Fred Harvey-

On August 4, 1939, by Board Order No. 39-513, the Board approved and adopted my opinion and recommendation that service to Fred Harvey in certain of that Company's operations before January 1, 1939, be ruled to be creditable under the Railroad Retirement Act and the Railroad Unemploy­ ment Insurance Act.

Attached to my opinion were two lists, designated as "(A)" and "(B)", vdiich contained the names of the points and operations covered by the ruling, so far as appeared from the information then in our possession. To Mr. Latimer's letter of August 14, 1939, to Mr. 3. S. Harvey, President of Fred Harvey, there were attached copies of these two lists, and Mr. e Harvey wqs requested to verify them. Mr. Harvey replied under date of August 24, 1939. He stated that "the operations shown on list A are easily verified and appear to be correct." He pointed out, however, that as list (B) stood, particular points on it were difficult of verification because of numerous changes in Fred Harvey operations, and thus made a suggestion for revising the manner in which list (B) was set up which would greatly simplify it, and which is followed in the revised list (B) hereinafter set forth.

Please be advised, therefore, that in adjudicating claims in which service to Fred Harvey is involved, List (B) attached to my memorandum of July 31, 1939, to the Board, L-39-502, should be regarded as superseded by the following List (b ), revised for the sake of simplification only:

(1) All dining car, hotel, eating house, lunch stand, etc., operations performed by Fred Harvey on the St. Louis- Railway System between October 5, 1910, the date of the first contract between Fred Harvey, the corporation, and the above-named Railway, and July 1, 1930, the date of termination of the contract.

(2) All dining car, and other operations performed by Fred Harvey m on tne Atchison, Topeka and Santa Fe Railway System between July 2, 1906, - 2- Memorandum to The Director, Retirement Claims

the date of the first contract between Fred Harvey, the corporation, and the Railway, and January 1, 1939, except for Fred Harvey operations at the following so-called "non-currier facilities", as to which no ruling has yet been made;
