SUBJECT: Municipal Development Plan

Background

The Municipal Development Plan is going to be reviewed by a committee established by Council.

A number of municipalities are speaking to more issues within their Municipal Development Plans that just Land Use policy. To give an illustration of some of the other plans, I am attaching to this document, the indexes of the Municipal Development Plans for the towns of; Sylvan Lake, Lacombe, Brooks and Hinton. The plans themselves are very lengthy and I can make them available if anyone is interested in reviewing them.

This information is just being presented at this time for Council to see what other communities are looking at. I feel that the review we are starting on gives the community the opportunity to look to the future in not only land use issues, but service level statements etc., throughout the municipal operation.

In speaking with PCPS I know that their proposed budget and plan for addressing the development of the plan at this time only reflects on land use issues, and that certainly meets the requirements of the MGA. However as indicated above, I feel we have an opportunity here to expand our view of the future, if Council so desires.

Statement of Purpose

This plan is prepared for the purposes of setting out the overall vision, goals, objectives and policies for governing the operation of the Town of Lacombe. INTRODUCTION

The Town of Sylvan Lake Municipal Development Plan was adopted in November 1996 (Bylaw # 1111/96). Although the MDP has been the subject of a number of minor amendments since 1996, there are a number of factors that have influenced the desire to carry out a major review of the MDP:

• Since 1996 the Town's population has grown from approximately 5200 to over 7500, an increased of about 45 percent. •A recent annexation and adoption of an area structure plan will impact use and development in and along the southern portion of the Town. • Current MDP policy states that Council will review the Plan within one year of the election of a new Council.

The goal of the proposed MDP review is to ensure that the MDP is up to date, comprehensive and relevant in order to gUide future subdivision and development so that it occurs in arf orderly, efficient, and appropriate manner that also reflects the values and aspirations of the community as a whole.

ISSUES

Section 632 of the Municipal GovernmentActoutlines what an MDP must address. This includes:

• Future land uses, • The manner of and proposals for future development, • The co-ordination of land use, future growth patterns and other infrastructure with Red Deer County, • The provision of transportation services both within and in relation to Red Deer County • The provision of municipal services and facilities, • Policies regarding development near sour gas facilities, and • Policies regarding the provision of municipal and/or school reserves

The revised MDP may address other issues identified during the plan's preparation.

'--"" PARKLAND 1 . COMMUNITY c; PLANNING ,/~ SERVICES 1 Public participation in the review process is desirable if the plan is to be effective. A number of methods are proposed in order to gather meaningful public input into the plan. These include:

• The publication of public notices in the Sylvan Lake Newstomform the general public abouUhe progress of the plan and opportunities for public review and input. • Formation of a focus group representative of the public to provide input into the Town's vision for the future development of the Town. • The hosting of an open house / public meeting where the public will have the opportunity to review and discuss the draft MDP in both an informal and formal setting. • Informal one-on-one discussions with the public on an ad hoc basis throughout the process. • The formal public hearing before Council prior to Council's consideration to adopt the MDP.

RESPONSIBILmES

Parkland Community Planning Services (PCPS) will be responsible for the following:

1. Review background materials and information. 2. Meet with the Review Committee to discuss priorities and approach to future land use (one meeting). 3. Initial notification and consultation with relevant agencies regarding their concerns. 4. < Notify the genera! public about the preparation of the MDF'. and request comments. 5. Host a meeting with a focus group of individuals selected by the Town as representative of the general public to determine the public's vision for the,future of Sylvan Lake as it relates to physical development. 6. Establish MDP goals in consultation with the Review Committee (one meeting) and Council (one meeting) 7. Prepare the draft plan. 8. Present the draft plan to the Review Committee for consideration and revise as necessary (one meeting). 9. Send the draft plan to referral agencies, including the Town's engineer, for comment. 10. Host a public meeting / open house to present the draft to the general public. 11. Review responses / comments with the Review Committee (one meeting) and revise the plan accordingly. 12. Present the proposed MDP to Council for first reading (one meeting). 13. Attend the pUblic hearing (one meeting). 14. Make any final revisions resulting from the public hearing and adoption by Council. 15. Prepare and distribute copies of the adopted MDP.

* As PCPS is GST exempt, there is no GST cost to the Town.

Costs for PCPS's work will not exceed the quoted amount unless the Town requests services additional to those outlined in the Terms of Reference (i.e. additional meetings, public consultation).

Should the Town terminate or place the project on hold, the Town will be billed for the number of hours and expenses already incurred by PCPS.

1.0 Purpose

To recommend to Council a change in direction for negotiations of special conditions for major subdivisions.

2.0 Background

During this term of Council, staff involved a member of Council with final negotiations respecting the terms (special conditions) for major Development Agreements. Council's involvement in the negotiations was to provide Council with insight into the negotiation process, as well as, input into the process if appropriate.

It has become apparent that during this process, developers choose to have all the difficult issues settled with staff prior to Council's involvement so that the final negotiation with a Councillor is nothing more than window dressing.

The Reports to Council on the Special Conditions due to a Councillor's involvement have consisted basically of the Special Conditions. Staff would like to implement a different process.

3.0 Staff Recommendation

Since all members of Council have had an opportunity to attend the negotiations, staff is of the opinion that a different process could be adopted. It is recommended that negotiations between the Developer and the Town take place without Council's involvement unless the Developer and staff cannot agree on the terms of the Special Conditions. The Administration Report to Council on the Special Conditions would provide insight and background information for the reasoning behind each condition.

1.0 Purpose To advise Council of issues relating to construction of a paved lane at Hinshaw Heights Condominium site, in Hewlett Park, Copies of correspondence are attached,

2.0 Background In the fall of 2002, Central Alberta Development Corporation paved the rear lane around three sides of the above development and their Engineer requested an inspection for the purposes of approving Construction Completion, It was apparent from the inspection on October 18th that the lane did not follow the design drawings submitted, Approval was originally given for a crowned lane but, for the most part, the surface was crossfalled to slope away from the condominiums towards eXisting lots opposite, Construction Completion was not accepted and the Engineer was notified on November 7th 2002 with a follow-up on February 3rd 2003,

Since then a number of complaints have been received from adjacent residents related to water from roofs and sump-pump discharges flowing across the lane and into or against other properties. A meeting was held on June 10th and subsequently a letter sent requiring temporary measures to divert the drainage and submission of a permanent th collection system design for construction by August 15 • Some discussions took place to th reach an acceptable solution and approval was given on July 15 . There was no activity to resolve the matter during the time specified and further reminders were given verbally until a letter dated September 15, 2003 was received from the Engineers which indicates a proposed completion date for the work of October 31, 2003,

3.0 Discussion The process to address this issue has been lengthy and only recently has there been a commitment to solving the problem, The builder of the condominiums has diverted the sump-pump discharge lines so as to outlet in the front yards instead of the rear, For the roof water collection, a buried pipe system will carry rainfall to the northeast comer of the development where an outlet is available. It would be preferable for the system to be completed and operational this season. There would be some difficulty for the Town in having the work completed before weather conditions might prevent full surface restoration this year,

4.0 Financial Implications If the system is not completed within the timeframe given, Operations will want to seek release of security funds, being held by the Town, to permit contracting the work by others at short notice. 5.0 Recommendation It is respectfully requested that Council accept the proposal by EXH Engineering Ltd, on behalf of Central Alberta Development Corporation, to complete the approved drainage collection system by October 31, 2003 with the proviso that securities held by the Town will be used to fund completion of the work if the developer fails to do so within the timeframe agreed to.

The Developer vvill construct a drainpipe within his property that ",ill run around the perimeter of the units (see attached dravvings). The downspouts will be connected to the drainpipe. The sump pump discharge will connect temporarily to the drainpipe. Once the landscaping is completed, the sump pump discharge will be redirected to the interior of the development away from the lane. It is proposed that the work commence next week subject to approval.

- take such temporary measures as maybe necessary to prevent surface water and sump pump discharge from the townhouse site entering into or flowing through any of the surrounding residential lots on or before June 30, 2003.

And secondly;

to reconstruct the paved laneway so that surface water and sump pump discharge from the townhouse site is carried along the near side of Jane and discharges across the lane surface only in the north-east corner onto the existing swale as shown on the approved design drawing provided by UMA Engineering Ltd. being CD-32-A1, NO.2 (file No. HIN8XREF.DWG). Necessary design drawings and details to achieve the above must be submitted for approval to the Town prior to carrying out the work. A construction schedule will be required with a view to achieving Construction Completion on or before August 15, 2003.

If satisfactory measures are not completed within the time frame given above, the Town will draw on the Developer's Letter of Credit and arrange for completion of the work

A jointinspection of the above work was made on October 18, 2002. Itwas noted that the design ofcrossfalls has been changed from that submitted in December 2000.

The original cr~wnedlane design has been constructed, for the most part, as crossialled, directing run-off to one side of each Janeway..This transfers additional water to Iane edges where there are gravel driveways and low-lying rear yards. Prior to considering acceptance of construction completion certificates for this work we require provision of an as-built survey pIan with sufficient elevations, slopes and crossfalls shown to determine the actual drainage patterns and correctness of crossfalls obtained.

There are large areas of the finished surface displaying open texture. Ifthe as-built elevations are found to be acceptable it"illbe required that asphalt seal coat and possibly, sand slurry-seal be applied to the paved surface when conditions are appropriateearly next year..

1.0 Purpose

To advise Council of correspondence received from the summer village of Norglenwold concerning extension of their sewage collection system. (Copy of letter attached)

2.0 Background

In March 1998 the Town completed an agreement with the summer village to receive sewage effluent from approximately 41 parcels located at the east end of the village. A connection fee was established, based on the applicable off-site levy of $39,996, to be paid in ten annual installments. The agreement also provided for a monthly fee to cover cost of treatment of the metered flow received. The amount charged to the summer village reflects the Town's commercial rate and includes a flat rate of $18.86 per month plus 76 cents per cubic metre of measured flow.

The summer Village contacted the Town in 2000 to confirm that additional effluent from extension(s) of the system would be accepted by the Town. Council passed a motion on May 8, 2000 to that effect. A recent letter received on August 29, 2003 indicates a more firm intention to proceed with extension of their low-pressure collection system, with possible completion by 2006.

3.0 Discussion

Based on the present size of the summer village, the additional effluent to be received from remaining un-serviced parcels would be relatively minor, representing approximately 189 dwellings. The existing agreement recognized this eventuality and provides for the Town of Sylvan Lake to charge the off-site levy in effect at the time of connection of additional areas, as well as increased costs for treatment on a monthly basis.

It will be appropriate to establish during the course of the summer village engineering study how the additional flow will be carried through our system to the treatment facility. We will need to confirm the recently up-graded pumping system at Marina Bay can properly accommodate the intended expansion and what, if any, measures will be necessary should there be other developments west of the town which might have to be accommodated by our system in future. Examples would be pipe system upgrades or an additional force main. /() 4.0 Financial Implications

The intention of the off-site levy and monthly rate charge is that accommodating additional effluent from other areas has a neutral effect on present tax-payers.

5.0 Recommendation

Operations respectfully recommends Council confirm to the summer village of Norglenwold that increased effluent from the remaining parcels within its present boundaries will be received and treated, subject to approval by the Town of the proposed delivery system.

1. Norglenwold has constructed a sanitary sewage connection line within the Summer Village to collect sanitary sewage within certain areas, (see Schedule "A" map attached). 2. The Sewage System is to be connected with the sanitary sewer system operated by Sylvan Lake and Sylvan Lake is to process and treat such sewage.

3. It is also anticipated that infuture, the sewage reqrtirements ofNorgJenwold may increase. It is also anticipated that itmay be desirable for communities or other parties located to the north and ~'ithin Norglenwold to connect to the sewer system, so as to ensure that the waters of Sylvan Lake are kept clean

4. The parties wish to set out their agreement in respect to the construction, maintenance and operation ofthe sewage system.

5. Norglenwold has constructed sanitary sewer lines to serve Norglenwold in accordance with the specifications ofthe engineers so as to connect with the sanitary sewer system ofSylvan Lake. The point of connection to the sewage system ofSylvanLake shall be in accordance with the plan ofworks set out and attached hereto as Schedule "A", and the specifications for such works shall be subject to approval by the Engineers retained by Sylvan Lake and Norglenwold.

6. At the point ofconnection between Korglenwold and Sylvan Lake, a meter will be installed so as to measure the volume ofsewage flowing into the Sylvan Lake system. The parties acknowledge that Sylvan Lake bas the obligation to report the amount ofsewage to Alberta Environment

Norglenwold undertakes to use its best efforts to ensure that new developments ·within its boundaries are connected to the sewer system as soon as possible., but it also agrees that it will not make, or permit to be made, any e>.1:enBion or extensions to the Sewer System without the prior written consent of Sylvan Lake, which consent will not be unreasonably withheld.

19. Ifthe parties agree to submit the dispute to arbitration such agreement shall only be binding ifgiven by notice ofsucb agreement in writing, such notice to be given to the other party and wbicb shall describe the mutters in dispute and shall name one arbitrator. A notice shall be binding upon the party giving same only ifwithin seven days after receipt ofthe notice the receiving party gives a like notice.to the other party.

21. The two arbitrators selected shall forthwith appoint a third arbitrator. A..-bitration shall be conducted and a decision ofthe majority ofthe arbitrators shall be binding upon the parties hereto provided; bowever, ifthe two arbitrators wbo have been appointed fail to agree upon the nomination of a third arbitrator, either party may apply upon notice to the other to a Justice ofthe Court of Queen's Bench ofAlberta who shall name such additional arbitrator. 1.0 Purpose

To have a basic design concept prepared by an architect group that will allow the Town to set pricing of a new arena. Once the design, which will include floor plans, is in place then fundraising prospects and special interest groups can be approached.

2.0 Background

Three architectural groups were asked to submit proposals. Proposals were received from Group 2 Architecture Engineering Interior Design, Barr Ryder Architects & Planners and Berry Architecture & Associates.

3.0 Financial Implications

Included in the fees for all three proposals were floor plans, building sections and elevations along with a rendering of the facility. Prices were as follows:

Barr Ryder Architects $4,200.00 with GST $ 4,494.00 Berry Architecture & Associates $4,790.00 with GST $ 5,125.30 Group 2 Architecture Engineering $6,500.00 with GST $ 6,955.00

Funding for this proposal will be taken from the Centennial Legacy Grant.

5.0 Staff Recommendation

All three proposals were very similar both in costs and drawing. Staff recommend that Council accept Barr Ryder Architects based on their proposal being the most cost effective and the fact that they have a great deal of experience in building arena facilities.

Importance: High Hi Sean: Thanks for the call regarding the arena proposal. I will get you a more detailed written proposal on Monday, as I am in Edmonton all day Thursday and I am in a proposal writing seminar on Friday looking into the federal governments green building funds available to municipal governments. We will be getting some infonnation out of that seminar that I know you will be interested in. We only use proven, solid energy saving techniques that save money.

For the arena project we are prepared to complete the architectural drawings for a package that can be used for marketing and fund raising for the fixed fee of $4790.00 (+GST). This package will result in presentation quality draWings that can be reproduced and used in fund raising. I would expect that they would included at least, floor plans, elevations and a building section.

An added feature of the way that we complete all our drawings is that they are drawn as a 3 dimension building and therefore, we will provide you with several exterior views that reflect the true finish of the product. I would be happy to come out and show you an example of these drawings. You could also check with Bevin, he may have the quick 3D drawing of the community centre renovation.

, do understand that you are on a tight timeframe and we could get started right away. The community centre project is out for tender next Monday and I could get some people working on this project as soon as you give me the go ahead.

The Fall 2003 Leisure Guide was the last guide published under the past tender awarded to the Sylvan Lake News. Ads were placed in the Sylvan Lake News and on our website inviting publishers to submit a tender under the following guidelines:

a. Nine - 32 page guides (for a three year period) b. Including layout, graphics and editing. c. 5,800 copies per guide publication.

2.0 Financial Implications

One sealed bid was received from the Sylvan Lake News. A faxed bid was received from Adviser Graphics. Total costs for each bid were as follows:

a. Sylvan Lake New - $28,829.33 b. Adviser Graphics - $72,099.81

Staffs recommend that Council accept the bid submitted by the Sylvan Lake News. Their bid was less than half the price of Adviser Graphics and they have provided good services with past Leisure Guides.

1.0 Purpose To request amendments to the Special Events policy by addressing concerns stemming from Special Events held over the summer.

2.0 Background Council adopted the Special Events Policy in April of this year.

3.0 Discussion The attached policy amends the existing Special Events Policy by:

• Requiring a security deposit in the amount of $1,000.00 (section 3.3.5) and addressing the refund of same (section 3.6) • Placing responsibility on the Event Coordinator for clean up (section 2.3)

4.0 Financial Implications We do not currently require a deposit. The cost of any remaining clean up following a Special Event is absorbed by the Town.

POLICY STATEMENT:

The Council of the Town of Sylvan Lake believes that this Policy will promote a consistent approach to approving Special Events within the Town of Sylvan Lake.

THE PURPOSE OF THIS POLICY IS TO:

Allow the Town of Sylvan Lake to facilitate special events while preserving and protecting publicly owned facilities. It will endeavor to ensure compliance with laws, address public health and safety & the impact of events on adjacent neighbourhoods.

1. DEFINITIONS:

Special Events: activities, including parades, occurring in the Town which are open to or intended to attract the general public and will take place in/on publicly owned facilities.

Event Coordinator: The contact person, Applicant or the person making the application to hold a special even!.

2. RESPONSIBILITIES:

2.1 The Council is responsible to permit or deny events within the Town.

2.2 The Chief Administrative Officer may designate a member of staff who shall be responsible to act as a liaison with the Event Coordinator. 3. PROCEDURES:

3.1 For events within the Town of Sylvan Lake, an initial application (Schedule A) should be completed and forwarded to the Municipal Office no less than one month prior to the scheduled event.

3.4 Events occurring annually may be approved by the Chief Administrative Officer or his designate and provided to Council as information.

3,5 Following approval, the completed application form shall be distributed to:

3.5.1 Town of Sylvan Lake Municipal Enforcement; 3.5.2 Town of Sylvan Lake Public Works; 3.5.3 Town of Sylvan Lake Fire Department; 3.5.4 R.C.M.P. Sylvan Lake Detachment; and 3.5.5 Ambulance Service provider for the Town of Sylvan Lake

3.6 Upon completion of the Special Event the Town shall conduct an inspection of the facility and if satisfied, refund the security deposit to the Event Coordinator.

1.0 Purpose Simplify the process for low-key events within Town such as block parties.

2.0 Background Since its adoption in April, the Special Events Policy has existed to govern the procedure for all events within the Town. An application is submitted for review by Operational Services and recommendation to Council. The applicant is required to provide a Certificate of insurance with minimum liability coverage in the amount of $2,000,000.00 with the Town of Sylvan Lake named as an "additional insured".

3.0 Discussion Concerns identified and addressed in the proposed policy:

1. Insurance: the requirement for certain functions (ie. block parties) to provide insurance is not viable. The proposed policy allows for a road closure to facilitate the party while the application form contains an indemnity statement in favor of the Town.

2. Time restrictions: the ability to approve or deny road closures internally will reduce the amount of processing time currently required.

The intent of the proposed Road Closure Policy is not to replace the Special Events Policy, only enhance how block parties and public works road closures are approved. Council retains the responsibility for approving or denying major events (parades etc.).

This policy will provide a process to provide for approval of road closure requests.

THE PURPOSE OF THIS POLICY IS TO:

Allow the Town of Sylvan Lake to provide a standard for road closure requests, provide for the safety of special function participants and the general public, and to ensure that all agencies such as fire, police and ambulance have been notified in advance of closure and any concerns have been addressed.

1. DEFINITIONS:

Block Parties: parties arranged by residents of an individual block, for those residents, which utilize the public roadway for the party and require same to be closed to general traffic for a limited amount of time.

Special Events: parades or similar functions, occurring in the Town which are open to or intended to attract the general public and will take place inion publicly owned facilities.

Event Coordinator: The contact person, or the person making the application to hold a special event.

Road Closure Policy /s 2. RESPONSIBILITIES:

2.1 The Council is responsible to permit or deny special events within the Town.

2.3 The Director of Operations or his designate is responsible for the safe rerouting of pedestrian and vehicular traffic when a contractor, utility company or internal forces require a road closure or detour for works within a public roadway.

3. PROCEDURES:

• SPECIAL EVENTS

3.1 For special events within the Town of Sylvan Lake, an application (attached as Schedule A) must be completed and forwarded to the Municipal Office. The application shall include;

a) site plan or map detailing location of the special event and location of any barricades requested by the Event Coordinator;

b) Written description of any/all signs, banners to be erected in relation to the special event with installation locations.

3.2 A copy of the road closure request shall be forwarded to Municipal Enforcement, Public Works, Sylvan Lake Fire Department, RCMP and the Ambulance Provider for the Town, for their comments.

3.3 If time permits, the application will be forwarded to the Operational Services Committee for their consideration and recommendation to Council.

3.4 Following approval of Town Council, copies of the approval will be distributed to Municipal Enforcement, Public Works, Sylvan Lake Fire Department, RCMP and the Ambulance Provider for the Town.

3.5 Upon receipt of an application for a Block Party, the Chief Administrative Officer or his designate shall forward the application to Municipal Enforcement, Public Works, Sylvan Lake Fire Department, RCMP and the Ambulance Provider for the Town, for their comments.

3.6 Following approval, copies of the approval will be distributed to Municipal Enforcement, Public Works, Sylvan Lake Fire Department, RCMP and the Ambulance Provider for the Town.

• UTILITY CLOSURES

3.7 The Director of Operations shall advise Municipal Enforcement, Public Works, Sylvan Lake Fire Department, RCMP and the Ambulance Provider for the Town of any street closures required for utility works.
