D66 morrelt aan vrijheid, democratie en burgerrechten Door Coen de Jong - 7 maart 2020 Geplaatst in D66 - Democratie D66 werpt zichzelf graag op als de hoeder van de rechtsstaat, de vrijheid en de democratie tegenover het oprukkende populisme. Vicepremier en minister van Binnenlandse Zaken Kajsa Ollongren sprak in 2018 in een lezing: ‘Het populisme wil sommige Nederlanders anders behandelen dan andere. En daarmee bedreigt het kernwaarden van Nederland’. Woorden gericht aan het adres van oppositiepartij Forum voor Democratie. D66 wilde bij oprichting een alternatief zijn voor het vermolmde Nederlandse partijstelsel. D66 stond voor bestuurlijke vernieuwing, inspraak van de burger in plaats van handjeklap tussen verzuilde elites en voor het kiezen van burgemeesters. Directe democratie, zoals via referenda, stond ook hoog aangeschreven. En D66 zag zichzelf als vanaf het begin in 1966 pragmatisch en later tevens als ‘redelijk alternatief’. Het hoogtepunt van D66 waren de ‘paarse’ coalities in de jaren negentig waarbij D66 het CDA uit de regering wist te houden. Maar in 2006 wist lijsttrekker Alexander Pechtold – geen succes als minister van Bestuurlijke Vernieuwing – met moeite drie Kamerzetels te halen. Maar de redding was nabij. Pechtold positioneerde D66 tegenover de PVV en Geert Wilders, wat hem populair maakte bij journalisten én progressieve kiezers. Deelname in 2017 aan Rutte-3 betekende voor D66 de terugkeer in het centrum van de macht. Alleen: van de oorspronkelijke principes en van bestuurlijke vernieuwing hoorden we niets meer. Integendeel, het raadgevend referendum sneuvelde uitgerekend met Kajsa Ollongren op Binnenlandse Zaken. Mr. Bill Browder: the Foundation of Magnitsky Law and the Case of the US
Symposium on Sanctioning Human Rights Violations: Magnitsky Laws in the World – Lessons Learned1 A Joint Symposium with Human Rights Watch and the University of Tokyo International Law Training and Research Hub Session 1 (12 March 2021, 18:00-21:00) The Symposium was opened by Professor Ai Kihara-Hunt, emphasizing its importance as a the first ever symposium on Magnitsky Laws in Japan. It aims, first, to spread awareness on the Law by sharing lessons learned from the adoption of Magnitsky legislation in other countries, and second, to provide space for discussions on the merits of enacting such legislation in Japan. Ms. Kanae Doi, Japan Director at Human Rights Watch, provided opening remarks by stressing the importance of remembering the legacy of the Magnitsky Act. She highlights that one of the fundamental merits of such legislation is that because it uses targeted sanctions against specific human rights abusers, it is able to avoid the highly political notion of sanctions that tend to affect relations between governments. She also underscored that Japan must implement Magnitsky Laws to be able to respond to human rights violations in Myanmar, Hong Kong, the DRC, and other parts of the world. She notes, “there are human lives being torn apart and people that should be held accountable.” Mr. Bill Browder: The Foundation of Magnitsky Law and the Case of the US Co-founder and CEO of Hermitage Capital Management, Mr. Bill Browder is well-known as a pioneer and primary advocate of Magnitsky legislation. He started the panel presentations by sharing his personal background and how large-scale corruption in Russia, where the investment fund management company he co-founded maintains an office in, has motivated his advocacy for global human rights legislation. -

As you may be aware, on 5 August 2019, the Law Society hosted a Thought Leadership panel titled 'A Magnitsky Act for Australia — Human Rights Bombshell or Frankenstein's Monster?' featuring Emeritus Professor Graeme Gill, Senator Kimberley Kitching, Jeremy Moller and Pauline Wright. The Law Society is pleased to be able to continue its contribution to consideration of this important issue in Australia. The Law Society's Human Rights Committee has contributed to this submission, which addresses each of the Inquiry's terms of reference. 1. The framework for autonomous sanctions under Australian law, in particular the Autonomous Sanctions Act 2011 (Cth) and the Autonomous Sanctions Regulations 2011 (Cth) Australia currently applies two types of sanctions. The first of these are United Nations Security Council sanctions, which Australia must impose as a member of the UN. These are primarily implemented through the Charter of the United Nations Act 1945 (Cth) and its regulations. The second type are autonomous sanctions, which are imposed through the Autonomous Sanctions Act 2011 (Cth) ("ASA") and the Autonomous Sanctions Regulations 2011 (Cth) ("AS Regulations"). -

1 2 INTRODUCTION TO THE PUBLICATION: “Albania´s bilateral relations: foreign policy challenges and opportunities” outheast Europe and especially its part of the so-called “Western Balkans” is in public opinion generally regarded as a key geostrategic region, but still also perceived as some area of remain- ing open or hidden local tensions and neighbor- hood-conflicts due to the continuity of diverse political or religious identities, ideologies and in- terests. Such obvious political or mental factors, mainly caused Sby partial still existing intolerant mind-set, misperception and prejudice-pattern, could lead to some further stagnation or delay of some necessary reconciliation and cooperation pro- cess and could over this provoke the danger of maintenance or recurrence of populism or nationalism. In consequence such a possible scenario would have decisive influence on regional stability of the “Western Balkans”. Basic precondition for development and peace in that frag- ile region are communication and cooperation between all relevant Western-Balkan-6 neighbor-states (WB-6), such as Albania, Serbia, North-Macedonia, Montenegro, Kosovo and Bosnia-Herzegovina, as it is manifested and proclaimed in the “Berlin-Process” agenda. Such an interactive approach obvi- 3 ously corresponds to the renewed “Enlargement-Strategy” of the European Commission from February 2018, to guarantee the “EU-Thessaloniki-promises form 2003”, if the Western Bal- kan States are really ready to solve their problems in a cooper- ative consensus also by themselves in “Regional Ownership”. According to the processes of political decision-making there should not be any doubt about the fact, that construc- tive neighborhood-relations and regional cooperation of the WB-6-states need as basic pillars mutual understanding and widely common interests. -

The United States has imposed sanctions on Russia mainly in response to Russia’s 2014 invasion of Cory Welt, Coordinator Ukraine, to reverse and deter further Russian aggression in Ukraine, and to deter Russian Specialist in European aggression against other countries. The United States also has imposed sanctions on Russia in Affairs response to (and to deter) election interference and other malicious cyber-enabled activities, human rights abuses, the use of a chemical weapon, weapons proliferation, illicit trade with North Korea, and support to Syria and Venezuela. Norway and other democratic countries should establish global Magnitsky mechanisms No. 2-2015 Norway and other democratic countries should establish mechanisms to freeze the assets of persons who commit gross violations of human rights with impunity and prohibit their entry into the country – the victims of these violations being human rights defenders or whistle-blowers. The mechanisms may resemble the current US Magnitsky legislation, however without being limited to Russian citizens. They should include strong safeguards in order to ensure fair treatment. The US Congress is currently debating a Global Magnitsky Human Rights Accountability Act, which will broadly function along the same lines as the mechanisms proposed here. Norway should seek to influence other democratic countries to establish similar mechanisms. If a large number of democratic states establish such mechanisms, it would represent an important breakthrough in the fight against impunity for gross human rights violations. Norway aims to promote respect for human rights, rule of law and democracy in its foreign policies. In White Paper 10 (2014-2015), Opportunities for All: Human Rights in Norway’s Foreign Policy and Development Cooperation , the Norwegian government states that it is “concerned by the fact that human rights are coming under increasing pressure worldwide. Human rights are the foundation of freedom, justice and peace in the world.” (Page 7). 1 The White Paper points out that one of the main challenges is that many states violate rule of law principles, the right to life and the prohibition against torture. It also points to the often-difficult situation of human rights defenders. Along with widespread corruption and tax crimes, these are issues central to the so-called Magnitsky case. -
