INTRODUCTION THE recently enacted Amendments to the International Claims Settlement Act of 1949' provide, among other things, a method of compensating American nationals, at least partially, for the national- ization or other taking of their property in Bulgaria, Hungary and Rumania. These Amendments establish a claims program for the benefit of American nationals, not only for the partial compensation of national- ization claims against the Governments of Bulgaria, Hungary and Rumania, but also for (1) war damage, and pre-war governmental debt (bond) claims against the said three Governments; (2) claims against the Government of Italy arising out of the war and not other- wise provided for in the Italian peace treaty; and (3) claims against Russian nationals secured by liens on certain assets prior to the NICHOLAS UJLAxi is a member of the Alumni Advisory Board of the NEW YORK LAW FORUm. 1 An Act to amend the International Claims Settlement Act of 1949, as amended, and for other purposes. 69 STAT. 562. NEws, No. 14, 3912-3928 (August 20, 1955) The draft legislation was introduced in the House of Representatives as H.R. 6382 on May 19, 1955, and passed the House on June 23, 1955. Hearings before the Senate Committee on Foreign Relations began on July 8, 1955, and were concluded on July 14, 1955. The Committee, after approving certain changes in the bill, voted without ob- jection, to report it favorably to the Senate on July 19, 1955. Cf. NEWS, No. 14, 4189-4203 (August 20, 1955). 266 NEW YORK LAW FORUM [VoL. 1 Litvinov Assignment, and other claims arising prior to November 16, 1933, against the Soviet Government Settlement of such claims out of assets available to the Government of the United States is long overdue, and legislation to the same effect was under consideration for a rather long period of time.3 In connection with claims against Bulgaria, Hungary and Ru- mania the law authorizes the vesting and liquidation of currently blocked assets of the Governments of said countries, and of their nationals, other than natural persons. The background of these pro- visions is, that: "in the peace treaties of September 15, 1947 the Governments of Bulgaria, Hungary and Rumania undertook to re- store American owned property in their respective countries or else provide compensation to the extent of two-thirds of the war damage suffered by it. These undertakings have not been honored. Nor have American owners been compensated for property which was national- ized or otherwise taken subsequent to the date of the peace treaties.4 Other obligations to American nationals likewise remain unsatisfied. Under the terms of the peace treaties (Art. 29 of the treaty with Hungary is typical) 5 it was provided that assets in the United States belonging to the three Governments or their nationals might be seized 2 Cf. All Hungarian property, or the proceeds thereof, in excess of the amount of such claims, shall be returned." Cf. INT'L LAw 273-300 (1947). 1955] NATIONALIZATION OF AMERICAN PROPERTY and liquidated, and the proceeds used for such purposes as the United States might desire 'within the limits of its claims and those of its nationals, including debts, other than claims fully satisfied under other Articles of the present Treaty'."6 It appears that while the use of said assets to compensate war damage and certain unsatisfied pre- war obligations is expressly within the peace treaties, the utilization of such assets to compensate American owners for property national- ized or otherwise taken subsequent to the date of the peace treaties is the result of an extended interpretation of the treaty provisions.7 Said extension, even if somewhat retaliatory in its character, is entirely in accordance with the well established principle of American law, that no government is entitled to take "private property for whatever reason without provision for prompt, adequate and effective payment therefore"." In the same matter the Secretary's note of July 21, 1938 (III HACxWORTH, p. 656) states: "If it were permissible for a government to take the private property of the citi- zens of other countries and pay for it as and when, in the judgment of that govern- ment, its economic circumstances and its local legislation may perhaps permit, the safe- guards which the constitutions of most countries and established international law have sought to provide would be illusory. Governments would be free to take property far beyond their ability or willingness to pay, and the owners thereof would be without recourse. We cannot question the right of a foreign government to treat its own nationals in this fashion if it so desires.. This is a matter of domestic concern. But we cannot admit that a foreign government may take the property of American nationals in dis- regard of the rule of compensation under international law. Nor can we admit that any government unilaterally and through its municipal legislation can, as in the instant case, nullify this universally accepted principle of international law, based as it is on reason, equity and justice." 0 The nationalization and expropriation laws recently enacted by the satellite states (see note 12, infra) either contain a provision for compensation or state that future legislation will provide for compensation, and, on the face of it, in most cases, there is no confiscation. The statutes speak of nationalization or expropriation and do not seem to differ in that respect from the corresponding law of the Western countries.

The first known civilization in the region was that of the Thracians, whose culture reached a peak in the sixth century B.C. Because of disunity, in the ensuing centuries Thracian territory was occupied successively by the Greeks, Persians, Macedonians, and Romans.     Euroization in Central, Eastern and Southeastern Europe – First Results from the New OeNB Euro Survey Sandra Dvorsky, This article presents the main results of a new OeNB survey on foreign currency holdings, Thomas Scheiber, which was conducted for the first time in late 2007 in four Central and Eastern European Helmut Stix (CEE) as well as seven Southeastern European (SEE) countries. The most important questions asked in the survey pertain to the currency composition and the amounts of foreign currency cash holdings and foreign currency deposits as well as to the motives for holding foreign cur- rency cash and deposits. The authors conclude that the euro plays a dominant role in foreign currency-denominated assets (both cash and deposits) throughout the region. 1 Introduction In Central, Eastern and Southeastern Europe (CESEE), the use of foreign curren- cies in general and of the euro in particular is a widespread phenomenon that is also referred to as euroization2 in the literature. There are several reasons for euroization, some of which relate to a country’s past (e.g. the erosion of confi- dence in the national currency owing to political and economic turbulences), while others possibly relate to its present or future situation (e.g. close economic ties with the euro area, migration and expectations about a prospective introduc- tion of the euro). For the countries concerned, euroization has implications on the conduct of monetary and fiscal policy. For the euro area, in turn, implications arise as a considerable amount of the euro cash in circulation is estimated to be held abroad.

    Bulgaria – National Report Since the Republic of Bulgaria is one of the newly accepted NATO members, the main purpose of this report is to give basic information on women in the Bulgarian Armed Forces. It will briefly review the historic background of the issue, the legal regulations concerning women in uniform as well as their current status in the armed forces. Introduction In our modern history examples of women taking part in military units date back to the Russian-Turkish war of 1877-1878 as well as to the Serb-Bulgarian War of 1885. Nevertheless, their organized participation in activities supporting the army began at the beginning of the 20th century. In 1912, when the First Balkan War was declared, the Bulgarian Red Cross organized short sanitary courses in some of the big cities. Many women volunteers, called “Samaritans”, attended those courses and after that were sent to field hospitals and small medical compartments close to the front lines. One of them was the first woman in the world to take part in a combat flight on Oct 30th 1912. At this same time Bulgarian women took also part in infantry units, fighting shoulder to shoulder with their brothers and husbands. Thirty years later, in 1944, when Bulgaria joined the anti-Nazi coalition, 4200 women voluntarily participated in Bulgarian military units, 800 of them being directly engaged in combat activities. Others served as doctors, nurses, military correspondents and even as actresses in the front theatres. As a part of the constitutional changes in the country after the end of the Second World War, discrimination based on sex was banned and women were officially given the right to practice the military profession.

Background The BDT, upon informal consultation with the SAITC representative, has decided to split the work load into two streams between Mr. Péter Vári, Senior Broadcasting Expert from Hungary and Mr. Petko Kantchev, Senior Broadcasting Expert from Bulgaria and former Specialist on Sound and Television Broadcasting at BDT/ITU as follows: • Mr. Vári shall elaborate case studies for Germany (Internet based research), Hungary (on-situ research) , Poland and Serbia (based on short missions of three working days); and • Mr. Petko Kantchev shall elaborate case studies for Bulgaria (on-situ research), Croatia, Macedonia and Slovenia (based on short missions of two and a half to three working days. 3. Brief description of Experts’ duties 3.1 Discuss with relevant Authorities the issues of transition to DTTV broadcasting and based on the available information, elaborate case studies for each of the said eight countries.

L’Hommedieu: Exiles and Constituents: Baltic Refugees and American Cold War Politics, 1948-1960 This dissertation explores the complicated relations between Estonian, Latvian, and Lithuanian postwar refugees and American foreign policymakers between 1948 and 1960. There were seemingly shared interests between the parties during the first decade of the Cold War. Generally, Eastern European refugees refused to recognize Soviet hegemony in their homelands, and American policy towards the Soviet bloc during the Truman and Eisenhower administrations sought to undermine the Kremlin’s standing in the region. More specifically, Baltic refugees and State Department officials sought to preserve the 1940 non-recognition policy towards the Soviet annexation of the Baltic States. I propose that despite the seemingly natural convergence of interests, the American experiment of constructing a State-Private network revolving around fostering relations with exile groups was fraught with difficulties. These difficulties ultimately undermined any ability that the United States might have had to liberate the Baltic States from the Soviet Union. As this dissertation demonstrates, Baltic exiles were primarily concerned with preserving a high level of political continuity to the interwar republics under the assumption that they would be able to regain their positions in liberated, democratic societies.
