Governance by Academics: The Invention of Memoranda of Understanding Jan Klabbers1 I Introduction II The Intellectual Non-history of the MoU III The Origins of the MoU: Fawcett’s Classic Contribution IV Beyond Fawcett V The 1980s and Beyond VI A Popular Misapprehension VII The Nail in the Coffin Abstract This contribution aims to sketch how a single article published in a legal journal came to influence generations of international lawyers worldwide, despite not being a very good article, and despite its main proposition not being supported by much empirical evidence. The article concerns is James Fawcett’s ‘The Legal Character of International Agreements’, published in 1953 in the British Yearbook of International Law, which more or less single-handedly invented the (binding, but ostensibly not legally binding) Memorandum of Understanding. This contributions traces Fawcett’s forerunners, dissects his argumentation, and scrutinizes its reception in both the academy and the practice of Foreign Office lawyers. It does so in order to illustrate how power can be shaped through epistemic means and can be exercised even by academics, in this case by means of a journal article. Keywords: Memorandum of Understanding James Fawcett Law of Treaties Epistemic Authority Expert Governance 1 Professor of International Law, University of Helsinki. An earlier version of this paper was presented at a panel discussion at the United Nations during International Law Week, 23 October 2018. I. Introduction Students of international affairs are increasingly aware that governance is not merely the province of formal decision-making processes, but can take place in many different ways and by many different people.

i CANADIAN COMMON LAW PROGRAM APPROVAL COMMITTEE REPORT ON AN APPLICATION BY RYERSON UNIVERSITY FOR APPROVAL OF A PROPOSED LAW SCHOOL PROGRAM December 2017 (i) CANADIAN COMMON LAW PROGRAM APPROVAL COMMITTEE Report on Application by Ryerson University for Approval of Proposed Law School Program Introduction 1. The Canadian Common Law Program Approval Committee (the “Approval Committee” or “the Committee”) is responsible for determining whether existing and proposed common law programs meet the National Requirement set by law societies. The requirement outlines the learning resources required of law schools, as well as the knowledge and competencies that all graduates must possess in order to gain entry into the bar admission programs in the Canadian common law jurisdictions. 2. In October 2016 the Approval Committee received a Letter of Intent from Ryerson University (“Ryerson”) for a new law school program, followed in April 2017 by an official proposal. The Approval Committee has reviewed Ryerson’s application and has determined that, subject to the concerns and comments described below, if the program is implemented as proposed, it will meet the National Requirement. The Committee’s detailed analysis, as well as the iterative process that led to preliminary approval of the program, are set out in this report and corresponding Appendix “A”. 3. The Approval Committee’s decision is only one step in the process. Pursuant to the Ontario Degree Granting Act the proposed program must be approved by the Ontario Minister of Colleges and Universities. In addition to academic and financial considerations, it is the Minister’s responsibility to determine the value or appropriateness of permitting the establishment of a new law school within the province.

  • These Days, It Feels Like You Can't Turn on the Television, Listen to the Radio
These days, it feels like you can’t turn on the television, listen to the radio or pick up a newspaper without there being something about Boris Johnson. We all know that he is the Prime Minister of the U.K, we all know that he can sometimes be a bit controversial but… what else do we know? What else is there to know? Born on 19th June 1964 in New York, Boris’ real name is actually Alexander Boris de Pfeffel Johnson. Boris, as we know him, is the eldest of four children. His father is Stanley Johnson who was a Conservative Member of the European Parliament and was employed by the European Commission and the World Bank. Boris’ mother is an artist named Charlotte Fawcett, his grandfather is Sir James Fawcett who was a prominent barrister and also the president of the European Commission of Human Rights. Is it any wonder Boris became involved in politics? Educated in Brussels, Boris attended the European School, Ashdown House Private School and then the prestigious Eton College. He earned a place at Oxford University where he studied Classics and became President of the Oxford Union. Following his time at university, Boris began a successful career in journalism, eventually settling into political journalism and working for The Times and The Telegraph, and subsequently becoming editor of The Spectator. Beginning his own political career in 2001, Johnson was elected as MP for Henley. In 2004, he was appointed as Arts Minister, which made him a front bench Member of Parliament. In 2007, Boris announced his candidacy for the Mayor of London and was successfully elected in 2008.
