INVITATION TO BIDDERS

The Board of Education of the City School District of the City of Kingston, New York solicits sealed bids for the transportation of students from within the Kingston City

School District.

Office, Cioni Administrative Building, 61 Crown St., Kingston, N.Y. 12401 by the Office of

the Deputy Superintendent for Human Resources and Business, on Friday,

April 26, 2019 at 11:00 AM (Note: if Kingston City School District is closed due to

inclement weather, it will be the next business day that KCSD is open, at 11:00 AM.) Any bid received after this date and time will be returned to the bidder unopened.

Specifications and bid forms may be obtained at the following location: Kingston City

School District, Transportation Department, 61 Crown St., Kingston, NY 12401 on business days between the hours of 9:00 a.m. and 3:00 p.m.

The Board of Education reserves the right to accept or reject any or all bids, and to require the submission of a bond for the faithful performance of any contract. Any bid submitted shall be binding for 90 days subsequent to the day of the bid opening.

INSTRUCTIONS TO BIDDER

1. Inspect carefully all “general” and “special” provisions of the bid package. Retain these and “Instructions to Bidder” for your reference.

2. Sign and return the “Bid Offer” forms with specifications and bid prices together with the proposal guarantee required by paragraph 6 below and Bid Proposal Certifications (including the non-collusive bidding statement).

3. Percentage discounts from list prices and/or subdivisions of the specifications of the group discount will be accepted only if specifically stated on our forms at the time of the bid opening.

4. All bids must be sealed. They must be submitted in plain opaque envelopes. All bids must be mailed or hand delivered to the Business Office, Kingston City School District, 61 Crown St., Kingston, N.Y. 12401. Bid envelopes must be marked “BID #2019-02 TRANSPORTATION BID“ and must include the date and time of the bid opening, as indicated on the cover sheet of the bid form and specifications. No telephone, e-mail, or bids by facsimile will be accepted.

All bids must be received in the Business Office by Friday, April 26, 2019, at 11:00 a.m. (Note: if Kingston City School District is closed due to inclement weather, it will be the next business day that KCSD is open, at 11:00 a.m.) Any bid received after this date/time will be returned to the bidder unopened. It is the sole responsibility of the bidder to ensure that his/her bid, by whatever method used to send/deliver the bid, is received at the Kingston City School District Business Office by the date and time indicated.

5. Signing of the “Bid Offer” constitutes certification of compliance with the conditions of the Bid Specifications.

6. In order to insure the faithful fulfillment of its terms, each bid shall be accompanied by a proposal guarantee in the form of a certified check, or Treasurer’s or Cashier’s check drawn upon a responsible bank or trust company doing business in New York State, or a bid bond issued by an appropriate agency, in an amount equal to five percent of the amount of the bid. Checks or bid bonds shall be made payable to the Kingston City School District. These will be returned to all bidders except those being considered for award. Upon awards being made and contracts signed, all other checks shall be returned. If any successful bidder shall fail to execute the contract awarded and furnish any required performance bond within the time limit specified, the Board of Education may, at its option, determine that the bidder has refused to execute the contract and the proposal guarantee shall be forfeited as liquidated damages, and the contract may be awarded to another bidder.

7. Please submit the original document and keep a copy for your records.

8. If two or more bidders submit identical bids as to price, the decision of the board to award a contract to one of such identified bidders shall be final. (General Municipal Law, Sec. 103, sub. 1.)

9. It is the bidder’s responsibility to supply all requested information for this bid package by the date requested. Kingston City School District will not notify the bidder if information is missing from the bid package submitted.

TRANSPORTATION BID SPECIFICATIONS

GENERAL AND SPECIAL PROVISIONS

All bids for transportation routes and options are for the 2019-2020 School Year and the 2019 Summer Program. The Board of Education of the Kingston City School District may extend the transportation contract for one or more additional years in compliance with law and the Commissioner’s Regulations.

The numbers relating to students and distances herein may be considered approximate. A bidder should submit a complete bid on the attached routes as described in the route descriptions and must include Bid Offer Forms A, B and C.

Any award of bid is dependent upon: WHAT IS CONSIDERED TO BE IN THE BEST INTEREST OF KINGSTON CITY SCHOOL DISTRICT.

A. Scope

1. Transportation of students from within the Kingston City School District. A copy of the school district’s calendar will be sent to the successful bidder.

2. The specifications are intended to describe the conditions, equipment, and places involved in transporting school children under the jurisdiction and control of the Kingston City School District.

3. Transportation shall be provided as described in the detailed bid specifications.

4. The bidder must submit proof of bondability for a performance bond equal to 100% of the contract price. Prior to the signing of a contract awarded hereunder, the successful bidder shall furnish a performance bond in a sum equal to one hundred percent (100%) of the contract price for the faithful performance of the contract. The cost of the bond must be shown. The Board reserves the right to waive the requirement of a performance bond when it deems it in the public’s best interest to do so.

5. Specific transportation days shall be forwarded to successful bidder upon award.

6. The School District may, at their discretion, dismiss one or more schools at noon, or at any other time of the day, upon proper notification to the contractor.

7. Buses must arrive and depart at the schools at such times indicated in the detailed bid specifications.

8. The contract will become valid and binding upon approval of the annual budget of the School District and when approved by the Superintendent of the School District and the Commissioner of Education.

9. The Board of Education may request an outline from each bidder stating experience for the past five years in the operation of school buses, if such information is available.

10. The Board of Education reserves the right to place additional buses in operation to transport students in the area, and such buses may be owned and operated by the District or hired from another contractor.

11. The contractor may not subcontract with any other bus operator to supply buses and/or bus drivers and/or aides/monitors/attendants for any part of this contract except with the express permission of the Superintendent of the Kingston City School District.

12. The Board of Education reserves the right to require the contractor to provide assistant drivers, monitors, attendants, and/or aides on buses where deemed necessary.

13. The enclosed dispatch sheet in the Detailed Bid Specification must be completed and given to Kingston City School District two (2) weeks prior to the opening of school and the 1st of every month, or when there is a change of bus # or driver.

14. By reference, all applicable federal and state statutes and regulations providing for mandatory conditions in the case of school transportation contracts are incorporated herein. The contractor by submitting his proposal agrees to this provision and acknowledges familiarity therewith.

15. The Board reserves the right to reject, accept or re-advertise the same work, or to award a Contract to other than the lowest bidder in appropriate circumstances. The Board may reject any Bid not prepared and submitted in accordance with the provisions hereof and may waive any informalities or irregularities in the bid when deemed to be in the best interest of the District, at the Boards’ sole discretion. Any Bid may be withdrawn prior to the opening of the Bids. Any Bid received after the date/time of the opening of the Bids will be returned to the Bidder unopened.

16. Student changes (new students or address changes) must follow the “Three Day Rule.” Transportation must begin within three (3) business days after the Contractor is notified by the District.

B. Facilities

Contractors shall have an operating location to provide adequate repair, maintenance and DOT inspection facilities for vehicles used in the operation of this contract. If the location is rented or leased, proof must be provided within 20 days of the bid award. Failure to provide this information to the Kingston City School District will result in the Board rescinding the bid award.

C. Provisions for Fuel Supply

All bids must be submitted by the bidder under the following provisions: 1. With the Kingston City School District furnishing fuel to carrier;

One (1) gallon of fuel for each eight (8) miles for buses in excess of 30 passengers

One (1) gallon of fuel for each (10) miles for buses that are 8-30 passengers

One (1) gallon of fuel for each (20) miles for 7 passenger bus or less

Fuel will be provided on the basis of actual route mileage as described under Detailed Route Description using Kingston High School as the start and end point for AM routes. PM routes start at Kingston High School and end at the last drop off.

2. Prior to the end of the school year the District will make an adjustment for any fuel that may be owed to the Contractor for routes that have exceeded the mileage originally quoted.

3. Fuel offered to the Contractor is diesel or gasoline. The District will not offer any other alternate fuel. Any fuel ordered by the Contractor without prior approval from the District will not be paid by the District.

D. Equipment Requirements

1. The Contractor shall use buses that are model year 2012 or newer at the start of this contract. For any contract extensions, buses must be seven (7) years old or newer at the start of each year.

2. The Kingston City School District may require the Contractor to implement a 5-year rotational upgrade program for the buses used to transport students. This plan would be contingent on the extension of the contract.

3. Buses to be used shall be subject to inspection by the NYS Department of Motor Vehicles, the NYS Department of Transportation, the Commissioner of Education and the Board of Education or their designees. The bidder shall provide a copy of its latest 12-month period, DOT Operator Profile report of the terminal that is proposed to operate this contract. If the terminal will be a new location of the bidder, the bidder shall furnish comparable reports for its terminals (up to three) located in closest proximity to this proposed location.

If awarded the contract, the Contractor shall supply the District on an annual basis a copy of its latest DOT Operator Profile report for the terminal that is operating this contract. Said report shall be for the latest 12-month period.

In addition, the Board reserves the right to reject any bidder whose DOT passing rate is below 90%. If the Board decides to accept a bid that is below the 90% passing rate, the passing rate for the bidder must be improved to the 90% rate within one year.

4. Contractor shall meet all current requirements of the NYS Department of Transportation, NYS Education Department, NYS Department of Motor Vehicles, and any other applicable State and Federal Laws & Regulations and as may be amended during the contract term or renewal term, if any, in regards to safety and signaling devices. Signaling devices shall be in good operating order and shall be operated at all times when students are on the bus.

5. Features of construction of the buses to be used that directly affect the safety of students to be transported shall not be less than what is required by the Commissioner of Education in the State of New York for District- owned buses.

6. Operation and maintenance of all buses used for transportation of school children shall be subject to any and all reasonable rules and regulations that may be adopted in the future by the Board of Education, and a copy of such rules and regulations shall be delivered to the contractor by the Board of Education.

7. Buses used in providing service: a. Shall be the National School Bus Chrome Yellow Color (may have white on top) in accordance with the standards set by the Department of Motor Vehicles of the State of New York. b. Shall be marked front and rear with the words “SCHOOL BUS” in the size and in the locations as required by the NYS Department of Motor Vehicles. c. Shall be equipped with stop lighting arrangements in strict conformity with the regulations established by the NYS Department of Motor Vehicles. Conformity shall also include regulations concerning braking, the exit doors and the arrangement of both front and rear lights.

d. Shall have a swing out stop arm on driver side near driver area. e. Shall be equipped with window arrangements which conform with the regulations of the NYS Department of Motor Vehicles. f. Shall conform to all other statutes and regulations not listed here pertaining to school buses, and specified by the State of New York.

8. Buses must be equipped with a two-way radio with the capability of transmitting and receiving the School District’s frequency. All buses must have a GPS system and a working camera system with three (3) interior cameras.

9. The contractor must have access to an enclosed, heated maintenance shop with a pit or lift as required by the NYS Department of Transportation.

10. Heaters and defrosters shall be of sufficient capacity to keep bus reasonably comfortable and safe for operation.

11. Buses must be equipped with air conditioning. Air conditioning should be fully operational as of May 1st of each year of the Contract term.

12. Buses shall be clean both inside and out and shall be maintained in first class operating condition at all times when used for the School District’s operation.

13. Buses used to transport students shall not display either inside or outside of the bus any advertisement, political or otherwise.

14. Tires used on buses must be in a condition to satisfy safety standards, with regard to tread and condition; front tires must never be below 4/32 tread depth, rear tires must never be below 2/32 tread depth. A tire that is smooth and without tread shall be deemed to be unsafe. Recut or re- grooved tires are not acceptable. During the months of November through March snow tires are required. 11

15. All buses shall have route numbers posted on both right and left front side windows. Numbers should be at least four inches high.

16. All contractors operating bus routes for the Kingston City School District will be required to have one spare bus for each seven bus routes or fraction thereof.

17. The Contractor shall provide a five (5) point car seat, safety vest or wheelchair hookup, as applicable. All equipment must be clean and in good working order. The contractor shall not use a harness without authorization from the District. Booster seats are NOT allowed.

E. Limitations on Use of Equipment

Buses used for student service shall be restricted to the transportation of school children authorized by the Superintendent of Schools and the Board of Education according to the limits of these specifications. Trips may be combined with other school districts’ trips with approval from all districts involved and final approval of such from each Superintendent of Schools. Students shall not be carried for pay or otherwise by private arrangement with parents while the bus is being used to fulfill the requirements of these specifications and any contract which might ensue from these specifications.

F. Conditions for Retention of the Contract

1. Failure to adhere to and comply with any of the conditions and specifications of this bid and the contract to follow will subject the contract to cancellation upon ten days written notice by the Board of Education to Contractor. In the event of cancellation/termination of contract and the necessity to bid or negotiate a new contract for transportation service with another contractor, the original contractor will be responsible for indemnifying the District for costs incurred in obtaining a new contract and for any increase in costs of services involved for the duration of the term of the original contract.

2. The contract will be null and void if at any time the NYS Department of Transportation refuses to approve the conveyor or the conveyance, or the conveyor is unable or unwilling or fails to meet the requirements of the NYS Department of Transportation or is unable or unwilling or fails to comply with the applicable federal and state regulations and statutory provisions.

3. The Board of Education shall have the right and option to terminate this contract upon the contractor making an assignment for the benefit of creditors, being adjudged as bankrupt, or filing a petition for corporate reorganization or to be adjudicated as bankrupt under any of the chapters of the Bankruptcy Act (including, but not limited to Chapter X and XI).

4. In the event of a strike or other reason which causes interruption of services for more than 24 hours, the Board of Education shall have the right to immediately secure other transportation as may be necessary and charge the cost of same to the account of the contractor.

5. Any change of ownership, conduct or management, or transfer of a portion of the entire interest in the business of the contractor/owner/operator shall be sufficient basis for cancellation of the period remaining under the contract after the date of such a change in ownership or management as above described, at the discretion of the Board of Education.

6. If the contractor is unable, unwilling or otherwise fails to timely transport all the scheduled students present on his/her route as per route description specifications for three (3) successive days of scheduled transportation, the Board of Education, in their discretion, shall have the right to terminate this contract without further notice to the contractor and without further obligation to the contactor. 7. Termination of insurance policies during the period of services shall be deemed a material breach of contract and shall have the effect of terminating said contract immediately without notice to contractor and without further obligation to contractor.

G. Personnel Requirements

1. Each contractor shall file with the Superintendent of Schools for their approval a list of all drivers, both regular and substitute, for the contract period together with drivers’ applications and completed medical examination forms. Contractor must also submit Motor Vehicle Record of any violations on any driver. Should changes in the driver list occur during the contract period, the District must be notified immediately and all requirements shall be met.

2. A DOT physical examination must be completed prior to starting to drive, and all future exams must be completed in accordance with the initial physical exam and shall not be longer than twelve months from previous year’s exam. Replacement drivers must have completed physicals. Kingston City School District does not accept 19A physicals.

3. The contractor must ensure and certify that all drivers meet the requirements of Article 19A of NYS Vehicle and Traffic Law, the federal Omnibus Transportation Employee Testing Act of 1991 (49CFR382), Section 156.3 of the Regulations of the Commissioner of Education, the New York State Department of Transportation, the Federal Department of Transportation regarding Drug and Alcohol Testing for employees engaged in safety-sensitive positions and all other laws, rules and regulations 14

applicable thereto. Records are subject to periodic audit by the District. Each driver must participate in approved driver training courses, training in the Dignity Act, training in student confidentiality under state and federal law (FERPA), and training on sexual harassment in the workplace in accordance with Section 201-g, Labor Law, where required by law.

4. All contract carriers and their drivers will cooperate fully and completely when information is required regarding routes and students carried. Such information is to be accurately compiled. The school system will not ask for “unreasonable” cooperation.

5. When the contractor is transporting school children, the contractor is required to provide its drivers and the Kingston City School District the telephone number of supervisory personnel who can be contacted AT ALL TIMES (24/7). THERE MUST BE SOMEONE IN THE OFFICE OR ACCESSIBLE TO THE DISTRICT DURING THE TIME THEIR BUSES ARE ON THE ROAD.

6. Any and all cell phone use (including but not limited to phone calls, emails and texting) is prohibited by a driver while the bus is in motion (including when stopped at a red light). If an emergency occurs that requires the use of a cell phone, the driver MUST find a safe place to pull over before using a cell phone.

7. All school bus drivers/monitors are prohibited from smoking and other tobacco use (including e-cigarettes/vaporizers and similar devices) on school buses at any time, whether students are on board or not. All school bus drivers are prohibited from smoking and other tobacco use (including e- cigarettes/vaporizers and similar devices) on school property and within 100 feet of the entrances, exits or outdoor areas of any elementary or secondary school building at all times.

8. The Board of Education may require the removal from service on any contract with the District of any driver/monitor whom the District believes to be unfit for either the safe operation of a bus or the supervision of children. The contractor must indemnify and hold harmless the District from any claim, action, proceeding, damages, loss and costs as a result of the contractor’s decision to discipline or discharge any bus driver.

H. Driver/Monitor Responsibilities

1. The school children must be conveyed safely at all times, exercising proper supervision over said children; all reasonable rules and regulations must be followed; the driver/monitor must always be approved by the Superintendent of the District.

2. Drivers/Monitors shall require all students to be seated up to the rated seating capacity of the bus. No standing allowed.

3. Drivers shall wear seat belts at all times when bus is in operation.

4. Drivers/Monitors shall make every effort to prevent smoking/tobacco use, horseplay, swearing, and the use of vile language on the bus. Incorrigible offenders shall be reported to the appropriate school official in a timely manner.

5. Drivers/Monitors shall not permit any student to board the bus or to be discharged from the bus except at the point on the route nearest his/her home or at the school unless a school official approves such change.

6. No persons other than bus monitors/aides/attendants and District students shall be permitted to ride the bus unless approved by the Superintendent of the District.

7. Monitors are on the bus to assist the driver and the students as necessary. Responsibilities will vary depending on the individual needs of the students on each route.

8. Drivers/Monitors are required to be on the bus at all times when students are on the bus. Monitors will supervise loading and unloading of students. Buses are never to be left unattended unless the ignition is off, the emergency brake engaged, bus doors closed, and ignition keys are in the driver’s possession.

9. Drivers/Monitors must check all the seats and look for sleeping children on the bus after unloading students after every trip. They must cooperate fully in all student accounting/management systems and policies established by the District. They must check for articles that might have been left on the bus. Failure to check for sleeping children may result in the driver/monitor being disqualified by the District.

10. Drivers/Monitors shall not make private or separate verbal/written agreements with any other person that might alter the assigned route or service. All parent/guardian/caregiver and contractor requests for changes in routes or service must be made through the District.

11. Drivers/Monitors are required to buckle or unbuckle the student’s car seat, seat belt, or harnesses and to properly secure all wheelchairs. The Contractor shall instruct all of its Drivers/Monitors in the proper use and operation of such equipment prior to being assigned a route.

12. Drivers/Monitors are required to complete all forms related to the transportation of the children, including, but not limited to the following information: mileage, attendance sheets, children’s names, pick-up/drop- off, and times between stops. The Contractor shall submit these forms to the District.

I. School Day

1. The school year calendar: A. consists of 180-190 days. The calendar will be used to determine the exact dates that buses will be in operation. The successful bidder shall be expected to conform to the school calendar and schedule of the school(s) involved. Transportation is primarily for Monday through Friday – follow school calendar for exceptions. B. The Summer Program consists of 30-38 days.

2. Buses must arrive and depart at the receiving schools at such times as designated in the route description specifications.

3. The school may, at its discretion, dismiss one or more schools at mid-day, or at any other time of the day, upon proper notification to the contractor.

4. In the event that changes in the duration of the school day, or the starting and dismissal times of any of the schools are made, the contractor will be required to provide service according to any modified school day plan, until such time as the normal school pattern can be reestablished. No increase in daily compensation rate shall be made should this situation occur, nor shall a decrease in compensation rate be made in the event that the modified school day plan requires fewer miles of daily driving for a bus.

J. Emergency Closings

Adequate provisions shall be taken by the contractor for service to the Kingston City School District in the performance of the regular bus runs at times other than that scheduled, which may be required by an emergency closing due to change in weather conditions, curriculum days, or other reasons deemed necessary by the Superintendent of Schools or designees.

K. Safety Requirements

1. School transportation buses must be operated at all times by capable and competent personnel at safe and reasonable rates of speed.

2. The Board of Education, through their officials, reserves the right to enforce any and all provisions of safety in the transportation of students to and from school.

3. Where practical, no bus shall be permitted to receive or discharge students on the highway where the bus cannot be seen by another motorist from a distance of at least 300 feet.

4. Drivers shall make every reasonable effort to give way for motorists who become lined up behind the bus for any considerable length of time.

5. Buses shall stop at all railroad crossings as required by law and comply with the applicable federal and state regulations and statutory provisions.

L. Insurance Requirements

The Transportation Company shall purchase and maintain during the life of the contract, and any renewal term, the insurance set forth in this provision. This insurance must be purchased from a New York State licensed, A.M. Best Rated “A” or “A+” carrier. The Kingston City School District and the Kingston Board of Education, with the exception of Workers’ Compensation, Disability and Employers Liability Insurance, shall be named as additional named insureds. A copy of the certificates shall be provided to the District, with a provision that in the event the policies are either cancelled or diminished, at least 30 days prior written notice by certified mail, return receipt requested, thereof shall be given to the District. Any endorsements affecting coverage for additional insureds must be attached to the certificate. The Transportation Company shall not commence work under this contract until they have obtained all insurance as required and such insurance has been submitted to and approved by the District. 19

The Transportation Company shall require any subcontractor(s) to provide all of the requirements of this section before any work commences. In addition, all subcontractors must carry statutory Workers’ Compensation, Disability and Employers Liability Insurance for their employees.

1. For all coverages: Any deductibles or self-insured retentions must be declared to and approved by the District. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the District, the Board of Education and their officers, employees, agents and volunteers.

2. Commercial General Liability Insurance: “Occurrence” forms, including Premises-Operations, Products-Completed Operations, Contractual, Personal Injury, Owner-contractor Protective and Fire Damage legal Liability. Coverage shall be in at least the amount of $1,000,000 per occurrence, $2,000,000 aggregate. Coverage is for bodily injury, property damage, products/completed operation, and personal injury. Coverage will be at least equal to the most recently approved (in New York) ISO form #CG 00 01. An additional insured endorsement, equivalent to CG 20 26 or CG 2010 naming the Kingston City School District, its Board of Education, and any of their public officials, agents, employees, and volunteers must be included and include coverage for ongoing and completed operations. Such Additional Insured status is to be provided on a primary and non-contributory basis. A Waiver of Subrogation in favor of the District must apply. Coverage is to apply on an occurrence basis only. There may be no endorsement or modification of this policy limiting the scope of coverage for Contractual Liability.

3. Comprehensive Automobile Liability Insurance: On owned, hired, leased, or non-owned motor buses in the amount of at least $5,000,000 per occurrence, Combined Single Limit. Policy must include code 1-“any auto” and Insurance Services Office (I.S.O.) endorsement CA0029 (Ed 12/88) – Change in Business Auto and Truckers Coverage.

With regard to Comprehensive Automobile and Commercial General Liability coverages, the policies shall be endorsed to contain the following provisions:

a) The Transportation Company’s insurance coverage shall be primary insurance as respect to the District, the Board of Education, officers, employees, agents and volunteers.

b) Any insurance or self-insurance maintained by the District, the Board of Education, officers, employees, agents and volunteers shall be excess of the Transportation Company’s insurance and shall not contribute to it.

c) The District and the Board of Education shall enjoy all rights and privileges of the policy without the responsibility to pay premiums.

4. Workers’ Compensation, Disability and Employers Liability: Statutory Workers’ Compensation, Disability and Employers Liability Insurance for all employees to be engaged in work under the contract and if such work is sublet, the contract shall require the subcontractor to maintain similar coverage for all employees.

5. Sexual abuse and molestation coverage must be provided with limits at least $1,000,000 per occurrence/$2,000,000 aggregate (aggregate to apply per project) and must include an additional insured endorsement naming the Kingston City School District, its Board of Education, and any of their public officials, agents, employees, and volunteers on a primary basis. The insurance coverage can be afforded either by a separate policy or an endorsement to the General Liability.

M. Conditions for Payments

1. Payments will be made monthly, in all months that service is provided upon verification that such services have been performed satisfactorily.

2. Should the contractor be unable or unwilling to convey students on any school day during the term of any contract, whether because of breakdowns, motor difficulties, unsafe buses or other negligence on the contractor’s part, strikes, riots, acts of God, or any other reason, then the daily compensation rate shall not be paid to the contractor for such school days.

In the event the contractor is unable or unwilling to fulfill the requirements as set forth in the detailed bid specifications, compensation for the trips/routes not covered will be required. Compensation will be determined by taking the cost per bus divided by the number of trips the bus is contracted to perform to get the cost per trip.

N. Financial Reporting

1. Successful bidders who are awarded contracts shall consent to an audit of any and all financial records relating to the contract, as authorized by the NYS Department of Audit and Control. Successful bidders shall also submit cost factor forms, if requested by the New York State Education Department.

2. Any contractor who has not previously done business with the Kingston City School District must submit a financial statement prepared by a certified public accountant and/or accounting firm.

O. Liquidated Damages

1. Liquidated damages may be assessed by the District against the Contractor for every instance of a violation (as hereinafter defined) on any given day of the Contract term. Liquidated damages shall be deducted from subsequent payments due to the Contractor for each such violation.

2. Liquidated damages in an amount equal to the violating buses’ full day’s rate may be assessed by Kingston City School District for the following violations:

a) Failure to provide the services required under the Contract on a day in which Providers are required to be open by the official school calendar;

b) Failure to provide all of the buses necessary to perform all of the services required under the Contract on any given day;

c) Assignment of work to any driver disqualified by the Kingston City School District;

d) Exclusion of any student from a route by the Contractor or one of its drivers;

e) Failure to immediately report any incident involving physical harm to a student.

3. Liquidated damages in an amount equal to one-half the cost of the violating buses’ per day rate may be assessed by the District for the following violations:

a) Each driver/monitor who has not received the proper training, instruction, and/or refresher courses as required.

b) Each bus transporting a greater number of students than the bus’s permissible seating capacity;

c) Each unauthorized transfer of a child from one bus to another bus either on the trip to a District site or on the homebound trip, except in the case of an emergency or breakdown;

d) Failure to provide new service to a student within the Three-Day Rule defined in bid specifications.

e) Each time a bus arrives after the time a program session is due to start or end;

f) Failure to comply with changes in the route, including additions or deletions of stops;

g) buses that do not have a monitor that is required.

h) Failure to notify parents/guardians/caregivers of scheduled pick- up/drop-off times; i) Failure of the driver to wait at the pick-up point until the scheduled pick-up time if the bus arrives early;

j) Failure to adhere to any special schedules or shortened or lengthened schedule of the District.

k) Altering the route schedule or pick-up sequence of the route without notifying the District, parents/guardians/caregivers;

l) Failure to notify the parents/guardians/caregivers, or the District immediately of breakdown on the way to or from District sites;

m) Anytime passengers other than students assigned by the District are carried in buses used in delivering services under the Contract, except as otherwise authorized by the District.

n) Any other violation of the Contract whatsoever for which no specified liquidated damages is provided;

4. A three hundred and 00/100 ($300.00) dollar fine will be assessed for each failure to provide approved special needs equipment requested by the District (car seat, harness or safety vest).

5. A five hundred and 00/100 ($500.00) dollar fine will be assessed for each time a driver is used by the Contractor who is not approved by the District.

6. A one thousand and 00/100 ($1,000.00) dollar fine will be assessed for each occurrence of a student being left unattended on a bus. The District reserves the right to immediately cancel the Contract if a student is left unattended on a bus.

Attached please find detailed bid specifications for transportation of students residing within the Kingston City School District. This bid was advertised in the Kingston Daily Freeman on Wednesday, April 3, 2019. The bid opening will be on Friday, April 26, 2019 at 11:00 a.m. (Note: if Kingston City School District is unexpectedly closed due to an emergency, it will be the next business day that KCSD is open, at 11:00 AM.) in the Kingston City School District Business Office located at 61 Crown St., Kingston, NY 12401.

• Estimated Program Dates: 2019-2020 School Year: September 4, 2019 – June 30, 2020 Summer Program: July 8 – August 30, 2019 (most programs are 30 days)

• All buses are required to have a two-way radio with the capability of transmitting and receiving the School District’s frequency.

• GPS System and working camera system with three (3) interior cameras for each bus are required for these routes.

• Buses 1021-1050 are 66-72 passenger buses and will be awarded as a 30 bus package-group bid.

• Buses 1051-1053 are 16-20 passenger buses and will be awarded as a 3 bus package- group bid.

• Buses 1054-1057 are 16-20 passenger buses and will be awarded as a 4 bus package-group bid.

• Buses 1051 – 1057 will pick up Kingston School District Monitors at Kingston High School or an agreed upon pick-up point.

• To arrive and depart at the schools at the listed times in the route descriptions. AM start time for the first stop on each route is listed on the route description. The PM time is listed on the school information sheet with addresses and daily hours on pages 28 and 29.

• Most buses do the same routes AM & PM as listed on the Bus Route Description sheets. If the route is AM or PM only, it will be listed and bolded on Detailed Route Description sheet.

• BOCES Routes for AM & PM are included in the AM/PM Bid.

• On Bid Form A for the 2019-2020 school year, #1, 2, 3 and 4 will be awarded together.

• The District reserves the right to add additional students up to the maximum seating capacity of the bus.

• The number of buses and bus stops are subject to change based on the District’s needs. Summer routes will be determined by June 1 of each year, and the school year routes by August 15 of each year.

(b) A bid shall not be considered for award nor shall any award be made where (a) (1) (2) and (3) above have not been complied with; provided, however, that if in any case the bidder cannot make the foregoing certification, the bidder shall so state and shall furnish with the bid a signed statement which sets forth in detail the reasons therefore. Where (a) (1) (2) and (3) above have not been complied with, the bid shall not be considered for award nor shall any award be made unless the head of the purchasing unit of the political subdivision, public department, agency or official thereof to which the bid is made, or his designee, determines that such disclosure was not made for the purpose of restricting competition. The fact that a bidder (a) has published price lists, rates, or tariffs covering items being procured, (b) has informed prospective customers or proposed or pending publications of new or revised price lists for such items or (c) has sold the same items to other customers at the same prices being bid, does not constitute, without more, a disclosure within the meaning subparagraph one (a). 2. Any bid hereafter made to any political subdivision of the state or any public department, agency or official thereof by a corporate bidder for work or services performed or to be performed or goods sold or to be sold, where competitive bidding is required by statute, rule, regulation or local law, and where such bid contains the certification referred to in subdivision one of the section, shall be deemed to have been authorized by the board of directors of the bidder, and such authorization shall be deemed to include the signing and submission of the bid and the inclusion therein of the certificate as to non-collusion as the act and deed of the corporation.

III. Debarment and Suspension Certification To ensure that a school authority does not enter into a contract with a debarred or suspended company or individual, each school authority must require that each responsive bidder include a certification statement with each bid on each contract. By signing the certification statement, the bidder certifies that neither it nor any of its principals (e.g., key employees) have been proposed for debarment, debarred, or suspended by a Federal agency. It is the responsibility of each bidder to sign the certification statement and submit it with any bid.

A school authority may rely upon the certification statement submitted by a bidder unless school authority personnel know that the certification is in error. In such cases, the school authority should contact the State agency for confirmation of the bidder's status relative to debarment and suspension.

IV. Iran Divestment: By submission of this bid, the bidder and each person signing on behalf of the bidder certifies, and in the case of a joint bid each party thereto certifies as to its own organization, under penalty of perjury, that to the best of its knowledge and belief, each bidder is not on the list created pursuant to paragraph (b) of subdivision 3 of section 165-a of the state finance law (the list created and maintained by the NYS Office of General Services cataloging significant investment in the Iranian energy sector).

V. Statement on Sexual Harassment: By submission of this bid, each bidder and each person signing on behalf of any bidder certifies, and in the case of a joint bid each party thereto certifies as to its own organization, under penalty of perjury, that the bidder has and has implemented a written policy addressing sexual harassment prevention in the workplace and provides annual sexual harassment prevention training to all of its employees. Such policy, at a minimum, meets the requirements of Section 201-g of the NYS Labor Law.
