FOI Request 85110 – Affordable Housing / Section 106 monies / CIL income

This is a response to the following FOI Request:

Could you provide details of the number of Planning Applications to City Council since 2012 (on developments that number more than 10 units per development/planning application) that as a consequence of "commercial viability" arguments or other reasons stated has resulted in either

(a) affordable social housing provision being reduced or removed. Additionally please detail planning guideline totals of what affordable housing should/could have been built versus actual realised totals of affordable housing units built per year since 2012;

Policy BCS17 of the Council’s Core Strategy requires the provision of affordable housing on schemes of 15 or more dwellings, and the Council keeps records on this basis. The policy requires up to 30% or 40% affordable housing (depending on the area of the city) subject to scheme viability. The following table contains the percentage of affordable housing secured through Section 106 Agreements from development of over 15 dwellings since 1 January 2012. It should be noted however, that since 2013 there are certain types of application for major housing development that the Council is unable to seek affordable housing from. These relate to schemes to convert offices to residential accommodation (prior notification consents) and under government regulations affordable housing cannot be sought from these schemes. A significant number of prior notification consents have been granted, including on large office buildings in the City Centre (eg Lewins Place) many of which are planned to be converted to in excess of 15 dwellings. The following table excludes such schemes.

(b) where section 106 monies have been reduced (on developments that number more than 10 units per development/planning application) since 2012 on developments across the City of Bristol please detail the total amount of the reductions versus the expected amount under planning rules that could have been collected;

There are no cases in Bristol since 2012 where Section 106 monies have been reduced. It should also be noted that CIL was introduced in Bristol on 1 January 2013, which has resulted in the use of Section 106 being significantly scaled back, as Section 106 contributions to general Parks, Library, Education and Public Transport improvements have been replaced by CIL. c) please provide the annual total figure for receipts of CIL since its introduction for planning applications made to Bristol City Council, the amount that has been devolved to each neighbourhood partnership with their current total of unspent CIL per neighbourhood partnership;

d) where Open Book conditions have been placed on developments please detail which developments since 2012 have had these conditions placed on them, please detail how many developments since 2012 have had their books reviewed since completion and since sales of all units have been completed, how much the profits differed from those put at the time of the planning application under commercially viable arguments, how much money Bristol City Council has received as a consequence of the Open Book conditions showing a profit. Please where possible give details of these benefits if received.

For clarity (for anyone who is unaware of the planning condition of having an Open Book) please can you provide an explanation of what the condition is for, what purpose it serves, how it benefits Bristol City Council, what powers it gives the Planning Department, how the citizens of Bristol benefit from such a condition being placed on an approved development.

There are no cases in Bristol since 2012 where Open Book conditions have been placed on developments. The RICS Guidance on Financial Viability in Planning, which was published in 2012, is clear that such conditions are not appropriate and that overage clauses should not be required. Any viability reviews in respect of large scale phased development are to be undertaken prior to commencement of the relevant phase. The RICS guidance can be found at the following weblink:

e) Please provide details of any unspent monies being held by BCC from Section 106 monies for each ward with details of what they monies are to be spent on with any expiration dates for spending the money.
