This copy of the Consolidation Order includes the provisions of The irklees Metropolitan Council (Decriminalised Parking) Order 2006 by 1 the additions to Article 2.1 (interpretation) 2. the addition of PART IX Article 12 (Contraventions of Provisions of the Order) 3. the application of the provisions of the Road Traffic Act 1991 in that the words "parking attendant" have been substituted for "traffic warden" N.B. The Council of the Borough of Kirklees ("the Council") in exercise of its powers under Sections 1, 2, 4, 32, 35, 45, 46, 47, 49 and 53 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 ("the Act") and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act hereby makes the following Order which relates to roads throughout the Kirklees Metropolitan District:-

PART I

1. COMMENCEMENT CITATION & REVOCATION

1.1. This Order shall come into operation on the 3rd day of July 2006 and may be cited as the Kirklees Metropolitan Council (Traffic Regulation) (Cleckheaton Area) (Consolidation) Order 2006

1.2. The Orders listed in the Thirteenth Schedule are hereby revoked to the extent therein stated

1.3. The revocations listed in the Fourteenth Schedule are hereby confirmed.

2. INTERPRETATION

2.1. Any reference in this Order to a' numbered Article is a reference to the Article bearing that number in this Order and any reference to a numbered Schedule is a reference to the Schedule bearing that number in this Order

2.2. In this Order except where the context otherwise requires the following expressions have the meanings hereby respectively assigned to them:-

"annual charge" in relation to a business parking permit means a sum (being such sum as the Council may from time to time determine) payable by a business permit holder to facilitate the issue or renewal of such a permit by the Council.

"authorised position" means in relation to:-

(i) Article 4 wholly within the limits of the parking place as marked on the carriageway in accordance with the road markings as indicated by Diagrams 1028.3, 1032 or 1033 in Schedule 6 to the 2002 Regulations and in a position so as not to obstruct the movement of other motor vehicles.

(ii) Article 5 wholly within the limits of the parking place as marked on the carriageway in accordance with the road markings as indicated in Diagrams 1028.4, 1032 or 1,033 in Schedule 6 to the 2002 Regulations and in such a position so as not to obstruct the movement of other motor vehicles;

KMC TRAFFIC REGULATION CONSOLIDATION ORDER 2006 CLECKHEATON.doc 1 21/06/2006 10:42 AM (iii) Article 6 wholly within the limits of the parking place as marked on the carriageway in accordance with the road markings as indicated in Diagrams 1028.3, 1032 or 1033 in Schedule 6, to the 2002 Regulations. and in a position so as not to obstruct the movement of other motor vehicles.

"Bank Holiday" has the same meaning as in the Banking and Financial Dealings Act 1971.

"bus lane" means the area of carriageway specified and described in Column 1 of the Tenth Schedule and has the same meaning as in the 2002 Regulations.

"carriageway" has the same meaning as in Section 329(l) of the Highways Act 1980.

"commercial vehicle" means any motor vehicle which is being used for the delivery or collection of goods:

"cycle lane" means the area of carriageway specified and described in Column 1 of the Twelfth Schedule and has the same meaning as in the 2002 Regulations.

"designation order" has the same meaning as in Section 142 of the Act.

"disabled persons badge" has the same meaning as in the 2000 Regulations and the Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000 as amended.

"disabled person's motor vehicle" means a motor vehicle lawfully displaying a disabled person's badge and which immediately before or after any period of waiting allowed by virtue of this Order has been or is to be driven by a disabled person or has been or is to be used for carrying disabled persons as passengers.

"driver" in relation to a motor vehicle waiting in a parking place means the person driving the motor vehicle at the time it was left in the parking place.

"dual purpose vehicle" has the same meaning as in Paragraph 2 of Schedule 6 of the Act.

"goods" has the same meaning as in the Road Traffic Act 1988.

"goods vehicle" means a motor vehicle not exceeding 30 cwts (1524 kg) unladen weight which is constructed or adapted for use for the carriage of goods of burden of any description.

"hackney carriage" has the same meaning as in the Town Police Clauses Act 1847.

"invalid carriage" has the same meaning as Section 136 of the Act.

"motor vehicle" has the same meaning as in Section 136 of the Act.

"omnibus" means a motor vehicle travelling to a point at which it will commence to be or from a point at which it ceases to be a public service vehicle, a school bus or works bus, as the case may be.

"owner" in relation to a motor vehicle means the person by whom such a motor vehicle is kept and used and in determining who was the owner of a motor vehicle at any time it shall be presumed that the owner was the person in whose name the motor vehicle was at that time registered under the Vehicle Excise & Registration Act 1994.

"parking disc" has the same meaning given by Regulation 8(5) of the 2000 Regulations.

"parking place" means in relation to:-

(i) Article 4 the parts of road specified in Column 1 of the Seventh Schedule authorised by this Order to be used as a parking place;

(ii) Article 5 the parts of road specified in Column 1 of the Sixth Schedule authorised by this Order to be used as a parking place;

(iii) Article 6 the parts of road specified in Column 1 of the Eighth Schedule authorised by this Order to be used as a parking place.

"passenger vehicle" means a motor vehicle (other than a motor cycle or invalid carriage) constructed solely for the carriage of persons and their effects and adapted to carry no more than twelve passengers exclusive of the driver.

"pedal cycle" has the same meaning as in Regulation 4 of the 2002 Regulations.

"permit" means a permit issued under the provisions of Articles 5.15 to 5.21 inclusive.

"permit holder" means a person to whom a permit has been issued under the provisions of Articles 5.15 to 5.21 inclusive

"permitted motor vehicle" means in relation to:-

(i) Article 4 commercial vehicles;

(iii) Article 6 a disabled person's vehicle or a vehicle displaying in the relevant position a valid disabled person's badge.

"postal packets" has the same meaning as in the Postal Services Act 2000.

"public service vehicle" has the same meaning as in Section 1(1) of Part I of the Public Passenger Vehicles Act 1981.

"relevant position" in relation to a disabled person's badge has the same meaning as in Regulation 12 of the Disabled Person's (Badges for Motor Vehicles) (England) Regulations 2000 and the 2000 Regulations.

"relevant position" in relation to a parking disc means:

(i) the disc is exhibited on the dashboard or fascia of the motor vehicle; or

(ii) where the motor vehicle is not fitted with a dashboard or fascia the disc is exhibited in a conspicuous position on the motor vehicle,

so that the period during which waiting began is clearly legible from the outside of the motor vehicle.

"resident" means in relation to a parking place any person whose usual residence is at premises the postal address of which is as defined opposite to that parking place in Column 2 of the Sixth Schedule.

"return prohibition period" means in relation to:-

(i) Article 3.3.2 - the period specified in Column 3 of the Fifth Schedule

(ii) Article 6.5 - the period specified in Column 3 of the Eighth Schedule.

"school bus" means a motor vehicle constructed or adapted to carry twelve or more passengers and being used to carry persons to or from school.

"term time" means the days and dates determined to be the school term in accordance with the provisions of the Education Act 1996.

"traffic sign" means a sign of any size, colour and type prescribed or authorised under, or having effect as though prescribed or authorised under Section 64 of the Act.

"universal service provider" means the same as in the Postal Services Act 2000.

"works bus" means a motor vehicle constructed or adapted to carry twelve or more passengers which has been provided by an employer for the purpose of

"the 2000 Regulations" means the Local Authorities' Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000.

"the 2002 Regulations" means the Traffic Signs Regulations and General Directions 2002.

PART II

3. PROHIBITIONS AND RESTRICTIONS ON WAITING/LOADING AND UNLOADING

3.1. Save as provided in Articles 3.6, 3.7 and 3.8 no person shall, except upon the ig direction or with the permission of a Police Constable in uniform or of a tia#Fifcoti w,aFden , cause or permit any motor vehicle to wait at any time in any of the lengths of road specified in Columns 1 and 2 of the First Schedule

3.2. Save as provided in Articles 3.6, 3.7 and 3.8 no person shall, except upon the direction or with the permission of a Police Constable in uniform or of a4raffic war-, cause or permit any motor vehicle to wait in any of the lengths of road specified in Columns 1 and 2 of the Third Schedule on the days and during the .times specified in Column 3 of the Third Schedule unless such day falls upon a Bank Holiday

3.3. Save as provided in Articles 3.6 and 3.8 no person shall, except upon the direction or with the permission of a Police Constable in uniform or of a t #ic warden, cause or permit any motor vehicle to wait in any of the lengths of road specified in Column 1 of the Fifth Schedule on the days and during the times specified in Column 2 of the Fifth Schedule unless such day falls upon a Bank Holiday:-

3.3.1. for a period in excess of that specified in Column 3 of the Fifth Schedule; or

3.3.2. if a period less than the return prohibition period has elapsed since the termination during the limited waiting hours of the last period of waiting of the motor vehicle in the same length of road

3.4. Save as provided in Article 3.6 no person shall, except uththe direction or with the permission of a Police Constable in uniform or of a a##iearen , cause or permit any motor vehicle to load or unload at any time in any of the lengths of road specified in Columns 1 and 2 of the Second Schedule

3.5. Save as provided in Article 3.6 no person shall, except upon t5 a ire tion or with the permission of a Police Constable in uniform or of a trr^ic- v^aden cause or permit any motor vehicle to load or unload in any of the lengths of road specified in Columns 1 and 2 of the Fourth Schedule on the days and during the times specified in Column 3 of the Fourth Schedule

Nothing in Articles 3.1, 3.2, 3.3, 3.4 and 3.5 shall prohibit any person from causing or permitting any motor vehicle to wait in any of the lengths of road specified in the First, Second, Third, Fourth and Fifth Schedules for so long as may be necessary:

3.6.1. to enable a person to board or alight from the motor vehicle;

3.6.2. to enable the motor vehicle, if it cannot be conveniently used for such purpose in any other road, to be used in connection with any wedding or funeral, building operation or demolition, the removal of any obstruction to traffic, the maintenance, improvement or reconstruction of the length of road so specified, or the laying, erection, alteration or repair in or near the said length of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus;

3.6.3. if the motor vehicle is a Mobile Speed Camera Unit or an Automatic Number Plate Recognition Vehicle;

3.6.4. to enable the motor vehicle, if it is in the service of the Post Office or other universal service provider to be used for the purpose of delivering or collecting postal packets;

3.6.5. to enable the motor vehicle to be used in any of the lengths of road so specified for police, ambulance, fire brigade, local authority or water authority purposes when used in pursuance of statutory powers or duties;

3.6.6. if the motor vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond the control of the driver, or to such waiting as is necessary to prevent an accident;

3.6.7. for the purpose of loading or unloading the motor vehicle whilst the motor vehicle is in actual use in connection with the removal or delivery of furniture to or from any premises fronting, adjoining or abutting any of the said lengths of road provided that notice is given twenty four hours in advance to the Police and their consent obtained;

3.6.8. for a hackney carriages to wait at a hackney carriage stand during the hours of operation of the hackney carriage stand

3.7. Nothing in Articles 3.1, 3.2 and 3.5 shall prohibit any person from causing or permitting any motor vehicle to wait in any of the lengths of road specified in the First, Third or Fourth Schedules for so long as may be necessary to deliver to or collect from or load or unload goods at any premises fronting on to the said lengths of road provided that no motor vehicle so engaged shall wait for longer than 30 minutes outside the s me r mises without the permission of a Police Constable in uniform or a n an lprovided always that a Police Constable in uniform or a t=,ulhe .4 en may at any time require the driver of a motor vehicle to move it if it is necessary for the purposes of preventing obstruction.

3.8. Nothing in Articles 3.1, 3.2, 3.3 and 3.5 shall render it unlawful to cause or permit any motor vehicle to wait:-

KMC TRAFFIC REGULATION CONSOLIDATION ORDER 2006 CLECKHEATON.doc 6 21/06/2006 10:42 AM 3.8.1. for a period not exceeding 3 hours (not being a period separated by an interval of less than 1 hour from the previous period of waiting by the same motor vehicle in the same road or part of road on the same day) in any of the lengths of road specified in the First, Third and Fourth Schedules;

3.8.2. in any of the lengths of road specified in the Fifth Schedule;

if the motor vehicle is a disabled person's motor vehicle which displays in the relevant positions:

(a) in all cases a disabled person's badge, and

(b) in the cases stated in Article 3.8.1 a parking disc issued by any local authority in accordance with the provisions of the 2000 Regulations, or a badge having effect under those Regulations as if it were a disabled person's badge and the driver or other person in charge of the motor vehicle marks on the parking disc the time at which the period of waiting began

PART III

4. PARKING IN LOADING BAY

4.1. The part of road specified in Column 1 of the Seventh Schedule is authorised to be used as a parking place for the parking of permitted motor vehicles in the authorised position on such days and during such hours as are specified in relation to the part of road in the said Seventh Schedule.

4.2. The driver of a motor vehicle shall not permit it to wait in the parking place unless it is a permitted motor vehicle.

4.3. Every motor vehicle using the parking place shall wait thereon in the authorised position.

4.4. The driver of a motor vehicle shall not permit it to wait in a parking place for longer than the maximum period permitted for waiting specified in Column 3 of the Seventh Schedule in relation to that parking place.

4.5. Save as provided in Article 4.11 the driver of a motor vehicle other than a permitted motor vehicle shall not use the arking place unless authorised to do so by a Police Constable in uniform or a s o en , always provided that no motor vehicle shall use the parking place so as unreasonably to prevent access to premises adjoining the road by other persons, or so as to be a nuisance and provided always that a Police Constable in uniform or araf+s-way may at any time require the driver of the motor vehicle to move it if it is reasonably necessary for the purpose of preventing obstruction or in the case of an emergency move or cause to be moved to any place he thinks fit, any motor vehicle left in a parking place.

The driver of a motor vehicle shall stop the engine as soon as the motor vehicle is in position in the parking place, and shall not start the engine except when about to change the position of the motor vehicle in or to depart from, the parking place.

4.7. The driver of a motor vehicle shall not permit it to wait in a parking place for any purpose other than when in actual use in connection with the delivery to or collection from or loading or unloading of goods to nearby premises.

4.8. A person authorised by the Council may suspend the use of the parking place or any part thereof whenever he considers such suspension reasonably necessary;

4.8.1. for the purpose of facilitating the movement of traffic or promoting its safety;

4.8.2. for the convenience of the occupiers of premises adjacent to the parking place on any occasion of the removal of furniture from a dwellinghouse or office to another or the removal of furniture from such premises to a depository or to such premises from a depository;

4.8.3. for the convenience of the occupiers of premises adjacent to the parking place at times of weddings or funerals or on other special occasions;

4.8.4. for the purpose of any building operation, demolition or excavation adjacent to the parking place or the maintenance or reconstruction of the parking place or the laying, erection, alteration, or repair in or adjacent to the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus;

4.8.5. and he has made an appropriate Order and/or given notice as may be required by legislation.

4.9. A person authorised by the Council suspending the use of the parking place or any part thereof in accordance with the provisions of Article 4 .8 shall thereupon ^_ - place or cause to be placed in or adjacent to that parking place or part thereof the use of which is suspended a traffic sign or notice indicating that waiting by motor vehicles is prohibited.

4.10. Save as provided in Articles 4.8, 4.9 and 4.10 no person shall cause or permit any motor vehicle to be left in the parking place or part thereof , as the case may be, during such period as there is in or adjacent to that parking place or part thereof a traffic sign or notice placed in pursuance of Article 4.9.

4.11. Nothing in Articles 4.1, 4.2, 4.3, 4.4 and 4.10 shall prohibit any person from causing or permitting any motor vehicle to wait in the parking place for so long as it may be necessary:-

4.11.1. to enable a person. to board or alight from the motor vehicle;

4.11.2. to enable the motor vehicle, if it cannot be conveniently used for such purpose in any other road, to be used in connection with any building operation or demolition, the removal of any obstruction to .traffic, the

KMC TRAFFIC REGULATION CONSOLIDATION ORDER 2006 CLECKHEATON.doc 8 21/06/2006 10:42 AM maintenance, improvement or reconstruction of the parking place or any part thereof or the laying, erection, alteration , or repair in or near the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus;

4.11.3. to enable the motor vehicle, if it is in the service of the Post Office or other universal service provider to be used for the purpose of delivering or collecting postal packets;

4.11.4. to enable the motor vehicle to be used for Police, ambulance, fire brigade, local. authority or water authority purposes when used in pursuance of statutory powers or duties;

4.11.5. if the motor vehicle is waiting owing to the driver being prevented from proceeding by circumstance beyond the control of the driver, or to prevent an accident;

4.11.6. to enable the motor vehicle to be used in connection with the removal of furniture from a dwellinghouse or office to another or the removal of furniture from such premises to a depository or to such premises from a depository.

4.12. Subject to the proviso hereto, when a motor vehicle is left in the parking place in contravention of any of the provisions contained in Articles 4.1, 4.2, 4.3, 4.4 and 4.10 a person authorised' in that behalf by the Council may remove the motor vehicle or arrange for it to be removed from the parking place provided that when a motor vehicle is waiting in the parking place in contravention of the provisions of Article 4.3, a person authorised in that behalf by the Council may alter or cause to be altered the position of the motor vehicle in order that its position shall comply with that provision.

4.13. Any person removing a motor vehicle or altering its position by virtue of Article 4.12 may do so by towing or driving the motor vehicle or such other manner as he may think necessary to enable him to remove it or alter its position as the case may be.

4.14. When a person authorised by the Council removes or makes arrangements for the removal of a motor vehicle from the parking place by virtue of Article 4.12, he shall make such-arrangements as may be reasonably necessary for the safe custody of the motor vehicle and its contents.

PART IV

5. PARKING PLACES - PERMIT HOLDERS

5..1. The part of road specified in Column 1 of the Sixth Schedule is authorised to be used as a parking place for the parking of permitted motor vehicles in the authorised position and on such days and during such hours as are specified in relation to the said part of road in column 3 of the Sixth Schedule. A permit holder may only park in any of the parking'places provided that they are of a

5.2. The driver of a motor vehicle shall not permit it to wait in the parking place unless it is a permitted motor vehicle.

5.3. Every motor vehicle using the parking place shall wait thereon in the authorised position.

5.4. Save as provided in Articles 5.10 and 5.11 the driver of a motor vehicle other. than a permitted motor vehicle shall not use the arkingplace unless authorised to do so by a Police Constable in uniform or aP, ^ en always provided that no motor vehicle shall use the parking place so as unreasonably to prevent access to premises adjoining the road by other persons, or, so as to be a nuisance and provided always that a Police Constable in uniform or a tfa#Ie warden may at any time require the driver of the motor vehicle to move it if it is reasonably necessary. for the purpose of preventing obstruction or in the case of an emergency move or cause to be moved to any place he thinks fit, any motor vehicle left in a parking place.

5.5. The driver of a motor vehicle shall stop the engine as soon as the motor vehicle is in position in the parking place, and shall not start the engine except when about to change the position of the motor vehicle in or to depart from, the parking place.

5.6. No person shall use a motor vehicle, whilst it is in the parking place, in connection with the sale of any article to persons in or near the parking place or in connection with the selling or offering for hire of his skill or services or any other person's skill or services.

5.7. A person authorised by the Council may suspend the use of the parking place or any part thereof whenever he considers such suspension reasonably necessary:

5.7.1. for the purpose of facilitating the movement of traffic or promoting its safety;

5.7.2. for the convenience of the occupiers of premises adjacent to the parking place on any occasion of the removal of furniture from a dwellinghouse or office to another or the removal of furniture from such premises to a depository or to such premises from a depository;

5.7.3. for the convenience of the occupiers of premises adjacent to the parking place at times of weddings or funerals or on other special occasions;

5.7.4. for the purpose of any building operation, demolition or excavation adjacent to the parking place or the maintenance or reconstruction of the parking place or the laying, erection, alteration, or repair in or adjacent to the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus;

a 5.7.5. and he has made an appropriate Order and/or given notice as may be required by legislation.

5.8. A person authorised by the Council suspending the use of the parking place or any part thereof in accordance with the provisions of Article 5.7 shall thereupon place or cause to be placed in or adjacent to that parking place or part thereof the use of which is suspended a traffic sign or notice indicating that waiting by motor vehicles is prohibited.

5.9. Save as provided in Articles 5.10 and 5.11 no person shall cause or permit any motor vehicle to be left in the parking place or part thereof, as the case may be, during such period as there is in or adjacent to that parking place or part thereof a traffic sign or notice placed in pursuance of Article 5.8.

5.10. Nothing in Articles 5.1, 5.2, 5.3, 5.4 and 5.9 shall prohibit any person from causing or permitting any motor vehicle to wait in the parking place for so long as it may be necessary:-

5.10.1. to enable a person to board or alight from the motor vehicle;

5.10.2. to enable the motor vehicle, if it cannot be conveniently used for such purpose.in any other road, to be used in connection with any building operation or demolition, the removal of any obstruction to traffic, the maintenance, improvement or reconstruction of the parking place or any, part thereof or the laying, erection, alteration, or repair in or near the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus;

5.10.3. to enable the motor vehicle, if it is in the service of the Post Office or other universal service provider to be used for the purpose of delivering or collecting postal packets;

5.10.4. to enable the motor vehicle to be used for police , ambulance, fire brigade, local authority or water authority purposes when used in pursuance of statutory powers or duties;

5.10.5. if the motor vehicle is waiting owing to the driver being prevented from proceeding by circumstance beyond the control of the driver, or to prevent an accident;

5.10.6. to enable the motor vehicle to be used in connection with the removal of furniture from a dwellinghouse or office to another or the removal of furniture from such premises to a depository or to such premises from a depository.

5.11. Nothing in Articles 5.1, 5.2, 5.3, 5.4 and 5.9 shall apply if the motor vehicle is being used by a legally qualified general medical practitioner, district nurse, midwife or similar people when visiting persons whose postal address is as defined opposite to that parking place in Column 2 of the Sixth Schedule, so tong

5.12. Subject to the proviso hereto, when a motor vehicle is left in the parking place in contravention of any of the provisions contained in Articles 5.1, 5.2, 5.3, 5.4 and 5.9 a person authorised in that behalf by the Council may remove the motor vehicle or arrange for it to be removed from the parking place provided that when a motor vehicle is waiting in the parking place in contravention of the provisions of Article 5.3 of this Order, a person authorised in that behalf by the Council may alter or cause to be altered the position of the motor vehicle in order that its position shall comply with that provision.

5.13. Any person removing a motor vehicle or altering its position by virtue of Article 5.12, may do so by towing or driving the motor vehicle or such other manner as he may think necessary to enable him to remove it or alter its position as the case; may be.

5.14. When a person authorised by the 'Council removes or makes arrangements for the removal of a motor vehicle from the parking place by virtue of Article 5.12, he shall make such arrangements as may be reasonably necessary, for the safe custody of the motor vehicle and its contents.

Application for and issue of permits

5.15. Any resident who is the owner of a permitted motor vehicle may apply to the Council for the issue of a residents parking permit for the leaving of that motor vehicle in a parking place and any such application shall be made on a form issued by and obtainable from the Council and shall include the particulars and information required by such form..

5.16. On receipt of an application for a residents parking permit duly made under the foregoing provisions of Article 5.15, the Council, upon being satisfied that the applicant is a resident and is the owner of a permitted motor vehicle, may, subject to the proviso hereto, issue to the applicant one permit for the leaving in ^._ the parking place of the motor vehicle to which such permit relates by the owner of such motor vehicle or by any person using such motor vehicle with the consent of the owner other than a person to whom such motor vehicle has been let for hire or reward provided that subject to the provisions of Article 5.24 and 5.25, the Council shall not issue a permit to any resident which would be valid for, any period during which any other permit issued to that resident.is or would be, valid.

5.17. Any resident may apply to the Council for the issue of a visitors parking permit to enable a bona fide visitor to his premises to leave a permitted motor vehicle in a parking place and any such application shall be made on a form issued by and obtainable from the Council and shall include the particulars and information required by such form. Subject to Article 5.20 one permit only to be issued to the residents of premises having a separate postal address.

5.18. Any occupant of business premises may, upon payment of an annual charge,, apply to the Council for the issue or renewal of a business parking permit,(which

KMC TRAFFIC REGULATION CONSOLIDATION ORDER 2006 CLECKHEATON.doc 12 21/06/2006 1:26 PM shall be valid for a period of twelve months from the date of issue or renewal as the case may be) for the leaving of a permitted motor vehicle in a parking place.

5.19. The Council may at any time require a permit holder or applicant for a permit to produce to an officer of the Council such evidence in respect of an application made to them for a permit as they may reasonably require to verify any particulars or information given to them.

5.20. The Council may at their discretion issue a permit with or without charge to any person who in the opinion of the Council requires to park in any parking place any permitted motor vehicle.

5.21. The issue of a permit under the foregoing provisions of Article 5.16, 5.17 and 5.18 shall not be construed as if any parking space in the parking place was reserved solely for the use of a permit holder.

Surrender, withdrawal and validity of permits

5.22. A permit holder may surrender a permit to the Council at any time and shall surrender a permit to the Council on the occurrence of any one of the events set out in Article 5.25.

5.23. The Council may, by notice in writing served on the permit holder by sending the same by the recorded delivery service to the permit holder at the address shown by that person on the application for the permit or at any address believed to be that person 's place of abode, withdraw a permit entirely at its own discretion and the permit holder shall surrender the permit to the Council within 48 hours of the receipt of the aforementioned notice.

5.24. A permit shall cease to be valid on the occurrence of any one of the events set out in Article 5.25.

5.25. The events referred to in Article 5.22 are:-

5.25.1. the permit holder ceasing to be a resident;

5.25.2 . the permit holder ceasing to be the owner of the motor vehicle in respect of which the permit was issued;

5.25.3. the withdrawal of such permit by the Council under the provisions of Article 5.23;

5.25.4. the motor vehicle in respect of which the permit was issued being adapted or used in such a manner that it is no longer a permitted motor vehicle.

Application for and issue 'of duplicate permits

5.26. If a permit is mutilated or accidentally defaced or the figures or particulars thereon have become illegible or the colour of the permit has become altered by fading or otherwise the permit holder shall surrender it to the Council and the Council, upon receipt of the permit, shall issue a duplicate permit so marked.

If the permit is lost or destroyed, the permit holder may apply to the Council for the issue to him of a duplicate permit and the Council, upon being satisfied as to such loss or destruction, shall issue a duplicate permit so marked and upon such issue the permit which it duplicates shall become invalid provided that a replacement for a duplicate permit will only be issued upon payment of a charge (being such sum as the Council may from time to time determine).

5.28. The provisions of this Order shall apply to a duplicate permit and an application therefor as if it were a permit or as the case may be an application therefor.

Form of permit

5.29.. A permit shall be in writing and shall bear the words "Residents Parking Permit", "Visitors Parking Permit", or "Business Parking Permit" as the case may be and shall include the following particulars:-

5.29.1. the registration mark of the motor vehicle in respect of which the permit has been issued, or the address of the premises in question;

5.29.2. the name of the road and district in which the parking place is situate and for which the permit is issued;

5.29.3. an authentication that the permit has been issued by the Council;

5.29.4. the period during which the permit shall remain valid.

Display of permits

5.30. At all times during which a motor vehicle is left in a parking place there shall be displayed on the front or near side of the motor vehicle a valid permit issued in respect of that motor vehicle so that all particulars referred to in Article 5.29 are readily visible from the front or near side of the motor vehicle.

Restriction on the removal of permits

5.31. When a permit has been displayed on a motor vehicle in accordance with the provisions of Article 5.30, no person not being the driver of the motor vehicle shall remove the permit from the motor vehicle unless authorised to do so by the driver of the motor vehicle.

PART V

6. DISABLED BAYS

6.1. Each of the parts of road specified in Column I of the Eighth Schedule are authorised to be used as a parking place for the parking of permitted motor vehicles in the authorised position on such days and during such hours as are specified in relation to the said part of road in Column 2 of the Eighth Schedule.

6.3. Every motor vehicle using the parking place shall wait thereon in the authorised position.

6.4. The driver of a motor vehicle shall not permit it to wait in a parking place for longer than the maximum period permitted for waiting specified in Column 3 of the Eighth Schedule in relation to that parking place.

6.5. When a motor vehicle has left a parking place as specified in Article 6.1 after waiting thereon, the driver thereof shall not, within the return prohibition period specified in Column 3 of the Eighth Schedule permit it to wait again upon the parking place.

6.6. Save as provided in Articles 6.12 and 6.13 the driver of a motor vehicle other than a permitted motor vehicle shall not use the parkin place unless authorised to do so by a Police Constable in uniform or a ^tr^a F r en, always provided that no motor vehicle shall use the parking place so as unreasonably to prevent access to premises adjoining the road, or the use-of the road by other persons, or so as be a nuisance and provided always that a Police Constable in uniform or a t^ra#+G-wey at any time require the driver of the motor vehicle to move it if it is reasonably necessary for the purpose of preventing obstruction or in the case of an emergency move or cause to be moved to any place he thinks fit, any motor vehicle left in a parking place.

6.7. The driver of a motor vehicle using the parking place shall stop the engine as soon as the motor vehicle is in position in the parking place, and shall not start the engine except when about to change the position of the motor vehicle in, or to depart from, the parking place.

6.8. No person shall use a motor vehicle, whilst it is in the parking place, in connection with the sale of any article to persons in or near the parking place or in connection with the selling or offering for hire of his skill or services or any other person's skill or services.

6.9. Any person duly authorised by the Council may suspend the use of the parking place or any part thereof whenever he- considers such suspension reasonably necessary:

6.9.1. for the purpose of facilitating the movement of traffic or promoting its safety;

6.9.2. for the convenience of the occupiers of the premises adjacent to the parking place on any occasion of the removal of furniture from an office or dwellinghouse to another or the removal of furniture from such premises to a depository or to such premises from a depository;

6.9.3. for the convenience of the occupiers of premises adjacent to the parking place at times of weddings or funerals or on other special occasions;

KMC TRAFFIC REGULATION CONSOLIDATION ORDER 2006 CLECKHEATON.doc 15 21/06/20061:28 PM 6.9.4. for the purpose of any building operation, demolition or excavation adjacent to the parking place or the maintenance or reconstruction of the parking place or the laying, erection, alteration or repair in or adjacent to the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus;

6.9.5. and he has made an Order and/or given notice as required in the appropriate legislation.

6.10. Any person authorised by the Council suspending the use of the parking place or any part thereof in accordance with the provisions of Article 6.9 shall thereupon place or cause to be placed in or adjacent to that parking place or part thereof the use of which is.suspended a traffic sign or notice indicating that waiting by motor vehicles is prohibited.

6.11. Save as provided in Articles 6.12 and 6.13 no person shall cause or permit any ^._ motor vehicle to be left in the parking place or part thereof, as the case may be, during such period as there is in or adjacent to that parking place or part thereof a traffic sign or notice placed in pursuance of Article 6.10.

6.12. Nothing in Articles 6.1, 6.6 and 6.11 shall prohibit any person from causing or permitting any motor vehicle to wait in the parking place for so long as may be necessary:

6.12.1. to enable a person to board or alight from the motor vehicle;

6.12.2. to enable the motor vehicle if it cannot conveniently be used for such purpose in any other road, to be used in connection with any building operation or demolition, the removal of any obstruction to traffic, the maintenance, improvement or reconstruction of the parking place or any part thereof or the laying, erection, alteration or repair in or near the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus;

6.12.3. to enable the motor vehicle, if it is in the service of the Post Office or other universal service provider to be used for the purpose of delivering or collecting postal packets; 6.12.4. to enable the motor vehicle to be used for Police, ambulance, fire brigade, local authority or water authority purposes when used in pursuance of statutory powers or duties;

6.12.5. if the motor vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond the control of the driver or to prevent an accident;

6.12.6. to enable the motor vehicle to be used in connection with the removal of furniture from an office or dwellinghouse to another or the removal of furniture from such premises to a depository or such premises from a depository.

Nothing in Articles 6.1, 6,6 and 6.11 shall apply if the motor vehicle is being used by a legally qualified general medical practitioner, district nurse, midwife or similar people when visiting a patient so long as the motor vehicle concerned is clearly marked Doctor, Midwife etc. and the visit is expected to be of less than 15 minutes duration.

6.14. Subject to the proviso hereto, when a motor vehicle is left in the parking place in contravention of any of the provisions contained in Articles 6.1, 6.2, 6.3 and 6.4 a person authorised in that behalf by the Council may remove the motor vehicle or arrange for it to be removed from the parking place, provided that when a motor vehicle is waiting in the parking place in contravention of the provisions of Article 6.3, a person duly authorised in that behalf by the Council may alter or cause to be altered the position'of the motor vehicle in order that its position shall comply with that provision.

6.15. Any person removing a motor vehicle or altering its position by virtue of Article 6.14, may do so by towing or driving the motor vehicle or in such other manner as he may think necessary to enable him to remove it or alter its position as the case may be.

6.16. When a person duly authorised by the Council removes or makes arrangements for the removal of, a motor vehicle from the parking place by virtue of Article 6.14 he shall make such arrangements as may be reasonably necessary for the safe custody of the motor vehicle and its contents.

PART VI

7. SCHOOL KEEP CLEAR - NO WAITING, LOADING OR UNLOADING

7.1. Save as provided in Article 7.2 no person shall, except u on the direction or with the permission of a Police Constable in uniform or of a tFa#te-waf cause or permit any motor vehicle to wait, load or unload in any of the lengths of road specified in the Ninth Schedule on the days and during the times specified in Column 3 of the Ninth Schedule.

7.2. Nothing in Article 7.1 shall apply:

7.2.1. so as to prevent a motor vehicle waiting in any of the lengths of road referred to in that Article for so long as may be necessary to enable the motor vehicle to be used in connection with:

7.2.1.1 . any building operation or demolition;

7.2.1.2. the removal of any obstruction to traffic;

7.2.1.3. the maintenance, improvement or reconstruction of the road comprising or including the carriageway; or

7.2.1.4. the laying, erection, alteration or repair in or near such road of a sewer or of any main, pipe or ' -

4' apparatus for the supply of gas, water or electricity or of any telecommunications apparatus,

7.2.2. to a motor vehicle being used for fire brigade, ambulance or police purposes in pursuance of statutory powers or duties;

7.2.3. to a motor vehicle being used in the service of a local authority or of a water authority in pursuance of statutory powers or duties;

7.2.4. to a motor vehicle waiting in any of the lengths of road referred to in Article 7.1 while any gate or other barrier at the entrance to premises to which the motor vehicle requires access or from which it has emerged is opened or closed, if it is not reasonably practicable for the motor vehicle to wait otherwise than on that length of road; or

7.2.5. to a motor vehicle waiting when the person in control of the motor vehicle:-

7.2.5.1. is required by law to stop;

7.2.5.2. is obliged to stop in order to avoid an accident; or

7.2.5.3. is prevented from proceeding by circumstances outside that person's control

PART VII

8. BUS LANE

8.1. Save as provided in Article 8.2 no person shall except u^po^ the direction or with the permission of a Police Constable in uniform or of Atra# a en `ause or permit any motor vehicle other than a Public Service vehicle, school bus, works bus, omnibus or pedal cycle to wait in the bus lane on the days and during the times specified in Column 3 of the Tenth Schedule other than for the purpose of crossing it.

8.2. Nothing in this Order shall render it unlawful for any person to cause or permit any motor vehicle to wait in the bus lane for so long as may be necessary for any of the purposes specified in Article 8.3.

8.3. The purposes referred to in Article 8.2 are:

8.3.1. the removal of any obstruction to traffic in the bus lane;

8.3.2. police, fire brigade or ambulance purposes.

8.4. Nothing in this Order shall render it unlawful for any person to cause or permit any motor vehicle to wait in the bus lane for so long as may be necessary for any of the purposes specified in Article 8.5.

8.5. The purposes referred to in Article 8.4 are:-

8.5.2. the avoidance of an accident;

8.5.3. the boarding or alighting of any person.

PART VIII

9. CLEARWAYS

9.1. Save as provided in Article 9.2 no person shall, except upon the direction or with the permission of a Police Constable in uniform or of a a ffi ^VLAIAA I , cause or permit any motor vehicle to wait on any of the main carriageways comprised of the lengths of road specified in Columns 1 and 2 of the Eleventh Schedule on the days and during the times specif ied in Column 3 of the Eleventh Schedule.

9.2. Nothing in Article 9.1 shall apply:-

9.2.1. sous to prevent a motor vehicle waiting on the carriageway of a road referred to in that Article for so long as may be necessary to enable the motor vehicle to be used in connection with:-

9.2.1.1. any building operation or demolition;

9.2.1.2. the removal of any obstruction to traffic;

9.2.1.3. the maintenance, improvement or reconstruction of the road comprising or including that carriageway; or

9.2.1.4. the laying, erection , alteration or repair in or near such road of a sewer or of any main , pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus.

9.2.2. to a motor vehicle being used for fire brigade , ambulance or police purposes , in pursuance of statutory powers or duties;

9.2.3. to a motor vehicle being used in the service of a local authority or of a water authority in pursuance of statutory powers or duties;

9.2.4. to a motor vehicle being used for the purpose of delivering or collecting postal packets;

9.2.5. to a motor vehicle waiting on the carriageway referred to in that Article while any gate or other barrier at the entrance to premises to which the motor vehicle requires access or from which it has emerged is opened or closed, if it is not reasonably practicable for the motor vehicle to wait otherwise than on that carriageway'; or

9.2.6.1. is required by law to stop;

9.2.6.2. is obliged to stop in order to avoid an accident; or

9.2.6.3. is prevented from proceeding by circumstances outside that person's control.

PART IX

10. CYCLE LANES

10.1. Save as provided in Articles 10.2 and 10.3 no person shall, except upon the direction or with the permission of a Police Constable in uniform or a tiaffi a L waa, cause or permit any motor vehicle other than a pedal cycle to wait in the cycle lane specified in the Twelfth Schedule on the days and during the times specified in Column 3 of the Twelfth Schedule.

10.2.. Nothing in Article 10.1 shall prohibit any person from causing or permitting any motor vehicle to wait in the cycle lane specified in the Twelfth Schedule for so long as may be necessary:

10.2.1. to be used for the removal of any obstruction to traffic;

10.2.2. to be used for police, fire brigade or ambulance purposes;

10.2.3. to be used in the service of any local authority or water authority or with the permission of any such authority in pursuance of statutory powers or duties provided that whilst being so used it is necessary for the motor vehicle to wait in the cycle lane;

10.2.4. to avoid an accident;

10.2.5. to gain entrance to premises, or land accessible only by crossing the cycle lane or to off-street loading facilities or garaging;

10.2.6. for public service vehicles at a bus stop area.

10.3. Nothing in Article 10.1 shall apply to the driving of any mechanical road cleansing vehicle or gully emptying machine or to anything done with the permission or at the direction of a Police Constable in uniform or a t#is wafden.

PART X

11. GENERAL

11.1. The restrictions imposed by this Order shall be in addition to and not in derogation of any restrictions or requirements imposed by any Regulations made or having effect as if made under the Act or by or under any other enactment.

11.3. For the avoidance of doubt, any reference in this Order to a length of road or a parking place shall.be deemed to be a reference to more than one length of road or more than one parking place where the context requires it.

11.4. Where the provisions of this Order or any Order made or having effect as if made under the Act which impose any restriction or prohibition on waiting by motor vehicles, or grant any exemption from such restriction or prohibition, relate to a road or length of road designated as a parking place in the Sixth, Seventh -and Eighth Schedules the provisions of the said Schedules shall prevail.

11.5. For the avoidance of doubt this Order is deemed to be a designation order for the purpose of charging for the issue or replacement as appropriate of a permit under the provisions of Part IV of this Order.

11.6. Where the Council deem it so expedient all references to "permit" in this Order shall include reference to "Residents Parking Permit", "Business Parking Permit" and "Visitors Parking Permit" and "Permit Holder" shall be similarly construed.

11.7. In this Order where the context requires, the masculine includes the feminine and the neuter and vice versa, the singular includes the plural and vice versa.

PART XI

12. CONTRAVENTIONS OF PROVISIONS OF ORDER

12.1 Where a motor. vehicle is left in a parking place or in any road or length of road in contravention of any provision of this Order, a penalty charge shall be payable by the owner of the motor vehicle.

12.2. A penalty. charge notice showing the information required by Section 66(3) 'of the 1991 Act may then be issued by a parking attendant in accordance with the provisions of Section 66(1) of the 1991 Act

12.3.. In the case of a motor vehicle in respect of which a penalty charge has been incurred it shall be the duty of the parking attendant to attach to the vehicle in a .conspicuous position or to give to the person, appearing to him-to be in charge of the motor vehicle a notice which shall include the following particulars:-

12.3.1.. the. grounds on which the parking attendant believes that a penalty charge 'is payable, with respect to the vehicle; 12.3.2. the amount of the penalty charge which Is payable; 12.3.3. . that the penalty charge must be paid before the end of the period of 28 days.beginning with the date of the notice;

12.3.4. that if the penalty charge is paid before the end of the period of 14 days beginning'with the date of the penalty charge notice, the amount of the penalty charge will be reduced by one half; 12.3.5. that, if the penalty charge is not .paid before the end of ' the .28 day period, a Notice to Owner may be sent by the. parking authority to the person appearing to them to be the: owner of the motor vehicle; 12.3.6. the address to which payment of the penalty charge must be sent. 12.4. The penalty charge shall be in the sum of the following amounts:-

12.4.1. £6Q on _ the' issue of a penalty charge notice subject to being discounted to £30 if the Council as provided in Article 12.3.4 received payment within 14 days of the issue of the penalty charge notice; 12.42. On the issue of a "charge certificate" the penalty charge will be increased to the sum of £90.

12.5. A penalty., charge notice fixed to a motor vehicle in accordance with. this section shall not be removed, or interfered with except under the authority of:-

12.5.1. the owner., or person in charge, of the motor vehicle; or 12.5.2. the parking authority. . 12.6. The owner of a motor , vehicle in ' respect of which a penalty charge has been incurred shall pay the penalty charge to the Council either:-

12.6.1 , by cheque or postal order which shall be delivered or sent by post so as to reach the Council 's Parking Office, Albion Street, Huddersfield (or such other, department as may from time to time be appointed for that purpose by the Council) not later 'than 10 :.00am on the twenty eighth day following the day on which the penalty charge notice was issued; or 12.6,2.' in cash, credit card or debit card in person at the said Parking Office. . . not later than as aforesaid; or 12.6.3. . automated telephone payment facility not later , than as aforesaid;. or .12.6.4. If the said twenty eighth day falls on a day on which the said Parking Office or department is closed, the period within which payment shall be made to the Council shall be extended until 10:00am on the next . day on which the said Parking Office or department is open; .12.6.5. If the penalty charge is paid before the end of the period of fourteen days beginning with the date of the penalty charge notice, the amount of the penalty charge will be reduced by one half; 12.6,6. if the owner of the motor vehicle fails to pay the penalty ,charge by the end of the twenty eight day period, a Notice to Owner may be served, and if the penalty charge is then not paid within a further twenty eight days it may be increased by 50%.

12.7. Where a motor vehicle is left in any road or length of road after a penalty charge.. has been incurred, a parking attendant or a, person acting under his direction may attach to the motor vehicle an immobilisation device or a notice in accordance with the requirements of Section 69 ( 1) and (2) of the Road Traffic. Act 1991.

12.8. The motor'vehicle shall only be released from the . immob! lisation'device:- 12.8.1. by or, under the direction of a parking attendant or-a person acting underlhis direction; or 12.8.2. upon payment to the Council of the:-

12.8.2.1. penalty charge or reduced penalty charge in accordance with the provisions of Articles 12 . 6 and 1.2.7; and 12.8.2.2. such release fee as may be required by the Council in accordance with the provisions of Section 69(4)(b) of the 1991 Act. FIRST SCHEDULE - NO WAITING AT ANY TIME
