1. APOLOGIES

Apologies for absence were received from Councillor John McAlpine. It was noted that having declared an interest in item 3, Councillor Colville would join the meeting later.

2. DECLARATIONS OF INTEREST

Councillor Rory Colville declared an interest in item 3, Continuation of Planning Application 04/01606/DET, because he had previously supported windfarms in Kintyre, and is a member of ALIenergy.

Councillor Bruce Robertson also declared an interest in item 3, Continuation of Planning Application 04/01606/DET as he is the Chairman of ALIenergy.

Prior to consideration of the following application Councillor Robertson, having earlier declared an interest therein, left the meeting and took no part in the discussion thereof.

3. CONTINUATION OF PLANNING APPLICATION 04/01606/DET

The Committee considered a 2nd supplementary report outlining information arising since the Area Committee’s consideration of the application at the Local Hearing held on 31st October 2006 and how the application ought to be determined in the light of that information.

Decision

It was agreed to continue consideration of this application to the March meeting of the Area Committee.

The minutes of the Civic Government Hearing of 6 December 2006 were approved as a correct record.

The Committee noted the decisions issued by the Head of Planning dated 14 December 2006.

7. PLANNING APPLICATIONS

05/01423/OUT Mr James Porter. Outline planning permission. Site for the erection of 4 dwellinghouses. Land at Imeraval, Port Ellen, Isle of Islay.

Decision

It was agreed to continue consideration to a PAN 41 Hearing to be held in the Ramsay Hall, Port Ellen on 21 February 2007.

06/00365/OUT Mr. C.L. MacDougall. Outline Planning Permission. Site for the erection of a dwelling house upon removal of residential caravan. Land at 6 Soroba Road, south of Higher Hey, Ardfern.

Decision

That outline permission be granted as a ‘minor departure’ to the adopted Local Plan subject to the standard outline conditions and reasons and the conditions and reasons outlined in the report by the Head of Planning dated 10 January 2007.

06/00412/MFF Pan Fish Scotland Ltd. Marine Fish Farm Application. Renewal and enlargement of Marine Fish Farm site. Near Camas na Ban-Tighearna, Loch Fyne.

Decision

The Committee agreed to refer this matter to the Public Service and Licensing Committee with the following recommendations -

1. That the Crown Estate Commissioners be advised that the Council have no objection to the proposal which is consistent with present and emerging local plans because - a) The Council raised no objections in 1995 or 2004 for a marine fish farm on this site b) The site is presently occupied by a fish farm c) The site is close inshore and camouflaged by a dark background d) Equipment is low-lying and of a recessive colour, therefore there is no significant landscape and visual impact.

2. That the comments raised by the Royal Yachting Association, detailed in the report, be taken into account.

06/01557/DET Strathclyde Police. Detailed Planning Permission. Erection of new police office and associated road and parking. Site adjacent to Hazelburn Business Park, Lady Mary Row, Campbeltown.

Decision

The Committee agreed –

1. That Planning Permission be granted subject to:

i. the standard condition and reason; ii. the conditions and reasons outlined in the report by the Head of Planning dated 18 December 2006; iii. the application being notified to the Scottish Ministers under the Town and Country Planning (Notification of Applications)(Scotland) Direction 1997, in view of such a decision being in conflict with advice issued by the Health and Safety Executive.

2. To refer consideration of the continued use of the route from Millknowe Road to Lady Mary Row to the Access Officer for discussion with Strathclyde Police.

8. PROPOSED LISTING OF BUILDING AS BEING OF SPECIAL ARCHITECTURAL OR HISTORIC INTEREST - FOLLY AT MINARD CASTLE WOOD, MINARD

The Committee considered a report indicating Historic Scotland’s intention to list a folly within the grounds of Minard Castle, as a Category C(S) listed structure. This is an early 19th century Gothic roofless folly built as a focal point within a designed landscape and also as a place from which to view the countryside. It is likely that the structure was not roofed in order to enhance its apparent antiquity.

Decision

The Committee agreed that no objection be raised to the listing of the folly and that Historic Scotland be notified accordingly.

9. SCHOOL HOLIDAYS

The Committee considered a report outlining the final patterns of inservice days and school holidays for all schools in Mid Argyll. Kintyre and Islay.

Decision

The Committee agreed:

1. to endorse the final patterns of school holidays and inservice days for all schools in Mid Argyll, Kintyre and Islay as outlined in the report by the Director of Community Services 2. that the details of schools holidays and inservice days for 2007/2008 and 2008/2009 should now be circulated to schools and all relevant organisations.

(A ) THE APPLICATION

(i) Development Requiring Express Planning Permission:

(B) RECOMMENDATION

It is recommended that planning permission be refused for the reasons set out in this report.

(C) DETERMINING ISSUES AND MATERIAL CONSIDERATIONS

This application is for a dwelling in the Knapdale/Melfort Scenic Area which is inconsistent with the established settlement pattern by virtue of the elevation of the proposed site. It would give rise to an isolated and prominent building, which would be an incongruous element in the landscape within an area where development is predominantly at low levels related to public roads and to the estate access to the nearby ‘Barbeck House’. The proposal would give rise to an unacceptable environmental impact upon the landscape at the head of Loch Craignish to the detriment of the designated scenic area, not only in terms of its location, but also in terms of its design characteristics and proposed materials, which neither reflect nor reinforce the Argyll vernacular.

A previous application to develop this elevated site were withdrawn in the face of a recommendation of refusal in 2001. Subsequently, permission was granted in 2003 for a dwelling in an alternative and more appropriate location lower down the hillside. That permission has not been implemented by the applicants, although the land remains in their ownership and it is still capable of being implemented.

The proposal is contrary to adopted and emergent local plan policy and fails to have regard to the siting and design principles applicable to housing in the countryside as set out in Planning Advice Note 72 and the Council’s approved ‘Sustainable Design Guidance 1 (Small Scale Housing Development)’

REASONS FOR REFUSAL RELATIVE TO APPLICATION: 06/01285/DET

1. The application site is situated in an elevated location within an area where development is largely confined to the lower lying ground surrounding and adjacent to the head of Loch Craignish. The proposal is neither related to the existing farm cluster at Kintraw nor to the established settlement pattern and would give rise to an isolated building in an elevated location which would be visible from a considerable distance. The maintenance of higher ground free of built development contributes both to the setting of Loch Craignish and to the character of the wider landscape, which is recognised for its scenic qualities in the statutory Mid Argyll Local Plan 1985 and 1989. The proposal would therefore give rise to an adverse environmental impact upon the Knapdale/Melfort Regional Scenic Area, and would be contrary to Policy STRAT DC 8 of the adopted ‘Argyll and Bute Structure Plan’ 2002 and Policies RUR 1, Policy RUR 2 and Policy HO13 of the adopted 'Mid Argyll Local Plan' 1985 (2nd Alteration 1993), which seek to maintain and enhance the value of such areas.

2. The proposed dwelling is a large hipped roofed split level structure with extensive areas of glazing and a large balcony. The scale and form of the design, which is uncharacteristic of its surroundings, coupled with the proposed use of timber clad walls and an aluminium sheet roof, result in a design which neither reinforces the local vernacular nor serves to help assimilate the building into its landscape setting. The building would therefore appear as an isolated and incongruous building of inappropriate form and design in an area of designated scenic quality. It would be contrary to Policy BE 16A of the 'Mid Argyll Local Plan' 1985, to Policy LP ENV 19 and Appendix A of the 'Argyll and Bute Local Plan' Modified Finalised Draft 2006, and would not accord with the advice given in the approved ‘Sustainable Design Guidance 1 (Small Scale Housing Development)’ or with the advice given in the government’s Planning Advice Note 72 ‘Housing in the Countryside’.

A. POLICY OVERVIEW

‘Argyll and Bute Structure Plan’ 2002

STRAT DC 8 – LANDSCAPE AND DEVELOPMENT CONTROL

A) Development which , by reason of location, siting, scale, form, design or cumulative impact, damages or undermines the key environmental features of a visually contained or wider landscape or coastscape shall be treated as “non-sustainable” and contrary to this policy. Outwith the National Park (as in this case) particularly important and vulnerable landscapes in Argyll and Bute are those associated with: 1. n/a 2. n/a 3. Landward and coastal areas with semi-wilderness or isolated or panoramic quality. B) n/a

STRAT DC 4 – DEVELOPMENT IN RURAL OPPORTUNITY AREAS

Within rural opportunity areas encouragement shall be given to small scale developments on suitable sites which in terms of siting and design will visually integrate with the landscape and settlement pattern; this may include small scale development in the open countryside as well as small scale infill rounding off redevelopment and change of use. Developments which do not accord with this policy are those with incongruous and unacceptable siting and design characteristics, including development resulting in undesirable forms of ribbon development or settlement coalescence.

'Mid Argyll Local Plan' 1985 (1st Alteration 1989 and 2nd Alteration 1993)

RUR 1 - The Council will seek to maintain and where possible to enhance the landscape quality of National and Regional Scenic Areas and Coasts and areas of local landscape significance and within these areas will resist sporadic or prominent development which would have an adverse environmental impact: (b) Regional Scenic Area – Knapdale/Melfort.

RUR 2 - Proposals for development in or affecting National Scenic Areas, Regional Scenic Areas and Coasts or areas of local landscape significance will require to be justified against the following criteria: (a) environmental impact (b) locational/operational need (c) economic benefit (d) infrastructure and servicing implications

HO 13 - In countryside outwith the inset maps … the Council is in favour of single or small scale residential development, providing there are no infrastructure, servicing or environmental constraints. Particular attention will be paid to infill, rounding off and redevelopment opportunities related to existing development and landforms.

Regard will be had to the principles set out in the Government’s Planning Advice Note 36 and proposals which promote undesirable ribbon development, are out of scale or cumulatively affect the character of an area detrimentally are likely to be resisted.

BE 16A - The Council will seek to achieve a high standard of design and layout for developments in the countryside. Proposals for new developments in the countryside should have regard to the Council’s published design guidelines.

'Argyll and Bute Local Plan' Modified Finalised Draft 2006

LP ENV 10 - DEVELOPMENT IMPACT ON AREAS OF PANORAMIC QUALITY Development in, or adjacent to, an Area of Panoramic Quality will be resisted where its scale, location or design will have a significant adverse impact on the character of the landscape unless it is demonstrated that:

(A) Any significant adverse effects on the quality for which the area has been designated are clearly outweighed by social and economic benefits of National or regional importance. Where acceptable, development must also confirm to Appendix A of the Local Plan.

In all cases the highest standards, in terms of location, siting, landscaping, boundary treatment and materials, and detailing will be required within Areas of Panoramic Quality.

Comment : Whilst the site lies within a area defined as an “Area Of Panoramic Quality”, this policy can only be given very limited weight as it has been the subject of representations as part of the local plan public consultation process, and will be the subject of consideration at the forthcoming Public Local Inquiry.

LP HOU 1 – GENERAL HOUSING DEVELOPMENT A) There is a general presumption in favour of housing development other than those catergories, scales and locations of development listed in (B) below. Housing development, for which there is a presumption in favour, will be supported unless there is an unacceptable environmental impact. B) There is a general presumption against housing development when it involves : 1. n/a – only relates to settlements 2. n/a – only relates to settlements 3. n/a – only relates to large and medium scale housing in the countryside 4. n/a – does not control small scale development in Rural Opportunity Areas, although if the case has an “unacceptable environmental impact” as in “A” above, then part A is relevant.

P/DCZ 4 – RURAL OPPORTUNITY AREAS (AREAS AND BOUNDARIES) The Local Plan Development Control Zone Maps define this site and all the land up to its south-eastern boundary as ‘Rural Opportunity Area’. Immediately beyond the site boundary, the zoning changes to “Very Sensitive Countryside.”

Comment: Whilst the policy relating to ‘Rural Opportunity Areas’ is set out in the adopted Structure Plan, these areas are to be given spatial expression by the emergent local plan. However, as the disposition of ‘Rural Opportunity Areas’ within Mid Argyll has been the subject of representations as part of the local plan public consultation process, and will be the subject of consideration at the forthcoming Public Local Inquiry, only very limited weight may be given at present to this designation and to the effect of Structure Plan Policy STRAT DC 4. Notwithstanding the current status of this policy, in any event it would not support development of this site as it would not be in line with the established settlement pattern in the locality.

LP ENV 19 - DEVELOPMENT SETTING, LAYOUT AND DESIGN

Requires a high standard of appropriate design in accordance with the design principles set out in Appendix A to the plan, the Council’s sustainable design guide and the following: - development shall be sited so as to pay regard to its context; - it shall integrate with its countryside setting and take into account the sensitivity of the area; - design shall be compatible with surroundings and particular attention to details shall be made in sensitive areas where the standard of design will require to be higher than in less sensitive locations.

Comment: This policy has not been contested as part of the local plan public consultation process and may therefore be accorded material weight.

B. OTHER MATERIAL CONSIDERATIONS

i) Site History

Application for one dwelling 01/00826/DET was withdrawn by the same applicants on the 28.09.01. This withdrawal occurred a few days before the case was due to be heard by Committee on the 03.10.2001 when it was to be recommended for refusal because of its prominent and isolated location, very similar to the position of the present proposal, which is just marginally closer to Loch Craignish..

Application for one dwelling 02/00236/DET was permitted on the 18.03.02. This application, also submitted by the same applicants but implemented to date, would provide them with a substantial well designed 2 storey dwellinghouse appropriate to the area both in design and location. This permission remains live until 17.03.07, and also in perpetuity if the permitted access or any other aspect of it is commenced before that date.

iv) Assessment

Applicant’s Supporting Information

The Applicant has submitted a statement in support of the application. It is stated that the current application is to allow Mr and Mrs Smyth (the Applicants) and their family to live in close proximity to Mrs Smyth’s parents (Mr and Mrs MacKay) who currently reside at, and work, Kintraw Farm. Mr MacKay has worked Kintraw Farm for almost 60 years and although he is now in his eighties and semi-retired he still actively manages a small flock of sheep of his own as well as maintaining the farming environment of Kintraw Farmlands which are presently rented out to neighbouring farmers for grazing purposes. It is the Applicants desire that they are able to reside in close proximity in order that they may assist with farm work if needed and to provide future nursing care if required and to allow Mr and Mrs MacKay to continue to reside at Kintraw Farm.

Description of development and comparison with the unimplemented permission 02/00236/DET

The dwelling lies some 85 metres further north than the position of the dwelling previously permitted (ref 02/00236/DET). It would occupy a location which is relatively high up on an attractive open hillside some distance from neighbouring roads and any property. In this more elevated location, unlike the permitted dwelling, it would not benefit from the same degree of tree cover at lower levels in order to help integrate it into its landscape setting. This property would be visible from roadside locations along the northern shore of Loch Craignish along the Ardfern road and by persons travelling south on the Oban – Lochgilphead road. In addition to the new site being out in the open, it also sits on higher land at 104.5 metres, some 5.5 metres higher than the ground associated with the permitted dwelling.

The access road to reach the proposed dwelling would be some 260 metres in length, where-as the permitted dwelling can be reached by a 85 metre long road. Both sites utilise the same first section of access to be taken from the same point on the A816.

The design of the current proposal has a two storey south elevation as would be seen from Barbreck and the northern shore of Loch Craignish. This face has a ground floor lined in vertical timber boarding, above which is a full first floor glass screen wall, in front of which is a full length balcony. The roof is hipped and aluminium clad. The property sits on a modest slope in this elevated location, so from the rear because of its split –level nature it appears in part one and a half storey and in part a hipped roofed bungalow.

The characteristics of this design are alien to this location, which coupled with its high visibility in the autumnal to winter months would make it an incongruous feature in the landscape due both to its uncharacteristic siting and design. In the summer months trees at lower level would have more leaf and screening effect, although the presence of a large dwelling will be evident, including parts of the upper glazed screen wall and the aluminium hipped roof. The size of the property is significant, some 13.5 metres long (the balcony is longer by some 2 metres) and a very wide 15.5 metres deep. Its height to eaves is 4.4 metres and to the top of the roof 6.8 metres.

For comparison, the permitted but as yet unimplemented dwelling lower down the slope and nearer the public road, would be screened to a large extent by mature deciduous tree cover, even in the winter months due to the depth of the planting. The approved dwelling was a traditional 2 storey

gabled and slated dwelling with appropriate wings and chimney. It approximates to a height of 5 metres to eaves and 8 to ridge, with a length of some 15 metres. Having a wing out the back its overall length is some 17 metres. The design of the approved dwelling reinforces the Argyll vernacular.

Members should note that a comparison has been made between the appearance of both sites within the landscape, in the light of poles erected on site by the applicant; and the application has been held in abeyance deliberately in order to allow a visual for visual assessment during both the summer and winter months (when trees are not in leaf).

Judged against policies RUR 1 and RUR 2 the assessment of the proposal is as follows:

a) Environmental impact.

The site of the proposed dwelling is in an elevated location on a hillside on the north-east side of the A816 public highway, opposite Kintraw Farm, Barbreck, Ardfern. The site lies within attractive open countryside and from its elevated position would be visible from Loch Craignish to the south- west, and from the A816 to the south as it drops into the Barbreck valley. By virtue of its elevation, the development site would also be conspicuous from the single track A8002 road to Ardfern along the northern side of Loch Craignish. The proposed dwelling is to be sited on the highest part of the application site where the ground levels rise steeply from the A816. The site is suggested by the applicant to be near that of a former dwelling; the ground is roughly level at this point and there are some stones and possible trace of a wall a little further to the north where an earlier withdrawn application was also considered. (There is, however, no conclusive visual evidence to show that a building existed at this point, and as there is nothing of visual substance today it is not possible for the applicant to present a case for this being considered as a redevelopment opportunity).

A dwelling erected at the proposed site would sit prominently within the surrounding landscape due to the elevated nature of the site itself, this would be inconsistent with the existing pattern of built development in the locality, where development is generally restricted to roadside sites at the foot of the valley hillsides or within the valley floor by ‘Barbreck House’. The surrounding higher land enclosing the head of Loch Craignish performs an important role in containing both development, and the roads serving that development, to the low lying land around the margins of, and at the head of the loch. Generally, there is no development of the upper slopes within this part of the valley, and the maintenance of higher ground free of built development contributes to the setting of Loch Craignish and the character of the surrounding landscape. With this in mind, the proposal would give rise to an isolated building visible over long distances in the autumnal and winter months, and also but to a lesser extent, in the summer (taking account of the presence of trees lower down the slope). The development would neither related to the farm cluster at Kintraw, nor consistent with the existing pattern of built development . The proposal would therefore give rise to an adverse impact upon the landscape to the detriment of this designated scenic area. Although the site lies within a ‘rural opportunity area’ (the disposition of which are contested in Mid Argyll, so little weight can be attached to this), in any event development in this location could not meet the requirements of this policy as the siting of the proposed building would not reflect nor reinforce the established settlement pattern in the locality.

b) Locational/operational need:

No detailed claim of agricultural need has been put forward in support of the application. As mentioned in the section above, the Applicant wishes to reside in close proximity to assist with farm chores at Kintraw Farm and to be able to provide future nursing care for the residents of Kintraw Farm. Such a desire cannot constitute an operational need in planning terms which would be sufficient to outweigh the adverse environmental impact that would result from such prominent and sporadic development within this designated scenic area.

c) Economic benefit:

There would be no direct economic benefit to the area as a result of this development, other than that arising from construction.

d) Servicing and infrastructure implications:

This proposal would utilise the access point previously accepted as being suitable for the dwelling which already has consent. It would be served by a private water supply and a septic tank and soakaway within the site.

The works required for the proposed subdivision and alteration of the building are considered acceptable in terms of adopted and emergent local plan policy in so far as they will not have an adverse impact upon the historic or architectural quality of the grade B listed building or the character and appearance of the Port Charlotte Conservation Area.

The Area Roads Manager has raised objection to the proposal on road safety grounds arising from inadequate off-street parking provision to serve the development. The proposal is contrary to the provisions of POL TR 5 of the ‘Islay, Jura and Colonsay Local Plan’ and LP TRAN 6 of the emergent ‘Argyll and Bute Local Plan’.

1. The application relates to a dwelling fronting onto a narrow road within a settlement where off-street parking is limited and on-street parking is at a premium, particularly during the tourist season. The property does not currently benefit from any dedicated parking provision, nor is any proposed as a consequence of this proposal. Appendix C – In normal circumstances, adequate off-street parking or communal parking should be provided adjacent to all new development to ensure that vehicles are not parked on the road where they may impede traffic flow or cause a hazard. A degree of flexibility will be available where:-

1. It can be shown by the applicant that the parking requirement can be met by existing car parks and that the demand for parking in connection with the development will not coincide with the peak demand from other land uses in the area.

5. Environmental considerations are of prime importance e.g. the development is in a conservation area.

6. There is a need for additional disabled parking to serve the needs of the users of the building.

It should be noted however, that before the parking requirement is reduced or increased it would have to be shown to the Council’s satisfaction that the development complies with one or more of the above criteria. Car Parking Standards: Houses (Use Class 9) and Flatted Dwellings:

• 1.5 spaces per 1 bedroom unit; • 2 spaces per 2-3 bedroom unit; • 3 spaces per 4 or more bedroom unit.

Assessments of the parking requirement for a particular development proposal will be rounded up to the nearest whole parking space.

B. OTHER MATERIAL CONSIDERATIONS

(i) Site History

A related application for listed building consent (ref. 06/01538/LIB) is pending determination by Historic Scotland; the Planning Department is of the view that the proposed works shall not have an adverse impact upon either the architectural or historic value of the property and has recommended to Historic Scotland that the proposal is consistent with the relevant provisions of the Development Plan and Historic Scotland’s Memorandum of Guidance and that accordingly listed building consent should be granted.

(ii) Consultations

• Scottish Water (11.08.06) – No objections subject to conditions and note to the applicant with regard to water and foul drainage connections.

• Area Roads Manager (08.11.06) – Recommends that the application be refused as no parking provision is provided for in the proposal. Concern is raised with regard to existing levels of on-street parking in the locale and the congestion that this creates which may in turn restrict access available to emergency vehicles.

(iii) Publicity

The proposal has been advertised for the purposes of Article 9 neighbour notification, as development in a conservation area and, as a ‘potential departure’ to the provisions of the Development Plan; expiry date 26th January 2007. To date, no letters of representation have been received.

(iv) Assessment

The proposal is a detailed planning application for alterations to a two storey dwellinghouse, located within a category B listed terrace in the Port Charlotte conservation area, to form two flatted residential flats. A separate application for listed building consent (ref. 06/01538/LIB) has also been submitted.

Alterations to the external appearance of the property are minimal and include: removal of existing uPVC front door and installation of traditional timber storm doors; replacement of three existing rooflights and, installation of four additional conservation type rooflights; replacement of 9 pane timber sash and casement window on the rear elevation with a 2/2 pane timber sash and casement window to match remaining units which will be overhauled and retained; installation of new door opening and timber door for boiler room and a balanced flue. It is considered that the proposal wouldl not adversely affect the architectural or historic value of the category B listed building, or the character or appearance of the Port Charlotte Conservation Area. With regard to impact upon the built/historic environment, the proposal is considered to be consistent with the provisions of polices BE 1A and BE 3 of the Islay, Jura and Colonsay Local Plan (1st review) 1988 and draft policies LP ENV 13a and LP ENV 14 of the emergent Argyll and Bute Local Plan.

Water shall be by connection to the public water main; foul drainage shall be to the public sewer. Scottish Water have not raised any objections subject to the imposition of a suspensive planning condition with regard to obtaining consent for the necessary connections prior to the commencement of development.

The existing six bedroom dwellinghouse does not have any off street parking provision; current roads standards would set a parking requirement of a minimum of three parking spaces for such a property. The proposed sub-division of the property would create a two bedroom ground floor flat and a four bedroom maisonette upper floor flat. The combined parking requirement these two units, in accordance with Policy LP TRAN 6 and Appendix C of the emergent ‘Argyll and Bute Local Plan’, would be five off-street parking spaces. Given that the existing property currently has no off-street parking provision then the expectation in this particular case would be for the additional parking requirement to be met, i.e. two off-street parking spaces. From the details submitted, the applicant does not have any land in their control which is suitable for the provision of any off street parking space. Although the policy recognises that there may be exceptions in conservation areas, where the provision of parking spaces would prejudice the maintenance of the character of a conservation area, such a concession would only be appropriate in the event of readily available on-street parking space, which is not the case in this instance.

The Area Roads Manager has raised objections to the proposal on the grounds of road safety on the basis that, in the summer months, there is presently insufficient on street parking available to serve existing development in Port Charlotte. He considers that an intensification in the requirement for on street parking in these circumstances would exacerbate existing congestion and impede access by service and emergency vehicles.

It is recommended that permission be refused for the reasons set out in the report.

(C) DETERMINING ISSUES AND MATERIAL CONSIDERATIONS

This application relates to a small, single storey terraced dwellinghouse situated within the Port Wemyss conservation area. The property has an existing flat roofed single storey rear extension and it is proposed to add a conservatory extension onto the end of this existing rear projection, resulting in a total projection from the rear of the original dwelling of 6.5 metres. The proposed conservatory together with the existing rear extension would almost double the depth and footprint area of the original dwellinghouse.

Although the proposed conservatory extension is at the rear of the dwellinghouse, the rear amenity areas of the houses in this part of Chrome Street are unfenced and open to view from Shore Street through a wide ‘gap’ between two existing properties. The proposed extension would have a prominent impact when viewed from this section of the public highway, and would not secure an acceptable relationship with adjoining dwellings in terms of privacy.

The proposal is contrary to development plan policy as firstly, it is would result in extensions which are disproportionate to the original dwelling, involving an extension which is not complementary to original building and is uncharacteristic of the conservation area both in terms of scale and design, and secondly, in view of the fact that it would have adverse consequences for the privacy and amenity of adjoining dwellings.

1. The proposed erection of a rear conservatory extension will have an unacceptable impact upon the character and appearance of this part of the Port Wemyss conservation area due to its size, and its combined impact together with the existing rear extension, over and above the size and scale of the original dwellinghouse; and also in view of its unacceptable design and external appearance using modern materials and detailing. The proposed development, by virtue of its design characteristics and the use of uPVC/polycarbonate materials, would not be complementary to the character existing property, nor would it preserve or enhance the character of the conservation area. The proposed development would therefore be, contrary to Policies BE 4 and BE 11A of the adopted ‘Islay, Jura and Colonsay Local Plan’ 1985 (First Review and Alteration 1988), and to Policies ENV 14 and ENV 19 of the emerging ‘Argyll & Bute Local Plan’ (Modified Finalised Draft) June 2006.

2. The cumulative impact of the current proposal and the previous extension is such that the footprint area of the original single storey cottage would be virtually doubled, resulting in extensions which would be disproportionate to the scale of the original dwelling. A conservatory located as proposed would have the potential to significantly affect the privacy and amenity of adjacent residential properties by virtue of overlooking of adjacent properties and their associated unfenced rear amenity areas. The proposed development is, therefore, contrary to Policy HOU 5 of the emerging Argyll & Bute Local Plan (Modified Finalised Draft) June 2006, which seeks to ensure that domestic extensions should be complementary to original buildings in terms of scale and design, and should not impinge on the privacy or amenity of adjoining dwellings.

(a) to prevent any deterioration in the character or setting of the designated area through unsympathetic new development, changes of use, demolitions, extensions or alterations to buildings and structures, many of which do not normally require planning permission.

Policy BE 11A – The Council will seek to achieve a high standard of layout and design where new developments are proposed. Proposals for new development should have regard to the Council’s published design guidelines.

Argyll & Bute Local Plan (Modified Finalised Draft) June 2006

Policy ENV 1 – “Development Impact on the General Environment.” - In all development control zones the Council will assess applications for planning permission for their impact on both the natural, human and built environment. When considering development proposals, the following general considerations will be taken into account, namely:

(B) Likely impacts, including cumulative impacts, on amenity, access to the countryside and the environment as a whole and in particular, the designated sites listed in (I) and (J) of this policy statement.

C. ASSESSMENT

The proposed extension wouldl have an unacceptable impact upon the character and appearance of this open and relatively prominent location within the Port Wemyss conservation area, due to its size and combined impact together with the existing rear extension, over and above the size and scale of the original dwellinghouse. There is a policy presumption that domestic extensions should be subordinate to original dwellings whereas this conservatory in addition to the existing kitchen and bathroom extension will result in an almost flat roofed rear extension some 6.5 metres in length. The cumulative impact of the current proposal and the previous extension is such that the footprint area of the existing single storey cottage would be virtually doubled in size.

The proposed uPVC / polycarbonate materials are not considered complementary to the existing property. Due to its unacceptable design and external appearance using modern materials and detailing, the proposed conservatory would not serve to preserve or enhance the character of the conservation area. It would therefore be materially harmful to the historic and architectural character of this sensitive location, and would not meet the council’s statutory duty under Section 64 of the Planning (Listed Buildings and Conservation areas) (Scotland) Act 1997 to safeguard conservation areas from inappropriate development.

In addition, although there have been no objections received from occupiers of neighbouring properties, it is considered that the proposed conservatory would have the potential to significantly affect the privacy and amenity of adjacent residential properties by virtue of overlooking of unfenced rear amenity areas and direct overlooking between windows.

ISLAY HIGH SCHOOL: ACHIEVEMENT REPORT 2006

1. SUMMARY

A report on the performance of all Argyll and Bute pupils in the Scottish Qualifications Authority (SQA) examination results was presented to the Strategic Policy Committee on 16 the November 2006.

This report, presented by the Head Teacher, Dr Liz Cunningham, outlines the major achievements of the school in 2005/6 and includes the SQA examination results for pupils who sat examinations in May/June 2006. The results are based on pre-appeal data.

2. RECOMMENDATIONS

The Area Committee are asked to note the continuing improvement in the performance of pupils and the commitment of staff in their examination successes and in the wider aspects of achievement across the school.

Islay High School Report on Achievement, 2005-2006.

Introduction

Last session was a very successful, but challenging year, for Islay High School as we embarked upon the Schools of Ambition initiative and the wide-ranging changes associated with this.

The academic achievement of many of our students was excellent in several curricular areas. Of particular note is the achievement of students with Additional Educational Needs. Each of these students achieved success in the examinations they sat.

We further developed our provision in areas such as health, enterprise and vocational studies, eco issues, sport, music, ICT and leadership skills.

Our agenda for 2006 /7

Schools of Ambition Initiative – 4 main strands: Curriculum Structures; Vocational Centre; ICT provision and Leadership Skills.

This session we have introduced our new curriculum structures: S3 – S6 choose from a wide menu of courses; each course is 5 periods per week and of 1 year in duration. Our on-site vocational centre, comprising a fully functional hairdressing salon and a construction workshop, is up and running offering SQA Skills for Work courses in Hairdressing and Construction Crafts .

Our already successful Enterprise and Vocational skills option has expanded – we now have 20 student on placements who are working on SVQ level 1 courses /units in a diverse range of areas eg. Customer Care, Manufacturing etc.

We have greatly enhanced our ICT provision; all departments/faculties have access to data projectors and interactive whiteboards. All teaching staff have tablet PCs and our aim is to provide every student with an Origami UMPC by the beginning of next session. The school is fully wireless networked. We have 2 areas which are equipped for whole class use of computers – bookable by staff. Our partnership with Microsoft guarantees us a minimum of £45,OOO of appropriate software by the end of the Schools of Ambition project.

The development of leadership skills has been and will continue to be an area of focus for all in Islay High School. Our 6th year students undergo a programme of induction which includes Peer mentoring; Events Management and Leadership. Page 49

The 6th year students plan and have full responsibility for all dances, Charity Events, and Inter-House activities. All students have the opportunity to plan and take part in projects which benefit various charities or the local community. e.g. an S1 group raised £170 by doing a beach clean and donated the money to IDEAS; another group are renovating the School garden. Staff have undergone extensive training in Leadership styles and strategies. All staff have opportunities to lead projects.

Our aim is to help all in Islay High School to be confident and compassionate individuals who fulfil the capacities as outlined in A Curriculum for Excellence.

Last session we introduced a Healthy Breakfast Club which runs 2 mornings a week and is free to students. Upwards of 40% of our students use this facility. We see a marked improvement in behaviour referrals. This session we have introduced an out of school hours Healthy Cooking Club – again this is very well attended. In order to help finance both of these we have formed a partnership with Islay Healthy Living Centre and local businesses. We will be applying to be assessed as a ‘Health Promoting School’ this session.

Our focus is upon effective learning and teaching and for this we rely upon the skills and abilities of the staff – teaching and support staff alike. Accordingly we place great importance upon the professional development of all staff. The success of this is shown by our ability to fully include those with very complex needs in both the curricular and the wider life of the school.

Attainment

Over the last two years we have introduced a range of strategies to encourage our students to raise their expectations and attainment. These strategies encompass work within and outwith the classroom.

Attainment remains steady; however we hope that the new vocational courses and range of courses from access 3 to advanced higher will better meet the needs of our students from the academic to the less so. A number of our departments perform consistently well: PE, Music, Home Economics and Physics. Other departments are presenting a steady or improving picture.

In addition, the government’s National Priorities for Education framework, requires reporting on the cumulative successes of pupils by the end of S6. This analysis adds together all examination achievement of all pupils by the end of S6, i.e. an addition of all successes achieved in S4, S5 and S6. The measure is a three-year average, 2003-2006.

Other achievements

Sporting Activities

We offer a wide range of sporting activities for boys and girls –football, rugby, basketball, table tennis, netball, dance club, and keep fit, swimming and Heart Start.

Our regular ‘school run’ raises a large amount of money to help finance trips for those involved in sport. Last session we raised almost £1900 pounds.

Our Activities Days involve a wide range of activities fly fishing; cycling around Colonsay; beach and woodland walks followed by a barbecue, hillwalking and overnight camping in Jura. Horseriding, festival of sport and many more. Every child in the school opts into a selection of these activities.

Mental sports include a Chess Club (staff and students); a Fantasy Football League (students and staff); Smart Club, Reader’s Group (staff and students) and MouseClub

Space school is another option. Two of our students have had notable success with this. Christopher Bermingham who was invited to N.A.S.A . Space School in Houston, USA Lindsay Smith who was asked to join the Scottish Space School.

Musical Delights

Our bands get better and better; we have introduced a band which is comprised of primary and secondary. Our choir (staff and pupils) is ever improving . Our recent Christmas concert was the best ever. The number of students receiving piping tuition is steadily increasing. Our pupils achieve success in both local and national events.

Our ever popular musical panto was a complete sell out this year.

Ileachs Abroad

Our Swedish exchange (staff and students) continues –our students visit Sweden in late August: Swedish students visit us in early June. Swedish staff arrive in October and our staff go to Sweden in April.

Islay High School’s first ever Ski- trip takes place in February. A group of staff and students are setting off to Pila –well-equipped with conversational Italian.

Currently we are negotiating an exchange with an island school in Paris.

Culture and Values

Our Culture and Values team (comprised of students, staff, parents and faith representatives organise and host opportunities for Religious Observance, conferences and discussion groups.

In the autumn term we embarked upon a major consultation exercise with staff and students to refresh our core values and confidences. Parental Consultation is scheduled early in February.

Students and staff work closely to create and maintain the positive ethos of which we are very proud. Visitors to Islay High School comment upon the positive interaction between staff and students.

Last Thoughts

It is impossible to describe all that happens in our school. I am amazed that a school of our size can offer such a range of activities and projects, curricular and non-curricular. However I am most proud of the care, concern and compassion that students and staff display for each other and for those in the wider community

Appendix 1: Comparator Schools

This is the group of the most similar schools across Scotland. The list is derived from Principal Component Analysis (PCA) which recently replaced the previous analysis based solely on free school meal entitlement (FME). The components of PCA are: free meal entitlement; the percentage of households whose mothers have degrees; the percentage of households where the head of household has never worked; the percentage of the lowest 15% of achievers nationally are in the school; the number of pupils with additional support needs and the number of pupils living in large city areas.

TAYINLOAN PIER 7 FEBRUARY 2007

1. SUMMARY

The purpose of this report is to advise Members of the Area Committee of the problems encountered at Tayinloan and potential solutions.

2. RECOMMENDATIONS

The Area Committee is asked to note the contents of the report.

3. BACKGROUND

3.1 The Council were made aware of problems with an accumulation of sand, silt and weed at Tayinloan on 24 November 2006 that prevented safe access for the Gigha ferry. This had resulted from southerly gales sweeping up the Sound of Gigha. Immediate contacts were made with a dredging company but the earliest they could mobilise to site was 7 December 2006. In the meantime, a long reach excavator was sourced but was unable to achieve any meaningful result due to the sea swell.

3.2 Subsequent gales continued to make the dredging operation difficult but the vessel was retained in the area and in between storms it returned to site and did effect a dredged channel to allow the ferry access. Unfortunately this also coincided with the Christmas break and further stormy conditions such that the sand was swept back into the berth and formed a bar at the western end of the aligning structure. Dredging works recommenced on the 8 January 2007 and close liaison with Calmac allowed some access that identified problem areas which were then addressed. The ferry service resumed normal service on 16 January 2007 and although the dredger was retained locally, the owners are scheduled to undertake work on behalf of Calmac in Oban.

3.3 It is relevant that Members should be aware that whilst problems have been encountered at Tayinloan in previous years, they have never been quite so serious. Calmac did undertake to provide a service between Gigha and Kennacraig running two ferries which had limited success due to the inability to utilise the linkspan at all stages of the tide.

3.4 Calmac have brought down the M V Raasay from the Tobermory to Kilchoan route. As this is a twin screw vessel, it has proved to be more able to cope with the weed than the normal vessel on this route but has a much smaller Page 58

capacity. This may provide a short term solution but reports are that the weed continues to collect in the sea area around Tayinloan and whilst the Council are criticised for using a dredger that is considered inadequate despite previous successes, the alternative is to employ a hopper dredger which requires a dumping at sea licence that takes approximately two months to acquire and may operate at a much slower rate depending upon where the approved dump site is located. It may be that the nearest suitable dump site is Port Ellen where the water depth is sufficient to accommodate the dredged material. It is also worth noting that hopper dredgers are not readily available.

4. Potential Solutions

4.1 A geomorphological study to determine the tidal flows north and south of the present breakwater could verify the premise that the stormy weather has dislodged the kelp and is driving it up the coast on the flood tide and back down on the ebb. The breakwater effectively operates as both a shelter for the ferry and as an obstruction to the tidal flow. It causes an interruption to the flow and allows the deposition of the sediment. There are two forms that such a study, either a desk top or a site based study. The estimated costs for the desk study obtained from an independent consultant in this field are approximately £5,000 for a desk study and £15,000 for a site study.

4.2 Informal discussions with this independent consultant have given consideration to introducing large diameter pipes within the breakwater to allow the tides to flow without being interrupted. This would need to be modelled to ensure that the correct engineering and hydrological outcomes were achieved but the idea is entirely feasible. Linked to this, is the ferry and the type of propulsion. The Loch Ranza vessel used on this route uses Voith Schneider units and these do have a tendency to clog up when sailing through weed seriously reducing their efficiency. If, as suspected, weed continues to be a problem for this area of sea, then it would be appropriate to approach Calmac with a view to using a vessel such as the M V Raasay that has twin screwed propulsion.

4.3 An alternative to this would be to extend the rock armour breakwater out into the Sound and form an arc thereby providing a sheltered approach for the ferry. Again, the design would have to be modelled to avoid the risk of a repeat of present conditions in another twenty years time. This would possibly give the most cost effective solution with relatively little maintenance.

4.4 A third solution would be to install a steel sheet piled structure. These forms of construction are very common in the marine environment and if cathodic protection is designed and applied from the outset, should give long service with minimal maintenance costs. However, it should be noted that in keeping with other marine installations in Argyll, it is likely that a rock armour breakwater would have to be constructed on the seaward side to dissipate the wave energy in storm conditions. This would add considerably to the overall cost of the scheme.

5 Funding

The Scottish Executive and the Transport Minister, Tavish Scott, are already aware of the problems being faced by the Gigha community due to the difficulties encountered at Tayinloan. The local MP and MSP’s have expressed a keen interest hat a solution is found and implemented such that the long term future of the island community is not damaged. The size of scheme required to effect a permanent solution here is such that Revenue funding is not a viable option. The dredging undertaken to date has been funded from this source. The Council have committed to promote a scheme which will have to be incorporated into the Capital allocation. Once a design solution has been approved an application can then be made to the Scottish Executive for a Piers and Harbours Grant that may contribute up to 75% of the scheme costs although this is open to all Authorities across Scotland and the percentage award may be limited. Other funding sources could include the Highland and Islands Enterprise and HiTrans.
