The CIR Board meeting was held on Tuesday, November 17, 2009, at 6:00 p.m. in Room 430 of the Broward County Governmental Center. Mr. John Rude chaired the meeting. He introduced and welcomed new member Mr. Hugo Pacanins, who was appointed by Commissioner Kristin Jacobs to represent the South Florida Regional Transportation Authority.

A-1 MOTION TO RECOMMEND BROWARD MPO APPROVAL OF THE FDOT DISTRICT 4 DRAFT TENTATIVE WORK PROGRAM FOR FY 2010/11 – 2014/15

 A motion was made by Mr. Jeffrey Brodeur and seconded by Commander Thomas Murray to recommend Broward MPO approval of the FDOT District 4 Draft Tentative Work Program for FY 2010/11 – 2014/15.

Ms. Chris Heshmati gave a brief overview of the Tentative Work Program and how it fits into the overall process. She informed the members that there are many transit projects in the Work Program. Mr. Michael Ronskavitz stated that, usually, the Work Program is based on an adopted LRTP. However, the new LRTP is a significantly different plan than in the past. It is more transit focused. Working with FDOT, a hybrid, unfunded priority list based on the not yet adopted LRTP was prepared.

Mr. Ronskavitz introduced Ms. Stacey Miller from FDOT District 4, who is in charge of the Work Program for District 4. We are approximately halfway through the cycle in the development of an Adopted Work Program for Fiscal Years 2011- 15. The Tentative Work Program is essentially based on the Long Range Transportation Plan and the unfunded priority needs from the Plan. The final Tentative Work Program will be submitted to the Governor’s office and the Legislature. After review, it’s adopted through the cycle of the budget and ultimately the Work Program is adopted by the Secretary of Transportation. District 4 will lose over $22 million in funds due to a change in the statutory formula, which is a combination of population and gas tax receipts. Approximately 48% of the funding received in District 4 is allocated to Broward County.

Ms. Miller pointed out that 1C through 1F on the key projects listing are new to the MPO priority list and Tentative Work Program. Funding is continuing to be amassed for priority #5; right of way for the last piece of State Road 7. Seventy million dollars has been amassed so far; about $93 million more is needed. The right of way will start to be acquired in fiscal year 2014.

The Strategic Intermodal System (SIS) is a variety of corridors, hubs and facilities that are of key importance to the State of Florida. The funding set aside for this system is managed through FDOT’s Central Office in Tallahassee. Each District provides priorities to the Central Office, and the priorities are evaluated on a statewide basis.

Mr. Michael Smith asked for clarification on page 43 of 65, project #427819-1, was it NE 26th or 25th Street. Also on page 36 of 65, what project was dropped (project #230656-1)? Ms. Miller will look into this.

Mr. Jeffrey Brodeur asked why project #5 didn’t receive appropriate right-of-way CIR – 11/17/09 - Page 2 of 5 funding. According to Ms. Miller, this is the last piece of State Road 7. FDOT has been actively pursuing all of the sections south of 595 to the County Line for many years. This is the most expensive piece. All of the funds can’t be prioritized on a single project, but must insure that various projects are moving forward. While SR 7 needs to be completed in order to get bus rapid-transit fully functional, it is FDOT’s responsibility to insure that transit projects, roadway projects, and non-roadway bike and ped projects are all moving through the system simultaneously. Although money continues to be amassed, because of the nature of the project and the volume needed, it won’t be fully funded for several years. However, as more projects are moved off, more money will be put towards the last piece of SR 7. Obviously, it will compete with the MPO’s priorities one through four, which are transit oriented.

Mr. Michael Madfis asked why FDOT wasn’t taking advantage of the reduction in the cost of real estate. Ms. Miller stated that while the land value is less, the other associated costs of acquiring a parcel (such as the appraisal process, legal fees, etc), have not decreased.

In response to a question by Ms. Petey Kaletta, Ms. Miller stated that this piece is most expensive because right-of-way acquisition costs are astronomical.

Mr. Robert Dillon asked if all the projects in the Work Program were projects that would be started or completed in the period between 2011 and 2015. Ms. Miller responded in the affirmative.

Ms. Kaletta requested an explanation of terms. Ms. Miller responded that “to let” means to accept bids; “miscellaneous” means that a local entity is doing the project on behalf of FDOT, through either state or federal funds.

Ms. Kaletta asked if there was a warranty/guarantee on resurfacing contracts. According to Ms. Miller, the standard resurfacing program in Florida is approximately fifteen years. Also, there are asphalt warranties.

Mr. Smith asked if asphalt paving contracts must always go to the lowest bidder and if consideration would be given to “quiet paving” to cut down on road noise. Per Ms. Miller, FDOT does not have a specification that allows for anything other than standard pavements, which are based on the best pavement for the longest period of time. If there was a specification for something other than what is currently used, it would be considered in a low bid scenario. At this point, the options are asphalt pavements and concrete pavement.

Mr. Hugo Pacanins asked about three projects related to joint use development. He wanted to know what the allocation of funds through the five year program goes for, where the rent money goes. And, with the current reduction in construction costs, what happens with the excess funding when a project comes in under budget? Answering the last question first, Ms. Miller stated that FDOT evaluates every construction and right-of-way cost every year. The numbers in the adopted work program for construction and right-of-way costs aren’t necessarily consistent with the draft Work Program because it takes into account CIR – 11/17/09 - Page 3 of 5 adjustments. Any excess funds go into a contingency fund to be made available for future projects, unforeseen conditions, or paying for other projects if they can be incorporated. Approximately 12% is held in contingency each year. The funding is retained in District 4, unless it’s strategic intermodal systems funds, which goes back to central office for reallocation to other state-wide needs. To answer the first question, the small amounts of money listed are for District 4 staff to work each project on a yearly basis. Ultimately, revenue will be received from those projects. To date, the revenue has been deferred since none of the projects are actively underway. Future compensation will be returned to District 4 for use within the District.

In response to a question by Ms. Marion Henderson, Ms. Miller stated that the types of pavement markings around school zones must, at a minimum, meet federal guidelines and requirements. Any deviations must be addressed by the Federal Highway Administration.

Mr. Rude complimented Ms. Miller on her presentation and answers to the members’ questions.

*A-2 MOTION TO RECOMMEND BROWARD MPO ENDORSEMENT OF THE FLORIDA’S TURNPIKE ENTERPRISE (FTE) TENTATIVE WORK PROGRAM FOR FY 2010/11 – 2014/15.

 A Motion was made by Mr. Jeffrey Brodeur and seconded by Commander Thomas Murray to recommend Broward MPO endorsement of the Florida’s Turnpike Enterprise (FTE) Tentative Work Program for FY 2010/11 – 2014/15.

Ms. Chris Heshmati stated that Turnpike staff has indicated that toll revenues are down and there is less funding for Turnpike improvements. Therefore, in order to be on the conservative side, a few less dollars are being programmed for improvements on the main line.

Mr. Rude asked if a lane would be added from Griffin to Sunrise. Ms. Miller responded that this is an active construction project. The Turnpike is offering an incentive to the contractor to finish within a certain time-frame. There aren’t many incentives in the tentative Work Program.

Mr. Brodeur asked if there were penalties to the contractors. Ms. Miller replied that there are penalty clauses on every job. Each contractor is provided with a designated amount of time in the contract. For every day they do not meet that time-frame, they are charged liquidated damages.

Ms. Kaletta asked how speed and quality were balanced. Ms. Miller answered that standard specifications were required for road construction.

Mr. Brodeur reminded the members that the A1A Scenic Highway Designation ceremony would be held the following day. He thanked Ms. Miller for her articulate answers and suggested that the CIR send a letter of appreciation to her Supervisor.

Mr. Rude informed the members that a transit related meeting would be held at the next meeting in January.

Mr. Smith commented that society should think about the energy and money being expended for road widening, and its climate and environmental consequences. The ongoing program of new lane miles is unsustainable. Rail based is more sustainable and leads to a cleaner environment.

Mr. Rude thanked Mr. Ronskavitz for his efforts to fill the vacancies on the CIR and reminded the members that the next meeting is January 26, 2010.

DESCRIPTION/REQUESTED ACTION:

Status Report and Priority Project List for Potential Federal Stimulus II Funding (Jobs for Main Street Act) This item is provided for information. No action is required.

SUMMARY EXPLANATION/BACKGROUND:

 The Jobs for Main Street Act was passed by the House on December 16, 2009. Through this Act, the federal government may be providing additional transportation infrastructure funds. If the Senate approves this bill, states and MPOs around the nation will begin to work quickly toward implementation of qualifying projects.

 As proposed, MPOs in each state would be allocated 30% of their respective state’s funding amount. It would be each MPO’s responsibility to evaluate and prioritize local projects for its funding portion of the Jobs for Main Street Act. Eligible projects would need to be on the Federal Aid System, placed under contract within 90 days, support additional workers, and would require appropriate amendments into the Transportation Improvement Program (TIP).

 In order to be proactive, Broward MPO staff contacted city managers and TCC members from local agencies and municipalities on January 5, advising them of the potential for Jobs for Main Street funds. Attachment 1 is the electronic notification sent to all TCC members and city managers. This notification also includes additional information on potential funding amounts and project submittal requirements.

 Attachment 2 is the potential Jobs for Main Street project list that includes submittals from cities in response to the notification. The project list in Attachment 2 also includes projects from other local agencies and projects already programmed in the TIP. Please note that the projects on this list have not yet been prioritized. Prioritization and the latest stimulus funding status will be discussed at the meeting.

Dear Members of the Technical Coordinating Committee (TCC):

At the request of our Executive Director, Greg Stuart, I am contacting you about the potential availability of additional federal stimulus funds through the “Jobs for Main Street Act”.

The US House approved the Infrastructure and Jobs Investment Bill on December 16, 2009. It still needs to be passed by the Senate and is subject to change. The Senate has indicated it will not take up the bill until late January 2010 at the earliest.

The bill includes $37.3 billion in transportation infrastructure funding. The highway portion is $27.5 billion and under the proposed formula, Florida would receive approximately $1.35 billion which is similar to what the State received under the American Recovery and Reinvestment Act of 2009 (ARRA).

The Broward MPO highway share may be between $45 million (low estimate) to $110 million (high estimate). To qualify for funding, the bill requires 50% of the funds awarded to each MPO be under contract within 90 days of apportionment. After 90 days, the MPO would lose 50% of the funds not under contract, and the remaining funds not under contract within one year. Similar to ARRA funding, projects must meet all federal guidelines. The bill requires a 3% set-aside for Enhancement and 30% of the funds are to be sub-allocated by the MPO Board for locally selected projects.

The MPO staff is contacting City and County agencies in order to develop a list of projects that will qualify for the funds. Attached is a form to be used in listing potential projects that your City is committed to producing. Should your city or agency be interested in this opportunity, prioritized projects must be received electronically on the attached form by EOB on Tuesday, January 12, 2010. This will enable the MPO staff to provide the list of projects in the TCC and CIR meeting agendas that will be mailed out the following day.

Unfunded project submittals for ARRA funding from earlier in 2009 must be resubmitted at this time in order to be reconsidered.

Living the LRTP – Livability Planning and Mobility Hubs Study Efforts This item is provided for information. No action is required.

SUMMARY EXPLANATION/BACKGROUND:

 The 2035 Long Range Transportation Plan (LRTP) was approved by the Broward MPO Board on November 19, 2009. The plan identifies systemic transit improvements and prioritizes 20 Gateway Hubs, 20 Anchor Hubs, and 63 Community Hubs. The purpose of these Mobility Hubs is to provide direct connections among multiple transportation modes and land uses such as housing, office, retail and entertainment.

 At the November 2009 meeting, MPO staff presented the general concepts of the areawide Livability Studies, recognizing that the 2035 LRTP provides the basic framework for Broward County’s transportation system and that additional analysis is necessary to ensure that the Mobility Hubs achieve their full potential. Further, areawide Livability Studies will provide justification for amending the Mobility Hub designations and locations in the LRTP as needed. Justification for appropriate Mobility Hub designations and locations will assist the MPO in determining funding availability, including local and private sources, based on study recommendations developed in coordination with municipal and Broward County Transit staff.

 To this end, MPO staff is developing a prioritization process to assess future Livability Study areas based on criteria such the status of municipal plans for the Mobility Hub areas, system connectivity and other factors that advance the implementation of hubs. Based on this analysis, staff has begun a new livability planning effort to address the Mid-Town Plantation and Southwest Sunrise/Sawgrass Mills area. This new effort will explore community support and ultimately guide the location and design of hubs within the study area to support local area plans.

 Further, as a means to address congestion and mobility issues resulting from the removal of University Drive in Palm Beach County, the Transit-Supportive Infrastructure and Land Use Study – Northern Broward County has resulted in interim recommendations regarding the Mobility Hubs along corridors within the study area. The study assessed the pedestrian, bicycle, and transit suitability of corridors. Analysis determined that the State Road 7 and Sample Road corridors are conducive for transit-supportive development. Adjustments to the Mobility Hub locations are also suggested.

 The future proposed Livability Study planning efforts and the findings of the Northern Broward Study planning effort will be presented at the meeting. Feedback and questions will be addressed.

 The Broward MPO’s Unified Planning Work Program (UPWP) describes the detailed transportation planning activities and studies to be performed by the MPO staff and its consultants. Federal regulations require the development of a UPWP in metropolitan areas as part of the transportation planning process. The regulations require MPOs to work in cooperation with FDOT, transportation operating agencies and local partners to develop the program.

 The FY 2010/11 – 2011/12 UPWP (2-year) cycle starts by requesting input regarding activities, subjects, and/or studies that need to be included in the upcoming two-year UPWP.

 The Safe, Accountable, Flexible, and Efficient Transportation Equity Act – A Legacy for Users (SAFETY-LU) Section 134 of Title 23, United State Code, requires an annual listing of transportation improvement projects for which federal funds have been obligated in the most recently completed federal fiscal year (FY 10/1/2008 – 9/30/2009). In addition, these projects shall be published or otherwise made available by the Broward Metropolitan Planning Organization for public review.

SUMMARY EXPLANATION/BACKGROUND:

 At the December 11, 2009, South Florida Regional Transportation Authority (SFRTA) Board meeting, the Board approved proceeding with a sole source agreement allowing the SFRTA to procure, with Miami-Dade Transit (MDT), an Automated Fare Collection System (AFCS) not-to- exceed $15,000,000. The implementation of this system between the SFRTA and MDT will provide a regional platform. This platform will include all types of rail technology and buses with a multitude of fares for the various transit services provided. Subsequent to the implementation of the regional platform, other local transit systems can join in, if desired.

 At the same SFRTA meeting, it was mentioned that across the nation the challenge has been the interoperability of the various technologies in place. They have to ‘talk to each other”. Other agencies would need to have the proper ‘readers’ and technology to communicate with the regional platform, now under implementation through the AFCS. When asked how the other two transit systems in the region were involved, Mr. Chris Walton, Director of the Broward County Transportation Department informed the SFRTA Board that Broward County Transit was in discussions with the other transit agencies to share equipment.

 In support of coordination and compatibility of the various technologies, the SFRTA Board also approved an amendment to their Universal Automated Fare Collection (UAFC) System Procurement and Regional Smart Card program. This amendment was to ensure that the technologies are compatible with AFCS. This program supports the above mentioned efforts to procure a fare collection system and plan a regional, multi- agency smart card plan of action between the SFRTA and MDT.
