In late February 2020, the ruling Pakatan Harapan government collapsed amid surreptitious political manoeuvring. On 1 March 2020, Malaysia’s King appointed Tan Sri Muhyiddin Yassin as Prime Minister after determining that he commanded the support of a majority of elected MPs under the umbrella of the Perikatan Nasional coalition. The turnover in government marked a political sea change and the abrupt end to the reform agenda of the Pakatan Harapan government. The ascendence of the Perikatan Nasional government coincided with the onset of the COVID-19 pandemic in Malaysia. The government implemented a strict Movement Control Order (MCO) that severely curtailed travel and social interactions. While the government’s efforts to stymie the spread of the virus have been successful in many respects, authorities have at times applied measures in a discriminatory manner and used the pandemic as an excuse to restrict human rights. This report examines the Perikatan Nasional government’s record on fundamental freedoms during its first year in power. Specifically, the report considers the government’s actions against its obligations to respect, protect, and fulfil the rights to freedom of expression, peaceful assembly, and association. These rights are the focus of ARTICLE 19 and CIVICUS’s work in Malaysia. Last year’s change of government has proven to be a major setback for fundamental freedoms in Malaysia. While the Pakatan Harapan government’s track record on human rights was disappointing in many ways,1 it took some steps to roll back repressive laws and policies and was much more open to engaging with civil society and the human rights community than its predecessor.

I will take your questions in turn below. 1. What is the geographical distribution of those above 60 who have yet to register for the COVID19 vaccine? Currently, registration for those above 60 stands at 40.1%. It ranges from 56.8% in Putrajaya, to 22.9% in Sabah. For States with low registration numbers such as in Sabah, Kelantan (25.1%), Terengganu (29.4%), Kedah (30.9%) and Pahang (31.5%), we are working with MKN, NADMA and the state governments on an outreach programme to encourage people to register, particularly for senior citizens. The outreach programme is not only to help them register for PICK but also to convince them on why it is important for people their age to be vaccinated against COVID-19. We also assure them that the vaccines are safe, effective and if they have any religious concerns, we also reassure them that the vaccines are halal. We are also working with the Ministry of Women, Family and Community Development to register and vaccinate residents and caregivers at elderly care homes. Mobile vaccination teams will be sent to the care homes to vaccinate on site. 2. What steps have been taken to work with state governments in order to increase the vaccine registration rate? According to Richtuyne Yusoff, the students’ spokesperson, UM’s Students Affairs Division’s decision to disallow former Bar council president and ex-Bersih 2.0 co-chairperson S Ambiga from giving a talk on ‘Public Interest Litigation’ in the university was deemed as suppressing academic freedom. Pakatan MPs who were present to receive the memo were Serdang MP Ong Kian Ming, Bayan Baru MP Sim Tze Tzin and Bukit Bendera MP Zairil Khir Johari Richtuyne said that on March 25 an official letter was sent to deputy vice chancellor of Student Affairs to seek permission for Ambiga to deliver the lecture. The deputy vice chancellor agreed on the condition that there must also be a pro government speaker at the function to balance the view during the lecture. Nevertheless, on March 27, the approval was retracted with the reason that the lecture was not part of the programme. The talk, organised by the UM Law Society , was to have taken place on March 29. Curbing students rights Richtuyne also attempted to contact Deputy Education Minister P Kamalanathan to hand in a copy of the memorandum but the latter failed to response to the students. The students said they would pass a copy of the memorandum to the Pakatan MPs to be passed on to Kamalanathan. In the memorandum, the students are seeking the UM management not to intervene into students’ affairs.

It is, as a result, a key part of a sound development program, as well as being a human right. We are writing to ask the Federal Barisan Nasional coalition to make an election commitment, in the upcoming general elections, to adopt right to information legislation as soon as possible. The right to information has been recognised internationally as a fundamental human right and it is therefore incumbent on all countries to adopt legislation giving effect to it. To date, more than 90 countries around the world have adopted right to information legislation, affirming the global recognition of this fundamental human right, as enshrined in Article 19 of the Universal Declaration of Human Rights. We are very concerned that the Barisan Nasional government has persistently rejected calls to enact such a law and has instead systematically targeted whistleblowers and individuals who have sought to expose wrongdoing and corruption in the public sector. The government’s persistent denial of this right is putting its credibility and popularity increasingly at risk.

Dr Abdelouahed Belkeziz, Secretary General of OIC Excellencies Ladies and Gentlemen Assalamu'alaikum Warahmatullahhibarokatuh, I would like to thank The Honorable Dato' Seri Abdullah Ahmad Badawi, Prime Minister of Malaysia today for his presence at this Special Meeting. I also thank delegates from other countries for their attendance. I know we have given very short notice but your attendance shows the importance and relevancy for this meeting to be held. As Chairman of the 10th OIC summit, Malaysia feels duty bound to call for this meeting amidst the problems and crisis facing the Muslim world and the Ummah. We witness the continued violence in the Middle East, be it in Palestine or Iraq and we also witness the arrogance of power and total disregard for international law and the multilateral process. In other words, we are facing all kinds of pressures in our intention of giving credibility and integrity to the Islamic Ummah. What is obvious is that there is a need for unity and cohesion amongst the Muslims if they want to be counted in the global affairs. Failing to do this would mean that we would continue to be sidelined, marginalized and deprived in making decisions for our own future. Others will instead make it for us. Finally, it is in this context that Malaysia has called for this special Meeting, hoping that in the spirit of brotherhood and unity, we will be able to sit down together to look at ourselves and chart our plans.
