The clerk informed the meeting that a notice board has been ordered and will be used to display our notices . The Parking space at the market hall which has been taken by Police Vehicles was queried. The clerk is to obtain more information on this

FC/8/2015 FOOTPATHS PARKS AND ALLOTMENTS

8/2015/1 To discuss letter received from the Land Registry Office re: land lying on the south side of Kirkland Road. The notice of an application to register mines and minerals was explained by the clerk. It was unanimously agreed to sign and return the application.

8/2015/2 Update on G Graham and allotment The clerk advised of the outcome of the hearing on 22nd April at which Mr Graham was given 4 weeks to arrange legal representation. The next court date is 16th June. The title deeds have been forwarded to our legal representatives and the solicitor has since asked for an extension of time as well as whether the council will consider a compromise. It was agreed that an extension of one week was given but the council were not willing to compromise.

FC/9/2015 WIGTON BURIAL JOINT COMMITTEE

The clerk reported that the Health and Safety Officer from Allerdale Borough Council was to visit the cemetery on 15th May concerning outstanding issues. Councillors Williams Clark and Lynch are able to attend. Cllr Scott requested copies of minutes/costs to be forwarded to him.

Cllr Hodson requested that stickers/signage be provided for bins – Clerk to contact Allerdale BC. Cllr Keaveney reported that the new notice board will replace the damaged Local Links sign.

21/2015/1 To receive comments and representations from members of the public – In answer to the question asked at the May Council meeting – Why have the police obtained the two parking spaces outside the Local Links Office - The Clerk read out a statement from NADT:

“NADT entered into a tenancy agreement with Constabulary to occupy an office in the Market Hall. They requested access to 2 parking spaces which we agreed to as we felt it was for the benefit of the Wigton community to retain a police presence in the town and therefore allocated the space to the front of our building.

The area in question is not for the use of Allerdale Borough Council customers as seems to be the query as ABC is not the landlord of the building and indeed in our view they should make a provision for their customers on Water Street car park to meet the needs of the community.”

The Clerk was asked to write a letter to ABC and ask for 20 mins free car parking spaces on Water Street Car Park for customers of Allerdale BC.

A member of the public asked who was in charge of the on street parking wardens as they were very rude and obstructive. The clerk informed her that it was Cumbria CC. The clerk was asked by members to write to CCC and convey this.

21/2015/2 To receive reports from Borough and County Councillors in attendance – Cllr Pitcher was in attendance but had nothing to report.

21/2015/3 To receive reports from the Police – PCSO Kier Irving was in attendance. Newsletter was read out. The Chair thanked Kier for her attendance.

22/2015/3 RESOLVED that copies of the Council’s accounts for the year ended 31st March 2015, as circulated by the Clerk, be formally received, noted and approved

22/2015/4 RESOLVED that it be formally recorded, that in the opinion of the Council it has met all its statutory obligations to comply with the Account and Audit Regulations 2011 and accordingly authorises the Chairman to sign the Annual Governance Statement, prior to submission to the External Auditor

22/2015/5 The Clerk reported that the Auditors report had not arrived in time for the meeting. It will be reported at the July meeting.

FC/23/2015 ALLERDALE BOROUGH COUNCIL

23/2015/1 The Clerk reported that the bollards for the Cornmarket had been ordered and works should commence within the next few weeks. Cllr Armstrong suggested that we write to The Leconfield Estate and ask for a lease agreement for the Cornmarket. RESOLVED that the Clerk write and suggest a 99 year lease agreement.

The Clerk reported that the Communal notice board was on order and it would be situated to the front of The Market Hall Building replacing the damaged Local Links sign. 3 no. Welcome to Wigton signs – Signs APPROVED by members

23/2015/2 To discuss car parking charges – Cllr Warren asked members to consider Wigton having a ‘Resident Card’ that would discount car parking charges for residents of Wigton. Full details to be discussed at a later date. It was AGREED that the Clerk write to ABC and ask for a meeting to discuss incentives for parking in Wigton.

Heart Start Course Hopes Auction Co. are interested in the course for 15 members of staff. 4 members of the business group and 1 member of public have also been in touch. I have contacted NW Ambulance Service who can accommodate as many people as we want. Hopes have kindly offered the venue and light refreshments free of charge.

ABC – Funding Allerdale may be able to help fund a project for the town that will make a difference. Please can you come back to me with ideas so I can put together a wish list? I will put this as an agenda item for the July meeting so ideas can be discussed further.

Old Tan Yard Still waiting for a price.

Moorside Project – Stage 1 Public Consultation NuGeneration Limited is proposing to build a nuclear power station to the north and west of the Sellafield Site. Consultation will take place in Wigton Market Hall on Wednesday 15th July between 11.00am and 7.30pm

Proposed Internal Drainage Board for Waver/Wampool NFU are holding a briefing meeting on Thursday 2nd July 2015 at Newton Arlosh Parish Hall at 7.30pm to discuss the above. Please let me know if you wish to attend and I can book places.

Town Council Election DC Ralph Henderson is coming to discuss the findings to the investigation on Thursday 11th June. I will let you know the outcome.

Colin Williamson asked members why Gray Graham can’t keep the allotment as he knew that tenancies had been passed down to family members in the past. The Chair made it clear that Council do not pass down tenancies but if he knew of instances that this has happened then please let the Clerk know and we will look into it.

Paul Dobson asked members to compromise with Mr Graham. It was stated that the decision had been made at Court.

Gwen Monaghan accepts Judges decision but was unhappy that Councillors didn’t attend the protest meeting. The Chair explained that we had been advised not to attend.

Mr Kenny asked when the Zebra Crossing on High Street will be repaired as it had been like that for nearly 2 years. The Clerk had reported this to Cumbria CC on several occasions but as yet nothing had been done. The Clerk to report it again.

Gwen Monaghan asked why the gates were closed to the Park on Carnival Day. The Chair explained that the gates to the park were only open weekdays but would note this for future events.

Mr Dobson, Kenny and Williamson left the meeting.

To discuss ‘Wish List’ for a project in the town that ABC can help with

Cllr Webster - Would like to see the changing rooms at Barton Laws being refurbished Cllr Armstrong - Would like to discuss Murals for the town Cllr Stabler - Discussed refurbishing the alleyways in the town and also a Market for the town. ABC to help us run a successful market. Cllr Armstrong wants the Town Council to take over the markets in Wigton.

The Chair asked that all the above ideas need to have more detail before we speak to ABC

Cllr Lynch – Markets need to be discussed with our Town Centre Manager and marketing needs looked at. Cllr Stafford – Ideas need to tie in with our Town Plan Cllr Scott – New Football pitch at West Road Cllr Hodson – Could ABC part fund our own Town Team Manager/Co-Ordinator (Part Time) who could help run a market etc. It could be a pilot scheme. Cllr Williams – An Interpretation board for the Sheepfold at Lowmoor Road and also a seat. Clerk to look into costs. Cllr Lynch stated that these would have to be placed outside of the Sheepfold.

FC/44/2015 CLERKS REPORT

Old Tan Yard

Mr Crawford (Owner of Old Tan Yard) called to see me yesterday. If Council are interested in buying Old Tan Yard as a storage/depot then he is willing to discuss payment over 3 years.

I’ve still been unable to gain any more quotes for building works but the two quotes we had received are as follows:

Quote 1 = £29,500.00 (Work to Gable End Included) Quote 2 = £15,000.00

Cllr Armstrong felt that we should use the building we’ve got at Barton Laws. Cllr Lynch didn’t think that we shouldn’t take space away from the football pitches. Cllr Scott added that we would need a Surveyor to look at it as the land at the front is contaminated.

Cllr Lynch proposed that this be dealt with at the Finance Committee and ask Mr Crawford to attend to discuss.

Cllr Williams asked if they were liaising with County Council? Cllr Cowell replied - not at the present time but will be in the future. Members asked if Car Parks will be devolved down to local councils. Cllr Cowell reported that this is not being discussed at the moment but hopefully in the future it will be on the agenda. Cllr Clark asked that car parks be put on town councils next agenda to discuss.

Cllr Cowell had thanked ABC for the financial support given to Wigton Theatre Club.

54/2015/1 To discuss meeting with ABC/Geraud Markets and Town Councillors – Cllr Keaveney explained we had a meeting on 10th August with ABC and Geraud Markets. We have asked for their help in launching a new market for Wigton in 2016. All parties have been tasked with collating information etc. before the next meeting to which Mark Fryer (ABC) will be attending. Next meeting is 16th September at 2.00pm

54/2015/2 To discuss plans for the surplus money from the 10k – The clerk explained that there was approx. £2,000 left in the budget. However we have been told that we will have to use an approved contractor by County Council to erect the Welcome to Wigton Signs. This had not been budgeted for therefore we will discuss the surplus once all costs are in.

87/2015/1 To receive comments and representations from members of the public – A member of the Business Group asked if we could confirm that a parking permit for Wigton would be charged at £500 next year. Wigton TC have no knowledge of this but will be discussing this and other parking issues at a meeting with ABC next month.

Gwen Monaghan asked if this was an open meeting why the numbers are restricted. The Council usually only get 2-3 members of the public coming to a meeting and due to health and safety reasons this is the safe amount of chairs for this room.

The Clerk read out a letter received from a resident in Wigton regarding the state of the old Hopes Auction Site. Cllr Pitcher reported that dilapidated buildings had been discussed on the town walk round and ABC are aware of it. Cllr Lynch asked if we could ask permission that the letter be forwarded to ABC and Hopes Auction. Clerk to write to resident. Cllr Keaveney added that this site had been raised with Mark Fryer (ABC) in respect to the Friday Market with regard to the safety of the buildings.

Cllr Scott asked that we ask ABC to add this property to the list of dilapidated building across Allerdale. PCSO Harris confirmed that the Police are liaising with Hopes with regard to ASB and health and safety concerns.

The following report was read out:

Wigton Town Council Report:

In the month of October there have been 34 crimes in the Wigton area and 10 incidents of Anti-Social Behaviour.

Between the 1st and 2nd October 2015 an attempt burglary occurred in the Hawthorns area. Police investigations have been conducted. Any witnesses or persons with further information regarding this incident are encouraged to contact the Police.

On 4th October 2015 a male was arrested for Affray.

On the 4th October a Galaxy Mobile phone was stolen from a house party in the Wigton area. Any witnesses or persons with further information should please contact the Police on telephone number 101.

On the 8th October 2015 an incident of Criminal Damage occurred during the incident plant pots were smashed. A suspect was identified and dealt with accordingly by the Police.

On the 9th October 2015 an incident of Aggravated Vehicle Taking occurred. The Police located the vehicle and identified a suspect who has been referred to the Youth Offending Team.

On the 13th October 2015 the Police attended an incident of Criminal Damage where a vehicle had had its windscreen smashed. Police investigations have been conducted. Any witnesses or persons with further information regarding this incident are encouraged to contact the Police on 101.

On the 13th October 2015 a pedal cycle was stolen from the Croft Court area. Police investigations have been conducted. Any witnesses or persons with further information regarding this incident are encouraged to contact the Police on telephone number 101.

On the 21st October 2015 an incident of theft occurred in a town centre supermarket. This happened between 12:42pm and 12:50pm during this incident a bank card was stolen. Police would like to remind members of the public to keep all items of value in a zipped pocket or bag at all times. Police investigations have been conducted. Any witnesses or persons with further information regarding this incident are encouraged to contact the Police on telephone number 101.

On the 25th October 2015 a bin was damaged on Lowmoor Road after a firework was placed into it whilst being alight. This happened between 1900 and 0800. Police investigations have been conducted. Any witnesses or persons with further information regarding this incident are encouraged to contact the Police on telephone number 101.

On the 31st October 2015 a male was arrested by the Police in the Wigton area for an assault. He was charged to court.

Anti-Social Behaviour: There were ten incidents of Anti –Social Behaviour in October 2015 in the Wigton area. These included incidents of youths playing football in carparks, threatening messages on Facebook, youths setting off fireworks and youths being abusive toward supermarket staff. Wigton PCSO’s continue to regularly patrol the area and deal robustly with any nuisance.

Cllr Keaveney asked if the groups mentioned (ASB) were known to the police and what age range they are? PCSO Harris confirmed that they are known to the police and they are mainly between 12-16 years old.

FC/87/2015 PARISH POLL

The Chair asked for comments about the recent Parish Poll from Members

SH – Very poor result. No change to decision BA – No change to decision GS – On Mr Graham’s side at the beginning but not happy with the state of the buildings. NO change to decision. BW – Small proportion voted. No change. We need to move on. JW – 394 out of 4459 came out to vote. Very poor turnout. No change PS – The group had online poll, posters, flyers and newspaper publicity and still a very low turnout. No change in decision. SK – Support for Parish Poll exceptionally low turnout. Council to be commended for their good conduct throughout this campaign. Can’t rule with emotion. Stand with original stance. MB – Enough money has been spent on this and the exceptionally low turnout. No change PW – agrees with everything said so far. No change EL – Decisions can’t be changed on such a small % of votes. Polls are a guidance for the Council and if the % was higher then we would have had to consider it. We were all democratically elected for Wigton. No change. MC – Poor turnout. It show’s that the majority of people do not care about Donald’s Ranch. JC – We have gone through due process, considered this for a number of years. The same conclusion has come about. I don’t think anything we’ve seen or heard has changed our position. CS – Echo what’s been said. Emotion will always be an issue. A line needs to be drawn now. PP – Enough money has been spent on this issue. No change in decision. AP – 91% did not turn out to vote so I feel they are either apathetic to Donald’s Ranch or they trust what the TC are doing.

‘I propose that the Town Council does not change its position on the land at Longthwaite Road and proceed as planned having designated all the land as allotments, as advised by the National Allotment Society’

The Chair made it clear that a YES vote would be to accept the proposal and a NO vote would be not to accept the proposal

A YES vote to accept the proposal – UNANIMOUS decision to accept the proposal.

Due to cabin/stores/premises at the park being inadequate for our use and until such time we can move on with plans at Barton Laws. Members from the Council went to look at a unit available at Station Road. All members agreed that the space was more than adequate for our needs with an area for the staff and a toilet. There is also a large hard standing area and the security of the site was very good. Cost = £7,800 per annum + rates, electricity and water We can take it on a short term lease (Quarterly). There will be no price increase on the rent for 2 years. Costs had been sought for other units in the town. Only smaller units are available at present 1. £9,000 per annum + rates, electricity and water 2. £8,528 per annum + rates, electricity and water Recommendation from Members of the Finance Committee is that we take on the lease of the unit at Station Road - AGREED

The motion was declined. 96% of council tax is collected by ABC. Cllr Cowell also reported that the Grounds Maintenance proposals had gone to the exec. On the 1st December the outline planning application for Station Hill had been passed by the Development Panel.

FC/98/2015 WIGTON CIVIC SOCIETY

Cllr Pitcher welcomed Mark Clowes and Colin Murray from the Wigton Civic Society.

They explained to members that ABC had been approached by The Heritage Lottery Fund and that they were looking at putting a global bid in. The Civic Society had undertaken a placecheck of the town and had identified problem areas etc. They had put together a small report to be submitted to ABC. They asked the council for comments. Some members felt that Wigton should go forward with their own bid. Mark explained that ABC had been approached by the Heritage Lottery Fund so thinks that we have a better chance of success being part of their bid. This does not mean that in the future we can’t try to get funds ourselves. With the exception of a couple of amendments (naming of shops etc) members were happy with the report. Cllr Cowell proposed to move things forward with ABC. Cllr Lynch seconded this proposal and the decision was unanimous. Mark to send final draft to the Clerk before submitting to ABC.

The Mayor spoke to members about the flooding at the weekend and how the Market Hall had become a reception centre for those stranded etc. in Wigton. The Hall was open all evening and provided shelter, hot drinks and food all weekend. Members agreed to donate £500 towards costs to NADT and also £500 to the Cumbria Community Foundation Flood Appeal.

He stated that he had been a victim of crime and that it had been reported to the police but they had done nothing about it. Inspector Smillie said that he would look into this and contact him after the meeting to discuss further. Cllr Pitcher asked that the Police let us know the outcome.

Mr Stephen Ward also had a concern to bring up with the police. There had been an incident outside his home where both of his cars had been involved in a hit and run. He had contacted the police but again was disappointed with their follow up procedures. Inspector Smillie said that he had no knowledge of this but would look into it and get back to them. Cllr Pitcher asked that the police let us know the outcome.

Cllr Armstrong asked about the fire at The Stocksman – Fire report came back to say it was not intentional. Cllr Keaveney asked if the kidnap and false imprisonment was isolated as there has been an increase in West Cumbria lately. PCSO Harris said they were isolated cases. Cllr Pearson discussed the boy racers on Water Street car park etc. PSCO Harris thought that it had been much quieter recently. Cllr Lynch asked about the complaints procedure for the police. Who to contact etc. Inspector Smillie replied that you ring 101, Any Officer on the street. Members of the public can request a meeting with the Inspector. Cllr Scott added that the way Mr Miles and Mr Ward had been dealt with leads to complacency and that the root cause of this is lack of communication. Cllr Williams asked where is 101 based? Penrith HQ and you will speak to a Police Officer. There are 50-60 Officer in the Allerdale Rural Area.

Cllr Pitcher thanked them both for attending the meeting.

FC/110/2015 SPEET GILL FLOODING

The Clerk reported that ABC had been in contact with regard to the silt etc. in the beck at Burnfoot (Lidl). They asked if we would be willing to clean it out.

Cllr Cowell said to contact the EA. It is their responsibility to clean out rivers/becks. If we clean it we will set a precedent. Cllr Lynch asked that we set up a meeting with the EA and find out what happened with the flooding in Wigton. What worked with the things that have in place. We need a review. Cllr Keaveney added that the beck is full of rubbish and silt and we would not need another ‘Storm Desmond’ for a further flood to hit. Cllr Cowell added that the emergency planning discussed this a t their last meeting.

The Clerk reported that the kissing gate at the Showfields had partly washed away. Cumbria CC have said it is our responsibility to repair/replace as it is on our land. The Clerk to add this to the next Footpaths, Parks and Allotments Agenda.

FC/112/2015 CAR PARK CONSULTATION

Cllrs Pitcher, Cowell and Warren attended a meeting with Mike Hall, Mike Heaslip and Charles Holmes along with Mary Huntington (Business Group) on Wednesday 6th Jan to discuss the Car Park Consultation.

Cllr Lynch felt that the charges were unfair especially when Allonby/Silloth are free and they’re tourist areas.

Cllr Keaveney asked when and who makes the decision – The Exec make the final decision and the consultation end date has been extended until the 21st January 2016. Cllr Webster asked if we could take over the running of the car parks in Wigton. – They didn’t say no but that decision would not be made alongside the consultation. Cllr Armstrong asked that we send a letter to ABC and ask that we take over the running of the car parks. Cllr Keaveney added that the increased charges is ridiculous and makes a mockery of their plans to look at regeneration in the town.

I have spoken with Dean Haney with regard to his sickness. He has been off work since 26th October with back problems. I am hoping to speak with ABC to discuss what we can do to start ball rolling due to ill health retirement.

123/2015/1 To receive comments and representations from members of the public – Mr Miles reported that his complaint from previous meeting is being dealt with by the Police and it will be resolved by July 2016. The Chair asked that he keep the Council informed.

FC/124/2015 PHOENIX PARK/BARTON LAWS

124/2015/1 Wigton Skate Park – A short presentation by members of the newly formed Wigton Skate Park Group. 6 children along with parents asked for the Council’s support. Members discussed with the group where, when and about funding. The group agreed to come back when they have some firm plans in place. The Council unanimously support a skate park in Wigton.

124/2015/2 To discuss refurbishment of changing rooms and the bridge – A short report was circulated by the Clerk. Cllr Armstrong had asked for this item to be placed on the agenda.

Cllr Armstrong and Scott asked who made the decision to put plans on hold. It had been agreed at the September FC meeting to which both members had attended. The Finance Committee had recommended to FC that we look at refurbishing the changing rooms first as funding is available for this. At the present time no funding is available for sports pitches therefore as planning refused the application for the bridge it would be left for the time being. A discussion took place and it was proposed by Cllr Cowell that this be shelved for 12 months with the proviso that a discussion takes place with EA on the reasons for their objections.

1. Off the A595 (From Red Dial) on the B5304 to replace the Welcome to Wigton and the Solway Coast Sign (Just before Old Brackenlands)

2. Off the A596 (From Carlisle) on the B5302 to replace small Wigton Sign in the layby before Kirkland Estate

Off the A595 on the B5305 just before the fork (Syke Road and Lowmoor Road). There is a small Rotary Welcome to Wigton Sign on the corner. Shouldn’t be a problem so long as the sign is situated where the old one is, in the corner of the field? The verge on the highway (on the left as you drive in) is too narrow in this location, and the existing location within the fork seems well positioned and relevant for both roads. You will have to contact the landowner, however. Do we want to pursue this? NO

Other Location to consider – replacing small ‘Wigton Sign’ at the top of Standingstone / Cross Lane (Near to layby). This would be acceptable by Cumbria CC

It was agreed that the 3rd sign should be place at the Western Banks Entrance into Wigton and replace an existing ‘Wigton Sign’

Wigton Market

Start date for Market is 11th March 2016. Launch date 25th March 2016. Wigton TC have made a commitment to set up and take down gazebos every Friday morning/evening. Friday 25th March is Good Friday (Bank Holiday). I will be speaking to Stephen to find out if staff are willing to work. If not I may be looking for volunteers from members.

A Meeting had taken place with Mr Evans from GEO Environmental with regard to the contamination on the allotment site. Members would like to split the areas and provide some ground allotments. This would require further testing of the areas identified by Mr Evans. This information would be required for planning.

Recommendation from Footpaths, Parks and Allotments Committee would be to proceed with further bore hole testing to satisfy Allerdale Planners. Members asked to vote on further testing - Unanimous

Agenda Item 6 – Bank Accounts The clerk had received information from banks/building societies in the town on future business banking due to the closure of the HSBC in Wigton. The Clerk’s recommendation would be to go with Building Society for the following reasons: Free banking - All banks are free for the first 12 months and then charges apply. It’s local It has a Business Manager in the Wigton Branch – No bank in Wigton has a local Business Manager To set up the following accounts: 1. Current Account 2. Friends of Wigton Park Account 3. Business Account 4. 40 days’ notice Account (Sale of Park House) – Better interest rate

Recommendation from Members of the Finance Committee is that we move our business banking accounts to the Cumberland Building Society and that we go with the 4 bank accounts recommended by the Clerk. Vote taken - Unanimous

Agenda Item 7 – Budget Monitoring The clerk circulated the 3rd quarter budget monitoring form for amendment/approval. No amendments necessary for this quarter. It was pointed out that the deficit budget has turned around due to the extra income generated on external contracts. The Clerk explained that it was becoming increasingly difficult for grounds staff to work with only one van as they go out of Wigton on numerous contracts which then leaves staff with no transport. Therefore members agreed that the Clerk look for a midi van for the Supervisor to use. Agreed amount of up to £6,000

Recommendation from Members of the Finance Committee is to accept the proposal of buying a van up to the amount of £6,000 and give the buying power to The Clerk and Supervisor. Vote taken - Unanimous

Antiques Roadshow held by Isobel Scott in the Market Hall raised £150 for the Festivals Fund. Cllr Lynch asked that the Clerk send a letter of thanks to Isobel.
