8. TREASURER’S REPORT-Gina Martinez a. Discussion and possible action to approve Monthly Expenditure Report (MERs) for November 2019. b. Discussion and possible action to approve the Monthly Expenditures Report for December 2019. c. Review & compare cost for the WNC Winter Dream Event & the WNC18th Anniversary party. d. 9. ACTION ITEMS- DISCUSSION & POSSIBLE ACTION TO APPROVE A. Discussion & possible action to approve having a community Safety and Information fair event this Spring. B. Discussion & possible action to approve funds in the amount not to exceed $ 2,500.00 for the WNC Safety & Information fair. C. Approve honoring two LAPD senior lead officers who have been in Wilmington for over 15 years. D. Approve funding in the amount not to exceed $300.00 to purchase the service plaques for officers. Present them at our WNC Board & Stakeholder meeting. E. Discussion & possible action to approve filing a Community Impact Statement in support of Council file 19-0002-S38 and send letters to elected officials to oppose SB 50. F. Discussion & Action to remove Ernesto Aguilar from the WNC board due to non-compliance and refusal to update his required Ethics training. Failure to comply is in excess of 6 months. This violates State Justice Department, Government code section 53235 which requires ethics training for local government officials. Empower LA: NC Board Members, both elected and appointed, are required to complete and update three mandatory trainings: Ethics, Funding, & Code-of-Conduct training. This violates the Board of Neighborhood Council Commissioner’s policy 2014-2(2): NC Board members are given 30 days to complete the training or the board member is removed. This violates the WNC Standing Rules. The WNC board member who refuses to complete or update their Ethics, and Code-of-Conduct shall not participate in any WNC meeting and full board vote will be taken to remove the board member indefinitely. G. The Finance Committee recommends to the full board to approve funding for a professional grant writing training workshops in the amount not to exceed $1,600.00.

Workshops offered to 5 current and active finance committee members/stakeholders plus 5 board members. In order to participate, members must be in good standing with board certification current. RSVP is required. H. The Beautification Committee recommends to the full board to approve funding in the amount not to exceed $400.00 for supplies for the March Wilmington Clean-ups. Every weekend in March we will clean up a different location. Items such as rakes, brooms, cloves, trash bags, trash cans, cutters and such if the City departments do not provide the supplies needed. I. The Planning & Land Use committee recommends to the full board to send a letter to Mayor Garcetti and LA City departments recommending they add a Code Enforcement Officer designated only for the community of Wilmington. Currently there are only two CEO for the Harbor area. J. The Finance committee recommends to the full board to approve requesting a full audit and explanation of all CD 15 funds including the Councilmember’s discretionary funds since he came into office. K. By-law’s committee recommends to the full board to accept the updates to the Wilmington boundary map for the community plan update.

b. CHAIR’S REPORT -OPENING REMARKS- The WNC submitted a letter of request to Public Works for City tree trimming on John Gibson Blvd. island and parkway. The work has been completed on the City trees.

The Caltrans letter of request has been submitted for weed removal and trees trimming. The threat of fire is being addressed by this Council and our Beautification Committee. Our committee has been working to be proactive for stakeholders to protest against the Deep Water Project. We did submit a letter against the Deep Water Project. We sent a letter about John Gibson Blvd. Urban Forestry has trimmed the trees. Caltrans was sent a letter and has completed the weed abatement, but there is still more work for them to do. The work is almost completed on the City side. Caltrans is just getting the list.

2. SWEARING IN OF THE NEWLY APPOINTED BOARD MEMBERS-Swearing in of newly appointed Boardmembers by Valerie Contreras, WNC president.

a. Simie Seaman – At Large representative I pledge to rep with dignity, encourage other points of view, Respect value and consider everyone’s opinion, find the good in my neighborhood and praise it and promote. To my neighbors and to neighbors throughout the city of los Angeles, I pledge to do this to the best of my ability.

b. Check Boardmember training certification is updated for board participation per State law. All elected officials are required to take the Ethics training to participate. Neighborhood Council Board members, both elected and appointed are required to do three trainings in order to vote on issues that come before the council: Ethics, Funding, and Code-of-Conduct Training. Certification must be updated to be in compliance. No motions, seconds or board participation or voting by the board member until in compliance.

b. Discussion and action to approve paying the invoice for AT&T in the amount of $518.98. Discussion / Public comment: This bill is for internet and phone at the office. Question about the higher cost. The account is under the City of Los Angeles and it was sent to the City Clerk. We received two of these bills in one day. It doesn’t describe what we’re paying for. There’s no voice mail included with this phone service. It’s for two phone lines which is running our internet and the other is for the actual phone number we use. This bill is for multiple months and these bills are sent to the DONE office, not directly to us. Helena said we have a bill for a building we don’t use. We do have access but only during certain hours. Lydia Gutierrez asked for an itemized bill and recommends contacting other Neighborhood Councils on how they’ve reacted to situations like this. We were not active June, July, August so no one was paying that bill. Even if we weren’t active, we should be getting the bill each month even if by online access so we don’t have late fees. We should be paying this bill monthly.

Discussion: Opportunity to go into the schools and tagged along with the Council Office. We made 800 copies that are in English and Spanish. One flyer goes into each student’s packet. They were very interested; they had no idea about Neighborhood Councils.

5. PRESENTATIONS: FROM AQMD TRUCK IDLING – Q&A AQMD could not make it to this meeting, but will be able to attend in January. Valerie did receive a PowerPoint presentation and handouts which she distributed. Better to present in January when AQMD is present. The Penalty Code number on the Sign is 13CCR2480 and 13CCR2485. This is important for officers to be able to enforce truck idling. Valerie met with Port Police to help enforce idling. They will meet with AQMD and get back to her. Will post this information on the website. Apologized for no AQMD at this meeting.

a. Lydia Gutierrez – Served on the Coastal NC for 7 years and thanked all for serving on the WNC. Lydia ran for School Board 5 years ago and lost by 6%. 30 yrs. teaching experience, kindergarten to 8th grade, 6-1/2 years in aerospace administrator, State Legislative background with CA Teachers Assn. with bills that have to do with career tech. The bills did not cover at all career pathways. We have 200-300 that will be retiring and we have serious problems to address. Needs 1,000 signatures to be on the ballot and you can sign any of the candidates who are running.

Discussion: Valerie Contreras stated that based on new information from last meeting Deep Water Project, there is more news and we need to send a letter requesting they come to our January meeting. Gina Martinez read the letter. Specifically, we would like to have the following question answered and following issues addressed: I. How many homeless shelters will be built within the beach city communities of Manhattan Beach, Redondo Beach and Hermosa Beach?

II. If no homeless facilities are to be built in those communities, why not?

III. Will any of the referrals made for interim or permanent housing or treatment centers services be in the community of Wilmington? If so, how many?

IV. How much funding from measure HHH will you receive from each beach community?

V. If there is to be referral for services located in Wilmington, how many of the 200 clients mentioned in the “agreement” will be referred to Wilmington?

VI. Of the 200 clients mentioned in the “agreement” how many will be referred to facilities within Council District 15?

VII. If no shelters will be located or built within the community of Manhattan Beach, Hermosa Beach or Redondo Beach, what actions has Harbor Interfaith taken with regards to feedback from the communities that will be getting these referrals?

Public Comment: Requested adding Torrance. Torrance hasn’t taken official action. We could send before they take action and cc them. We are supposed to only advocate for our community. We could send our letter to CD15 and to other communities including HANC all councils in CD15. Don’t send to Joe’s office, he’s part of the problem. He wants these Bridge Housing projects. There are some other Neighborhood Councils who are working in an opposite direction than we want to do and we could cc them rather than asking them to support it. Discussion: This is so the board can take action and have a say so on what the community needs. Letter includes that the community continues to feel overburdened by industry without enough services in return from the Los Angeles city government and the Port of Los Angeles. The issues intersect with daily lives and cause unfair burdens. It all makes for a more dangerous and unsafe community. Board Comments: Increase funding for speeding cars included and LPR (License Plate Reader). LAPD was asked to take them all down, but we are going to ask for it anyway.

e. The Finance committee recommends to the full board to approve the NPG guidelines. Discussion: We were supposed to implement these guidelines 3 years ago. Everyone who gives grants is supposed to have guidelines. We never posted in the past what we have. In the past if we had a budget, we would just increase more funding but with guidelines we will have a process. Do we have feedback after they receive a grant? The City has a form to complete. Also, when you have NPG, the WNC should be included on any banners, flyers, etc. Conflict of interest between the nonprofit and one of the members of the board if they don’t recuse it’s not the Boardmember who gets penalized, it’s the nonprofit that is penalized and it’s not until every single board member is off the board which could take a decade. Valerie said that all NPGs were thrown out because of all the mistakes. We never saw the people again. By us establishing guidelines will help the nonprofit to be transparent to the stakeholders and guide them every step of the way. If we say we only give 5 and then give others then we are not being fair to the community. At the strategic plan we have no funding. We still want to establish the guidelines going forward. The funding department has specific guidelines and if it doesn’t meet the guidelines it can be thrown out indefinitely. Our Finance committee is a good place to start. Everything goes to the full board for approval. If we give out NPG funds it’s better to fund early on and not waiting till the last minute. Biggest reasons NPGs get kicked back is that NCs cannot give things away. NPGs can pay for tables and chairs but not for items that are given away as that would be considered a gift of public funds. Sometimes they are kicked back because not enough people are involved. What does the NC get back in return? In the past we didn’t ask for our logos to be added to literature. We had two return with photos and showing our logo on their materials and place it on the website. We want to ask that the NC banner goes up. Do they charge us to go to their events?

10. STANDING COMMITTEES a. Finance Committee Chair Gina Martinez reports that all our bills are paid. Meeting this month cancelled due to tonight’s meeting, December meeting Cancelled. We have a lot of ideas and we want to know what is being spent in Wilmington and ideas on how to educate our community to bring things to our community. Attended opportunity zones and looking into how people can get grants. We have to find other means to bring things to our community. Congratulations to Robert Jones on his permanent position as a teacher.

b. The Beautification Committee- Chair Steven Contreras-trees on Gibson were trimmed because of Jeff at Urban Forestry. Board members received email thanking Jeff. Next meeting cancelled.

c. Transportation Committee Chair Carlos Sanchez and Adolfo Fermin. First meeting will be on Dec. 2, 6:30-7:30 p.m. We have open ideas. Anyone is welcome. Neeno’s Café, 910 Pacific Coast Hwy. Regular meeting day is 4th Monday of each month but this time will be day before our board meeting because of the holidays. The Wilmington Neighborhood Council requests a presentation by Harbor Interfaith Services to discuss and answer questions regarding the agreement entered between HIS and the City of Manhattan Beach.

As the duly elected body tasked with representing our community interest, we request that a representative from your organization provide information to our community in a clear and transparent manner so we can be fully versed on what effects your agreement will have on our community and CD15 as a whole.

We are requesting that a presentation be given at our January 2020 meeting. It is our understanding that the agreement that Harbor Interfaith Services entered with the City of Manhattan Beach the scope of services include, “referrals to interim housing, treatment centers, and permanent housing.” It goes on to state,” Over the 16-month contract, at least 200 Beach Cities’ homeless residents will receive case management and will be documented per LAHSA’s standards. Out of that number, at least 24 will be referred to Interim Housing, 32 clients will be referred to CES and other permanent housing components (e.g. Rapid Rehousing, Permanent Supportive Housing), and at least 50 will be referred to treatment programs. These targets are consistent with LAHSA’s performance outcomes.” Specifically, we would like to have the following question answered and following issues addressed: 1. How many homeless shelters will be built within the beach city communities of Manhattan Beach, Redondo Beach and Hermosa Beach? 2. If no homeless facilities are to be built in those communities, why not? 3. Will any of the referrals made for interim or permanent housing or treatment centers services be in the community of Wilmington? If so, how many? 4. The Wilmington Neighborhood Council has taken official action opposing Bridge Housing, Safe Parking and Permanent Supportive Housing within our Community. We oppose the trafficking of individuals into our community because more affluent communities have chosen not to address these issues within their own communities. It is an unfair burden to ask our already environmentally burdened community to have individuals placed, referred and tracked permanently and intermittently into our community when we are struggling with our own issues and request that Harbor Interfaith do not place clients from the beach city communities or any other community within the boundaries of Wilmington.

2) Our CES team includes county-recognized leader Shari Weaver, SPA 8 CES Director for all three systems.-Along with CES Adult Regional Director Breanna Jaijairam, they will provide leveraged management oversight and mentorship to the three contract FTEs. Additional HIS staff- CES Coordinators and Case Managers - will provide further pro bono support.

3) Our Homeless Coordinator/Liaison will report directly to Ms. Jaijairam, who will work closely with this person to ensure HIS 1 high program standards are maintained. Previously responsible for conducting SPA-wide case conferencing meetings and managing 40 street outreach staff give Ms. Jaijairam the ideal background to provide direct management oversight.

4) Our proposed approach mirrors the highly successful work performed through our current contract with the City of Redondo Beach and staffed by case manager Lila Omura. In one year, 149 of her clients have accepted services including enrollment in treatment programs and shelters, and 21 have been connected with permanent housing. The second group contains some of the most challenging "Top 10/) identified by the Redondo Police Department. We know people experiencing homelessness in the Cities of Hermosa Beach and Manhattan Beach have characteristics like those living in Redondo Beach, so we feel confident our approach will be successfully extended to these northern beach jurisdictions.

5) Our case managers generally will work individually, by themselves, significantly increasing their productivity over being part of a team. For the infrequent situations when safety is a concern, the case managers will double up or possibly seek law enforcement assistance. Using their own vehicles, the case managers will provide transportation to seize the moment when reluctant participants say "Yes!/) to services, and will accompany them to all their appointments to ensure prompt attendance.

6) Adherence to all the strict Los Angeles Homeless Services Authority's (LAHSA) standards for maintaining case files, HMIS (database) updates, and case conferencing will be made.

7) HIS possesses widespread experience training and briefing different levels of partners and stakeholders. Previous topics include homelessness awareness, "myth busting," pragmatic eneaeernent techniques, and connecting existing stakeholder services to the broader homelessness system. We will use our close relationship with United Way of Greater Los Angeles' "Everyone ln 11 campaign to tailor and incorporate their materials into our work ..

WHEREAS, any official position of the City of Los Angeles with respect to legislation, rules, regulations or policies proposed or pending before a local, state or federal governmental body or agency must first have been adopted in the form of a Resolution by the City Council with the concurrence of the Mayor; and

WHEREAS, the City of Los Angeles is leading the State of California in incentivizing multifamily development near transit through the passage of Measure JJJ, which was approved by the voters in November 2017, and

WHEREAS, Measure JJJ resulted in the creation of a city-wide program known as Transit Oriented Communities (TOC), which provides both base allowances and additional incentives to build affordable housing if the project is within a half-mile of transit much like SB 50 (Weiner); and

WHEREAS, the City has crafted a TOC program that is not allowed within single-family zones and aims to keep the expanded development capacity within the commercial and most multi-family zoned parcels; and

WHEREAS, TOC is a city-wide approach which itself needs further tailoring to the unique communities within the expansive 503 square miles of the City of Los Angeles; and

WHEREAS, the City is embarking on an aggressive program to update all thirty-five Community Plans which will provide the vehicle for tailoring the TOC program to each of our unique communities; and

WHEREAS, the City of Los Angeles is already exceeding our Regional Housing Needs Allocation (RHNA) target for market-rate housing through TOC and moving toward our below-market-rate housing goals; and

WHEREAS, Senate Bill (SB) 50 aims to do a version of what Los Angeles' TOC program is doing without respecting the integrity of single family zoning and other local characteristics; and

WHEREAS, as currently drafted, SB 50 includes terms and implementation concepts that are not yet adequately defined, such as “jobs-rich" and “sensitive communities." Further, SB50's relationship to other state laws such as the Ellis Act is vague, and lacks innovative incentives to increasing the amount of affordable housing required in return for development incentives beyond the City’s local TOC; and

WHEREAS, the passage of SB 50 would threaten to move Los Angeles backward in “right-sizing” our TOC program to each community through our State mandated Community Plan Update efforts, thereby impeding our local land use control and thwarting our current efforts to gather community input and support to customize our local incentive program;

THEREFORE, BE IT HEREBY RESOLVED, that with the concurrence of the Mayor, that by the adoption of this Resolution, the City of Los Angeles hereby includes in its 2019-20 State Legislative Program OPPOSITION to SB 50 (Weiner), which would allow construction of higher density multi-family housing developments near major transit stops that are out-of-compliance with local land use regulations and procedures, unless amended to exclude the City of Los Angeles from its provisions. \ A J ) i L

Dear Honorable State representatives,

The Wilmington Neighborhood Council urges you to oppose Senate Bill 50 (Wiener), which has unusually high impact on our senate district, in particular the community of Wilmington. This one size fits all approach to housing does not take into consideration the unique characteristics of each city and more specifically the unique characteristics of Wilmington. SB 50 will eliminate single family zoning. SB 50 will devastate the families of Wilmington and destroy the protections we have in place for safety and environmental protections. Furthermore, most of our historic properties will lose the protections that they currently enjoy.

Here is what you may not know:

• Wilmington is one of the most polluted communities in the nation. So much so that the City of Los Angeles has placed an extra layer of protection with it’s Clean Up Green Up ordinance. We are surrounded by refineries, railroads and are the backbone of the port and trucking industry. A vast amount of our properties sits on Methane Zones and on any given day we house up to 363,000 barrels of crude oil at only one refinery. As fuel for ships that come to port. As a result, CEQA guidelines protect not only the environment but our stakeholders as well. Should SB 50 pass we will lose all these protections. • Wilmington has the only Civil War monuments this side of the Mississippi including the last remaining munitions depot left in the from the Civil War and Historic Preservation zones. The Port or LA/LB started its humble beginnings here in Wilmington and the railroad servicing Los Angeles began here. Like most of the historical assets in Los Angeles not all of these are listed on Federal or State registry. SB 50 would allow a developer to DEMOLISH assets such as our munitions depot. Our history needs to be protected and preserved. Civil War veterans are laid to rest at our historic cemetery. • The is in opposition to this Bill as are numerous Neighborhood Councils (Harbor Gateway North, Sunland-Tujunga, Westwood, Empowerment Congress, Westchester Playa, Bel Air, Beverly Crest, Westside, Rampart Village, and Central Hollywood. Over 30 Tenant Rights organizations also oppose the bill. • SB50 provides only market rate and luxury rate units and has loopholes that bypass the affordable housing requirement. A single person would need to make over 58,000.00 to afford these new units. The average median income in Wilmington is less than 50,000.00. This will displace more people than it will help.1

SB 50 is bad policy for all Californians

• SB 50 takes away local planning powers, strips away local decision making and hands those powers over to luxury housing developers. • There is no mandate for affordable units for complexes that have less than 10 units. UCLA’s Michael calls this 10- unit exemption a gentrification tool. • Complexes that have 11-20 can pay a small fee in lieu of building affordable units. • For complexes with 21 or greater units only 20% of the units will need to be affordable housing • SB 50 bans single family zoning. Developers can buy blocks of land to erect market rate fourplexes with only 1 parking space for every 2 units. • Developers and investors will override city zoning near rail and bus stops to erect 4 and 8 story towers with no parking requirements • San Francisco’s planning department has confirmed that SB 50 allows developers to override up to 6 local rules not 3 as the author claims, when erecting large buildings with the small amounts of affordable units. Developers, not planners, become our new land use planners. • Safety is a huge concern: During a natural disaster, evacuation such as wild fires or earthquake, it is already a challenge for our densely populated communities to escape. Towers that house 160 to 200 unites, will make it impossible for cities and small communities to get people to safety and for our emergency vehicles to get there in a timely manner. Our schools are already over- crowded and our infrastructure cannot accommodate it. SB50 At what cost? • It strips away our right as an elected body, to give input on our community plan regarding housing. ▪ Setbacks-Developers can slash the breathing room cities require for trees, green belts, side yards ▪ Floor Area Ratio-Developers can OVERIDE CITY SIZE restrictions, adding 47%- 297% to building size ▪ Parking-Developers can erect big apartment complexes with NO PARKING ▪ Standards-Ability to IGNORE ANY CITY STANDARD (design, sustainability, earthquake, safety) that isn’t state law ▪ Onsite Open Space- Developers can IGNORE required courtyards for children to play and balconies ▪ Historic Buildings- Developers can DEMOLISH homes not on the CA Registry of Historic Resources (most historic homes are registered at the local level only)

With the homeless crisis in California there is a need for affordable housing units not market rate or luxury rate as outlined in SB 50.

STANDING RULES Approved Oct. 2019

BOARD MEMBER TRAINING

ETHICS: Board member training will be checked at all WNC meetings until all board members are in compliance. On the third time a member is not in compliance action will be taken to remove the board member from the meeting. ALL Wilmington Neighborhood Council board members shall complete the ethics, funding and code of conduct training according to State law and keep it in compliance to update it every 2 years. In any event, the WNC board member who refuses to complete or update their Ethics, and Code of Conduct shall not participate in any WNC meeting and full board vote will be taken to remove the board member indefinitely. No motions, seconds, comments or voting, he/she cannot be a candidate for office or chair a committee or participate in any WNC actions. The member will be removed and escorted out. Their seat will be declared vacant at the next meeting. Should the board member complete the required training at that time it’s too late. Once the board member is removed, he cannot return for non-compliance. Ethics, code of conduct and funding are required training in order to vote on funding matters. All three are required per the City funding department. The ethics and code of conduct are required in order for a member to participate in any board involvement.

ATTENDANCE

A. All board members may be allowed three (3) excused absences from Monthly Governing Board & Stakeholder Meeting during their two (2)-year service, or upon appointment to the board. B. If a board member misses 4 meetings the matter will be taken up with the Executive officers and taken to a full board vote for removal. C. Notification is to be made in advance of monthly meetings to at least one member D. of the Executive Board (Chair, Vice Chair, Secretary, Treasurer and E. Parliamentarian). Therefore, notification after 6:00 p.m. does not count. F. Should you seek a fourth (4th) excused absence during your service on the board G. you will be asked to meet with the Executive Board to discuss your absences. H. Unexcused absences at governing board meetings are not tolerated. One (1) no-show, I. no-call is grounds for removal from the board and shall cause the matter to be placed on the agenda for the next regular meeting of the Board. The board member in question shall provide reason for unexcused absence. J. Tardiness is not tolerated. After 4 times it will be referred to the Executive officers. K. The matter will be up for discussion by the Executive board and followed with a board vote. L. Notify an Executive Board member if you expect to arrive late to a governing board meeting.

CIVILITY AT MEETINGS

A. All board members shall raise their hands for recognition from the Chair or presiding Officer before discussing a matter or the member is “Out of Order” Per Parliamentary rules.

B. Individuals speaking out of order- occurs when an individual does not seek recognition from the Chair or presiding officer before speaking- will be given three (3) warnings. A warming, a second warning advising individuals they C. could be asked to leave, and a final warning asking individual to leave. Should an D. individual refuse to leave, the Chair or presiding officer shall declare a recess and call for removal.

E. No board member shall engage in side conversations when a meeting is in session. Board members shall make public their comments, questions or concerns by first being recognized by the Chair or presiding officer.

F. Board members shall not engage in conversations or answer questions with stakeholders during public comments. According to EmpowerLA rules.

Board members should display professionalism during the meeting at all times. Members shall ask to be excused from your board seat during a meeting. It

F. displays a lack of respect for the WNC board to just get up and leave during a meeting as it effects the quorum for voting.

G. During presentations board members are asked to turn their chair to see the screen or presenter unless you need a restroom break. Please do not take a seat in the audience.

COMMITTEES: Standing committees of the WNC are: Planning & Land Use, Finance, Environmental, Transportation, Public Works, Bylaws, Publicity & Outreach, and Beautification.

A. Chairs of all Standing Committees must be chaired by current WNC Board Members only and have completed/updated all required trainings: Ethics, Funding and Code of Conduct. B. Members of the current WNC Governing Board are the only authorized individuals to conduct community meetings, chair committee meetings, conduct neighborhood council business and have access to equipment at the office. C. No member or members can speak on behalf of the full board or make a commitment to a group or individuals on behalf of the full board. ALL matters go before the full board for a vote. Only the Chair has the authority to speak on behalf of the board according to our By-laws. D. Handouts and community resources are allowed and space will be available at the WNC resource table available at each Monthly Governing Board and stakeholder meeting. E. Individuals may provide Governing Board handouts during public comment. The board member closest to the Podium will accept the handouts for distribution.

F. Anyone who wants to share information on an event, reports etc. shall attend the WNC meeting and provide their own copies of handout, reports, and materials. The WNC does not make announcements for those who cannot attend the meeting nor do they copy flyers, handouts or print materials for anyone who cannot attend. Individuals who cannot attend our meeting but have information to share can send someone on their behalf.

G. Communications: The official means of communication is by Email. Text messages should only be used to the full board when setting up a meeting to confirm there will be a quorum or to notify the executive officer that you are running late to the meeting or that you will not attend. Notifications should be given regarding excused absence prior to the start of the meeting or it will be considered a non-excused absence. Please be considerate of others who work and cannot receive text messages. Use text messages for emergency purposes

and board members may wish not to give out their personal cell phone numbers for communication. It’s not required.

H. Board members should create a separate email from their personal email to use for WNC correspondence. Changes and updates should be sent to the Chair, Secretary or executive officer so they can send the updates to Roster with the City and update on the website.

USE OF OFFICE & EQUIPMENT

A. Members of the current WNC Governing Board are the only authorized individuals to conduct community meetings, chair committee meetings, conduct neighborhood council business and have access to equipment at the office. B. Any unauthorized use of the office or equipment shall be subject to the applicable laws. C. All equipment must be properly labeled with the WNC logo and added to the inventory list before log out or use. D. Notification is to be made 72 hours in advance to at least one member of the E. Executive Board for use of WNC audio and visual equipment, folding tables and chairs, and flags outside of the office. F. Equipment must be checked out at the office with the log in/log out sheet. G. ALL equipment is for official WNC events only. H. Board member must be present with equipment while off-site of the WNC office. I. Equipment must be returned within 24 hours, or the next business day in the event of a weekend or holiday.

FILLING VACANCIES BY APPOINTMENT

Vacant seats shall be declared at the follow governing board and stakeholder meeting when the seat becomes vacant. Any Stakeholder interested in filling a vacancy shall submit a completed Candidate filing application form and submit it via email only to the full WNC board to [email protected] The seat will remain vacant until members of the Governing Board appoint a qualified candidate by a simple majority vote during a governing board and stakeholder meeting. In the event of a tie, a coin flip will determine a winning candidate. The winning candidate will be appointed to the fill the vacant seat. The same process shall determine the winner during an official WNC City Election. The tie breaker shall be conducted within the Wilmington boundaries at a stakeholder meeting to ensure transparency. New appointments will be seated and sworn in at the next regularly scheduled meeting and serve for the duration of the term. In no event shall a vacant seat be filled where a general election is scheduled to occur within 60 days of the date that a written application is presented to the Board.

WNC ELECTIONS

Candidates: The Wilmington Neighborhood Council Election candidates must verify their stakeholder status and provide proof of their declared seat to be filled. This applies even if the City Election division, EmpowerLA or the WNC or any other entity holds the WNC elections.

The Community Interest Representative seat must continue to be ongoing and substantial participation with the organization by which the candidate applied with to fill the WNC vacant seat or election candidate seat. The affiliated community interest seat must be within the Wilmington boundaries. Once the board member no longer has participation in the community organization by which the seat was filled then they can be removed from the WNC board. Per the WNC by-laws Attachment B governing board structure and voting, community interest representative elected or appointed must be ongoing and substantial. The same goes for all WNC seats. The candidate who applies for a seat on the WNC board as a stakeholder for a specific seat being At-Large, residential, employee or own property shall hold that seat and it must be ongoing. i.e. if you hold a residential seat and move out of Wilmington boundaries your seat is no longer ongoing and therefore you need to give up your seat on the board. This applies to all seats.

Qualifications to be a candidate for the WNC board: No person in a paid position with an elected official, including but not limited to, the Mayor’s representative, State Senator, Congress person, State Assembly, Council member, Governor, Port of LA, LA County Supervisor representative, and all City Elected official departments representatives.

A board member of the WNC should not engage in ongoing serious criminal activity while serving on the WNC board. We are elected representative of our stakeholders and therefore are responsible for funds, decision making and sound judgement and we must reflect well. Per WNC By-laws organizational structure C.6 “to the best of our ability the WNC shall comply with local, state and federal laws.”

Voters: Method of verifying stakeholder: All voters shall provide proof of their stakeholder status with documents that proves they are a stakeholder within the Wilmington Boundaries. No proof of verifying stakeholder then no voting.

LA City Officials & Departments,

On January 28, 2020 the Wilmington Neighborhood Council held a meeting to discuss the need for more Code Enforcement Inspectors our community. The Beautification and Planning committees held a joint meeting to recommend to the full board a solution that would better serve our community needs.

It is our understanding that there is currently not enough Inspectors for the entire Harbor area. We have taken official action to request additional Code Enforcement Officers for the Harbor area and specifically one that would be designated for the community of Wilmington on a full-time basis. We are faced with violations that are overwhelming for our small community. Permits, zoning, proper business operations and many more.
