6. County Warden’s Welcome and Remarks

Warden Bain welcomed the members and noted that he had attended the following events:

• Cops for Kids Camp at Gesstwood Camp and Retreat Centre

• Tomato Festival

• Tecumseh Corn Festival. Warden Bain also participated in the ALS Ice Bucket challenge

• Western Ontario Warden’s Caucus meeting in London – The Warden advised that a joint meeting had taken place with the Wardens Caucus where issues such as high speed internet and job creation were discussed.

• Harrow Fair

• AMO Convention – Warden Bain advised that he and Mr. Gregg and Mr. McNamara had met with the Ministry of Health representatives regarding additional funding for the Windsor Essex County Health Unit.

• Leamington Raceway Opening on Sunday, September 7, 2014 at 1:30 PM at the Leamington Fairground.

• Warden Bain introduced the new Chief Librarian, Robin Greenall and welcomed her to the County of Essex.

B) Report Number 2014-R025-ENG-0903-TRB from Tom Bateman, P. Eng. County Engineer, dated September 3, 2014 regarding County Road 22 Capacity and Safety Improvement Program Phase 5B, Contract Award.

179-14 Moved by Mr. Antaya Seconded by Mr. McDermott That the Warden and Clerk be authorized to execute an agreement with Dillon Consulting Ltd. for the provision of Contract Administration/On Site Services for Phase 5B of the County Road 22 Capacity and Safety Improvement Program, and

That the tender for the construction of Phase 5B of the County Road 22 Capacity and Safety Improvement Program be awarded as follows:

Project No. 13107-545 County Road 22 – Phase 5B to:

Coco Paving Inc. for a Total Tender Amount of $3,178,000.00 plus H.S.T. Carried

Ms. Hardcastle questioned when the report previously requested by Council reviewing the designation of County Roads, would be coming to Council. Mr. Gregg stated that this report would be brought to the newly elected Council in early 2015.

C) Report Number 2014-R007-EMS-0903-BK from Bruce Krauter, Chief, Essex-Windsor Emergency Medical Services, dated September 3, 2014 regarding The Corporation of the Town of Essex and EMS Station Lease Agreement.

180-14 Moved by Mr. Hurst Seconded by Mr. Paterson That the Lease Agreement pertaining to the property municipally known as 53 Alice Street North, Essex, Ontario, be approved for a fixed term of twenty (20) years, from February 15, 2013 to February 14, 2033 at a fixed cost of $11.46 per square foot (plus applicable taxes) of usable floor area and that By-Law #46-2014 be adopted authorizing the Warden and the Clerk to execute the agreement on behalf of the Corporation of the County of Essex. Carried

D) Report Number 2014-R008-EMS-0903-BK, from Bruce Krauter, Chief, Essex-Windsor Emergency Medical Services, dated September 3, 2014, re: Delegation of Authority to Sign EMS Special Events Service Agreements.

Mr. Paterson questioned if a report could be provided by EMS which outlined how many hours were spent on special events and the amount billed and received. Chief Krauter advised that this information was tracked and could be provided.

181-14 Moved by Mr. Paterson Seconded by Mr. Fazio That By-Law #48-2014 be adopted, under which authority to execute Essex-Windsor Emergency Medical Services’ (EWEMS) Special Events Services Agreements with purchasers of EWEMS services would be delegated by Essex County Council to the Chief of Essex-Windsor Emergency Medical Services and Chief Administrative Officer or senior administration appointed to assume their duties during periods of absences. Carried

Mrs. Brennan and Ms. Mustac unveiled the new County of Essex website and County Wide Active Transportation System website.

B) Public Reporting of Closed Meeting held at 6:00 PM, September 3, 2014.

A Closed Meeting of Essex County Council was held at 6:00 PM, on September 3, 2014, pursuant to Section 239(2)(b)(d) and (e) of the Municipal Act, 2001.

During that meeting, Administration provided information on a personal matter about an identifiable individual, labour relations matters, and potential litigation before an administrative tribunal and received direction from Council on how to proceed.

A) Maryvale Adolescent and Family Services – Smile Cookie Cook-off

Mr. Carrick encouraged everyone to purchase Smile Cookies from Tim Horton’s from September 15 – 22, 2014. He noted that 100% of the proceeds would go to Maryvale Adolescent and Family Services which was a mental health facility that treats youth with challenges.

B) Accessibility Workshop – October 30, 2014

Mr. Wright reminded members of Council of the upcoming Accessibility Workshop scheduled for Thursday, October 30, 2014.

Double Hatter Firefighter Issue in the Media

Issue: Professional firefighters as volunteer firefighters during their free time.

Yesterday, this issue was profiled in a front page Globe and Mail story about a firefighter who is taking on the union’s actions as relates to ‘double hatting’. ‘Double hatting’ is forbidden by the International Association of Fire Fighters and its Ontario union, The Ontario Professional Fire Fighters Association. Over the years, union charges have been brought against individuals who are double hatters and as a result, generally stop their involvement as a volunteer. Double hatters want to protect family, friends and the community where they live and are an important backbone of fire services within smaller municipalities and its loss proves challenging. Many double hatters were volunteer fire fighters before becoming salaried professionals.

Tom Hunse, a Toronto professional fire fighter for 22 years and a 26 year volunteer with Innisfil Fire Services and his union, is demanding that since he has not stopped his volunteer work that he be fired from his Toronto job. Mr. Hunse is taking a principled stand – that how he uses his free time is his to determine. Yesterday’s Globe and Mail and other major news outlets are now covering his story. The public’s reaction is that Hunse and other double hatters should be able to use their skills and knowledge in their free time in his own community without repercussion. An arbitration hearing is set for later this year that would deal with his permanent employment status with the City since he is no longer a member in good standing and only Association members in good standing are able to be members of the full-time bargaining unit.

Mr. Hunse has filed a Duty for Fair Representation Application with the Ontario Labour Relations Board against the Toronto Professional Fire Fighters Association. The "duty of fair representation" provisions of the Labour Relations Act stipulate that a trade union shall not act in a manner that is arbitrary, discriminatory or in bad faith in representing employees.

AMO has requested intervener status as this matter affects many municipal governments and the double hatters that work. This is a matter of fairness and personal liberty as fire fighters should be able to use their free time as they wish to without reprisal or interference. These volunteers should be supported, not pressured for wanting to protect their neighbours in their home communities. The union does not object to full time firefighters working other jobs which many do.

What is the solution to this threat? A simple change to provincial law would prevent this type of union interference. To our knowledge, every Canadian province has such protection, except for Ontario and Newfoundland. It is time for Ontario to give our volunteer firefighters the same freedom and protection that other employees in Ontario enjoy, as well as those fire fighters everywhere else in the nation.

Attached is a draft council resolution your council may wish to pass that asks the Ontario government to provide this protection to double hatter firefighters who want to serve their home communities in their spare time.

As mentioned, double hatters are worried about being threatened with job loss and municipal governments have been watching this matter closely. If you feel your municipality is vulnerable, please let us know.

25 Draft Council Resolution to Support Double Hatters’ rights

WHEREAS the training and certification of professional firefighters is established and mandated by the Province of Ontario under the Fire Protection and Prevention Act, 1997;

AND WHEREAS it is the responsibility of municipalities to establish fire departments and appoint fire chiefs to provide fire protection services as they determine may be necessary in accordance with their needs and circumstances;

AND WHEREAS many Ontario municipalities rely on both full time and volunteer firefighters in order to provide fire protection;

AND WHEREAS the International Association of Fire Fighters ("IAFF") Constitution prohibits full time firefighters from volunteering as firefighters in another municipal jurisdiction (i.e. "Double Hatting");

AND WHEREAS the IAFF’s stance on Double Hatting is specifically prohibited by legislation in almost all provinces in Canada and much of the United States;

AND WHEREAS a volunteer firefighter in the Innisfil Fire and Rescue Service is challenging the IAFF ban on Double Hatting and their expulsions from that union because of his desire to continue volunteering while being employed as a full-time firefighter in another jurisdiction;

AND WHEREAS the right of individuals to use their free time in service of their community is a fundamental right in a free, open and democratic society.

NOW THEREFORE BE IT RESOLVED that the Council of ______requests that the Province of Ontario amend the Fire Protection and Prevention Act, 1997 with respect to salaried firefighters who also work as volunteer firefighters, such that if a person is denied membership in an association of firefighters, is expelled or disciplined by the association or engages in reasonable dissent within the association in connection with this kind of dual role, the association is not permitted to require the employer to refuse to employ the person as a salaried firefighter, terminate his or her employment as a salaried firefighter or refuse to assign the person to fire protection services.

This resolution should be sent to the following:

Provincial Matters The Ontario Community Environment Fund supports environmental improvement projects in a watershed where a violation occurred. Applications accepted until November 5, 2014.

As of January 1, 2015, changes to the Ontario Building Code will allow for the construction of wood framed buildings up to six storeys. Requirements are also included to ensure that these buildings meet enhanced fire safety standards.

Provincial Mandate Letters Released

Today Premier Wynne released all the mandate letters that outline the key priorities for every Cabinet Minister and their respective ministry. The thirty letters focus on the government’s work expected to be completed over the next four years. They contain the priority provincial initiatives – many of which were stated in the government’s Throne speech, 2014 Budget, and in their election platform. They do not necessarily include all the activities such as the regular work expected to be done by each ministry and mandated reviews of various legislation. The letters can be found at http://www.ontario.ca/government/mandate-letters.

AMO is in the process of reviewing these letters. Should there be any surprises or unexpected gaps, we will let you know shortly. The AMO Board of Directors and staff will use the content of the mandate letters as we set our policy and advocacy objectives.

MAYORS CALL FOR IMMEDIATE ACTION TO KEEP DRINKING WATER SAFE IN THE GREAT LAKES AND ST. LAWRENCE RIVER Toledo water crisis a ‘wake up call’

Today, at the Mayors Drinking Water Summit, Chicago Mayor Rahm Emanuel and fellow Great Lakes and St. Lawrence Cities Initiative mayors from across the region called for immediate action to protect the Great Lakes and St. Lawrence River as a source of drinking water for over 40 million people.

“Today, my fellow mayors and I stand united in our call for more, better and faster action to protect Great Lakes and St. Lawrence residents from the kind of threat that recently closed down Toledo’s drinking water system,” said Mayor Rahm Emanuel. “This situation cannot and will not be tolerated as the new normal.”

The summit, hosted by Mayor Emanuel and the Great Lakes and St. Lawrence Cities Initiative, brought together twenty U.S. and Canadian mayors and leading experts in drinking water and environmental protection. Topics of discussion included threats to drinking water, with a particular focus on the causes of the Toledo drinking water shut down. The mayors were joined by U.S. Environmental Protection Agency (EPA) Administrator Gina McCarthy, who explained the federal government’s response to the threat of microcystin toxins in Lake Erie.

“The microcystin toxin as seen in Toledo’s drinking water represents a significant public health threat, ” said Racine Mayor John Dickert, chair of the Great Lakes and St. Lawrence Cities Initiative. “Mayors will work with federal, state and provincial authorities, agricultural interests, residents and businesses to ensure that everyone is doing their part to eliminate this threat to Great Lakes drinking water.”

Following expert presentations and in-depth deliberations, the mayors called for action:

 By USEPA to establish a common limit and an emergency response protocol for microcystin in drinking water for the Great Lakes and St. Lawrence region;

 By Great Lakes states to establish a phosphorus open lake water quality standard;

 By agriculture to further reduce the runoff from farms into Lake Erie, including better nutrient management and application of the ‘4R Nutrient Stewardship’ program;

 By municipalities to further reduce phosphorus loadings through more green infrastructure, better treatment plant operations, and pollution prevention measures.

“We receive most of our water in the St. Lawrence River from the Great Lakes,” said Québec City Mayor and Québec Metropolitan Community President Régis Labeaume, “With shared responsibility for these waters, Canadian cities stand as strong partners in cleaning up Lake Erie and protecting the remaining Great Lakes from all threats to our drinking water.”

The Great Lakes and St. Lawrence Cities Initiative (www.glslcities.org) is a binational coalition of 114 mayors and other local officials representing over 17 million people, that works actively with federal, state, tribal, first nation and provincial governments and other stakeholders to advance the protection, restoration and promotion of the Great Lakes and St. Lawrence River basin.

Please be advised that at its meeting held Tuesday, August 26, 2014 the Council of The Township of Greater Madawaska adopted the following resolution:

PROTECTION OF PUBLIC PARTICIPATION ACT, 2104 (BILL 83)

WHEREAS Bill 83, Protection of Public Participation Act, 2014, being “An Statutory Powers of Procedure Act in order to protect expression on matters of public interest” (hereinafter “Bill 83”), was introduced into the Provincial Legislature in June 2013;

WHEREAS Bill 83 was introduced by the government out of concern that Strategic Lawsuits Against Public Participation (SLAPP), being lawsuits brought before the court by one party against another party or individual as a tactic for silencing or intimidating the other party, are having a chilling effect on public participation on contentious matters of public interest in Ontario;

WHEREAS Bill 83 is intended to protect persons from being subjected to legal proceedings that would stifle their ability to speak out on public issues or promote, in the public interest, action by the public or any level of government;

WHEREAS the ability to engage in public participation forums is the foundation of a democratic society;

65 WHEREAS there exist a number of high profile environmental issues in Township of Greater Madawaska that are of public interest and that have generated a great deal of debate in the community;

WHEREAS Council is of the opinion that public participation in matters of public interest ought to be encouraged and not discouraged through tactics such as strategic lawsuits against public participation;

WHEREAS provision is made in Bill 83 to amend the Courts of Justice Act for such SLAPP legal proceedings to be dismissed at an early stage and for defendants subjected to such proceedings to be indemnified for incurred costs in such proceedings with the potential for additional damages to be awarded in appropriate circumstances;

WHEREAS provision is made in Bill 83 to amend the Libel and Slander Act to state that any qualified privilege that applies in respect of an oral or written communication on a matter of public interest between two or more persons who have a direct interest in the matter applies regardless of whether the communication is witnessed or reported on by media representatives or other persons;

WHEREAS provision is made in Bill 83 to amend the Statutory Powers Procedure Act to provide that submissions for a costs order in a proceeding must be made in writing, unless the tribunal determines that to do so is likely to cause a party to the proceeding significant prejudice;

THEREFORE BE IT RESOLVED THAT the Council of The Township of Greater Madawaska advise the newly elected Premier of the Province of Ontario, the Honorable Kathleen Wynne, MP’s and MPP’s, party leaders and all Ontario municipalities of its support for the Protection of Public Participation Act, 2014 and request that Bill 83 be re-introduced forthwith in the Legislature;

THAT the Association of Municipalities of Ontario be requested to support this resolution.

Emilie Bastien, BSW, University of Windsor. Emilie is currently working to graduate from the undergraduate program this upcoming April, along with a double minor in psychology and sociology.

Erin Flannery, MSW, Wayne State University. Erin is in her first

70 year of the MSW program at Wayne State University. She holds a M.Sc. in biological sciences and a BA in both psychology and biology from the University of Windsor.

Melissa (Missy) Sauro, BSW, University of Windsor. After returning to Windsor-Essex from Carleton University, where she studied Public Affairs and Policy Management, Missy has been dedicated to improving local opportunities for youth.

Ema Sisic, MSW, Wayne State University. Ema is in her first year of the MSW program at Wayne State University. She has a Bachelor degree in Behaviour, Cognition and Neuroscience and four years of research experience on animal cognition.

The Faculty of Law is proud to announce that lawyer, social worker and community advocate Adam Vasey will be joining Windsor Law part-time this Fall as a Law Foundation Community Leadership in Justice Fellow.

The Director of Pathway to Potential and instructor in Windsor Law's MSW/JD program is also currently supervising student interns working on a joint Windsor Law/Pathway to Potential project funded through the university's Strategic Priority Fund. He will spend his fellowship during the 2014-2015 academic year at Windsor Law exploring how the principles and practices of social work might inform the ways in which lawyers formulate responses to poverty.

The Law Foundation Fellowship is awarded in a competitive process and we congratulate Vasey on this achievement that

Mr. Patterson introduced Mr. Tom Zadorsky, Manager, Projects, Canada Post.

Mr. Patterson presented a PowerPoint presentation to the Committee on the conversion from door to door mail delivery to community mailboxes. He noted that he was not sure when this would be coming to Essex County communities.

He explained that financial pressures were the main reason for going to community mailboxes. Due to the fact that less and less mail is delivered because of internet use, financial savings had to be found.

The new community boxes have been tested by persons with various mobility disabilities to ensure that they can be opened by anyone. The new boxes were lower to the ground and the slots were enlarged to accommodate bubble packages. As well, there are two compartments in the community boxes for parcels.

He acknowledged that the challenge would be the switchover for people who have always had door-to-door mail delivery. Mr. Patterson also stated that in some cases, the community mailbox may not work for an individual due to health reasons. Letters would be sent out to people asking that they advise Canada Post if they will not be able to use the community mailboxes. If a person feels they are not able to use the community mailboxes, they can contact Canada Post and an accommodation package would then be sent out to this person. An authorization from a health care professional would be required stating that the person would not be able to use a community mailbox. The information would be reviewed by a team at Canada Post and then if deemed necessary, arrangements would be made for the mail to be delivered to their door, but not on a daily basis.

Mr. Patterson also advised that new engineering standards are required for the new community mailboxes. The boxes would be located on concrete pads instead of cement blocks. Canada Post is working with municipalities to come up with the best locations for the boxes. He also advised that existing community mailboxes may not necessarily be replaced until they reach their normal replacement age. If it is felt that a box needed to be replaced, the individual can contact the phone number on the box and report the problem. This starts a ticket process.

Mr. Patterson stated that he would be speaking to a number of municipalities and noted that he appreciated receiving input from the accessibility advisory committees.

B) Mr. Rob Maisonville, Director of Corporate Services/Treasurer, County of Essex to speak to the Essex County Accessibility Advisory Committee regarding an update on the Civic Centre renovations.

Mr. Maisonville showed the plans for the renovation of the main lobby and washrooms located near the lobby in the Civic Centre.

The following suggestions were made:

• One of the men’s accessible stalls may not be large enough to accommodate a wheelchair and have the door closed. It was suggested that perhaps 2 of the urinals at one end could be removed to allow for more space.

• Have some sort of signage on the other accessible family washroom located around the corner from the other washrooms indicating that it is an accessible family washroom.

• Dryer height and locations should be considered

• Install rails at the back of the toilets and side

• One of the women’s accessible washrooms looked to be located too close to the wall. Mr. Maisonville will look into this.

An update on the Agenda, registration form, budget, evaluation form and promotional information was provided.

• All the speakers have been arranged – Gayle Jones, Accessibility and Diversity Officer, City of Windsor would be replacing Dory Azar and would be speaking on Design of Public Spaces

• Workshop Registration Form and Information Fair form are completed and would be sent out on September 12, 2014 along with the 211 Fax broadcast. The forms would also be put up on the website.

• Speaker system – The media centre had been contacted and they indicated that they did have a large function at the Caboto Club that night but that they may have extra equipment that could be used at the Workshop. Mrs. Brennan stated that she would also be looking possibly at using the Hall’s speaker system.

Mrs. Saxon agreed to review the “Talk Video” to determine the length and the Committee would determine what would be included in their 7:00 PM delegation to County Council at their next meeting.

A) Closed Captioning of County Council Meeting Telecasts on Cogeco

The Programming and Community Relations Manager for TVCogeco in Windsor has advised that Cogeco Cable Canada LP will be providing the funding required to have closed captioning on the live broadcasts of Essex County Council meetings. This includes the cost of purchasing an encoder, as well as the cost of the captioning service from Broadcast Captioning and Consulting Services (BCCS), to transcribe the telecast. This amounts to a total investment of over $16,000, plus taxes.

To seek County Council’s approval of an amended policy providing for non- union performance management.

Background

The original Performance Management Policy (created in 1995) applied only to Department Heads at the Corporation. For a variety of reasons and circumstances, the conduct of formal performance appraisals of Department Heads has not occurred for a considerable period of time. Notwithstanding this reality, regular and ongoing discussions have occurred between the CAO and Department Heads regarding performance issues and management.

In December 2013, Administration committed to County Council to reintroduce a performance appraisal process for all nonunion employees in 2014.

Discussion

The Corporation’s Management Team (i.e. Department Heads) reviewed the 1995 policy and has made considerable edits to it, reflecting the County’s

current Council and organizational structure and operating environment. The result is that the original policy has essentially been recast. The new draft policy developed by the Management Team is attached as Appendix I.

The amended Performance Management policy is not intended to apply to non-union employees at the Essex County Library or the Essex Windsor Solid Waste Authority.

The most significant and relevant changes include:

- Expansion to include all non-union employees

- Appraisals are to be completed on an employee’s anniversary date

- Progressing to the next step on the 5 step pay grid is contingent on receiving at least a “meets expectations” rating

A comprehensive tool has been developed to assist supervisors and employees in the completion and administration of the performance management process. Supervisors have also been provided with training with respect to effective completion of performance appraisals and communication of appraisal results.

Recommendation

That County Council approve the proposed Performance Management Planning – Non-Union Employees Policy 95-003 as attached.

1.0 Purpose

To provide employees of the Corporation, the opportunity to understand where they stand relative to their job performance. Performance evaluation is intended to be a constructive and positive experience whereby the Corporation and the employee jointly discuss and agree as to the expectations both have towards carrying out the work to be done.

2.0 Scope

Applies to all non-union employees in all departments, divisions or sections of the Corporation.

3.0 Responsibility

1) The Chief Administrative Officer and Warden are responsible to ensure that the requirements of this policy are implemented and adhered to.

2) The Director, Human Resources is responsible for the timely administration of the yearly process and to advise on best practices.

4.0 Performance Management

1) Performance Management is a process for evaluating job performance as a means of measuring efficiency and effectiveness of the organizations operations; provide employees with meaningful information about their work; aid the Corporation in making decisions related to such areas as training and development, work assignments, promotion, compensation, retention and short and long range planning of its operations.

2) Focus maximum attention upon achievement of assigned duties as set out in the Job Fact Sheet.

3) Provide a vehicle which enables the accurate assessment of individual strengths and weaknesses, relate these assessments to current and future needs, and aid management in making staffing and organizational plans.

4) Challenge employees to continually improve performance and personal effectiveness.

5) Keep employees continually informed of their strengths and weaknesses so they are in a position to control their own progress.

6) Evaluation process is intended to be participatory in nature. In addition to the employee’s direct supervisor, both the employee and their chain of supervision up to their respective Department Head will have input.

7) The Warden will be accountable for conducting the CAO’s Performance Review.

5.0 Process

1) Performance reviews will be completed within one month of an employee’s anniversary date.

2) Human Resources will advise managers and supervisors when an employee’s performance review is due.

3) Completed and signed performance appraisals are to be forwarded to the Director, Human Resources for central filing, within 1 month of the employee’s anniversary date.

4) For cases where an employee’s performance is judged to “Not Meet Expectations”, the employee, direct supervisor, applicable Department Head, and the Director, Human Resources will document a customized development plan.

6.0 Administration for Employees not yet at Job Rate (Step 5)

1) To progress to the next step on their pay grid, the employee’s performance rating must be at least “Meets Expectations” This is an overall judgment/assessment by the employee’s immediate supervisor. Before communicating a rating to an employee, the supervisor is required to review their rationale with their Department Head. Ratings below “meets Expectations” should also be discussed with the Director, Human Resources.

2) If the employee’s anniversary date (when they would normally progress to the next step) is within 3 months of when the most recent performance appraisal was conducted, then the results of that appraisal will be referenced in determining eligibility to progress to the next step. Otherwise, an additional performance appraisal will be conducted at the time of the employee’s anniversary.

3) If an employee’s pay is at a step other than step 5, for reasons other than their anniversary date (such as a change in pay band because of their job being upgraded through job evaluation), the effective date for the progression to the next step will be deemed to be one year from when they were placed at their current step.

Purpose

The purpose of this report is to provide Council with an update with respect to the extent that the Corporation utilizes commodity price hedging and recommend continued participation with the Association of Municipalities of Ontario / Local Authority Services Ltd. (AMO/LAS) Procurement Programs, to procure, in bulk, electricity and natural gas in the open market on behalf of the partnering municipalities.

Background

In accordance with the Municipal Act, 2001, regulation 653/05, and the County of Essex Commodity Price Hedging Policy (Policy #06-001), the Treasurer is required to report annually on all commodity price hedging agreements in place. The goal of the commodity price hedging policy is to allow the Treasurer to enter into fixed price agreements for the future delivery of all or any portion of a commodity when deemed advantageous for the County to do so.

The County continues to utilize the services of AMO/LAS Procurement Programs. As part of the strategy, a hedging contract is used to minimize potential risk of spot market fluctuations.

A hedge is merely a financial agreement that fixes the price to be paid by the municipality for the future delivery of a commodity. A hedge is typically used to reduce costs fluctuations and provide cost certainty.

The County’s current agreement with LAS includes a hedge of 65% of its total electricity requirements, exclusive of street light accounts, which are kept on the spot market because of low non-peak rates.

For natural gas, LAS purchases incremental gas contracts at various points each year with a goal of building a total hedge portfolio of 80-90% of program requirements for the current year, with the remaining consumption settling at prevailing market rates.

Discussion

Electricity

The commodity price of electricity in Ontario is comprised of two components, one being the spot market (also referred to Hourly Ontario Electricity Price – HOEP) and the other being the Global Adjustment. The Global Adjustment is the mechanism that has been put in place to collect from consumers the difference between the HOEP price and the price the government has guaranteed to the suppliers of various renewable energy sources.

Based on the most recent data provided from LAS (July 2014), as highlighted in Table 1 on the following page, participation in the bulk purchase program have resulted in a commodity cost savings of approximately 1.43 cents/kWh for accounts below 250,000kWh and approximately 0.59 cents/kWh for accounts above 250,000kWh, compared to the RPP/Time of Use and/or average market HOEP + GA rates. With an estimated annual electrical use of approximately 5.7 million kWh, this translates into a savings of approximately $68,000 for the period from August 2013 through July 2014.

The term of the LAS Electrical Agreement is annual, automatically renewing from year to year unless and until terminated by either Party upon 180 days prior written notice.

Natural Gas

As noted above, the County is a participating municipality of the LAS Natural Gas Procurement Program. Average natural gas pricing through LAS for 2014 is approximately 16.3 cents/m3. Estimated average market price for the 12 month period of 2014 is approximately 20.22 cents/m3(current price effective July 2014 is 22.59 cents/m3). With an estimate aggregate annual volume of 875,000m3, participation in the LAS program will result in an annual savings of approximately $34,000 for 2014 in comparison to open market rates.

The term of the LAS Natural Gas Agreement is annual, automatically renewing from year to year unless and until terminated by either Party upon 120 days written notice, prior to the program's Oct 31 gas flow year-end date. Should such notice be given, the participating municipality would be removed from new program purchases but would be required to satisfy obligations (purchases) for the next program year.

In accordance with established practice, a projection of the results of operations for the current fiscal period is prepared on the basis of the results of operations to various interim dates.

Discussion

Based on September year-to-date activity and assuming reasonable wage rate settlements for Sun Parlor Home ONA and CUPE contracts, corporate operations are projected to be in a surplus position of approximately $446,000 for the year ending December 31, 2014. This projection is after giving effect to the approved Essex County Council Resolution 84-14, drawing $759,000 from the rate stabilization reserve to address 2014 winter control cost overruns and additional road rehabilitation requirements.

It is important to highlight that the projections are predicated on a number of significant assumptions, namely:

 Favourable resolution to various outstanding collective agreements  Winter Control activities remain within the five-year average for the 4th Quarter  Social Service caseloads and Social Housing costs remain favourable  No significant tax write-offs  Stable returns on investments within the County’s investment portfolio

Factors contributing to the year-end position are highlighted below by departmental operation:

Community Services $90,000

Operations for Community Services are projected to be in a surplus position of approximately $90,000 as at December 31, 2014. Resident capacity remains at approximately 215 residents; however subsidy levels are projected to be favourable, based on current resident complement and associated income levels. Requests for discretionary benefits remain consistent from prior year (including financial support for eye glasses, dentures, and incontinent supplies).

Sun Parlor Home ($140,000)

The Sun Parlor Home is projected to be in a deficit position of approximately $140,000 as at December 31, 2014. Favourable increases in subsidy per diems, post budget approval, are more than offset by additional wages and benefits associated with up-staffing and overtime required during the severe winter weather, infectious outbreaks and staff retirement / absence. Note that variance excludes the additional one-time expenditures ($245,000), recently approved by Council and drawn from the Rate Stabilization Reserve to address capital and training costs associated with fire protection/safety.

Emergency Medical Services ($134,000)

Based on existing operating conditions, EMS is projected to be in a deficit position of $134,000 as at December 31, 2014. Projected unfavourable variances in vehicle repairs (delay in vehicle replacements), fuel costs, medical supplies, legal and wages & benefits (replacements for WSIB, STD and retirements) are the contributing factors.

Provincial funding for the Emergency Room Nurse Program remains outstanding; projection assumes 100% provincial coverage as per budget ($993,000).

Transportation Services ($220,000)

Transportation Services is projected to be in a deficit position of approximately $220,000 as at December 31, 2014. Significant additional drainage assessment projects requested from the local municipalities (subsequent to budget approval), greater than budget winter control costs associated with the Essex/Kent Boundary Road and unanticipated wage & benefit variance associated with retirement overlaps account for the deficit variance.

Library Services $0

Library Services are projected to be on budget at this time. Projected overages in utility costs, legal/consulting and insurance deductible are offset by savings in wages and benefits associated with the delay in openings at new library facilities.

General Government $700,000

In total, General Government Services is projected to be in a $700,000 surplus position as at December 31, 2014. The significant factor is projected greater than budget return on investments, specifically with the AMO/LAS One Fund Program. Other minor favourable variances include wage and benefit savings in Administration and Human Resources due to timing of staff turnover and not filling budgeted student positions.

External Commitments $150,000

External Commitments are projected to be in a surplus position as at December 31, 2014. Estimates by the City of Windsor indicate lower than budget demand for social assistance, offset, in part, by a greater than budget shift in cost from the City to the County for Social Services and Social Housing, related to regional weighted assessment cost sharing.

No other significant variances to report at this time.

The Corporation’s projected financial position is based on nine months activity with significant uncertainty regarding budget performance for Social Services, Social Housing, Emergency Medical Services, Transportation Services, investment earnings and outstanding arbitrated contract /wage settlements. Variance from projections in any one of these operations could

Corporate Services with the assistance of all departments continue to look for opportunities for reductions / cost savings and will carefully monitor operations and report accordingly.

Being a By-law to Confirm the Proceedings of the Council of The Corporation of the County of Essex

Whereas under Section 5(1) of the Municipal Act, 2001, S.O. 2001, c.25 as amended, the powers of a municipality shall be exercised by its Council; and Whereas under Section 5(3) of the Municipal Act, 2001, S.O. 2001, c.25 as amended, a municipal power, including a municipality’s capacity, rights, powers and privileges under Section 8 of the Municipal Act, 2001, S.O. 2001, c.25 as amended, shall be exercised by by-law unless the municipality is specifically authorized to do otherwise; and, Whereas it is deemed expedient that the proceedings of the Council of The Corporation of the County of Essex, at this meeting be confirmed and adopted by by-law;

Now therefore The Council of the Corporation of the County of Essex hereby enacts as follows:

1. That the actions of the Council of The Corporation of the County of Essex in respect of all recommendations in reports of committees, all motions and resolutions and all other action passed and taken by the Council of The Corporation of the County of Essex, documents and transactions entered into during the October 01st, 2014, Regular Meeting of Council, is hereby adopted and confirmed, as if the same were expressly embodied in this By-law. 2. That the Warden and proper officials of The Corporation of the County of Essex are hereby authorized and directed to do all the things necessary to give effect to the action of the Council of The Corporation of the County of Essex during the said October 01st, 2014, Regular Meeting referred to in Section 1 of this By-law. 3. That the Warden and the Clerk are hereby authorized and directed to execute all documents necessary to the action taken by this Council as described in Section 1 of this By-law and to affix the Corporate Seal of The Corporation of the County of Essex to all documents referred to in said Section 1.
