Interpretation. 2. IT is hereby notified that Excise Notification No. 218 published in Gazette No. 7,845 of April 17,1931, as amended by Excise Notification No. 295 published in the Gazette No. 8,256 of November 13, 1936, is, with the approval o f the Governor, amended from the date hereof, by the addition of the following paragraph after paragraph I.B. thereof;— “ I.C. Licence to Manufacture Country Made ‘ Foreign ’ Spirits from spirits distilled from the coconut or any of its products other than toddy.— This licence may be granted, subject to the approval of the Excise Commissioner, by the Government Agent to holders of bottling and wholesale licences for the manufacture of country made ‘ foreign ’ spirits on payment o f a fee of Its. 500 for the 12 months ending September 30, or Rs. 250 for any period commencing after April 1, but ending September 30 in any year. This licence differs from the ordinary licence to manufacture country made ‘ foreign ’ spirits, referred to in item 1a in respect of (a) the higher fee payable, and (b) the fact that it is a licence both to distil and to manufacture, the spirit used as a base being distilled from the coconut or any of its products other than toddy.”

The licensee is prohibited from holding any interest in the retail sale o f arrack, refined arrack or toddy, and from employing for the purposes of this licence any person who had such interest. 4. The licensee shall be bound by such departmental orders concerning distilleries generally and Country Made ‘ Foreign ’ Spirits Manufactories particularly, and the spirits distilled or manufactured therein as may be issued by the Excise Commissioner from time to time. 5. No Country Made ‘ Foreign ’ Spirits shall be bottled except imder a bottling licence, or sold except under a wholesale licence. 6. Country Made ‘ Foreign ’ Spirits shall be sold only in sealed bottles or other receptacles approved by the Excise Commissioner. 7. All notices shall be deemed to have been duly given to the licensee, if delivered at the manufactory or affixed to the door or gate thereof.

The licensee shall observe and keep all such rules applicable to distilleries generally, and to Country Made ‘ Foreign ’ Spirits Manufactories particularly, and to the issue of spirits therefrom, as shall have been or may be from time to time made under the Excise Ordinance, No. 8 of 1912. 3. The licensee is prohibited from holding any interest in tho retail sale o f arrack, refined arrack or toddy, and from employing for the purposes of this licence any person who has such interest. 4. The licensee shall be bound by such departmental orders concerning distilleries generally and Country Made ‘ Foreign’ Spirit Manufactories particularly, and the spirits distilled or manufactured therein as may be issued by the Excise Commissioner from time to time. 5. No Country Made ‘ Foreign ’ Spirits shall be bottled except under a bottling licence, or sold except under a wholesale licence. 6. Country Made 1 Foreign ’ spirits shall bo sold only in scaled bottles or other receptacles approved by the Excise Commissioner. 7. All notices shall bo deemed to have been duly given to the licensee, if delivered at tho manufactory or affixed to the door or gate thereof.

KANDY MUNICIPAL COUNCIL The Minutes of Proceedings of a Meeting of the Municipal Council of Kandy held in the Town Hall, Kandy, on February 20, 1937, at 8.45 a.m., in accordance with the notice dated February 16,1937. Present : Mr. T. A. Hodson, Chairman ; Ratwatte Adigar ; Mr. Geo. E. de Silva ; Mr. S. A. Wijayat.ilake ; Mr. W. A. B. Soysa ; Mr. Haji M. S. Usoof Ismail ; Mr. M. A. S. Marikar ; Dr. E. S. Godlieb ; Mr. C. H. Bradley. 1. The Minutes of Proceedings of the Meeting held on January 16, 1937, having been previously submitted to the Chairman for his approval and a copy thereof furnished to each member, were taken as read and confirmed by the Chairman. 2. The following documents were submitted :— (a) Statement of receipts and disbursements from close of 1936 to January 31, 1937, on account of theMunieqml Fund. (b) Progress report of works brought up to the same date. (c) Health Officer’s report for January, 1937. (d) Statement o f cases instituted by the several inspectors and o f work done by the Municipal Magistrate during the month of January, 1937. (e) The reservoir readings for the week ending February 20, 1937.

Resolved that the statement (a), together with the Minutes of Proceedings o f this meeting, as required by section 83 of “ The Municipal Councils Ordinance, No. 6 of 1910” be forwarded to the Commissioner of Local Government for publication in the Government Gazette. 3. The following papers were laid on the table :— Reports by the several inspectors on laundries, bakeries, dairies, standpipes, and house service taps inspected during January, 1937. 4. Petitions :— Mr. Marikar presented— (1) Petitions from Essa Bai and Naim Bai, dated January 30, 1937, stating that two employees of the Council have pleaded the Public Servants Liabilities Ordinance and avoided payment of their debts, and suggesting that the two officers be dealt with. Mr. Ismail presented— (2) Petition from Mr. A. Z. A. Jaldin, dated February 18, 1937, applying for the post of Caretaker of the Ratwatte Pavilion at Bogambara. The Chairman agreed to look into the matters referred to in the petitions. 5. Correspondence :—Letter No. B. 900 of Febraury 15, 1937, from the Commissioner of Local Government inviting the deputation in connection with the Municipal reforms to meet the Executive Committee of Local Adminis­ tration on February 26, 1937, at 9.30 a .m .— Tabled. Resolved to inform the Commissioner o f Local Government that a deputation- consisting o f the Chairman, Ratwatte Adigar, Mr. de Silva, With possibly one other member, will meet the Executive Committee of Local Administration on the 26th instant, at 10 a .m . 6. Municipal Electrical Engineer’s letter No. E. 21/38 of January 15, 1937, stating that a decision is necessary regarding the steps to be taken to prevent the overload of plant during 1937. Chairman moved the Council into Committee to consider this item, together with item 21 on the agenda, viz. :— “ Municipal Electrical Engineer’s letter dated February 11, 1937, stating that a sum of Rs. 5,238'25 is necessary for carrying out repairs to the No. 1 Ruston Engine 4 V.G.”

. Decision of Council in Committee. The Municipal Electrical Engineer, who was present at the meeting, was questioned at length as regards the repairs required, and the extent of the connected load and the maximum demand at the last Perahera, and during the visit of the Duke of Gloucester. Thereafter, it was resolved—(1) that a vote of Rs. 5,2.38'25 be granted for repairs of the No. 1 Ruston Engine— Mr. de Silva dissenting, (2) that applications for new connections should be generally rejected until after the Coronation Celebrations, and (3) that the Municipal Electrical Engineer be asked to furnish a scheme indicating what sections should in his opinion be disconnected in the event o f overload. 7. To obtain forma] sanction to accept the tender o f Messrs. WaJker & Greig, Ltd., for Rs. 2,777 for the Rotary Balancer, and Rs. 998 for the Electricity Meter, as recommended by the Mnnicipal Electrical Engineer..—Resolved that the tenders he accepted. 8. Estimate from the Municipal Electrical Engineer for Rs. 370 for the extension of electric cable along Gregory road to enable lights to be installed to premises No. 1 7 / 2 a belonging to Mr. G. F. Bnultjens.—Resolved that the vote be granted in this case, and that future policy regarding similar applications should be definitely settled after ascertaining the practice in Colombo and Galle. 9. To approve of the recommendation of the Economy Committee on Municiapl Electrical Engineer’s letter No. 1/84 o f January 29, 1937, suggesting that all public lights except those in Ward street, Peradeniya road, Victoria Drive, and Public Market, be lit for 104 horn's (instead of the present arrangement, o f 11-J hours and 44 hours) as it did not involve any additional cost in the public lighting bill.—Resolved to approve of the recommendation, but substituting “ 10 hours ” for “ 104 hours ” . 10. Application from Mr. Tambiraja, Rat Campaign Overseer, for the quarters at the Lake Spill Stores, ■which Mr. Kaimal is vacating.—Resolved that the application be rejected. 11. Letter No. 657/4 (PT) of January 25, 1937, from the Financial Secretary in reply to representations made to Government as to the desirability of reimbursing the Council for the loss sustained by it as a result of the abolition o f the toll consequent on the erection of the footbridge.— Consideration was deferred. 12. Paper's relating to the inquiry held by the Special Committee into the allegations made by contractor L. W. L. John.—Tabled. 13. Tenders received for— (1) the supply o f emulsified asphalt, (2) the provision o f a path and footbridge at Huduhumpola, and (3) the survey of the Mahaiyawa General Cemeteiy. The Chairman tabled the tenders received at the Finance Committee meeting under items (1) and (2) and a further tender received under item (1) from The Standard Vacuum Oil Co. was opened.—Resolved that the tenders he referred to the Municipal Engineer for report. No tenders were received under item (3).

(1) Letter from the Commissioner of Local Government No. B. 1242 of December. 22, 1936, on the subject of amendment of section 19 of the Colombo Municipal Council’s Waterworks Ordinance, No. 18 of 1907.— Recommended adoption of the revised draft of section 19, and the further proposal to amend the Ordinance to legalize metering of supplies for domestic purposes. (2) Letter from the Commissioner o f Local Government No. H. 189 o f January 8, 1937, forwarding a letter from the Treasury suggesting an enhanced contribution towaids the salary of the Municipal Magistrate..—Recommended payment of an enhanced contributon of Rs. 1,000 subject to jurisdiction in respect of offences under the Housing Ordinance, No. 19 of 1915, being transferred to the Municipal Magistrate.

(3) Papers re the application of Mr. Segu Mohammado requesting the transfer of half share of beef stabs Nos.58a, 88, and 89, Public Market, in favour of his second son, Mr. S. Cader Mohideen, and his subsequent withdrawal o f this application, and his request to transfer his elder son,Mr.S.MeeraMohideen’sinterestinbis(Segu Mohammado’s) favour.— Recommended to allow each a stall, Mr. Segu Mohammado to have the first choice, Mr. Meera Mohideen the next, and Mr. Cader Mohideen the remaining stall—the right of occupation of the stalls to be auctioned if this arrangement is not accepted by them. (4) Papers relating to the cancellation o f the licence granted to Mrs. Maggie de Mel for Fish Stall No. 68 and appli­ cation received from Mr. C. P. de Mel for the stall.—Recommended to allow the licence to Mr. C. P.. de Mel in view of Mr. Soysa’s report o f January 15, 1937.

Extracts from the Minutes of the Meeting of the Standing Committee on Finance and Assessment held on January 16, 1937. (5) Papers re letter from Mr. M. 0. A. Raheem, co-owner of premises No. 171, Colombo street, stating that as the premises have enjoyed a water supply previous to their use as a tea kiosk and the metering of the supply for trade purposes, that the meter should be removed when the premises cease to be used for trade purposes, with report thereon from the Council’s lawyer.— Recommended to act in terms of the report of the Council’s lawyer and regard the supply as a new metered domestic supply if the tea kiosk is closed and the water cease to be used for trade purposes. (6) To obtain sanction for the payment of the following gratuities:— (a) Rs. 75 to ParuWathie, widow of Sanda- nam, Market Labourer, deceased, under section 24 of the Pension Rules. (G 322)..—Recommended. (6) Rs. 54'75 to Muthamma, widow of Sinna Arumugam, Scavenging Labourer, deceased, under section 24 of the Pension Rules.— Recommended. (7) To obtain a vote for Rs. 15 representing amount of fine levied by the Municipal Magistrate on Mr. A. L. M. Mohammed Ismail Lebbe in connection with his failure to erect .a latrine in premises Nos. 212 a - c , Mavilmada, proposed to be refunded to him.—Recommended. (8) To obtain a vote of Rs. 31'50. for retaining Counsel in the Supreme Court in P. C., Kandy, ease No. 52,757 which is the subject of an appeal by accused on a point o f law. (O 28).— Recommended. (14) .Resolved that from and after June 1, 1937, the Committee should prescribe the fee for the use of the ground in each case subject to a maximum of Rs. 10 and in respect o f matches in which a gate fee is taken special terms should be laid down according to the circumstances of each case. Extracts from the Minutes of the Meeting of the Special Committee on the Administration of Bogambara * Grounds held on February 1, 1937. (15) To consider letter received from the Kandy Sports Club dated January 14, 1937, on the subject, o f neglect of the grounds.—Recommended—(i.) that judging from the condition of the ground and Municipal Engineer’s report dated January 25, 1937, the playing of polo caused damage to the ground and it should be prohibited in the interest of other games ; (ii.) that the use of the grounds as a public path should be prohibited and pedestrians should use the bank by the water-course ; (iii.) that car driving practice, horse and cycle riding practice, fire engine practice, on the grounds should bo prohibited ; (iv.) that the parking of cars within the grounds should be prohibited ; (v.) that public notices should be erected indicating the prohibitions ; and (vi.) that the Pavilion Watcher should be appointed as a cattle seizer under “ The Thoroughfares Ordinance ” , and that all cattle straying into the grounds should be seized and delivored at the Police Station. (16) To consider Mimicipal Engineer’s report on the subject of improvement to the ground—For purposes of upkeep of tho grounds.—--Recommended— (1) to hire a pair of bulls for the roller at a daily rate, (2) to appoint temporarily of the following staff :— Ono Pavilion Caretaker and supervisor on Rs. 20 per mensem. Three labourers on Rs. 15 per mensem each, (3) to authorize the Municipal Engineer to purchase the new lawn mower in time to be available for use on Juno 1, 1937. Extracts from the Minutes of the Meeting of the Special Committee on the Administration of Bogambara Grounds held on February 15, 1937. (17) Latter dated February 9, 1937, from the Principal, Dharmaraja College, asking for the uso of the area of Bogambara Grounds reserved for sports for a historical pageant in connection with their carnival during Peraliera.— Recommended subject to the condition that no buildings are erected. If buildings are required previous sanction to be obtained. (18) Letter dated February 10, 1937, from the President, Kandy District Association Football League, suggesting that— (1) one Saturday in each month be allotted to the League; (2) the League be allowed to store their goalposts, nets, &c., in one of the rooms in Ratwatte Pavilion ; and (3) the ground bo allowed to the League for November 11, for a Charity Soccer Match.—Recommended to reply—(1) that as the application Was not received in time arrangements cannot be made for any Saturdays up to September. Commencing from October, the first Saturday of each month will be provi­ sionally reseived for the League, but bookings must be confirmed on application which should be made at least one month in advance o f the date ; (2) that goalposts, nets and equipment, &c., can be stored in a room under the care of the Pavilion Watcher on payment of a reasonable rent; and (3) that, the ground will be allowed to the League on November 11, free o f rent. Resolutions o f Council on the recommendations o f tho Standing and Special Committees. Resolution on items (1), (4), (6), (8), (10), (11), (12), (15) (v.), (vi.), (16), and (18). Resolved that, the recommendations be adopted. Resolution on items (2) and (9). Resolved to refer back to the Finance Committee for further consideration. Resolution on item (3).—Resolved to adopt the recommendation and if the stall offered to Mr. Segu Mohammadu is not accepted by him, to offer it. to Mr. S. M. Mohideen, subject to usual premium. Resolution on item (5).— Resolved that, the recommendation be adopted, Messrs. Wijayatilako and Ismail dissenting. Resolution on item (7).—.Resolved that the recommendation be adopted and the refund be made subject to Mr. Ismail Lebbe waiving all claims in respect of the Council’s action. Resolution on item (13).—Resolved that the recommendation be adopted subject to the exception that in an emergency the Secretary may allow an application after consulting one member of the Committee, if possible. Resolution on item (14).—Resolved that the fee per booking be fixed at Rs. 5 for all Clubs, except that in respect o f League Football matches the fee should be Rs. 2 ■ 50, and that in respect of matches in which a gate fee is taken, the normal foe should be Rs. 10 but the Council reserves the right to fix a fee not exceeding Rs. 25 in special cases. Resolution on item (15) (i.).—The letter dated February 3, 1937, received from the Hony. Secretary of the Kandy Race and Gymkhana Club on the subject of the use of the ground for Polo and Gymkhana events was read by the Chair­ man. Mr. de Silva moved that the recommendation of the Committee be adopted. Mr. Marikar seconded. The Chairman and Ratwatte Adigar opposed the motion. The motion Was put to the meeting and carried by a majority of 1 vote. Ayes— Messrs. De Silva, Soysa, Marikar, Wijayatilake, and U soof Ismail. Noes.— The Chairman, Ratwatte Adigar, Mr. Bradley, and Dr. Godlieb. Resolution on item (15) (ii.).—Resolved that the use of portions of the ground as pathways should be discouraged. Resolution on item (15) (iii.).—Resolved that persons be forbidden to drive cars or ride horses on the grounds. Resolution on item (15) (iv.).—This recommendation was after some discussion withdrawn by Mr. de Silva with the approval o f other members o f the Special Committee. Resolution on item (17).— Resolved that the recommendation be adopted. In this connection the Chairaian made a statement indicating that Mr. Methananda, by his letter dated February 16, 1937, had undertaken to pay a further sum of Rs. 500 for the use o f the Bogambara Grounds for the Golden Jubilee Fair o f the Dharmaraja College and he was, therefore, withdrawing his objection to the lease granted by Muncipal Council resolution o f November 21, 1936, and had addressed the Commissioner of Local Government accordingly. 16. Letter from the Minister for Health requesting that arrangements be made to provide a separate water supply to the Kandy Civil Hospital of 20,000 gallons per diem.—Resolved that the application be allowed subject to the conditions contained in Municipal Engineer’s report dated February 12, 1937. 17. To sanction the establishment of a rickshaw stand as follows :—Stand on Railway Approach road bounded on the north by masonry drain, east by Approach road leading to ’Bus Park, south and west by Railway Approach road, for rickshaws not exceeding six in number.—Resolved to sanction the establishment of the Rickshaw Stand accordingly. 18.
