For e-tendering, intending tenderer may download the tender document from the said website directly with the help of Digital Signature Certificate. Earnest money shall be deposited by the intending tenderers by way of NEFT/RTGS in favour of the Executive Officer , Naxalbari Panchayat Samity, and the same should be documented for e-tendering & virus free scanned copies are uploaded. 2. Both Technical Bid & Financial Bid should be submitted in Technical & Financial Folder concurrently duly digitally signed by the Tenderer only through http://wbtenders.gov.in. 3. Eligibility criteria for participation in tender :

1. All categories of intending tenderer require furnishing the documents of necessary CREDENTIAL. “CREDENTIAL” In the form of completion certificate/ Payment Certificate from the competent authority of not less than 40% (fourty percent) for 1st call only and 30%(thirty percent) for 2nd call only of the estimated amount put to N.I.e-T in a single contract from any Govt. Department/Autonomous bodies / govt. undertaking firms/Zilla Parishad for similar nature of work with in 5 (five) years prior to the Date of Publishing with this N.I.e-T is required. (Credential should contain i) Name of Work, ii) Date of Commencement, iii) Date of Completion, iv) Reference NIT and Work Order, v) Name of Credential Certificate Issuing Organization, vi) Gross Bill Amount Paid till date). 2. All Categories of Prospective tenderer shall have to submit Valid and upto date 1. P.Tax receipt challan, 2. I.Tax Return acknowledgement receipt, 3. PAN Card issued by I.T dept, 4. Voter ID Card, 5. Valid Trade License of current year 6. TIN /VAT Registration Certificate (Mandatory) 7. AADHAR CARD (Mandatory) - in respect of Prospective tenderer. 8. Registered Unemployed Engineers and Labour Co-operative Societies Ltd are required to furnish the documents as described in Sl. No. 4. (1) & (2) along with the other documents as follows : a. Registration certificate, b. Current “No Objection Certificate” from the Assistant Registrar of Co-operative Societies. c. Current Bye-laws duly approved by the Assistant Register of Co-operative Societies. d. The partnership firm is required to furnish copy of Partnership Deed. e. Joint venture will not be allowed to participate in the above NIeT. 4. A Company shall furnish the Article of Association and Memorandum. 5. Payment of bill on its production will be made after successful execution of the work subject to availability of fund and no claim, what so ever, will be entertained for any delay of payment. No escalation charge will be entertained against any accepted work under this NIe-T. 6. Deduction of Income tax, V.A.T. (if required), Construction Workers’ Welfare Cess, P.Tax etc. will be made at Source in accordance with the existing rules/orders. The successful agency will have to abide by the provisions of the Contract Labour (Regulation & Abolition ) Rules 1972 as will be in force from time to time. If no such licence is obtained & produced at the time of payment it will be withheld until the production of the same. 7. Neither any Mobilization Advance nor any Secured Advance will be allowed.

8. Bids shall remain valid for a period of 180 days from the date of opening of Financial Bid. If the bidders withdraw the bid during the period of bid validity the earnest money as deposited will be forfeited forthwith without assigning any reason thereof. No interest on the deposited Earnest Money shall be allowed if the said bid is cancelled. 9. Date & time Schedule: Sl. 11. Financial bids of those tenderers who qualify in technical bid will only be opened. Dates, if changed, due to un- avoidable circumstances, will be published in the said websites and the office notice board only without any individual intimation. 12 A tenderer may visit the site of works and its surroundings of his own cost in order to prepare bid for its submission. 13. No cost of Bidding shall be reimbursable by the undersigned .He may accept or reject any tender without assigning any reason, whatsoever, and is not liable for any cost that might that have been incurred by a Bidder. 14. Refund of EMD: The Earnest Money of all unsuccessful Tenderers will be refunded through on receipt of application from the Tenderer. 15. The Earnest Money deposited by a successful Tenderer will be refunded after completion of work in all respect. 16. The willing tenderers may only remain present at the time of evaluation of Technical & Financial Bid in presence of TSC. 17. The undersigned reserves the right to cancel the N.I. e-T due to unavoidable circumstances and no claim in this respect will be entertained. 18. A tenderer’s bid will be outrightly rejected with a forfeiture of his earnest money if it comes to the notice of the tender inviting authority during scrutiny that the credential or any other papers of a tenderer are manufactured/fabricated, etc. 19. The Tender Inviting Authority may verify the original credential & other original documents of the lowest tender, if found necessary, before issuance of the work order and the work order will not be issued in favour of the tenderer if it is found on verification that such document submitted by him is either manufactured or fabricated, etc. 20. There shall be no provision of Arbitration. 21. A clause stated in the later notification will supersede the corresponding one mentioned in former notification in following sequence:- a) Tender Form as prescribed. b) NIT. c) Special terms & Conditions. d) Technical bid. e) Financial bid. 22. At the Bidders meeting any type of valid quarry regarding this tender will be discussed with the tendering authority. 23. Rejection of BID. The Employer (Tender Accepting Authority) reserves the right to accept or reject any Bid and to cancel the Bidding processes and reject all Bids at any time prior to the award of contract without thereby incurring any liability to the affected Bidder or Bidders or any obligation to inform the affected Bidder or Bidders of the ground for Employer’s (Tender Accepting Authority) action.

24. Any intending bidder who have failed to execute any contract under this organization & was terminated by any Sub-Rule / clause of tender form or terminated under any clause of Standard Bidding Document by the Block Authority in last 3 (three) years, action will be taken against him by the undersigned as deems fit. 25. Tender Selection Committee. i) The Committee will act for recommendation of technically and subsequently financially qualified bidders. ii) Intending Tenderers may remain present during evaluation of Technical & Financial Bids. Technical Bids will be opened first and the defective tender will summarily be rejected. 26. Scrutiny of Technical Bids (Off line) &Scrutiny of Financial Bids (Offline) will be held at the MGNREGS cell as mentioned in Sl-10(8) & Sl-10(10) of this NIeT.

27. The Successful Tenderer will have to submit duly filled up Tender Form which will be issued from this office along with BOQ within 7(Seven) days from the date of receipt of LOA with depositing Processing Fee as prescribed in LOA. Failure to do so will be liable to Termination /Rejection of Tender with forfeiture of EMD without any reference to the contractor,Cashier-in-charge(Naxalbari Panchayat Samity), will receive Processing fee as mentioned in LOA & simultaneously issue Formal tender paper to the successful tenderer.
