General information Free zones official definition:

“A free zone is a designated, secured area in which commercial and industrial activities are carried out and gazetted by the Minister of Finance as stated under section 3(1) Free Zones Act 1990 (Act 438). There are two types of free zone that is the free zone for commercial activities (FCZ) and free zone for industrial activi- ties (FIZ). Licensed Manufacturing Warehouse (LMW) definition:

“Licensed Manufacturing Warehouse (LMW) is a premise licensed under section 65 and 65A of the Customs Act 1967 and is a facility provided for export orientated industries. “In efforts to encourage a more balanced dispersal of export-oriented industries in all the states in the country, the Royal Malaysian Customs has introduced the LMW facility in states where the setting up of FIZ are neither feasible nor practical. The setting up of LMWs is provided for under Section 65 and 65A of the Customs Act 1967”. “A manufacturing company which exports at least 80% of its production and import the bulk of its raw materials/com- ponents qualifies to apply for the LMW facility. Corporate Tax and Eligibility for Free Industrial Zones Incentives • To qualify for location in a FIZ, a company has to export at least 80% of its output and its raw materials/ components are mainly imported, even though the govern- ment does encourage the use of local raw materials/components. If a FIZ company has obtained an approval from the Ministry of International Trade and Industry to reduce its export condition to 60%, it can also apply to the Customs to be allowed to export 60% instead of 80%. • Companies operating in a FIZ can enjoy duty-free imports of raw materials, inclu- ding packaging materials and machinery and equipment used directly in the pro- duction of approved products as in their Manufacturing Licence (ML) (unless these manufacturers are exempted from ML). Observations The island of Penang was a free port until 1969. Bayan Lepas Free Industrial Zone, or FIZ, has started in 1972 It’s a high-tech industrial zone on the southern part of Penang Island. The Bayan Lepas Industrial Zone is the main labour market in Penang, drawing from a pool of skilled and semi-skilled workforce locally and from the neighbouring states. Since its inception in the 1970s, the Bayan Lepas FIZ has grown to become the “Silicon Val- ley of the East” (Motorola, Intel, AMD, Osram, Hewlett Packard, Bosch, Hitachi, Clarion, etc.

Observations Malaysia’s most advanced container terminal, The Port of Tanjung Pelepas (PTP) is strate- gically located at the confluence of the main east-west shipping lanes, offering Shipping Lines minimal deviation time of 45 minutes. PTP is situated in a sheltered bay and has no tide restrictions. Local cargo movement to major industrial estates is accessible through the second Ma- laysia-Singapore expressway and the north-south highway. In addition to road, sea and air inter-modal linkages, PTP is also connected to the national rail grid passing through from Singapore to Southern Thailand. PTP has 14 linear berths totaling 5.04 km. The terminal is equipped with 57 Super Post Panamax cranes, 10 of which have a 22-box outreach catering for the next generation of Super Post Panamax vessels. These cranes also have twin-lift capability to further enhance productivity. PTP’s currently averages over 32 moves per hour/crane, and berth producti- vity stands at 100 moves per hour minimum.

PTP was accorded with Free Zone status in 1997 and the Free Zone Authority in 1998 to administer, manage and operate its Free Zone area. The Free Zone laws are governed by Free Zone Act 1990 that is enforced by Ministry of Finance, Malaysia. The Free Zone in PTP promulgates the local container trade volumes of the port and forms part of the hinter- land cargo catchment area.

Free Zone land comprises of 5 phases with a total acreage of 1,583. Phase 1 and Phase 2 which account for approximately 635 acres are developed with basic infrastructure such as electricity supply, water supply, telecommunications facilities, roads and drainage. To date, more than 80% of the developed land in phase 1 and 2 has been subleased to various local and global companies. Phase 3, 4 and 5 which constitute 948 acres, can be potentially developed to expand the current Free Zone development.

Apart from plans to attract 4-star hotels and restaurants and parks and recreation facilities, a proposed furniture factory would help to improve local productivity, worker skills and family incomes. Observations MILS Logistics Hub (MLH) - a new generation, world class logistics facility offering a com- plete range of logistics services which is supported by a single integrated IT platform with a world-wide reach via the web. Located in Pulau Indah, Selangor, the development of MLH has been divided into 3 phases, with the completion of the final phase resulting in the formation of a 90,000 square meter multi modular storage and processing facility. Observations Duty free zone. Located on the Malaysia-Thai border, this duty-free zone is the place to go for a wide variety of t-shirts, souvenirs, household items and more. Unlike air-conditioned exclusive duty-free shops at the airport, these are open-air stalls where visitors can immerse them- selves in the local style of shopping and haggle for the best prices.

Observations Port Klang consists of three ports operate by private operators namely Northport, West- ports, and Southpoint. The status of Free Commercial Zone was given to Northport on 1 April 1993, Westports on 20 June 1996 and Southpoint on 19 February 2004. Port Klang Authority was assigned as the Free Zone Authority to administer the Free Zones (Northport, Westports and Southpoint) in Port Klang. Non-containerised cargoes are handled at two facilities in Northport – a dedicated conventional cargo terminal in Southpoint, and the conventional cargo terminals in Northport for break bulk, liquid and dry bulk cargoes. Southpoint, formerly known as Southport, is the oldest section of Northport. Southpoint also acts as a niche port to handle transhipment activity for the Indonesian barge traffic due to its proximity to the Sumatran ports of Tanjong Balai, Dumai, Pekan Baru, Buatan and Perawan. Located in the centre of Port Klang town, Southpoint which is aptly termed "port-in-town", has its advantages whereby hundreds of freight forwarders and shipping agencies, banks, and other Government agencies such as the Customs, Im- migration, Harbour Masters, are all located nearby.

Observations Southpoint has eight wharves (from Wharf 1 to Wharf 7A). Observations Built by the Johor Port Authority and run by Johor Port Berhad in 1977, it is the first port in Johor and is designed as a multi-purpose port that caters to practically all types of cargo. It is the first port in Malaysia to be located within a free trade zone. Johor Port's war- ehouses are exempted from customs duties.

Centralised customs clearance, warehousing and e-fulfillment facility. It will later lead to the launch of Alibaba’s regional e-fulfillment centre at the end of 2019.

The implementation of e-commerce under the Masterplan has been brought forward from 2020 and beyond to 2017. This will boost the local e-Commerce sector as one of the main catalysts for the digital economy and increase gross domestic product (GDP) contri- bution. DFTZ will be a regional logistics hub to cater for the e-commerce business. When DFTZ is fully developed by 2025, the e-fulfillment hub is anticipated to handle and move up to US$65 billion worth of goods around the ASEAN region. It will facilitate cross-border movement of goods as well as ensure seamless air connectivity. It could deliver packages within 72 hours to ASEAN countries through the good air connectivity at KLIA and sea connectivity via Port Klang.
