Plaintiffs request the Court to defer consideration of such motion until a determination is made whether the recount litigation now pending in the Southern District of Ohio, State Ex. Rel. Yost v. National Voting Rights Institute, Civ. No. C2-04-1139 (ES/TK) (hereinafter “Yost” case), should be transferred to this Court and consolidated with this action. Secretary Blackwell has on at least four occasions suggested in papers filed in the Yost case that the case should be Case 3:04-cv-07724-JGC Document 14-1 Filed 01/27/2005 Page 2 of 10 transferred to this Court and consolidated with this case, which was the first recount case filed.1 Moreover, as plaintiffs establish below, they have standing to pursue their constitutional right to a recount, and the issues raised in their complaint are not moot.
