On the Cusp of Change

As we move forward into 2013, there are many changes on the horizon. The Healthcare for America bill, including expansion of Medicaid, is one area that will continue to affect how Physical Therapists provide care for South Dakotans. The APTA continues to push forward with the Alternative Payment System and new mandatory Functional Limitations Reporting from CMS continues to add to necessary paperwork. It is important to look to the National APTA offices to assist us with learning about new requirements. The APTA offers pertinent articles in PT in Motion, PT in Motion courses, webinars and online continuing education through APTA’s Learning Center, and opportunities for educational seminars throughut the United States. It is important to use the valuable resources available through the APTA to allow for efficient and appropriate PT services. These are just a few of the opportunities offered with your membership in the APTA.

On a local level, the Education Committee continues to assemble pertinent continuing education twice per year. The committee has put together courses that bring national speakers to our region saving us money and time away from our PTA Caucus 2 jobs. In addition, the Board of Directors holds a membership meeting to assist Ethics 3 members in discussing the business of the SDAPTA. I encourage you all to attend these meetings to participate in your Association, network with your colleagues and FAL Reports 3 help to create a forward momentum as we undergo the many changes that are PAC 7 occurring in our busy profession.

USD PT Update 9 Upcoming Event 11 Treasurer’s Report by Patrick Hauer, PT, EdD LATI Update 12 The 2011 Financial Spread Sheet has been uploaded to the SDAPTA Conference 13 website. I would encourage all members to look over the spread sheet. As of 2-25-13 the association had $65,685.18 in checking and $151,511.50 in Fall Business 13 two Vanguard accounts. Contact Info 17 The majority of investments are in a Short-term Corporate Bond ETF with a small amount in Wellington Admiral Shares. Our investments earned the association $13,102.95 in 2012.

Total assets = $217,196.68.

Revenue generated in 2012 equaled $98,994.91, while expenses totaled $72,938.04

First, I would like to extend a personal thank you for your support that allowed me to represent our chapter at the 2012 PTA Caucus and House of Delegates (House) in Tampa Florida June 2-6, 2012.

The PTA Caucus Business Meeting began with reports from groups that meet throughout the year, including the Communication Committee that has been focused on liaison relationships with the Sections; and the Education Task Force that has been discussing PTA entry-level requirements in light of Healthcare Reform.

Niki Wallen, MO Representative and Alternate Delegate, conducted the annual leadership training program that helped participants to identify their leadership styles and the potential impact on others in group situations. Holly Clynch, MN Chief Delegate, provided background information about RCs 19-12 and 20-12 that address PTA entry-level education. Also, Shawne Soper, APTA Speaker of the House, provided a summary from the Governance Review Report. PTA Caucus Representatives and Delegates expressed their concern to the Speaker about decreased representation of PTAs in the House; the structure and function of the proposed PTA Assembly; and the ongoing absence of PTA representation on many chapter boards and the APTA Board of Directors.

The PTA Caucus established new goals; compared them to previous goals and outcomes; and analyzed the likelihood of achieving the goals of the PTA Caucus within APTA’s current and proposed governance structure.

The PTA Caucus election results: Amy Smith (AL) was elected Chief Delegate by acclamation; Niki Wallen (MO), Delegate (1-year term to fill Smith’s unexpired term); Russell Chrischilles (IA), Alternate Delegate; and Debbie Simmons (OK), Nominating Committee.

Of particular interest to the PTA community in the 2012 House were RCs 1-12 through 12- 12 that pertained to proposed changes to the physical therapy practice model (PT-PTA- aide). The PTA Caucus continues to believe that the PTA is the only other provider that has the requisite knowledge and skills in physical therapy interventions that are required to provide safe and effective patient/client care and therefore, only support models that protect the patient (i.e. those models in which the PTA is the only other provider of physical therapy interventions).

The PTA Caucus also believes that patients/clients would receive more timely care in models that included expanding the role of the PTA to include components of examination and evaluation. After considerable discussion, the House elected to continue to explore practice models that “are responsive to the needs of society and adaptable to our changing health care environment.

Regarding RCs 19-12 and 20-12 that addressed PTA entry-level education, the PTA Caucus was in support of investigating the educational needs of the entry-level PTA who must be fully prepared to assist the autonomous, doctoring physical therapist. The House elected to conduct a feasibility study to explore the “need for implementation of the entry- level bachelor degree for the PTA.” A summary of the work of the House relative to PTA education can be found on the APTA’s web page at www.apta.org and search 2012 House of Delegates.

Ethics Committee by Patrick Cross, PT, DPT, EMT-B, RHF

No formal ethical complaints have been submitted to the President of the SDAPTA and given a formal case number. Over the last 6 months the Ethics Committee has responded to various episodic ethical dilemmas, including potential overutilization of modalities, supervision of a new graduate without a license, and appropriate supervision of support personnel.

As the Federal Affairs Liaison for SDPTA, I have been privileged to participate in monthly phone calls and frequent e- mail correspondence with officials at the APTA. To say the least, the Federal Affairs Liaison position has been a very rewarding and fantastic educational experience for me. Based on last year’s survey results, I have tried to provide more information about federal affairs issues to you through numerous e-mails that Shelley has graciously sent out on my behalf, as well as regularly posting new information, in a more orderly and professional fashion, under the FAL Web page on the SDPTA Web site. I welcome additional ideas on how federal affairs information can be distributed more effectively and efficiently to membership.

Many of the e-mails that have been sent out to membership were generated by officials at the APTA. These officials have also recognized a need to better educate FALs and membership; while trying to reduce frustrations related to duplicate e-mails (previously they did not tell FALs which e-mails were sent to general membership and which ones were not). It must be noted that we have an amazing group of individuals at the APTA who are constantly meeting with federal officials and analyzing bills, laws, and rulings, in attempt to advocate for our profession and those who we serve. I would hate to think what would occur if these individuals were not advocating on our behalf on a daily basis.

I would like to thank Chris Barrett, Jamie Boomgarden, Karen Gallagher, Mike Latour, Phil Moe, Jim Simons, and Leonard Suel who served as Key Contacts in 2012. I would like to also thank Chris, Karen, and Phil, who have expressed to the APTA that they are willing to serve as Key Contacts again in 2013. Amanda Rausch will be joining this group as a new Key Contact. If there are any other individuals interested in serving as a Key Contact for specific SD federal officials, please let me know.

Traditionally, most of the expenses related to attendance at the Federal Affairs Forum/ PT Day on Capitol Hill are paid by the APTA for the SDPTA FAL and 1 Key Contact. This year the event will be April 14 – 16. If anyone else intends on attending the conference, please let me know; the deadline for registration is March 22. I would like to thank the SDPTA Executive Board for approving funds to send select PT and/or PTA students to the Forum. From my experiences, the federal officials and their staff want to talk with the students, thus giving the SDPTA a lot more time and attention. I feel the extra time we are given to present our issues, as well as the increased potential for those students to become members of the APTA/SDPTA after graduation, due to their experiences, is worth every penny the SDPTA spends on this endeavor.

Below is a list, with a brief synopsis, of some recent federal topics which have the potential or have already had a direct or indirect effect on physical therapy services in both urban and rural settings.  On January 1, 2013, the US Senate passed the American Taxpayer Relief Act of 2012 (HR 8). Among other things, this legislation included several Medicare provisions critical to rehab therapy and rural health: o An aversion of the scheduled 26.5% Medicare fee schedule cut through 2013. o A fix of the Medicare sustainable growth rate (SGR) through the end of 2013. o An extension on the existing 1.0 floor on the “physician work” index through 2013. . The Medicare fee schedule is adjusted geographically for three factors to reflect differences in the cost of resources needed to produce physician services: physician work, practice expense and medical malpractice insurance. o A reinstatement of critical Medicare reimbursement payments to more than 850 rural hospitals . Both the Medicare-dependent hospital program and the low-volume hospital adjustment had expired Oct. 1, 2012. o An extension of Medicare inpatient hospital payment adjustment for low-volume hospitals: . Qualifying low-volume hospitals receive add-on payments based on the number of Medicare discharges. To qualify, the hospital must have less than 1,600 Medicare discharges and be 15 miles or greater from the nearest like hospital. This provision extends the payment adjustment through 2013. o An extension of the Medicare-dependent hospital program. . The Medicare-dependent hospital (MDH) program provides enhanced reimbursement to support rural health infrastructure and to support small rural hospitals for which Medicare patients make up a significant percentage of inpatient days or discharges. This greater dependence on Medicare may make these hospitals more financially vulnerable to prospective payment, and the MDH designation is designed to reduce this risk. This provision extends the MDH program until Oct. 1, 2013. o An extension to the exception process (KX modifier) for payment for outpatient therapy services (including services provided in an outpatient hospital department) through December 31, 2013. . In 2013, the therapy cap dollar amount is $1,900 for physical therapists and speech language therapists combined and a separate $1,900 for occupational therapists. The manual medical review threshold remains at $3,700. The provision also extends the cap to services received in hospital outpatient departments only through 2013.On February 21, 2013 the Centers for Medicare and Medicaid Services (CMS) issued interim guidance on how the manual medical review process will be implemented in 2013 for outpatient therapy claims that exceed $3,700. For 2013, CMS has replaced the prior approval process (in place Oct. 1, 2012 – Dec. 31, 2012) with prepayment review. Under prepayment review, when the patient reaches $3,700 in outpatient therapy services, the Medicare Administrative Contractors (MAC) will send the provider an additional development request (ADR) asking him or her to submit documentation so that the MAC can determine whether the services are medically necessary. CMS has stated that with regard to the therapy cap manual medical review process, MACs must decide within 10 days of receipt of the documentation whether the services exceeding $3,700 will be paid. CMS currently is working on a long-term strategy for the manual medical review process. However, in the interim, the agency will enforce prepayment review of outpatient therapy claims that exceed $3,700 with a 10-day turnaround time.

However, to compensate for not moving forward with the fee schedule cuts, the Senate approved a series of payment reductions. The most important payment reduction for rehab therapists to note is the multiple procedure payment reduction (MPPR), which increases the MPPR from 20% in private practices and 25% in non-private practices to 50% across the board. o According to the Healthcare Billing & Management Association (HBMA), this provision (which provides a budget savings of $1.8 billion) further reduces payment for subsequent services performed on the same day. MPPR is based on the assumption that duplication exists in the practice expense portion of therapy codes billed on the same day. However, the practice expense portion of the therapy codes were already reduced when these codes were initially valued since multiple services are typically provided to a patient during a visit. Currently set at 20% in private practice and 25% in facilities, the legislation includes a provision that raises the MPPR policy to 50% for all outpatient therapy settings beginning April 1, 2013. The APTA estimates the application of a 50% MPPR policy will reduce aggregate payments for outpatient therapy services (physical therapy, occupational therapy, and speech language pathology) by 6-7% from the 2012 payment amounts. This is in addition to the 6-7% reduction of payment for outpatient therapy services that occurred in 2011 when the 20-25% MPPR reduction was implemented. This means that in calendar years 2011 and 2013, outpatient therapy services were subject in aggregate to a 12-14% reduction in payment overall. The current MPPR policy on therapy imposes a reduction to all therapy services and is not a discipline specific policy. To determine the impact on your individual practice, refer to both the 2012 and 2013 MPPR calculators available on APTA’s Web site (http://www.apta.org/Payment/Medicare/CodingBilling/FeeSchedule/).

 In 2013, Physical therapists must submit information regarding a patient’s functional limitation for Medicare Part B services. o For more information visit APTA’s Functional Limitation Reporting Web page and associated links (http://www.apta.org/Payment/Medicare/CodingBilling/FunctionalLimitation/).

 The Physician Quality Reporting System (PQRS) changes from an incentive-based program to a penalty program in 2013. o In order to avoid penalties of 1.5 percent in 2015 physical therapists can report a variety of measures. See APTA’s PQRS Web page, and associated links, for more information (http://www.apta.org/PQRS/).

 As a follow-up to the issuance of the Home Health Prospective Payment System (HH PPS) Calendar Year (CY) 2013 Final Rule, CMS has updated its website to clarify that the therapy provisions will be effective for episodes beginning on or after January 1, 2013. Please see http://www.cms.gov/Center/Provider- Type/Home-Health-Agency-HHA-Center.html. o In the CY 2013 final rule published on November 2, CMS finalized three revisions regarding the requirement that a qualified therapist complete a functional reassessment of the patient at the 14th and 20th visit as well as every 30 days: . If a qualified therapist missed a reassessment visit, therapy coverage would resume with the visit during which the qualified therapist completed the late reassessment, not the visit after the therapist completed the late reassessment. . In cases where multiple therapy disciplines are involved, if the required reassessment visit was missed for any one of the therapy disciplines for which therapy services were being provided, therapy coverage would cease only for that particular therapy discipline. . In cases where the patient is receiving more than one type of therapy, qualified therapists must complete their reassessment visits during the 11th, 12th, or 13th visit for the required 13th visit reassessment and the 17th, 18th, or 19th visit for the required 19th visit reassessment. However, CMS also states in instances where patients receive more than one type of therapy, if the frequency of a particular discipline, as ordered by a physician, does not make it feasible for the reassessment to occur during the specified timeframes without providing an extra unnecessary visit or delaying a visit, then it will still be acceptable for the qualified therapist from each discipline to provide all of the therapy and functionally reassess the patient during the visit associated with that discipline that is scheduled to occur closest to the 14th Medicare-covered therapy visit, but no later than the 13th Medicare-covered therapy visit. Likewise, a qualified therapist from each discipline must provide all of the therapy and functionally reassess the patient during the visit associated with that discipline that is scheduled to occur closest to the 20th Medicare- covered therapy visit, but no later than the 19th Medicare-covered therapy visit.

 Legislation to Repeal the Medicare Therapy Cap o The Medicare Access to Rehabilitation Services Act (H.R. 713/S. 367) would permanently repeal the $1,900 therapy "cap" imposed on physical therapy, occupational therapy, and speech- language pathology services.  Education and Workforce Legislation o This legislation would authorize physical therapists to participate in student loan forgiveness programs such as the National Health Service Corps and Frontline Providers program. Other:  Justin Beebe was a project team member on a $52,800 grant that was funded by Permara Corporation for a pilot clinical trial of Permara-treated socks for the treatment of athlete’s foot.  Pat Cross and 12 Class of 2015 students provided acute sports physical therapy services at an all Native American high school basketball tournament in Macy, NE during January 2013.  Pat Hauer, Pat Cross, and Will Schweinle were awarded a $5000 seed grant through the University of South Dakota’s School of Health Sciences Research and Scholarship Seed Grant Program to work with the Omaha Nation High School/Omaha Tribe of Nebraska to incorporate cardiovascular screenings as part of their high school physicals.  Pat Cross was appointed the Chair of the Nominating Committee for the Global Health Special Interest Group of the Healthcare Policy and Administration Section of the American Physical Therapy Association.  Roy Osborn received the 2012 School of Health Sciences Faculty Research Achievement Award.  Roy Osborn was chosen as the Invited Speaker for the graduation celebrations of the USD PT Class of 2013 and the USD tDPT Class of 2012.

LATI Update by Brenda Norton, PTA BS

Spring semester is in full swing at LATI. The 25, first year students are busy with Kinesiology, Observation and Measurement, Pathology, Physical Agents and Massage, and Therapeutic Exercise. This semester is the toughest one for them. The second year students have finished their didactic work and are now completing their last two clinicals. Some of them are placed throughout South Dakota but some have wandered from one coast to the other. Alaska, Hawaii and Florida are a few of the coastal states that the students were able go to for clinicals this spring. Our students also have a little fun while they are here with Intramural sports such as softball, volleyball, basketball etc. We are proud to admit that our students usually win the league championships. 5 of our students also won LATI’s 1st Annual Amazing Race.

Lake Area Technical Institute has continued to stay busy with construction and the addition of new programs. We are also humbled to announce that LATI was named a Top 4 two-year college in the nation for 2013 by the Aspen Institute. We were also named one of two colleges-with-distinction. All faculty and staff take great pride in this achievement. We work very hard to help our students succeed.

KINESIOTAPING: FUNDAMENTALS & ADVANCED (KT1 & KT2)

This two day course is designed to provide therapists with information and instruction on Kinesio Taping methods. Kinesio Taping is a method of treatment for musculoskeletal and myofacial disorders and edema control. This method can be used during physical activity and in conjunction with many therapies. Attendees will gain insight into theory and taping techniques for a variety of concerns, including joint instability, muscular weakness, abnormal alignment, pain and inflammation. During lab sessions, attendees will have ample time to practice screening and muscle testing created for the enhancement of your KT skills and muscle applications for both the upper and lower body. Upon completion of this course, attendees will be able to discuss and apply the Kinesio Taping Method to relax overuse syndromes, stimulate weak muscles, and decrease pain and swelling. Day two includes six Corrective Techniques (Mechanical, Functional, Space, Fascia, Ligament/Tendon, and Lymphatic) and discussion of their application in a variety of clinical conditions.
