3 RECOMMENDATION
Grant planning permission subject to conditions and a legal agreement to secure developer contributions and a community liaison group.
4 DESCRIPTION OF THE PROPOSAL AND PLANNING HISTORY
4.1 The site is allocated in the local plan as suitable for office, general industrial or storage uses (classes 4, 5 and 6). The site lies just to the north of Boghead roundabout on the outskirts of Bathgate and, as such, has very good connections to the strategic road network. Other industrial uses lie to the north and open countryside lies to the west. To the east there are residential properties, separated from the site by coniferous woodland.
4,2 The application site is an established waste management facility, used for the processing and recycling of waste. The site also contains a recycling facility for end of life’vehicles. The site comprises predominantly hard standing and is mostly used for the open storage of waste and ‘end of life’ vehicles. Planning permission for a waste reception building with mechanical separation and sorting was granted in March 2009 (0799/FUL/08).
4.3 The planning application now submitted is for an anaerobic digestion (AD) facility. Materials brought to the site would be taken in to the reception hall where the recyclable materials would be separated from the organic materials. The organic material is then processed into slurry and pumped in to digestion/fermentation tanks for anaerobic digestion. This process produces bio—gaswhich is fed into a combined heat and power plant (CHP) to produce heat and electricity, which the applicant intends to use to supply industrial uses on the surrounding land. Once it has been treated, the organic material is then dried out to stop the fermentation process and produce a stabilised odourless material. This material can be used as organic compost or a feedstock for an energy plant.
4.4 The most prominent plant are six large tanks, which are 19m in diameter and 19m high, and situated at the north end of the site. In front of these are smaller tanks and ancillary plant and stores approximately 4m high. The bio filters are in four separate buildings to the front of the site, each measuring 12m wide, 20m deep and 3m high. A 16m high stack is proposed next to this. The large sheds wrap around the back of the plant, in an L shape, for approximately 15Cm east to west and 12Cm north to south. The buildings are approximately 13m high. A copy of the elevation is attached to this report.
4.5 The site would have the capacity to process up to 200,000 tonnes of waste per annum, with 105,000 tonnes of this being treated in the anaerobic digestion plant and the remainder being recycled. Most of the waste would be commercial, however the facility could also take municipal waste. The development would result in approximately 180 HGV trips per day (combined two-way). A transport statement has been submitted and satisfactorily assessed by the council’s Transportation Services.
4.6 The current planning application was submitted in February 2009 and advertised in the local press. An environmental statement was submitted in May 2009 and the application was readvertised. In response to the objections and following discussions with Environmental Health and Planning Services, additional information was submitted. This included further information about the proposed technology, updated reports on noise, health and air quality and an amended site layout to relocate the bio filter some lOOm further away from the residential properties and amend the position of the sheds to help minimise noise disturbance. The application was readvertised and notification was carried out by the council.
4.7 In addition to the statutory notification requirements, the applicant has held two public exhibitions, which were supported by a leaflet drop and a press release. In response to the objections a meeting with residents was organised by the applicant in August 2009. On submission of the most recent information, the applicant wrote to the local residents and MSP and met with the community council.

The reception and sorting buildings, which already have consent under a separate application, will be approximately 8Cm from the boundary and 12Cm from the nearest houses. The AD plant will be approximately 22Cm away from the houses. Health PAN 63 makes clear that planning authorities should not take into account matters which are regulated by SEPA and should accept that a PPC license is adequate and suitable for public health protection. Air quality, including dust and Environmental Health has been consulted and raised no odour objections. In addition, the air quality assessment that was submitted by the applicant has been independently assessed by consultants on behalf of the council. Noise Environmental Health is satisfied that the development, as amended, willnot give rise to unacceptable noise levels. Traffic The development will not give rise to a significant increase in traffic. The site is well located with good access to the strategic road network. The development is unlikely to result in an increase in gulls or vermin. 8 ASSESSMENT
8.1 Section 25 of the Town and Country Planning (Scotland) Act 1997 requires planning applications to be determined in accordance with the Development Plan, unless material considerations indicate otherwise.
Scottish Planning Policy
8.2 As set out above, Scottish Planning Policy is very clear that there must be an increase in the number and type of waste management facilities. It is supportive of proposals which increase recycling, minimise the amount of waste going to landfill and those which generate energy from waste. PAN 63 is clear that impact on public health is a matter for SEPA and not for planning authorities. However, it does recognise that siting, design and layout can be used to try to address perceived impacts. In this case the applicants have provided further information and amended the site layout in response to concerns raised by residents. The application is therefore supported by national policy and advice.
Development Plan: Edinburgh and the Lothians Structure Plan
8.3 The structure plan is supportive of sustainable approaches to waste management. The proposal would divert waste away from landfill, increase the amount of material being recycled and allow energy to be generated from the waste that cannot be recycled. The application is therefore supported by the structure plan.

8.4 The processing of waste is an industrial process and therefore generally considered acceptable on employment land allocations, subject to detailed site considerations, In this case the key issues are the proximity of sensitive land uses and the visual impact of the proposed development when viewed from the west.
8.5 As part of the ES, reports on the noise and air quality impact have been submitted and assessed by Environmental Health. In addition, the air quality report has been independently assessed by consultants on behalf of the council. The design of the building, the site layout and the operating procedures on the site are designed to minimise the impacts on the residential properties. The assessment process has concluded that the impacts of odour, bio-aerosols and dust will be negligible and that noise levels will be within relevant limits. The development will not have a significant impact on the residential or visual amenity of the existing residential properties.
8.6 The proposed development will have a significant visual impact when viewed from west. In order to address this, the applicant is considering alternative proposals for the design of the buildings. Some indicative elevations have been provided. It is recommended that this matter is dealt with by condition, with the details delegated to the Development Management Manager to approve, in consultation with a local liaison committee. In addition, the application presents an opportunity to improve the visual appearance of this site and other land in control of the applicant along the B7002. This is a prominent location, which would benefit greatly from quality landscaping along the road edge.
8.7 Taking all of the above into account, the application is considered to comply with the development plan.
Other Considerations
8.8 The objections and the consultation responses have been responded to above. Conditions will be attached relating to the access and elevation details. A legal agreement will be required to secure payments to towards the dualling of the A801 and the setting up of a community liaison group. The environmental impacts of the proposal have been assessed by Environmental Health, the council’s Health Improvement Team and an independent air quality consultant on behalf of the council. The operation of the site, including stack emissions, will be controlled by SEPA as the licensing authority.
9 CONCLUSION AND RECOMMENDATION
9.1 In conclusion the application complies with the development plan and national policy and advice. There are no material planning considerations to indicate that the application is unacceptable. Accordingly the application is recommended for approval.

The pollution in the air will be dangerous for residents and children, and there has been no studies conducted regarding the effect this would have on peoples health.
The smell, noise , dust, and activity from this plant which is open 7 days a week all day long would have a detremental effect on everyone living near the plant. Commercial waste being delivered in open heavy goods trucks (180 heavy goods trucks a day) so close to houses is totally unacceptable.
I would be grateful if you could inform me of further decisions on this proposal.

The building of this plant willonly succeed in bringing this back tenfold, This is also I believe an untested system When the wind blows from the West thie smells, dust, plus vermin and a drastic increase in road traffic never mind the eeffect on Asthma sufferers. Your are also going to expose the children of f3athgate to this, which I think is totally thoughtless on the Councils behalf There are enough industrial units already in that area without adding this type of operation, to the area of Bathgate. This site was previously used as an Abbatoir and the smell some days was horrendous and this plant would he 20-3(3 worse. The draining system from the Abbatoir caused problems and i feel this would be worse with this type of plant.
There are young Children and Elderly people who live in this area and i feel this would be a health hazard to them. I STRONGLY object to The Anaerobic Digestion Plant plans going ahead.
