We can however confirm that discussions included the future ownership of Durham Tees Valley Airport, growth opportunities for investment in the airport, the long-term commitment to retain air services, and other matters.

Since 31st May 2017, Graham Robb, Senior Partner of Recognition Marketing & PR, has served as a member of the Tees Valley Local Enterprise Partnership. At the point he assumed that role, to avoid perceptions of conflicts of interest; Mr Robb withdrew Recognition Marketing & PR as an active member of the Framework Agreement. A revised Framework Agreement procurement process will be initiated shortly.

In relation to the second part of your request, I can confirm that South Tees Development Corporation have not paid any monies to Recognition Marketing and PR. However, as part of the communications remit of the Combined Authority, £399.41 was spent with Recognition Services in 2017 for video and photography services for the South Tees Development Corporation launch & Prime Minister’s visit.

A prompt response would be welcomed. As I advised in my emails on 10th May and 10th June 2019, as the information requested refers to a third party, we have consulted with Middlesbrough Council on the information we hold that falls within the terms of your request.

Middlesbrough Council considers that the requested information is withheld from release as it is considered that the information falls under the following exceptions of the Environmental Regulation Act 2004:

• Regulation 12(4)(d) – Material in the course of completion, unfinished documents and incomplete data; and

• Regulation 12(5)(e) – relating to Confidentiality of commercial or industrial information.

The Public Interest Test

Both of the above exceptions cited by the Council are subject to a public interest test; that is, does the public interest in the matter outweigh the basis of the exception relied upon to withhold the information?

The Information Commissioner states in the guidance document “How exceptions and the public interest test work in the Environmental Information Regulations” (July 2012):

“In the context of EIR, there is a public interest in a sustainable environment. More generally, there is also a public interest in transparency and accountability, to promote public understanding and to safeguard democratic processes.”

Regulation 12(4)(d) provides:

In relation to the first ground specified by the Council above, The Information Commissioner’s Guidance confirms that this exception applies to most work in progress and that a key consideration here is the status of the information at the time of the request.

In this case, the information requested was submitted to the TVCA in support of Middlesbrough Council’s Expression of Interest is in draft form. This documentation has not been through Middlesbrough Council’s internal approval processes and as such is neither approved by the Council, nor in the public domain. Middlesbrough Council therefore consider that the release of such information could have an adverse effect on the Council.

Applying the public interest test to this ground, the Combined Authority considers that the public interest in maintaining the exemptions detailed above outweigh the public interest in disclosing the information you requested. In line with The Information Commissioner’s Guidance, the Combined Authority considers that public interest public in maintaining this exception will decline once the final version of the documents in question have been completed. At present, it is unclear whether the Council has any plans to finalise these documents.

Regulation 12(5)(e) – provides:-

The idea of upgrading this road was therefore ruled out for these reasons.

If the link road comes from the east as your attached map indicates then it will destroy the largest concentration of cowslips (photo attached) on any Stockton road verge where they grow amongst glaucous sedge (Carex flacca) an indicator of old grassland [ref: Species indicators for naturally-regenerating and old calcareous grassland in southern England, Markus Wagner et al 2019] – I have asked Natural England for their guidelines on what constitutes an irreplaceable grassland habitat.

If the long term plan is to have the road from the east then that means the development will have needlessly destroyed a grassland community that is a national priority habitat first in order to build the link road from the west, before going onto destroy more of our heritage grassland.

So whilst I can see why you would refer me to the Airport working with the developer, my concern is that they are not capable of doing a the job at a standard I would expect for a public body and if the work on that aspect is poor then naturally there are concerns about the safety of the whole development and the quality of the work carried out by companies that public money (authorised by the Tees Valley Combined Authority) is being spent on. It equally does not convince me that as principle investor in the Goosepool 2019 Limited which is the principle investor in the Airport company that you have any record of the biodiversity assets present on the site in which you have invested and are not making any plans for how they could be used for public good.

As a public body spending public money you should be setting a best practice example so that we can be proud of living and working in the Tees Valley. My concern here is an informed concern as I am the person who has surveyed almost all of our grassland Local Wildlife Sites over the last twenty years.

We have checked our records again and can confirm that at the time of your original request we did not hold the information you requested. At that time we did hold some airport passenger numbers included in Goosepool Limited’s Board papers. Tees Valley Combined Authority holds these Board papers in our capacity as provider of group support services to this organisation and in relation to personal offices on the Company’s Board held by specific staff members. We do not consider this to be Tees Valley Combined Authority’s information. Goosepool Limited is a private joint venture company and we hold them only in relation to our provision of board support services.

In any event, the information we held did not address your request. Had it done so the authority would have had to consider if section 41 or 43 of the FOIA 2000 exempted the information from disclosure.

This is because we are currently in detailed negotiations with a number of companies over the future of the site, which are commercially sensitive. Section 43(2) is a qualified exemption and subject to the public interest test. We have to consider if disclosure of this information would, or would be likely to, prejudice our commercial interests or the commercial interests of a third party. Consideration is also given to the harm disclosing this information would likely cause. The public interest test also (as detailed above) requires the Authority to consider the public interest in disclosing this information against the public interest in not disclosing this information.
