AN ORDINANCE TO VALIDATE THE IMPOSITION OF CERTAIN FEES UNDER THE LAND SETTLEMENT ORDINANCE, 1928

BE IT ENACTED by the High Commissioner for Palestine with the advice of the Advisory Council thereof:—

1. This Ordinance may be cited as the Land Settlement Short title. (Fees Validation) Ordinance, 1933.

2. Notwithstanding anything contained in section 62 of the Validation of Land Settlement Ordinance, 1928 (hereinafter referred to as certam fees• the Ordinance) the fees prescribed:— No. 9 of 1928.

(a) by paragraph 10 of the regulations dated the thirtieth day of May, 1928, and published in the Gazette ol the first day of June, 1928, made by the High Commissioner- No. 212. Council under the Ordinance, from the making of such־in regulations until the cancellation of such paragraph by a regulation dated the eighth day of December, 1928, and published in the Gazette of the first day of January, No. 226. 1929, made by the High Commissioner-in-Council under the Ordinance, and

(b) by paragraph 11 of the regulation dated the eighth day of December, 1928, and published in the Gazette of the first day of January, 1929, made by the High Commissioner- in-Council under the Ordinance, from the making of such regulation until the cancellation thereof by a regulation dated the seventeenth day of March, 1932, and published in the Gazette Extraordinary of that date, made by the ,Council under the Ordinance־in־High Commissioner shall be deemed to have been lawfully prescribed and imposed.

OBJECTS AND REASONS

The object of this Ordinance is to validate the imposition and collection of certain lees inadvertently imposed by regulations made under section 65 instead of by order under section 62 (1) of the Land Settlement Ordinance, 1928.

AN ORDINANCE TO AMEND THE ADVERTISEMENTS ORDINANCE, 1920

BE IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof :—

Short title. \ This Ordinance may be cited as the Advertisements (Amendment) Ordinance, 1933, and the Advertisements Ordinance No. 25. published in the Gazette dated the fifteenth day of August, 1920! (hereinafter referred to as the principal Ordinance) and this Ordinance may together be cited as the Advertisement Ordin­ ances, 1920-1933. "

Substitution of 2. Section 2 of the principal Ordinance shall be deleted and new section in the following section shall be inserted in the place thereof:— place of section 2 of the principal Ordinance. "2. In a town area the Municipality with the consent of the District Commissioner, and elsewhere the District Com­ missioner, mav authorise

(a) the erection in specified places of one or more boards or hoardings for the exhibition of notices and advertisements, and

(b) the exhibition upon the premises of any person of advertisements relating to the business or occupation carried on by such person in such premises."

Deletion of 3. Section 3 of the principal Ordinance shall be deleted. section 3 of the principal Ordinance. Amendment of 4. Section 4 of the principal Ordinance shall be amended by section 4 of the the deletion of the expression "or section 3" appearing in principal Ordinance. paragraph (a) of sub-section (1) thereof.

Renumbering 5. Sections 4, 5 and 0 of the principal Ordinance (the first- certain sections named as enacted in section 4 of this Ordinance) shall be of the principal Ordinance. renumbered 3, 4 and 5 respectively.

OBJECTS AND REASONS

This Ordinance amends the Advertisements Ordinance, 1920 (Gazette—15th .tist, 1920) by amplifying section 2 and deleting section 3 with a view to־»Au placing'beyond doubt the right of municipalities to collect fees in respect of advertisements on business premises.

AN ORDINANCE TO AMEND THE ROAD TRANSPORT ORDINANCE, 1929

BE IT ENACTED by the High Commissioner for Palestine with the advice of the Advisory Council thereof:—

1. This Ordinance may be cited as the Road Transport Short title. (Amendment) Ordinance, 1933, and the Road Transport Ordinance, 1929 (hereinafter referred to as the principal Ordinance), the No. 23 of 1929. Road Transport (Amendment) Ordinance, 1931, the Road No. 13 of 1931.: Transport (Amendment) Ordinance, 1932, the Road Transport No. 22 of 1932. (Amendment) Ordinance (No. 2), 1932, and this Ordinance No. 46 of 1932. may together be cited as the Road Transport Ordinances, 1929-1933.

2. OBJECTS AND REASONS

The object of this Ordinance is to vest in the High Commissioner the power to provide, by regulation, for the control of public vehicles plying for hire in and between areas of municipal or local councils.

2. Hitherto certain powers have been vested in local authorities and other powers in the High Commissioner and it has been deemed advisable in order to secure co-ordination of control that all necessary powers should be vested in the High Commissioner.

JAFFA MUNICIPAL COUNCIL (VALIDATION) ORDINANCE,

No. 14 of 1933

The Jaffa Municipal Council (Validation) Ordinance, No. 14 of 1933, which was published as a Bill in Palestine Gazette, No. 348, of the 9th March, 1933 (page 223), has been enacted in the following form and was signed by the High Commissioner on the 22nd April, 1933.

AN ORDINANCE TO MAKE PROVISION FOR THE VALIDITY OF CERTAIN ACTS AND DECISIONS OF THE JAFFA MUNICIPAL COUNCIL AND THE CONTINUATION IN OFFICE OF CERTAIN MEMBERS THEREOF WHO HAVE CEASED TO BE QUALIFIED

BE IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof:—

1. This Ordinance may be cited as the Jaffa Municipal Council Short title. (Validation) Ordinance, 1933.

2. Notwithstanding anything contained in section 17 of the Legality of certain Municipal Franchise Ordinance, 1926:— acts and decisions of the Council and qualification of (a) no act done or decision made by the Jaffa Municipal certain members Council ' as elected at the elections held under the thereof• Municipal Franchise Ordinance, 1926, or at any bye- election held under that Ordinance prior to the com• mencement of this Ordinance, shall be deemed to be invalid by reason only of such act having been done or such decision having been made at a meeting at which any member sitting and voting had, at any time between the date of his election and the commencement of this Ordinance, ceased to be qualified so to do, by reason only of his not having a place of residence within the Jaffa municipal area.

(b) no member of the Jaffa Municipal Council to which reference is made in paragraph (a) hereof, who shall have ceased to have a place of residence within the Jaffa municipal area shall be deemed to be disqualified from sitting as a member of such Council by reason only of his not having a place of residence within the Jaffa municipal area.

' TEL AVIV LOCAL COUNCIL (VALIDATION) ORDINANCE, No. 15 of 1933

The Tel Aviv Local Council (Validation) Ordinance, No. 15 of 1933, which was published as a Bill in Palestine Gazette, No. 348, of the 9th March, 1933 (pages 224-225), has been enacted in the following form and was signed by the High Commissioner on the 22nd April, 1933.

AN ORDINANCE TO REMOVE DOUBTS AS TO THE CONSTITUTION OF THE LOCAL COUNCIL OF TEL AVIV, AND TO VALIDATE CERTAIN RATES, TAXES AND FEES . IMPOSED BY THE COUNCIL.

WHEREAS a Local Council was constituted under the Local Councils Ordinance, 1921, for the Township of Tel Aviv at a time when the area of Tel Aviv formed part of the Municipality of Jaffa; and doubts have arisen as to the validity of the acts of the Local Council because Tel Aviv no longer forms part of the municipal area;

AND WHEREAS doubts have arisen also as to the validity of certain rates, taxes and fees imposed and collected by the Local Council;

BE IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof:—

Short title. !. This Ordinance may be cited as the Tel Aviv Local Council (Validation) Ordinance, 1933.

Validation of the 2. The Township of Tel Aviv Order dated the eleventh day Local Council. of March, 1921, and published in the Gazette of the first day of June, 1921, shall be deemed to have been lawfully made under the Local Councils Ordinance, 1921, as if ,the area of Tel Aviv still formed a part of the municipal area of Jaffa, and the Local Council of Tel Aviv shall be deemed to have been lawfully constituted thereunder.

Validation of 3.—(l)Any house tax charged upon a landlord prior to the certain rates, twenty-fourth day of June, 1929, as assessed by or on behah taxes and fees imposed and of the Tel Aviv Local Council, shall be deemed to have been charged by the lawfully imposed and charged upon him notwithstanding any Council. agreement between such landlord and his tenant for the payment of such tax by the tenant:

Provided that where the tax was paid by a tenant prior to the twenty-fourth day of June, 1929:— (a) such tax shall not be recoverable from the landlord of such tenant; and,

(b) such tenant shall not be entitled to a refund of the amount so paid.

(2) The - tax on business premises levied by the Tel Aviv Local Council prior to the first day of July, 1929, in accordance with assessments made by or on behalf of such Council, whether upon commercial premises or upon the offices of professional persons, shall be deemed to have been lawfully imposed and charged. 27th April, 1933 THE PALESTINE GAZETTE 449

(3) The service rate for the removal of refuse in the Township of Tel Aviv charged upon any person prior to the twenty-fourth day of June, 1929, shall be deemed to have been lawfully imposed and charged notwithstanding that such person was also chargeable

Provided that if the sum of the house rate and service rate payable by any person in respect of any premises exceeds twelve and a half per centum of the rental value of the premises as assessed by and on behalf of the Tel Aviv Local Council, the excess shall not be payable.

(4) The poll tax for education levied by the Local Counci of Tel Aviv prior to the first day of February, 1928, whether upon persons of the age of eighteen years and upwards, or upon heads of families, shall be deemed to have been lawfully imposed and charged; provided that no amount in respect thereof in excess of one pound and two hundred mils for each adult person per annum shall be recoverable in respect of such tax.

4. Any sums paid to the Local Council of Tel Aviv on account Certain payments of rates, taxes, fees or any other charges levied by the Council, !^6been^eVli a y and any sums paid to the Council by way of donations to the m ade. ^ Tel Aviv Embellishment Fund prior to the commencement of this Ordinance, shall be deemed to have been legally paid and shall not be recoverable.

5. Any sums payable to the Local Council of Tel Aviv by Payment of sums reason of the provisions of section 3 of this Ordinance shall be due to the payable by such number of instalments respectively payable on Counci1• such dates as the High Commissioner by order to be published in the Gazette shall direct.

AN ORDINANCE TO AMEND THE POST OFFICE ORDINANCE, 1930

BE IT ENACTED by the High Commissioner for Palestine with the advice of the Advisory Council thereof:—

Short title. !. This Ordinance may be cited as the Post Office (Amendment) Ordinance, 1933, and the Post Olfice Ordinance, 1930 (herein-

No. 20 of 1930. after cai]e(j the principal Ordinance) and this Ordinance may together be cited as the Post Office Ordinances, 1930-1933.

Amendment of 2. Sub-section (1) of section 15 of the principal Ordinance

section 15 of the snarj De de!eted and the following shall be substituted therefor:— principal ° Ordinance. "The Postmaster-General may detain any postal packet believed to contain any goods subject to Customs import duty or any smuggled goods and may open and examine the packet; and if he iinds any dutiable or smuggled goods may detain the packet, or deliver it on payment of any duty or fine or of any duty and fine under the Ordinance for the time being in force relating to Customs and such additional charges as may be authorized by regulations under this Ordinance: Provided that in the case of a letter packet such opening and examination shall (unless the cover bears an authori• zation by the sender for the packet to be opened in the post) take place either in the presence of the person to whom the packet is addressed or in that of such person's authorized agent but if, after notice in writing to such person requiring his attendance or that of his authorized agent left at or forwarded by post to the address on the packet, such person fails to attend himself or by his authorized agent the Postmaster-General may open and examine the packet notwithstanding the absence of such person."

Substitution of a 3. Section 44 of the principal Ordinance shall be deleted and

new section for the following shall be substituted therefor:— section 44 of the ° principal Ordinance. "44. In case the body having the control of any road resolves at any time to alter the alignment, width or level of such road or of any portion thereof under, in, over, along or across which any telegraph work is constructed, or to execute any other work on such road or portion thereof which may involve the removal or alteration of any telegraph work or expose such telegraph work to undue risk such body shall give to the Postmaster-General one month's notice in writing of the work which it proposes to execute, together with a plan indicating clearly the existing and the proposed works and the Postmaster- General shall at the expense of such body remove the telegraph work and replace it, if necessary, in such position and manner as may be determined by the High Commissioner."

1. These by-laws may be cited as the Kites By-Laws, 1933. Citation.

IT IS HEREBY NOTIFIED that the Anglo-Egyptian Provisional Commercial Agreement which was established in the correspondence between the Egyptian Foreign Minister and His Majesty's High Commissioner in Egypt, and which was published in the Official Gazette of the 1st December, 1930, has been extended for a further period of one year until the 16th February, 1934, by notes exchanged on the 16th and 19th February last, in terms similar to those of the notes exchanged in February, 1931.

The text of the notes exchanged in February, 1931, was published in the Official Gazette of the 1st July, 1931.

VISA REQUIREMENTS FOR TRAVEL TO CERTAIN ARAB STATES

1. British subjects proceeding to the Aden Protectorate (as distinct from the Aden Settlement, which is considered as forming part of British India), the Hadramaut, Bahrein, Kowait, Muscat and Oman and the Trucial Sheikhdoms require a special endorsement on their passports for the territory concerned, which may be granted gratis, and a visa, for which the standard fees of one and ten gold francs, respectively, should be levied for transit and ordinary visa.

2. Visa fees for foreigners, other than British subjects, proceeding to any of the abovementioned territories will be levied according to the nationality of the applicant, on the same scale as British visa fees, except in the case of nationals of countries with which His Majesty's Government in the United Kingdom have concluded visa abolition agreements, when the standard fees of ten gold francs and one gold franc for ordinary and transit visas, respectively, will be levied.

3. In the case of passengers proceeding by east-bound aeroplane to India, neither endorsement nor visa for any of the Arab Principalities will be necessary. Similarly, passengers by west-bound aeroplane will not require endorsements or visas if they are booked to proceed to Basra or places beyond

4. When, however, passengers propose to discontinue their journey at Kowait, Bahrein, Sharjah or Gwadur, or to break their journey at any of those places, they must comply with the ordinary passport requirements regarding endorsements and visas.
