Note: Permits will only be issued to Road Authorities and Utilities Committee (RAUC) approved contractors. 4. Charges

The charge is £260 for first week and £104 for any additional 7 day periods (or parts thereof).

5. Conditions

a . All works must be signed and guarded as stated in the booklet “Safety at Street Works and Road Works” obtainable from HMSO Publications Centre, bookshops, accredited agents or through good booksellers. b. This permit does not carry with it any right to interfere with any apparatus in or above the road. c. It is the applicant’s responsibility to contact utilities to obtain plant information before t he commencement of the work. [Note: From …(date pending)… the Council will enter the notice for these works into the Scottish Road Works Register as required under the Transport (Scotland) Act 2005 Section 19.] d. No openings shall be permitted on bridges nor shall any tunnelling be allowed unless special detailed application is made and approved. e. Any person(s) carrying out works must hold a relevant Scottish Environment Protection Agency (SEPA) certificate for the transport and disposal of waste materials. f. This permit must be shown, if requested, to a police officer or to any officer of the C ouncil. It is only valid over the period authorised.

6. Specification The road must be permanently reinstated in accordance with the New Road and Street Works Act 1991 Code of Practice “Specification for the reinstatement of road openings” January 2015 and any subsequent amendments. The materials, course depths etc, shall be in accordance with the appropriate road type.

Note: i. It is an o ffence for works to be executed in or excavations made under a public road without the road authorities consent in writing (ie a road opening permit.) Any person who carries out such works without permission is guilty of an offence and shall be liable to a fine not exceeding £1000 (1991). ii . Works executed, or an excavation made, in contravention of 1 above, may be removed, or as the case may be, filled in by the roads authority who will recover such expenses as are reasonably incurred in so doing.

Maintain the reinstatement in good condition during the maintenance period of 12 months from the date of completion of the works is notified to the office issuing this permit. [Note: Any works undertaken in relat ion to public utilities or services will b e subject to the 24 and 36 month guarantees as per the New Road and Street Works Act 1991 Code Of Practice “Specification for the reinstatement of road openings”.] 3. Relieve the council of all liability for any loss, injury or damage due to my/our operations, either during the opening or during the period of maintenance. 4.
