Despite the international outcry following last summer's slaughter in Gaza, Israeli policies and practices of annexation, occupation and brutal military control continue. Recent election results in Israel suggest that these practices will only intensify, creating ever deepening violations of social, economic, political and human rights for the Palestinian people.

On foot of motions passed by last year condemning the attacks on Gaza and calling for arms and trade embargos and sanctions to be imposed on Israel, this Area Committee:

 supports the Palestinian-led international civil society initiative calling for the end of the arms trade with Israel  endorses the 'End The Irish Arms Trade With Israel' Campaign of the Ireland-Palestine Solidarity Campaign  calls on the government of Ireland to end the Irish arms trade with Israel, to advocate for an international arms embargo at EU and UN levels and to take the brave step to become the first EU member state to openly call for the suspension of the EU-Israel Association Agreement

Furthermore, this Area Committee will ask other town and city area committees to also adopt this motion, calling on Councillors across the country to formally endorse the IPSC Campaign.

This area committee acknowledges the tremendous work carried out by the SPARK campaign organising lone parents. On 2nd July thousands of lone parents and their children will be pushed further into poverty as the One Parent Family Payment will cease when a child turns seven. These measures are being implemented without the promised childcare and will have devastating effects on parents in part-time or low-paid work who will ultimately be forced out of their jobs. This Area Committee wishes to express and document our concern directly to the Minister for Social Protection and Tanaiste Joan Burton that the imminent cuts are going to have a devastating effect on lone parents in this area, one which already bears more than its fair share of poverty for all, and in particular for one parent families.

This Area Committee calls on the Parks Dept to remove or partially remove the hedge on the outer boundary of the playground in Edenmore Park as a means of deterring vandalism and anti-social behaviour, including drinking of alcohol, in the playground. This fine facility is constantly misused by anti-social elements to the extent that many parents now have ceased to bring their children to it. The work sought to be done is modest but the local community feels that it is one element that could help to alleviate the problem. Order: Report to Councillor

Dublin City Local Economic and Community Plan 2016 - 2021 Public Consultation

Dublin City, Ireland’s capital and largest City, is home to more than half a million people and host to many workers, students and visitors on a daily basis. Covering an area that stretches from in the north east to in the south, Dublin City is bordered by the Phoenix Park to the west and Dublin Bay to the east.

Dublin City Council, together with local organisations in the public, business and community and voluntary sectors, is drawing up a six year Local Economic and Community Plan for the City. The overall aim of the Plan is to improve the quality of life and well-being of citizens and to develop and implement actions at a local level that will strengthen the community and economic dimensions of the City over a six year period.

Early in 2015, the two bodies tasked with developing the Plan (the Local Community Development Committee and the Economic and Enterprise Development Strategic Policy Committee) identified twelve key social and economic goals for the City, to be addressed over the lifetime of the Plan. The goals are deliberately broad and aspirational but over the coming months through research, consultation and engagement with local communities, businesses, representative organisations and state bodies, more specific objectives and actions to achieve the goals will be agreed.

We are now inviting submissions from everyone with an interest in the City – from individual citizens to small residents’ associations; from community and voluntary organisations to state agencies; from local businesses, entrepreneurs, social entrepreneurs and business representative organisations to workers and students across the city.

The opportunity to have in-put into this early stage of the development of the Plan offers citizens and businesses the best chance of influencing the overall shape and outcomes of the Dublin City Local Economic and Community Plan and ultimately to ensure that Dublin City grows and develops in a manner that improves the quality of life for all who live, work, study in and visit the city now and in the future.

The focus of the Plan is on the social and economic issues and goals that can be addressed by Dublin City Council, local businesses and community and voluntary organisations and state bodies. We would welcome your opinion on the following questions:

Dublin City Local Economic and Community Plan High Level Goals

1. Ensure that all citizens, regardless of social or cultural background, feel a sense of ownership and engagement with the City, feel safe in their communities and are welcome to fully participate in the political, social, cultural and business life of the City.

The Environment & Transportation Department intends to submit a Part VIII Application for the proposed Clontarf Road to Amiens Street Cycle Route. The scheme will comprise approximately 2.5km of high quality, continuous and consistent cycle facilities and improvements to public realm in Fairview.

The proposal is an important strategic piece of cycling infrastructure for the city which will provide a proper, high quality link from the junction of Talbot Street to the junction of Alfie Byrne Road and Clontarf Road, providing a good facility both for commuting and recreational cyclists. In developing the proposal, several options were considered before determining the final route design. As part of this option development, consideration was given to achieving a high Quality of Service, level A and improving connectivity along the scheme particularly to areas such as Fairview Park. This route will form part of the S2S cycle route. The proposals will also provide for improved bus priority.

The proposal conforms to the cycling objectives of the Dublin City Development Plan 2011 – 2017 in addition to relevant national policy such as the National Cycle Policy Framework 2009 - 2020 and ‘Smarter Travel – A Sustainable Future 2009 - 2020’. It is also consistent with the Fairview Marino Local Environment Improvement Plan 2014-2017.

Background/Planning Context

Dublin City Council began installing cycling lanes in the mid 1990’s and now has a network of over 200km of cycling lanes.

The provision for cycling in the City Centre primarily is either on-street cycle lanes, both advisory and mandatory, or bus lanes. The facilities are generally low in quality for cyclists, mainly due to the lack of space for cyclists, inadequate widths for buses to safely pass cyclists in bus lanes, conflicts at bus stops and left turns and discomfort caused by large volumes of traffic sharing the road space. While some existing routes are well connected, there are significant gaps in facilities and generally, road space has been prioritised for traffic and buses. There has been difficulty in providing for cycle lanes in the city centre, where there is considerable competition for street space, between traffic and bus lanes, on street parking and so forth.

National Policy

National Cycling Policy Framework 2009 - 2020 In recognising cycling as one of the most important forms of sustainable transport the Department of Transport published a National Cycling Policy Framework in April 2009. The policy framework emanates from the Governments new transport policy for Ireland – 2009-2020 Smarter Travel – A Sustainable Transport Future. The framework sets out many policies and objectives in relation to cycling, with the ultimate aim of increasing cycling’s share of the total travel market from 2% to 10% by 2020. The key objectives of the policy framework are as follows:  Move 160,000 people a day to work by bike; an increase of 125,000 people;  Invest in better, safer cycle routes around the country for commuters, leisure cyclists and visitors. (Improve existing cycle routes and introduce new routes to best international standards);  Increase cycling’s share of the total travel market, from 2% to 10%;  Introduce a new approach to the design of urban roads to better recognise the needs of cyclists and pedestrians; and  Retrofit major road junctions and roadways in key cities and towns to make them cycle-friendly.

The National Cycle Policy Framework 2009 – 2020 aims to create a strong culture of cycling in Ireland with an aim that 10% of all trips will be by bike by 2020. Reaching this national target will require that major urban Page 13 of 146 centres achieve significantly higher cycling modal share. Currently around 5% of trips in Dublin are taken by bike.

As outlined in the National Cycle Policy Framework, no single action will prompt more people to cycle but the development of high quality cycling infrastructure will play an important part in helping to achieve a new culture where cycling is seen as an attractive mode of transport, particularly for short trips in urban areas.

Dublin City Development Plan 2011 - 2017

Dublin City Council is committed to a policy of developing and improving infrastructure for cyclists throughout the city.

Chapter 5 - Connecting and Sustaining the City’s Infrastructure of the Dublin City Development Plan sets out the Councils policies and objectives for promoting modal change.

Policy SI2 states: “It is the policy of Dublin City Council to continue to promote the modal shift from private car use towards increased use of more sustainable forms of transport such as cycling, walking and public transport and to implement the initiatives contained in the government’s, ‘Smarter Travel, A Sustainable Transport Future 2009-2020”.

Policy SI014 states: “It is an objective of Dublin City Council to develop a direct cycle linkage system away from the primary traffic network including on and off-road cycle lanes designed and constructed to minimise conflict with other road users”.

Policy SI015 states: “It is an objective of Dublin City Council to improve existing cycleways and bicycle priority measures throughout the city”.

Policy SI018 states: “It is an objective of Dublin City Council to provide additional cycle and pedestrian bridges across the city’s canals and rivers to form part of strategic cycling and walking routes”.

Policy SI020 states: “It is an objective of Dublin City Council to provide increased priority for cyclists at key road junctions where possible, by using road marking, priority light signals and other measures as appropriate”.

Policy GC6 states: “It is the policy of Dublin City Council to protect and improve the natural character of watercourses and to promote access, walkways and other compatible recreational uses along them.”

This project will provide a high quality facility specifically designed for pedestrians and cyclists. It will assist in encouraging a modal change away from cars.

Greater Dublin Area Cycle Network Plan

Primary Radial Route 1, identified in the Greater Dublin Area Cycle Network Plan, from Fairview – – Amiens Street – Beresford Place – Matt Talbot Bridge, is one of the thirteen radial routes to the city, linking Dublin North Central and North East. It is also indicated to be the busiest cycle route in the City.

Page 14 of 146 The scheme consists of on road and raised cycle lanes in both directions, along with bus lanes and traffic lanes from the junction of Amiens Street and Talbot Street to the junction of Clontarf Road and Alfie Byrne Road. A ‘green-way’ is proposed along the edge of Fairview Park. A link is also included between Annesley Bridge and Alfie Byrne Road via Fairview Park.

The location of the scheme is shown in Figure 1 below.

The scheme's primary objectives are to provide 2.5km of high quality, continuous and consistent cycle facilities along the route to cater for commuter and recreational cycling. The scheme will improve safety for all road users; enhance connectivity for cyclists and other commuters while improving permeability through the area. The scheme will largely be confined to the existing road and essentially will involve relocating kerb lines or widening of the existing road.

Commencing at the junction of Talbot Street and Amiens Street there are dedicated on road cycle lanes on both sides of the carriageway for the entire length of the scheme. The scheme will also address conflicts between pedestrians and cyclists at Clontarf seafront, at the crossing points either side of the Alfie Byrne Memorial. A link is to be provided from Annesley Bridge to the Alfie Byrne Road through Fairview Park. This link, for cyclists and pedestrians, is adjacent to the Tolka River and continues under the existing railway bridge, an area currently closed off to the Public. The project is to include a greenway or esplanade, a pedestrian and cycle-friendly way, at the edge of Fairview Park, please refer to Figure 2.

Following workshops and consultations with various stakeholders, a Public Realm Strategy document was prepared for the area. This document, while taking into consideration other local area plans and studies, is to identify the key public realm areas along the route and presents possible proposals for consideration to enhance the area. A landscape proposal is to be prepared as part of the scheme to retain the character of the area and the overall public realm. As the route is a future designated BRT route, the scheme will be assessed in terms of BRT compatibility.

Update from Previous Report dated 20th March 2015 to present:

LTACC Sub-Group Meeting with Travact and Architects to Discuss Options within St. Dominic’s/Tara Lawns 11/03/15:

DCC stated its position:

 There are several instances of illegal occupancy in the wider Dublin area and responding to feuding by dedicating scarce development lands to providing additional housing for those families involved would have consequences for all other households with a housing need, who have applied to, and are waiting on, housing in accordance with the adopted Allocations policy.

 Development of any new housing in the North Central Area will take account of demand from Traveller families for group and/or mainstream social housing, as it will for all households with a housing need. The potential for new developments in the Belcamp Lane area are at a preliminary stage only and do not offer any relief in the short to medium term.

 There is potential within the N32 land bank owned by DCC and managed by the traveller Accommodation Unit to restructure the accommodation so that the Gavin family would no longer be adjacent to Cara Park.

Consultant Architects presented drawings/plans to show the options and discuss whether any design options could assuage concerns of the various parties.

1. Travact Reps agreed to discuss the whole site potential with all the affected parties: Gavins, Cara Park residents, the family on Tara Lawns that are indigenous to DCC, and others who use the site on a transient basis. 2. If an agreement can be reached between the parties, DCC will seek a design brief to be drawn up to represent the agreed uses of the available land. This would form the basis of an application to the DECLG for funding. 3. The immediate priority is to clear the site so that cleaning can commence of the dumped material. The Structural Engineer had scheduled a contractor to commence works but this has been put on hold while a new instance issue of illegal occupation is resolved. 4. MH expressed her view that after a year of discussions with the LTACC, affected parties and local councillors that a new development site just for the Gavins is not realistic and the solution should be found within the lands that we own and can progress quickly.

13/03/15: Formal correspondence between DCC and solicitors representing the families at Newtown Court.

Meeting 31/03/15:

Martin Collins from Pavee Point organised a meeting attended by Travact (JM Singh, Paddy McDonagh, Winnie McDonagh), Martin Gavin, Mary Hayes DCC and the Chair of the LTACC Councillor Bríd Smith. From DCC’s perspective the purpose of the meeting was to meet with all the principals to discuss the potential within the entire site to address the concerns of all parties. DCC was requested at the meeting to accept that neither Dominic’s nor Tara Lawns were viable options. This is directly contrary to the position of DCC. In the interest of seeking alternatives, MH - Traveller Accommodation Unit outlined where there are current vacancies/voids within its stock: Grand Canal (4 vacant bays), St. Joseph’s (2 bays), Grove Lane (5 houses now derelict following feuding), Tara Lawns and potential for designing a development within the Dominic’s to Tara Lawns land bank. For various reasons none of these were considered viable alternatives by the Traveller representatives present.

The meeting did not result in any resolution.

 A letter was received from the Gavins’ solicitors raising the illegal occupation of the St. Dominic’s lands as an impediment to moving back onto the lands.

 DCC TAU has served an initial warning letter followed by a notice under the provisions of Section 10 of the Housing (Miscellaneous Provisions) Act 1992 as amended by Section 32, Housing (Traveller Accommodation) Act 1998, to remove the temporary dwelling from St. Dominic’s Park, Dublin 17 by the 6th May 2015.

 The request for Garda support for enforcement of the notice has been sent to Coolock Garda Station for consideration.

May 5th Local Traveller Groups Meeting

Travact organised a meeting between concerned Traveller groups. DCC TAU representative declined the request to attend another meeting and suggested instead that if local groups can agree a use of the available lands that is acceptable to all, DCC would meet to discuss any concrete proposal emanating from the meeting. To date no agreed plan has been submitted.

Current Status: DCC put legal proceedings on hold to allow the Chair of the LTACC engage with all parties to try to agree a solution that would be acceptable to all parties. We acknowledge and welcome the considerable effort by the LTACC Chair, Councillors, Residents of Newtown Court and Traveller representatives but in the absence of an agreed solution, the issue has been referred back to the Law Agent.

Re: Report on Oral Hearing concerning the proposal to extinguish the public right of way at 17-32 Castilla Park, Clontarf, Dublin 3

Approval to initiate the procedure to extinguish the public right of way over the laneway to the rear of 17-32 Castilla Park, Clontarf, Dublin 3 was granted by the North Central Area Committee on the 16th December 2014. A verbal report that an Oral Hearing would be held was given to the Area Committee on the 20th April, 2015. I was appointed to conduct the Oral Hearings at which submissions were made in person or in writing on the proposal to extinguish the public right of way at 17-32 Castilla Park, Clontarf. The hearing was held on the 29/04/2015.

Following publication of the proposal to extinguish the right of way in the national press on the 26/01/2015, two requests (one subsequently withdrawn) were made, in writing, to Dublin City Council by a couple and an individual wishing to state their case at an Oral Hearing. Residents of all 16 houses were invited in writing to attend the Hearing and were allocated 20 minute slots. Three residents attended the actual Hearing, of which two were in favour of the proposal and one was against. House calls were made to a further two elderly and infirm residents, who were both in favour of the proposal. Written submissions were received from seven residents (including the original requester and another resident, who both attended the Hearing).

Fourteen of the residents signed a petition seeking the extinguishment on the following grounds: o There has been a significant increase in antisocial behaviour in the laneway in recent years. o We feel that free access to the rear of the properties increases the risk of burglary.

Checks made with utilities providers but no objections to the proposed extinguishment received. One utility, UPC, requested that the gate be located about 1 metre back from the entrance to the lane in order to leave their chamber, riser and amplifier in the public space.

The main points made in the submissions against the proposal were: -

 Restricted access for oil tankers – a) decreased width of lane due to a gate would make it more difficult for tankers to access the laneway; b) difficulty and risk for elderly residents opening the gate for deliveries in the dark; c) fire risk associated with the alternative option of making deliveries though front of houses using a hose.

 Inconvenience of having to unlock gates for bicycles, bins and service providers.  Vehicular access would be restricted for both residents and service providers.  No anti-social behaviour in the laneway over decades / reduced anti-social behaviour since new block wall built last year replaced trees and bushes on part of one side of the laneway.  Unwilling to share the cost of the proposed gate.  Reluctance to have a gate if the elderly do not want a gate for practical reasons.  Concern about the future management of costs/issues around surfacing and drainage and overgrowing trees etc.

A total of 3 residents have an oil-heating system. The rest use gas. I checked oil tanker sizes and delivery procedures with a number of suppliers, including the company which delivers oil to two of the residents. Deliveries in a custom built mini-tanker (Daf LF 45 cab and chassis with the tank attached) are currently made using the rear lane. The company’s driver has advised that it is a very tight squeeze to get up the lane and that the addition of gates or any other change to the lane would make delivery almost impossible. The company has also informed me that “…delivering through a house is absolutely not an option. Firstly, no oil company will be insured for this as if oil spills in the house it does untold damage, often requiring the residents to vacate for a long period of time and [in the] worst case scenario the house may have to be demolished. We never make deliveries through a house and I am not even sure about the legalities of doing so.”

The main points made in the submissions in favour of the proposal were: -  A large proportion of the residents are elderly, five of whom live alone.  Security for residents e.g. a deterrent against burglaries.  There is anti-social behaviour - graffiti; fires; litter (mainly cans and bottles); binge drinking sessions; smell of drugs. Residents’ children exposed to risks from anti-social behaviour.  Fellow residents willing to pay the share of the costs of any resident refusing to pay for the proposed gate.  The laneway has no exit point and therefore is of no consequences to anyone not living in Castilla Park.

Page 21 of 146 Checks with the Gardai and Dublin City Council have not demonstrated a high level of anti-social behaviour in the laneway:  A check was made with Catherine Brophy Walshe, Environmental Liaison Officer for the North Central Area in relation to the removal of graffiti last April. Ms. Brophy Walshe reported that only a small amount of graffiti (16 sq. Metres) was removed. A second incident was recently responded to. These are the only two reported incidents in the last year.  Gardai in Clontarf station have provided the following data on reported incidents in the vicinity of Castilla Park. There is nothing specifically recorded for the laneway although some of the incidents may have occurred there:

Public order Incidents since 2002 2 incidents in 2006 - not pertaining to laneway. Burglaries since 2001 2, both at the same address, in 2001 and 2002. Unauthorised Taking (UT) of Pedal 2 UT incidents - 2012 and 2015. Cycles Unauthorised Taking of Vehicle 1 incident in 2003. Car hotwired in driveway. Criminal Damage 4 incidents of Criminal Damage in 2006.

Fireworks/ Endangering traffic 1 incident in 2012 Halloween - youths throwing fireworks at cars (3 arrested – Juvenile Liaison Officer assigned).

There have been complaints of youths congregating in the area which did not come through the 999 system. These are mostly local youths and - apart from being in a group - were not involved in anti-social behaviour.

Conclusion

There is no significant level of anti-social behaviour in the laneway and there is a low level of burglaries in the area. The erection of a gate on the laneway would not impact on access for utilities providers but would make oil deliveries using a truck almost impossible. There is no safe alternative means of oil deliveries for the 3 residents affected. Many of the residents are senior citizens and most I spoke to, expressed the view that a gated laneway would provide a greater sense of security and peace for them. The laneway has no exit point and the extinguishment of the public right of way would have no impact on non-residents of Castilla Park.

Recommendation

Following the Oral Hearing and assessment of the reasons put forward by both Proposers and Objectors I recommend that the request for the extinguishment of the Public Right of Way over the laneway between 17-32 Castilla Park, Clontarf, Dublin 3 is refused

Plant Sale

Public Domain and Community Development held a Plant Sale on Thursday 4th June at the front Car Park of Parnell’s GAA Club from 11am. The plants were sold at cost price to Community Groups etc. who are involved in planting within their own areas. A gardener from Parks was also present on the day to give advice on planting to the groups.

Public Domain team has locally sourced large wooden planters and have linked with groups/businesses who are willing to plant up and maintain. The planters were made by the participants of training courses in and PACE in . Planters have been allocated to the following areas/groups: Artane/ Group Ashcroft Estate Raheny Clontarf Business Group Grange Woodbine Estate Marino/Philipsburgh Avenue

Area Clean Ups

A large amount of time has been dedicated by the residents of the North Central Area to their local area through area clean ups. Public Domain support and advise the groups and supply with any material necessary ie. Bags, gloves, pickers etc. We also coordinate collections with the waste management supervisors and public domain crew.

Area Clean Ups are held regularly by at least 50-60 groups in the North Central Area, these are generally kick started each year by the National Spring Clean which we heavily promote in the area. The larger clean ups come to an end each year with the large Leaf Collection programme that we undertake each year. In 2013 approximately 5000 blue bags were issued under the blue bag scheme. In 2014 over 610 residents groups & individuals, who have great pride in their area have availed of the scheme. From September 2014 to December a staggering 20,000 blue bags were issued and collected. Significant resources have been invested in the collection & correct disposal of these leaf filled blue bags. The initiative is an excellent example of partnership between local residents & Dublin City Council.

Village Improvement/Cleaning

Public Domain has been working alongside the local Forum with regard to Suburban Villages. We are linked in with Forum in Raheny, Edenmore, Fairview, Drumcondra, , Clontarf and Darndale. We meet with these groups on a monthly/bimonthly basis and endeavour to tackle any issues that may arise, we are in regular contact and consultation with these groups relating to any proposals we or they may have around enhancement/cleaning of the areas.

Fairview/Marino has recently had an upgrade with much input from Public Domain. We arranged for intensive cleaning of all footpaths, including gum removal, power washing of all bins and lampstandards. We linked in with local businesses with regard to supply of wooden planters of which the businesses are responsible for filling and maintaining. Black traffic bollards were all repainted and graffiti removed from all public property. A large amount of graffiti was also removed from the local park benches and bandstand.

We regularly facilitate Fairview with assistance and logistics around their annual festival in the park and their tree lighting ceremony each Christmas.

We meet monthly with Killester Village through the business forum and have recently arranged for a programme of small works with them. These works are ongoing and include: power washing of traffic triangle, supply of planters, graffiti removal, re-location of village name signs. Regular clean ups take place also at this location and we facilitate the group with this. A Christmas tree are also supplied at this location annually and we have responsibility for the logistics around this and the tree lighting ceremony and festivities.

Public Domain Crew. The Public Domain Crew and Local Grab Lorry continue to operate in the area to remove bulky material from open spaces and green areas.The Public domain crew work on a 5 over 7 roster which enables us to plan for work to be carried out over weekends and to remove bags and debris that is collected from Community clean ups. I can also say that the crew empty litter bins from the promenade and other large footfall locations that are busy over the summer months.

There is a proposal to implement the Swiftway Bus Rapid Transport ( BRT ) along this route through Drumcondra . The corridor is already a busy transport artery and additional capacity is required to cater for the travel growth along this corridor using sustainable transport initiatives.

DCC supports sustainable transport initaitives and it is not recommended to

With reference to the request to surrender the leasehold interest in part of the Northside Shopping Centre Coolock swimming pool access area. Dublin City Council holds a 250 year lease in part of the Ground floor, 1st Floor and 2nd floor (swimming pool area) of Northside Shopping Centre, Coolock which includes an external access ramp, walkway link and stair block to the pool area.

DRIVE INVESTMENT FUNDS PLC an investment company with variable capital and having segregated liability between its sub-funds, incorporated in Ireland with limited liability with registration number 558577 and which is authorised by the Central Bank of Ireland as an investment company pursuant to Part XIII of the Companies Act 1990 (as amended) acting on behalf of its sub-fund DRIVE NS FUND having its registered office at 2, Grand Canal Square, Dublin 2 being the owners/landlord of the Northside Centre were granted planning permission to redevelop the access area to the shopping centre. This involves demolition of the existing external ramp, walkway and stair block to the pool area and replacement with a new entrance and extended retail area and new lift and stairway for common use and provision for a gym area on the new 2nd floor space.

During the proposed works a temporary access stairs will be provided so that use of the pool will not be disrupted. On completion of the works permanent access arrangements will be provided in the new development.

To facilitate this redevelopment the Law Department has advised that it is necessary for the Council to surrender its leasehold interest in the external ramp, walkway and stair block as outlined in red on the attached map (for information purposes) to the owner/landlord.

The dates for the performances of any of the requirements of the proposed agreement may be amended at the absolute discretion of the Assistant Chief Executive.

The disposal shall be subject to such conditions as to title to be furnished as the Law Agent in his discretion shall stipulate.

No agreement enforceable at law is created or intended to be created until an exchange of contracts has taken place.

Given the cancellation of the summer festival in Fr Collins Park, that the budget allocated to this festival be retained for other recreational/festival support initiatives use within the Belmayne/Clongriffin community.

Reply:

Dublin City Council was eager to hold the event in in 2015 but any such event requires a considerable collaborative response from either local business and/or the community itself. At both the January and March Safer Forum meetings expressions of interest in this regard were sought from the community but none were received. Given the nature of the event and the risks associated with the water feature and the attendance of young children considerable volunteerism is required for the event to run successfully and safely. The Deputy Area Manager informed the local representatives of this situation at the May Forum meeting. If there is a viable alternative proposal we would be happy to support the event in some way.

That, for the purpose of renovation/works traffic, access into Priory Hall from Belmayne Avenue be granted only in the case whereby Belmaye Avenue be fully taken in charge by DCC or whereby Belmayne Avenue be furnished with DCC appropriate and enforceable road markings, speed signs and traffic signalisation so as toe ensure the safety of residents and local road users.

Reply:

This area is not in the charge of D.C.C. Traffic management including traffic restrictions, signage road markings, signalisation etc is the responsibility of the site developer until such time it has been approved and taken in charge. Notwithstanding this, the Road Traffic Act/Rules of The Road would still apply and is enforceable by the Gardaí.

4933. Motion in the name of Councillor Deirdre Heney

That this area committee note the concerns of residents of Whitethorn Estate about the proposed location of a new pavilion in Rockfield Park and that same be discussed as many are fearful that the proposal will lead to an exacerbation of anti-social behaviour in the area.

Reply:

Dublin City Council is proposing a significant redevelopment of the sporting facilities within Rockfield Park. This includes the provision of a new tennis pavilion (in a new location), an upgrade of tennis courts and the provision of small football training area. The proposal also proposes the demolition of the current tennis pavilion.

The proposed positioning of the new tennis pavilion to the front of the tennis courts is to increase its visibility and attract people into playing tennis. The new pavilion will operate in conjunction with the local tennis club under a tight licence agreement. For example no alcohol will be allowed be consumed on the premises. It is expected that the new location of the tennis pavilion will allow for greater visibility of the facility and will in turn see a reduction of anti-social behaviour within the area.

Despite the international outcry following last summer's slaughter in Gaza, Israeli policies and practices of annexation, occuation and brutal military control continue. Recent election results in Israel suggest that these practices will only intensify, creating ever deepening violations of social, economic, political and human rights for the Palestinian people.

On foot of motions passed by Dublin City Council last year condemning the attacks on Gaza and calling for arms and trade embargos and sanctions to be imposed on Israel, this Area Committee:

 supports the Palestinian-led international civil society initiative calling for the end of the arms trade with Israel  endorses the 'End The Irish Arms Trade With Israel' Campaign of the Ireland-Palestine Solidarity Campaign  calls on the government of Ireland to end the Irish arms trade with Israel, to advocate for an international arms embargo at EU and UN levels and to take the brave step to become the first EU member state to openly call for the suspension of the EU-Israel Association Agreement Furthermore, this Area Committee will ask other town and city area committees to also adopt this motion, calling on Councillors across the country to formally endorse the IPSC Campaign.

This area committee acknowledges the tremendous work carried out by the SPARK campaign organising lone parents. On 2nd July thousands of lone parents and their children will be pushed further into poverty as the One Parent Family Payment will cease when a child turns seven. These measures are being implemented without the promised childcare and will have devastating effects on parents in part-time or low-paid work who will ultimately be forced out of their jobs. This Area Committee wishes to express and document our concern directly to the Minister for Social Protection and Tanaiste Joan Burton that the imminent cuts are going to have a devastating effect on lone parents in this area, one which already bears more than its fair share of poverty for all, and in particular for one parent families.

At the weekends we empty the litter bins in shopping areas and areas with high footfall. We are not in a position to include litter bins in residential areas in our weekend cover. We had the area around the school entrances on (details supplied) Road cleaned on the 3rd June 2015. 2) Parks and Landscape Services have inspected the tree concerned and it will be included for consideration on the Tree pruning schedule 2015/2016. 3) We will examine the poles on (details supplied) Road, (details supplied) Avenue and (details supplied) Park and if painting is required and the poles are suitable, they will be included on a future painting programme subject to available finances.

Following notification from the tenant that there were outstanding repairs the contractor made contact with the tenant to inspect this dwelling in relation to outstanding repairs. Access was refused by the tenant. Should the tenant wish for this inspection to be carried out contact can be made with this office, Housing Maintenance, and arrangements will be made.

Dublin City Council contacted the Loss Adjuster to request him to reopen the case and carry out a reassessment. The Loss Adjuster advised that the case cannot be reopened without a formal instruction from the Insurance Underwriter, whom he contacted earlier this week. The Insurance Underwriter has agreed to retrieve papers from archive and revert with instructions within the next couple of days. Dublin City Council will update Councillor O’Farrell as soon as these instructions are confirmed, hopefully before the end the week (19/06/2015).

A request for replacement of a public litter bin was recently received through the (details supplied) Safety Forum and approval has been given for same, we are currently waiting for delivery of some new bins and it will be replaced as soon as they are received.

Graffiti is monitored on an ongoing basis by the Public Domain Unit and removed within 48 hours where practicable if on public property or deemed political, racist or offensive.

Road Maintenance Services has no works programmed in (details supplied) as part of the Road Maintenance Services Annual Works Programme 2015. We will continue to respond to requests to carry out repairs on localised repairs where our budget allows.

Reply:

Planning permission was granted on 25 August 2004 for the erection of a two-storey, detached house on the site mentioned (Planning Register reference 3053/04 refers). Condition 6 of the permission required: “The following requirements of the Drainage Division, Dublin City Council, shall be complied with: a) The developer shall comply with the requirements of the Code of Practice for Development Works - Drainage. b) The Development is to be drained on the completely separate system with separate connections to the public foul and surface water systems. c) All private drains, downpipes, gullies, manholes, Armstrong Junctions, and similar private fittings are to be located within the final site boundary, with the exception of the Private Drain Connection to the Public Sewer. d) There is an existing public sewer running through the site. A clear distance of three metres shall be maintained between sewers and all structures on site. The exact location of this pipeline must be accurately determined onsite prior to construction work. e) The developer shall submit two copies of a revised site drainage plan directly to the Drainage Division of Dublin City Council for written approval. These plans shall be submitted not later than the submission of the commencement notice for the development, and drainage works shall not under any circumstances commence prior to the issuing of such written approval. Reason: In the interests of the proper planning and development of the area.

The developer did not comply with the requirements of this condition and an enforcement notice pursuant to section 154 of the Planning and Development Acts 2000-2014 was served. The notice required full compliance with the condition by 22 August 2014. As the developer did not comply with the requirements of the notice legal proceedings were initiated.

This issue is now before the Courts. When the case came for hearing on 2 December, 2014, the developer gave an undertaking to the court to address the requirements of the Enforcement Notice and work has commenced.

These works are being monitored by the Council’s Drainage Division to ensure compliance with the terms of the Enforcement Notice and the requirements of condition 6 of the permission only. Any impact on adjoining properties is a civil issue to be resolved between the parties concerned.

Enforcement action was pursued in relation to this development. Specifically, the developer had to comply with drainage requirements vis-à-vis the proximity of the public sewer (that crosses this site) to the house. Works have now been completed on the diversion of the sewer to ensure the required clearance from the house.

Reply:

An application was approved for an extension to this dwelling in February 2015 and placed on our waiting list for commencement when funding is available.

Further to an OT report from Beaumont Hospital in December we were informed that this tenant would be able to use a stairlift. The lift was purchased but the family declined the installation of same. Subsequently, the community care Occupational Therapist advised that she would only recommend downstairs accommodation and as such, on her recommendations at this time, the City Council will not proceed with the lift installation. A ramp to the front access of the dwelling has been installed.

The current position with extensions to City Council dwellings for persons with Disabilities is,3 extensions currently in progress, a further 7 at tendering stage, and a further 5 at the early stages of the planning process, to a total of 15.

There are a further 25 approved cases for extensions on the waiting list (not yet assessed by a surveyor/architect) with high medical priority. This case is 4th on this list.

Reply:

Further to a previous reply to a question raised in connection with this issue, the Air Quality Monitoring and Noise Control Unit is continuing with an investigation into the operation of a solid fuel boiler at (detail supplied). Following discussions with the owner of the device, an undertaking to carry out works to rectify the air pollution problem was given by the operators in March 2015. These works were scheduled to be carried out during the off peak heating season.

An updated statutory notice has been served on the residents of (details supplied) and the owner is required, inter alia, to demonstrate compliance with the notice under the Air Pollution Act 1987 by operating the system in accordance with the terms of the notice following these works.

It is proposed to carry out an assessment of the operation of the system at a prearranged time within the current month. Legal proceedings will be initiated should the air pollution emissions persist.

It is currently the case that maintenance requests for windows, window frames, front doors, panels and doorframes are investigated by the local depot. If the repair can be carried out by the local depot, i.e. minor repairs, repairs to handles/hinges, seal repairs etc it will be carried out locally and within a short timeframe (weeks). In the past, if the repair was deemed to be more substantial, and new windows and/or doors were required the works were placed on a waiting list irrespective of condition or priority by our Joinery Workshop. A more targeted approach is now being adopted which includes an inspection and a categorisation, as follows:

Category Description Estimated Timeframe A Windows are extensively rotten. Urgent 0 to 3 months replacement required. (approximately, depending on demand) B Partial rot. Senior Citizens. Reduced integrity. 3 to 12 months (approximately, depending on demand) C Windows in acceptable condition. No immediate Re-inspect within 24 months. repairs evident. Single to Double glazed needed. D Windows in good condition. No future repairs. Re-inspect within 36 months or on request

This system will ensure that those windows in greatest need of replacement will be dealt with firstly and in the shortest timeframe.

It should be noted that there is a high demand in the 'Category A' list as a result of a backlog due to the change over in categorisation which will require the '0-3 months approximately depending on demand' to be extended for a period until the backlog is cleared.

An order for replacement windows for this dwelling was made under past practice, however on inspection the windows were not prioritised as 'Category A' for replacement. However as a written commitment was given to replace these windows in 2015 this order will be proceeded with. Due to the volume of orders currently in 'Category A' it will be towards the end of 2015 when the windows will be replaced. The tenant will be contacted prior to installation.

Reply:

The applicant is currently placed in emergency accommodation in the Sunnybank Hotel. A member of the New Presenters Team from Focus Ireland met with the applicant on the 11th May 2015 for initial assessment. I am informed that due to the large number of new families currently being placed into emergency accommodation, it may be a number of weeks before she will be allocated a keyworker. As there are applicants currently in emergency accommodation for a longer time frame and who are currently being considered for more suitable housing, I am not in a position to say how long the applicant may have to remain in her current placement.

The Arts and Cultural Advisory Group at its meeting on the 30th of March considered the proposal by the artist to restore the memorial on site or to reconstruct it in another location in the community. The Arts and Cultural Advisory Group decided that the present site was not suitable for the memorial due to its location near the sea and that to reconstruct it elsewhere would remove its contextual relevance. Therefore, the Arts and Cultural Advisory Group decided that the memorial should be decommissioned permanently.

Reply:

Responsibility for this scheme transferred to Irish Water on 1st January 2014 and the project was novated from Dublin City Council to Irish Water by Ministerial Order on the 21st February 2014.

Dublin City Council Capital Project Office is managing these works under the terms of the SLA on behalf of Irish Water.

The project, originally a 40 week contract was awarded in July 2014 to Ward & Burke Construction Limited with Nicholas O’Dwyer Consulting Engineer appointed as the Employer’s Representative.

The timeframe for delivery of the project could not be completed on time due to the date of Contract award and the subsequent EIS restrictions within the Clontarf Promenade area prohibiting works in the area between the end of September to the 1st of April.

Works commenced onsite in October 2014 and are ongoing at present. The expected completion of the project is October 2015.

This project is Phase 1 of the North City Water Supply Scheme and upon completion will provide security of supply to the local area of Fairview/Clontarf and increased water quality control processes. The completion of the overall scheme will ensure security of supply for the entire North Central region of the Dublin City Administrative Area with a linking of the new trunk main to the North Fringe Water Supply at Bayside Boulevard. It will also provide security of supply to the North Docklands SDZ.

Reply:

The Planning Enforcement has not received any complaints regarding this laneway. Occasional complaints about activities within the adjoining properties – satellite dishes, extensions etc – have been received but these have not been in relation to the laneway itself.

It appears that laneway once led to some allotments that lay to the rear of the Cottages. However, the allotment site has now been sold and developed. While allotment holders and residents of the Cottages may have enjoyed an access over the laneway, there is no evidence that a public right-of-way exists over it.

Since the cessation of the allotments, some of the adjoining residents applied for and acquired that part of the laneway behind their houses to incorporate into their gardens. Others may have simply taken in a section without permission. A recent inspection has shown that the owner of one property has opened an entrance onto the lane and may have realigned his boundary wall. Where no public right-of-way exists, the provision of the entrance constitutes exempt development. These issues are civil matters to be resolved between the laneway’s owner and the residents concerned.

Threshold is currently providing a service on behalf of the four Dublin Local Authorities for people who are in danger of losing their private rented accommodation. I attach the information below.

A safety barrier is not recommended along this 170m stretch of (details supplied) Lane as it does not conform to the DMURS Urban Roads & Streets Design Manual objectives regarding Pedestrian Perspective (Section 2.1.2.Connectivity).

Guardrails may be counter productive: as they have been found to increase vehicle speeds & aggressive behaviour.

They can create a false sense of safety for both drivers and pedestrians(rails will only stop vehicles travelling at low speeds), block intervisibility between drivers and children, can result in pedestrians being trapped on the outside of the guardrail, reduce the width of footpaths and create a collision hazard for cyclists.

Notwithstanding the current Department of Transport policy a bus corridor is in place on this section of carriageway between the hours of 07.00-10.00hrs and 12.00-19.00hrs, Monday to Saturday. This creates a buffer zone of 3m between the footpath and general traffic prohibited from using this lane during school peak travelling times.
