Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of February 13, 2018, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on January 13, 2018, and as you were notified in Status Update Letter 19-18077, issued on February 15, 2018.

The proposal, as approved, consists of exterior alterations at, and adjacent to, the south facade of the lower level (17th floor) of the upper penthouse, including constructing a one-story metal framed glass enclosed rooftop addition and enlarging and combining existing masonry openings by removing six (6) one-over-one double-hung windows and a portion of the adjoining brickwork and installing three (3) metal and glass assemblies featuring a combination of single-light doors and windows, as well as installing a glass railing at the inboard sides of the parapets at the south facade and at portions of the east and west facades of the lower penthouse, adjacent to the upper penthouse terrace, as shown in a digital presentation, titled “75 Varick Street/Hines,” dated February 13, 2018 and prepared by Architecture + Information, including 49 slides, consisting of photographs, drawings, photomontages, and renderings, all presented as components of the application at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the Holland Plaza Building Designation Report describes 73-93 Varick Street (aka 73-99 Watts Street and 431-475 ) as a Modern-Classical style manufacturing building designed by Ely Jacques Kahn and built in 1930.

With regard to this proposal, the Commission found that the work will not damage or conceal any significant architectural features; that the proposed addition will not obscure the original massing of the building or diminish a significant silhouette; that the addition will be small in relation to the size of the building and simple in design, and will feature framing with spacing that relates well to the proportions of the building’s design, helping it remain a harmonious secondary presence; that the enlargement of the existing masonry openings and proposed new infill will not detract from any significant features, and when seen from public thoroughfares at a distance, will be barely perceptible; that the glass railings will be standard in height and simply designed, with a non-reflective coating, and when seen from public thoroughfares within the context of the existing penthouse and other rooftop accretions, will have a discreet presence; and that the work will not detract from the special architectural or historic character of the landmark. Based on these findings, the Commission determined the work to be appropriate to the building and voted to approve the application.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of two (2) or more sets of signed and sealed Department of Building filing drawings showing the approved design.

Accordingly, staff reviewed these materials and noted that they omit the construction of the one-story rooftop addition, which will be included in the second phase of work after the Commission's review and approval of the signed and sealed Department of Buildings filing drawings showing the approved design for the addition. Additionally, the scope of work was expanded and modified to include replacing an additional five (5) one-over-one double-hung windows and a portion of the adjacent brickwork with three (3) assemblies of light brown painted metal and glass single-light bi-fold doors, extending the length of the proposed glass railings along the inboard sides of the east and west parapets from the returns to the middle of the parapets, installing an additional glass railing at the inboard side of a portion of the north parapet, and enlarging an existing brick stair bulkhead by raising the roof 6 1/2" and extending the bulkhead horizontally by 6'-2"; alterations at the east facade of the upper penthouse, including installing wall-mounted ducts, replacing a one-over-one double-hung window with a light brown painted metal door and single-light transom, in conjunction with enlarging the opening by lowering the sill and removing a portion of the adjoining brickwork, as well as alterations at the south facade of the upper penthouse, including sealing an opening by replacing an existing modern door with plain brickwork, replacing an existing modern door and single-light transom with a light brown painted one-over-one double-hung window, in conjunction with reducing the opening by raising the sill and infilling the opening with brickwork, and replacing a one-over- one double-hung window with a light brown painted metal door and single-light transom, in conjunction with reducing the opening by lowering the sill and removing a portion of the adjoining brickwork; replacing Page 2 Issued: 08/07/18 DOCKET #: LPC-19-27833 roofing membrane in-kind and installing pavers at the roof of the lower penthouse; and interior alterations at the 17th and 18th floors, including the demolition and construction of nonbearing partitions and finishes, as well as mechanical, electrical, plumbing, HVAC, and structural work.

With regard to the changes and additional work, staff found that the commencement of the specified work, independently of the full scope of the approved work, will not detract from any significant architectural features or draw undue attention to the work that will commence first; that none of the windows to be removed are special windows, as defined by Section 3 or Appendix C of the Rules; that the proposed enlargement of openings at the south facade, which will be similar to the openings and infill approved for other bays at this penthouse, will support a unified facade; that the additional glass railings will be standard in height, simply designed, and feature a non-reflective coating, thereby helping them to have a discreet presence when seen at a distance from public thoroughfares in the context of the existing rooftop accretions; that the bulkhead will only be moderately increased in size and will remain simply designed and only minimally visible, if at all, from public thoroughfares at a distance and against a background of brickwork and other, larger rooftop accretions; that the wall-mounted ducts will be minimally visible, if at all, from public thoroughfares at a distance; that the mounting structure for the ducts will be attached to the masonry wall through the mortar joints and its installation will be reversible; that the windows and doors at the south and east facades will be installed within existing masonry openings and openings to be enlarged and reduced in accordance with Section 2-15 of the Rules, and that such modification will not alter or destroy protected features; that the proposed finish of the windows and doors will be in keeping with the typical color palette of buildings of this type, style, and age; that the replacement masonry will match the historic masonry in terms of material, dimensions, texture, finish, profiles and details; that the pointing mortar will be compatible with the masonry in terms of composition and will match the historic mortar in terms of profiles, texture, and finish; and that none of the work will detract from any significant architectural features. Additionally, staff found that the design approved by the Commission has been maintained. Based on these and the above findings, the drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 19-27833 is being issued.

PLEASE NOTE: This permit is contingent upon the Commission's review and approval of installed sample mockups of replacement bricks and repointing prior to the commencement of work. Samples should be installed adjacent to clean, original surface(s) being repaired; allowed to cure; and cleaned of residue. Submit clear, color digital photographs of all samples to Julianne Wiesner-Chianese for review, or to schedule a site visit. This permit is also contingent on the understanding that the work will be performed by hand and when the temperature remains a constant 45 degrees Fahrenheit or above for a 72 hour period from the commencement of the work.

PLEASE ALSO NOTE: No construction of the rooftop addition may commence prior to the Commission's review and approval of all Department of Buildings drawings for this work. Once the drawings are ready, submit the drawings, along with a cover letter requesting a Miscellaneous/Amendment, and any relevant supporting materials to the Commission.

This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of the approval. The work is limited to what is contained in the perforated document. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fine.
