3. GOALS AND OBJECTIVES

3.1. To ensure conservation and protection of fish stocks coastwide through the application of ") scientific management principles.

3.2. To ensure the optimal use of fish stocks in order to meet social and economic objectives of the people of Canada.

3.3. To develop fishing plans consistent with principles of conservation, through a consultative process with users of the resource.

3.4. To preserve, enhance, restore and protect critical aquatic habitat for fish production.

3.5. To optimize the quality offish harvested.

4. ENFORCEMENT PLAN

The Conservation and Protection Sector of the Department of Fisheries and Oceans has the responsibility to enforce the Fisheries Act and associated regulations, to address conservation, health and safety issues and to maintain proper management and control of the various fisheries.

Users of the resource have a responsibility to report violations. Any suspected or actual fisheries, wildlife or pollution violations can be quickly and discretely reported to the appropriate Enforcement Officer by using the toll free Observe, Record and Report hotline. This toll free number is available 24 hours a day. Confidentiality is assured.

5. ABORIGINAL FISHERIES PLAN

The Department of Fisheries and Oceans recognizes the importance of fish, including invertebrates, to the aboriginal peoples of . Through the Aboriginal Fisheries Strategy, the Department seeks to negotiate, with aboriginal organizations, allocations for food, social and ceremonial purposes. Subject to conservation, these allocations will have priority over allocations for commercial and recreational user groups.

The Department will consult with aboriginal organizations to determine what these allocations should be. In some cases, instead of negotiating allocations, an area may be closed to certain fishing except fishing by an aboriginal organization. These closures may be for the season or for specified times. Whenever possible, the appropriate annual fishing plan will identify such closures. Communal licences will be issued to the aboriginal organization for the fishing.

6. SPORT FISHING PLAN

... ) The recreational harvest of fish is regulated via the British Columbia Sport Fishing Regulations made under the Fisheries Act. A DFO Tidal Waters Sport Fishing Licence is required for the recreational harvest of all fish species. The regulations are summarized annually in the British Columbia Tidal Waters Sport Fishing Guide which lists closed times, bag limits, size limits (where applicable) and closed areas. If necessary, public notices are posted to document closures or changes from the Guide. Closures may be implemented in order to conserve vulnerable stocks, or to protect the public from consumption of contaminated shellfish or to meet Aboriginal food, social and ceremonial needs. For some species, areas have been closed to commercial harvest or commercial harvest openings have been delayed to provide an opportunity for the recreational community.

The primary consultative body for the recreational fishing community is the Sport Fishing Advisory Board (SFAB). The SFAB has representatives from all parts of this community including the BC Wildlife Federation and the Sport Fishing Institute of BC. If you have any questions or need further information, please contact a Recreational Fisheries Coordinator listed on page 4 of this fishing plan or a local Fisheries Office.

7. COMMERCIAL FISHING PLAN

7.1 Management Changes For 1996

7.1.1. Closures in Area 13 have been redescribed for clarification, but have not been changed in extent from the 1995 plan. 5

7.2 Open Times

7.2.1. All Pacific Fisheries Management Subareas are closed by regulation from January 1 to December 31 unless varied by Order. The master of the licenced vessel must contact the local Fisheries Management Co-ordinator listed on page 3 of this plan, to request an area to be opened. The opening must be confirmed before fishing commences.

7.3 Area Closures

7.3.1 In Area 13:

7.3 .1.1. : Subareas 13-3, 13-4, 13-5 and a portion of 13- 6. Those waters of Discovery Passage bounded on the north by a straight line drawn true west from North Bluff on Quadra Island, across Seymour Narrows to a fishing boundary sign on Vancouver Island, and on the south by a line from the Cape Mudge light true west to Vancouver Island (Marine Reserve).

7.3.1.2. Deep Water Bay. A portion of subarea 13-7 inside a line from a fishing boundary sign at Separation Head to a fishing boundary sign at the northwesterly entrance to Deepwater Bay.

7.3.1.3. Kelsey Bay: Subarea 13-34.

7.3.2. In Area 14:

Subareas 14-11 and 14-14.

7.3.3. In Area 16:

7.3.3.1. Skookumchuck Narrows Provincial Park: Those waters of Skookumchuck Narrows and Sechelt Rapids bounded on the west by a line from a point on the foreshore at the westerly limit of Secret Bay on SecheIt Peninsula thence 50° true to a point on the foreshore on the mainland; and the east by a line from Raland Point on Sechelt Peninsula, thence 50° true to a point on the foreshore on the mainland.

7.3.3.2 Subareas 16-3 (Bargain Bay), 16-4 (Pender Harbour) and 16-5 (head of Sechelt Inlet).

7.3.4. In Area 17:

7.3.4.1. Subareas 17-7 (Ladysmith Harbour) and 17-14 (Nanaimo Harbour).

7.3.5. In Area 18:

7.3.5.1. Subareas 18-7 (Sansum Narrows. Burgovne Bay and Maple Bay), 18-8 (Cowichan Bay) and 18-10 (Eulford Harbour). 6 .'

7.3.6. In Area 19:

7.3.6.1. Subareas 19-1 (Victoria Harbour), 19-2 (Esquima1t Harbour), 19-6 (Sidney Spit Marine Park), and 19-7 to 19-12 ().

7.3.6.2. Ogden Point closure: Those waters of subarea 19-3 inside a line from the Navigation Light at the western end of the Ogden Point Causeway thence to Brotchie Ledge Light, thence to Holland Point on Vancouver Island (marine reserve).

7.3.6.3. 10 Mile Point Ecological Reserve: Those waters of subareas 19-4 and 19-5 within 0.4 nautical mile ofCadboro Pt. navigation light (marine reserve).

7.3.6.4. Race Rocks Ecological Reserve: Those waters of subareas' 19-3 and 20-5 within 0.5 nautical mile of Great Race Rock.

7.3.7. In Area 20:

7.3.7.1. Race Rocks Ecological Reserve: Those waters of subareas 19-3 and 20-5 within 0.5 nautical mile of Great Race Rock.

7.3.7.2. Botanical Beach Provincial Park: That portion of subarea 20-3) between the lowest tide level on record and the highest tide level on record from j San Juan Point thence following the Vancouver Island shoreline easterly to the mouth of Tom Baird Creek (marine sanctuary).

7.3.7.3. Subareas 20-2 (), 20-6 and 20-7 (Sooke Harbour and Basin).

7.3.7.4. Pacific Rim National Park: That portion of subarea 20-1 between the lowest tide level on record and the highest tide level on record from Bonilla Light thence following the shoreline of Vancouver Island easterly to Owen Point.

7.3.8. In Area 21:

7.3.8.1. Pacific Rim National Park: That portion of Area 21 between the lowest tide level on record and the highest tide level on record from Pachena Point thence fol\owing the Vancouver Island shoreline easterly to Bonilla Point.

7.3.9. In Area 23:

7.3.9.1. Pacific Rim National Park: Those waters lying within 0.5 nautical mile of the Broken Group Islands in . 7

7.3.10. In Area 28:

7.3.10.1. Porteau Cove: That portion of Subarea 28-4, east of a line drawn from a white fishing boundary sign located on the south shore of Porteau Cove to a white fishing boundary sign located on the north shore of Porteau Cove.

7.3.10.2. WhytecliffPark: That portion of Subarea 28-2 bounded by a line commencing from the most southerly point of Whytecliff Park; thence in a straight line to a point located 100 m east of the most southeasterly point of Whyte Is.; thence following the southern shoreline of Whyte Is. at a distance of 100 m to a point lying 100 m from the most southwesterly point of Whyte Is.; thence in a straight line to a point lying 100 m west of Whytec1iff Point; thence following the shoreline at a distance of 100 m in a northerly direction to a point 100 m north of Lookout Point; thence following the shoreline at a distance of 100 m in an easterly direction to a point 100 m perpendicular to the most northerly point of Whytecliff Park; thence to the most northerly point of Whyte cliff Park on the mainland.

7.3.10.3. Horseshoe Bay: That portion of Subarea 28-2 bounded by a line commencing from Whytecliff Point, thence in a straight line to the most southerly point of Bowyer Island, thence in a straight line 112 degrees True to the mainland.

7.4. Licensing

7.4.1. Licence Category:

A category "Z-K" licence is required to harvest anchovy.

7.4.2. Species:

Anchovy, Engraulis mordax

7.4.3. Gear:

Seine nets only, maximum length of 200 fathoms.

7.4.4. Maximum Catch

Ten (10) metric tonnes (10,000 kg., equals 22,000 Ibs.) The licence holder may apply for an amendment to this licence condition to allow for additional catch. Contact the Herring Section in Nanaimo at 756-7287.

7.5. Notification

7.5.1. The vessel master shall advise the departmental office nearest to the area in which he intends to fish, 24 hours prior to arrival in the fishing area, of the estimated time of arrival and the Subareas that will be fished. 8

7.6. Catch Reporting

,~ 7.6.1. Harvest Log Data ... )

7.6.1.1. The vessel master is responsible for the provision and maintenance of an accurate record, a "log", of daily harvest operations. This log must be completed and a copy submitted in both hard copy (paper) and electronic form in an approved format. Logbooks meeting DFO requirements are available from 1. o. Thomas (291-6340) who, for a small fee, will provide both the logbook and the keypunch service, thus complying with the requirements for a hard (paper) and an electronic copy. This log must be accompanied by a chart record of the locations fished. The original white page copy of the log, the electronic copy and the chart record must be forwarded each month to:

As an alternative to the above, you may provide a log in the same form and providing the same particulars as shown in the fishing log sample attached (see Conditions of 1996 Licence). You must also provide an electronic copy which must be DOS compatible ASCII format on a 3.5" disk. Disks will remain the property of the Department of Fisheries and Oceans. Both the paper and the electronic copy of the harvest log must be forwarded each month to the above address, accompanied by the chart record of fishing locations clearly marked with harvest locations and dates.

7.6.1.2. Catch information must be recorded in the harvest log by midnight of the day of fishing and kept aboard the licenced vessel when fish are being harvested or when fish are on board. Logbooks must be produced for examination by a Fishery Officer or Guardian.

7.6.1.3. The vessel owner reported with the Commercial Licence Unit is responsible to ensure that the vessel master has completed and submitted a copy of the log data. DFO can only release log data to the vessel owner on record, and only upon written request.

THE DEPARTMENT WISHES TO REMIND FISHERS THAT IT IS A CONDITION OF THEIR LICENCE THAT LOGS BE COMPLETED DAILY FOR EACH DAY FISHED AND TURNED IN AT THE END OF EACH MONTH FISHED. DELAY OF COMPLETION OR SUBMISSION OF LOGS IS A VIOLATION OF A CONDITION OF LICENCE.

7.6.2. Fish Slip Requirements

It is a condition of this licence that an accurate written report shall be furnished on a fish slip of all fish caught under the authority of this licence. A report must be made even if the fish landed are used for bait, personal consumption, or otherwise 9

disposed. The written report shall be posted not later than seven days after the offloading and sent to:

CONDmONS OF 1996 ANCHOVY LICENCE

Pursuant to subsection 22(1) of the Fishery (General) Regulations, and for the proper management and control of the anchovy fishery, the following conditions are specified for this 1996 commercial fishing licence:

1. Species of fIsh permitted to be taken: Anchovy

2. Quantity of fIsh that may be taken: A maximum of 10 tonnes of anchovy may be caught under this licence. (The licence holder may apply for an amendment to this licence condition to allow for an additional catch. Contact the Herring Section in Nanaimo, 756-7287.)

3. Fishing gear permitted to be used: One seine net with a maximum length of 200 fathoms.

4. Information that the master of the vessel shall report to the Department of Fisheries and Oceans:

The vessel master shall advise the departmental office nearest to the area in which he intends to fish, 24 hours prior to arrival in the fishing area, of his estimated time of ) arrival and the Subareas he is planning to fish.

5. Records that the master of the vessel shall keep:

(1) Harvest Logs:

(a) The vessel master is responsible for the provision and maintenance of an accurate record, a "log", of daily harvest operations. This log must be completed and submitted in both hard copy and electronic copy. Logbooks, meeting DFO requirements, are available from an outside supplier who, for a small fee, will provide both the logbook and the keypunch service, thus complying with the requirements for a hard and an electronic copy. The hard copy of the log must be forwarded each month to:
