standards, among which:

The subprojects which started the land acquisition and the demolition relatively early and applied the old policy include: the Gaoguan Town water supply subproject of Chengkou County, the water supply subproject of Yunyang

County, the Wubai Road subproject of Fuling District and the Mawang Town water supply subproject of Youyang County; the subprojects which started the land acquisition and the demolition relatively late and applied the new policy of 2013 include: the Chengguan 2nd Road subproject of Chengkou County, the water supply subproject of Wushan County, the rural road subproject of Wushang County and the Meijiang-Yunai rural road subproject of Xiushan County. 4.2.2 Compensation Standard

The permanent land acquisition (occupation) compensation standards include land compensation standard, resettlement compensation standard and crops compensation standard. Due to different economic development levels of districts and counties, the land compensation standards in different districts and counties are different when they are making their own compensation documents based on Chongqing relevant documents. However, during the implementation process, the actual compensation standards of the projects are different from the relevant documents. There are several reasons. The first one is that some districts and counties have put the original roadbeds into the compensation scope. The second one is the different economic development status and different geographical positions. The third one is to assure the consistency of the compensation standard and method of the same project type in the same area. The details are as following table 4-3.

According to the survey, the related agencies in the project counties have compensated the APs, but some standard gaps still exist comparing with that in the RP. The main reasons are as follow: (1) ADB loaned Subcomponents

①The standard for Xiushan road, Yunyang water supply and Wushan water supply and road subcomponent are higher than the standard in the RP. Because when the RP was prepared in 2009, the policy was made according to the document of 2008. However, the actual LAs for the above counties were started after 2013 when the new policy had been issued. Therefore, the new compensation standard should be updated based on the new standard.

②The standard of Fuling Wubai Road is in accordance with FFF [2008] 138 and RP. Furthermore, Wubai road is the upgrading construction, which only needs to compensate the crop, and the amount of new acquisition land is

54.75mu. During the implementation, the local people applied for compensating the original roadbed together with the new acquisition land. Therefore, the actual affected land amount includes the 54.75mu new land and 685.452mu original roadbed, which leads to the increase of the affected land and decrease of the compensation standard. Table 4-1 shows the compensation funds utilization of the project; table 4-2 shows the Minutes of the related meetings.

③ Chengkou water supply and road subcomponent are all used the comprehensive compensation standard; the rate of Gaoguan water supply subcomponent is 41935Yuan/mu; the rate for cultivated land of Chengguan road is from 49300yuan/mu-80000yuan/mu, and for other land type is 25500 Yuan/mu. Through evaluation, the actual compensation rate of both water supply and road subcomponents are higher than the rate in the original RP. The standard for water and road subcomponent is different in Chengkou County: the policy for water supply was made in 2009, using the old policy while the policy for road subcomponent was made in 2013, using the new policy issued in Chongqing government in 2013. Furthermore, the rate of road subcomponent is also different for each township; the less the cultivated land has, the higher the compensation rate will be made for the township.

④Yunyang Jiangkou water supply subcomponent had completed the LA in April 2008 and September 2008 when the project had not involved in the ADB project; therefore, the compensation rate is 1200Yuan/mu. Since the above compensation standard was made based on the agreement with the APs, it was also used in the latter 3 ADB Yunyang water supply subcomponents.

⑤ADB-loaned Fengjie Qinglong road, Tuxiang road, Caotang road and Hongtu road are all used the original roadbed for construction; therefore only crops were compensated to the APs based on the policy of “ One project one discussion”. For the newly added Pingqu road, the standard was made in accordance with other similar project in Fengjie county. After quitted from ADB project, the total investment and road class of above roads were all decreased, only using the original roadbed for hardening and widening. Therefore, the compensation policy was made based on the “one project one discussion”, and APs would obtain the same comprehensive price in the same areas. For Fengjie Hongtu and Caotang water supply subcomponent, only a few new lands was acquired during construction; the APs were compensated following the standard of other project constructed in that area.

4.2.3 Crops Compensation and Temporary Land Occupation Compensation Standards

Crop compensations mainly include one-off compensations for permanent land acquisition and compensations temporary land occupation. According to the relevant regulations of the construction land system and policy, the lease time of temporary land occupation should not be longer than 2 years. If the temporary land occupation time has to be longer than 2 years, the occupation need to be approved by relevant departments and should be contracted between the project owner and the APs. Alternatively, the project owner has to renew the relevant formalities for the temporary land occupation. At the end of the lease, the project unit has to pay for the land consolidation of the temporary occupied land. The final right to use of the land still belongs to the farmer. The rate for some components is higher than the original RP because they use the new 2013 policy. Some subcomponents use the comprehensive price, compensating the cultivated land without distinguishing the land type (vegetables or grain); the rate for above subcomponents is at the middle level between vegetables rate and grain rate.

4.2.4 House Demolition (HD) and Resettlement Compensation

Xiushan road, Wushan road and Chengkou road are involved in HD; during the phase II monitoring period, Fengjie had to demolish 3 houses, but after improvement of the alignment, there’s no HD in Fengjie road. During construction, Xiushan and Wushan also conduct some alignment variation to avoid the HD. By now, the affected households (AHs) of HD for Xiushan have decreased from 130 households to 122 households; and from 19 to 12 for Wushan road, respectively. For Chengkou road, because the major design variation was conducted in 2014, the AHs of HD only 14 households, which decreased too many compared with that in the original RP (It can not be compared the gap in Chengkou because the design is totally changed comparing with the original design). Wushan County and Chengkou County have made corresponding compensation policies according to the relevant documents. The actual compensation standards are basically the same with or a little higher than those in the documents. The specific situation is in Table 4-5.

There are 28 subcomponents in 13 subprojects; among which there are 9 subcomponents in 5 water supply subprojects and 19 subcomponents in 8 rural road subprojects (including 2 newly added roads in Fengjie and Wushan). According to the survey, the local governments or land acquisition and demolition offices entrusted by the project owner are responsible for the compensation distribution. The APs in all subcomponents suffer from LA for both permanent or temporary, and some of APs also suffer from the HD, which may lead to the decrease of their income especially for those households whose mainly income resources are from cultivation. Based on this condition, the related governments have conducted the compensation in accordance with the related policies and standard; besides they also provide some livelihood restoration to the APs in order to keep their life standard higher or the same after construction.

4.5.1.1 Employment for APs under the Project

The non-skill workers are needed during the construction such as remover, cleaner cook, e.g. When signing the contract with contractor, it was agreed during the construction the contract should hire the local people as many as they can. Through 5 monitoring phase, the contractors have hired the local for construction. In some of the project sites where the constructions have been completed, the contractor also hired some local people to conduct the works such as road maintenance and pool cleaning. The employment percrntage for women has been over 30%.

4.5.1.2 Through technical training to promote employment

Project construction shall ensure sufficient participation of women and the enjoyment of project benefits. Implementing construction and construction unit shall ensure that women will have working chance through physical labor, which conforms all stipulations of Labor law of China, such as equal pay for equal work and no occurrence of child labor employment or labor trade. Based on the present survey, the employment rate of women during the construction period exceeds 30%. Local residents should be hired as much as possible for the temporary employment. Priority shall be given to affected housewives in terms of employing non-technical laborers. As for the settlement methods, except that long-term employments such as cooking and cleaning are paid monthly, other temporary works are paid everyday. The salary is mostly 200RMB a day.

4.5.1.3Petty Loans for Developing Economy

According to the related policy in Chongqing, the cash compensation from 1200 Yuan to 2400 Yuan will be paid to those persons based on the poverty condition.

Besides, the local governments recently focus on improving the industry structure, developing the characteristic industry as well as building the industry park, which directly help the local through income and employment improvement.

4.5.2 Demolition And Resettlement Status

4.5.2.1 Resettlement Method

Most of APs live in the rural areas where are far from the township. Based on the resettlement preference of the APs, most of them prefer self-build. The APs (the census register should be in the local) suffer from HD can be allocated the land by 30m2/person, the area of the new house will be no less than 60m2 and no more than 150m2 . Besides, 2 households in Wushan Baiquan road select to buy the allocated house built by the government with special rate. Details see table 4-14. Based on the survey, the areas for the new house of the APs suffer from HD are bigger comparing with that of the old house. The house structures are improved to the brick-concrete structure from wood or wood and brick structure. Furthermore, most of the houses are built along side the road, where the transportation is more convenient and live environment is better than the old house.

4.5.3 Income Restoration for APs

From 2016, the Chinese central government has proposed to overcome the poverty of 70 million people within 5-6 years. Based on this condition, the project county governments have included some difficult households into the anti-poverty system. Meanwhile, the government focuses more on the infrastructure development, livelihood improvement. The details include: ① Strengthen the construction of the rural road, and decrease the cost of transportation. ② Enhance the communication development and improve the convenience for the local to the outside world. ③ Improve the education quality, strengthen the civilization and increase job opportunities for the rural. ④ Improve the health care system, decrease the disease incidents of people; strengthen the rural insurance, decrease the medical cost. ⑤ Strengthen the irrigation construction, decrease the flood; improve the safety water accessibility. The project will inevitably impact the life of the local during the construction. But with the development of the infrastructure construction by the government, the economy will improve fast. Especially the local governments recently focus on improving the industry structure, developing the characteristic industry as well as building the industry park, which directly help the local through income and employment improvement. During the whole LA and HD implementation, the IA of each subcomponent has compensated to the APs according to the related documents. Meanwhile, the government has included some people into the anti-poverty system based on their poverty condition. In this report period, 404 households are involved in the survey. Most income of the households improved year by year; however, small part of households decreases their income due to the disease or other reasons. The appeal and complaint channel, coordinately problem solving means and adjudication means of the subprojects are basically the same. If the affected persons are dissatisfied with anything related to the project, they can report the problem to the village communities or the sub-district offices. The relevant staff will explain the puzzlements to the reporter. If problem cannot be solved, the affected persons can appeal the problem to the specific resettlement implementation institutions and coordination meetings and hearings will be convened to solve the problem. If the problem still cannot be solved, the affected persons can appeal the problem to the People’s Court. During the whole process, the affected persons have the right of directly appealing the problem to the People’s Court.

Stage 1: If APs have any dissatisfaction with RP or implementation, they may report to the villagers’ committee. The villagers’ committee or the APs may directly appeal to the resettlement offices for negotiated resolution or put forward an oral or written grievance. The resettlement offices record the

complaints and resolve the problems within two weeks after the receipt of the complaints if the grievance is oral.

Stage 2: If the APs who lodge the complaints are not satisfied with the results of the Stage 1, they may lodge a grievance to county PMO, after receiving the decision. The latter will make resolution within two weeks.

Stage 3: If the persons who lodge the complaints are still not satisfied, they may after receiving the decision, lodge complaints to the CPMO for arbitration. The latter will make arbitration decision within three weeks.

Stage 4: If the persons are still dissatisfied with the decision of the Stage 3, they may, after receiving the arbitration decision, appeal to administrative setups step by step (township office, county office, authorities of letters and calls, administrative supervision, disciplinary inspection and procurement department) according to Administrative Procedure law. 。

The public participating action plan is mainly divided into three stages: The first stage: project preparatory stage. The public participating action plan of this stage mainly includes:

① Owner unit and local government publish the basic information of the project by means of putting up publicity and granting publicity materials, including the route and trend of the road, the width of the road, as well as the starting and ending points;

② Hold the villagers meeting, to make local residents understand the possible scope for land requisition and demolishing, the compensation related policy documents and compensation method;

③ With the deepening of the design stage, there may be local adjustment on route, in which condition, the owner and local government shall hold villagers meeting to explain changes on the plan, to further strengthen local residents’ understanding on the project, to make them understand the project and support for the project;

④ Release the environmental impact assessment, conservation of water and soil and geological survey review result in a real-time way, to make local residents understand the possible environmental influence, water and soil loss and adopted remedial measures of the project, and make them participate in supervision according to the review result of related plan during the project construction;

⑤ After the determination of the project construction design scheme, the owner and local government entrust the land requisition and demolishing part or unit to conduct field investigation on the red line scope of the project according to the construction design scheme, to determine the final land requisition and demolishing amount and affected residents, and formulate the resettlement of inhabitant manual, and grant to local residents;

⑥ According to the field investigation and local land requisition and demolishing compensation files, grand compensation subsidy to the effected residents; The second stage: construction stage. The public participating action plan during this stage mainly includes:

① Construction unit and local government put up publicity and release publicity materials to make local residents understand knowledge about construction safety;

② Local labor force participates in project construction;

③ Communicate and coordinate with local residents about the infrastructure must be exploded in construction, and explode after communication, and warning mark shall be put up at the explosion site;

④ Local residents have the right to supervise the environment protection and water and soil loss prevention and control statuss of the construction unit; in condition of disruption of existing roadway caused by road construction and

① The construction unit shall recover the temporary occupation of land and conduct land consolidation, to recovery the original functions of the land; for example, the land shall be recovered to forest if it was forest before, and the land shall be recovered to plough if it was plough before;

② The owner unit employs local labor force to participate in the project during the later operating stage; Within this supervision period, all the project have basically completed the construction of the main works and have been put into the commissioning stage, except for Guihua Bridge – Shilongping of Wushan County, Pingqu Road of Fengjie, the 2nd Chengguan Road of Chengkou and water supply project of Mawang; therefore, the public participating of this stage mainly includes participating in project construction, operating maintenance and household survey by supervision unit. The public participating of this stage involves in 1189 person-times, including 478 women, occupying 40.20% of the total participating person-time, as shown in Table 4-16.

Women mainly participate in works such as material handling, field cleaning, pipe ditch excavation, cooking, planting trees and forestation; posts of cooking and cleaning are monthly settled (1800 yuan/month -2200 yuan/month), and all the other posts are daily settled because of large personal mobility, with the wage of more than 200 yuan/day, which is beneficial for local women to increase income by working during slack seasons. Women participating in project maintenance: During the operating stage of the road project, it is necessary to conduct maintenance for damaged road surface, and it is needed to employ local labor force to participate in the maintenance; water plant needs to conduct pond cleaning at least 2 times each month, and it is needed to employ local labor force; the wage is daily settled, more than 200 yuan/day. Wubai Road of Fuling District is one of the main passages connecting to Wuling Mountain scenic spot; it employs 5 people as the labor force (each of them is in charge of about 3km), to clean the road surface every day, with long term employment relationship. The 5 people employed at present are all affected residents with much land requisition, with the wage of 1800 yuan/month. The participation of local labor force (including women) in project construction and operating maintenance during later stage is beneficial for local residents to understand project status, and support for project construction, and increase their income to certain extent.

5.1 Conclusion

(1) Most of the subcomponents have completed the LA and HD; (2) The actual compensation rate for Xiushan road, Youyang water supply, Wushan water and road subcomponents as well as Chengkou water and road subcomponents are higher than that in the original RP. The policy of “one project one discussion” has been implemented in the following subcomponents: Fengjie Tuxiang road, Qinglong road, Hongtu road and Caotang road as well as Qianjiang road, Youyang road and Yunyang road which used the domestic funds. (3) All the households involved in the survey have been compensated based on the related documents; meanwhile, the government for each county has provided continuous trainings and job opportunities to the APs. The income and livelihood restoration for the APs be surveyed are good and the life standard are higher than that before construction. (4) All the project counties have the stable institutes and staffs to LA and HD works. The coordination and communication mechanism are smooth for different departments during the LA and HD implementation.

5.2 Suggestion

During the monitoring the following problems are found: (1) For Xiushan road subcomponent: the Insurance Certificates for the old urbanized people have not distributed to the related APs, the local government should urge the progress of this issue.

(2) For Chengkou road subcomponent: the water drainage construction has not completed yet, which has been led to the back flow to the farmland during the rainy weather. The IA should urge the contractors to push the progress of the construction, avoiding the backward again. (3) Through five phase monitors, it is found the amount of LA and HD for each subcomponent has some variations comparing with that in the original RP. The preparation woks and DMS should be more careful in the latter projects.

(4) Due to the long implementation duration of ADB project, the stable ADB project management staffs is needed until the completion of the project.
