Dear Mr. Lauby:

The Town of Hamburg, located in Erie County, New York is hereby issuing this "Notice of Quiet Zone Establishment" for the creation of a New 24 hour Quiet Zone at the CSX railroad crossings located on Rogers Road and Cloverbank Road (USDOT Grade Crossing Inventory Nos. 519502A and 519501T). With the 21 day minimum period following the mailing of this notification, the Quiet Zone is to go into effect starting on Tuesday, June 24, 2014.

This Quiet Zone has been established by public authority designation, under the Federal Railroad Administration (FRA) Train Hom Rule [49CFR Part 222.39(a)(1)]. A signed copy of the FRA web page containing the quiet zone data upon which the Town is relying is enclosed (see Attachment 1). The "Notice of Intent to Create a Quiet Zone" under this project was issued by the Town on January 3, 2014, and sent by certified mail to all appropriate parties. The only response received in this regard was from CSX Transportation (CSXT), in which it was stated that CSXT did not have any comments on the Notice ofIntent (copy of 1/22/14 correspondence enclosed-see Attachment 2).

Also enclosed are the Grade Crossing Inventory Forms for the referenced crossings, reflecting the conditions at the crossings prior to and following the modifications that have recently been made to establish the Quiet Zone (see Attachments 3 & 4). Supplemental Safety Measures in the form of mountable medians with reflective traffic channelization devices were installed along the centerline of the approach highways at both crossings in conformance with FRA regulations in this regard.
