It is doubtful whether there exists even any general agree- ment as to what subjects are within its scope. The problem of whether, and in what sense, it is to be considered philosophy or science, cannot, however, be discussed without adopting at least some tentative notion of its meaning that shall serve as the basis for the discussion. This can be more effectively done by a general description of the types of problem usually dealt with in treatises and courses on Jurisprudence than by framing a logically correct definition that secured accuracy and completeness by resort to a convenient vagueness. Investigation discloses its use to denote lines of inquiry having little in common other than a professed interest in general questions and problems concerning law and justice. -
The Philosophical Underpinnings of Educational Research
The Philosophical Underpinnings of Educational Research Lindsay Mack Abstract This article traces the underlying theoretical framework of educational research. It outlines the definitions of epistemology, ontology and paradigm and the origins, main tenets, and key thinkers of the 3 paradigms; positivist, interpetivist and critical. By closely analyzing each paradigm, the literature review focuses on the ontological and epistemological assumptions of each paradigm. Finally the author analyzes not only the paradigm’s weakness but also the author’s own construct of reality and knowledge which align with the critical paradigm. Key terms: Paradigm, Ontology, Epistemology, Positivism, Interpretivism The English Language Teaching (ELT) field has moved from an ad hoc field with amateurish research to a much more serious enterprise of professionalism. More teachers are conducting research to not only inform their teaching in the classroom but also to bridge the gap between the external researcher dictating policy and the teacher negotiating that policy with the practical demands of their classroom. I was a layperson, not an educational researcher. Determined to emancipate myself from my layperson identity, I began to analyze the different philosophical underpinnings of each paradigm, reading about the great thinkers’ theories and the evolution of social science research. Through this process I began to examine how I view the world, thus realizing my own construction of knowledge and social reality, which is actually quite loose and chaotic. Most importantly, I realized that I identify most with the critical paradigm assumptions and that my future desired role as an educational researcher is to affect change and challenge dominant social and political discourses in ELT. -

Weber/Editor’s Comments EDITOR’S COMMENTS The Rhetoric of Positivism Versus Interpretivism: A Personal View1 Many years ago I attended a conference on interpretive research in information systems. My goal was to learn more about interpretive research. In my Ph.D. education, I had studied primarily positivist research methods—for example, experiments, surveys, and field studies. I knew little, however, about interpretive methods. I hoped to improve my knowledge of interpretive methods with a view to using them in due course in my research work. A plenary session at the conference was devoted to a panel discussion on improving the acceptance of interpretive methods within the information systems discipline. During the session, a number of speakers criticized positivist research harshly. Many members in the audience also took up the cudgel to denigrate positivist research. If any other positivistic researchers were present at the session beside me, like me they were cowed. None of us dared to rise and speak in defence of positivism. Subsequently, I came to understand better the feelings of frustration and disaffection that many early interpretive researchers in the information systems discipline experienced when they attempted to publish their work. They felt that often their research was evaluated improperly and treated unfairly. They contended that colleagues who lacked knowledge of interpretive research methods controlled most of the journals. As a result, their work was evaluated using criteria attuned to positivism rather than interpretivism. My most-vivid memory of the panel session, however, was my surprise at the way positivism was being characterized by my colleagues in the session. -

The school of Legal Positivism developed over the period of 18th and 19th century through the works of influential jurists such as John Austin and Jeremey Bentham. The works of these two great jurists was mainly responsible for the Legal Positivist School to acquire such importance in the field of legal jurisprudence. Their work was taken forward by jurists such as H.L.A.Hart. Although not free from shortcomings, the Legal Positivist School is regarded as the most influential school of thought in jurisprudence. Judges have based their decisions on this school of thought across various countries, including India. Indian Judges have been greatly influenced by the thinking of legal positivists and have applied their jurisprudence while giving landmark judgements such as A.K.Gopalan v. State of Madras to name one of them. The basic idea behind legal positivists was that they considered law as it is and not what it ought to be. They separated moral principles from legal principles. -

Chapter 1 develops the Nomological Account of ground, – p1, …, pn ground q if and only if the laws of metaphysics determine q on the basis of p1, …, pn, – and the constructional theory of the metaphysical laws, – the laws are general principles that characterize construction-operations. Chapter 2 offers an analysis of the notion of determination involved in the Nomological Account: the laws determine q based on p1, …, pn if and only if q follows from p1, …, pn and the laws in the grounding-calculus. The grounding-calculus is characterized in terms of two inference rules and a suitable notion of ‘proof’. The rules are designed to analyze the input- and output notions that are intuitively associated with laws: the laws take some facts as input and deliver some other facts as output. ii Chapters 1 and 2 also go beyond the development of the positive view. Chapter 1 shows how the Nomological Account explains general patterns among grounding-truths, the modal force of ground, and certain connections between ground and construction. Chapter 2 shows why the Deductive-Nomological Account of metaphysical explanation escapes the objections to the traditional DN-account of scientific explanation, and it also outlines two views on logical explanation that are available to the proponent of the Nomological Account. -

ESSAYS LAW AND ENCHANTMENT: THE PLACE OF BELIEFt Joseph Vining* I. THE QUESTION The question I wish to raise is whether one must believe what one says when one makes a statement of law. The language of belief that we know, and from which moral discourse and the moral never stray far: do judges, lawyers, law participate in it? Any such question is but an aspect of a larger question, indeed issue, of what we may call the objectivity of legal language. It is raised perhaps most acutely by the broad claims now being made for artificial intelligence and in particular for the computer programming of legal advice (as a species of what is called, in that field of applied science, an "expert system"). -

LAW AND IDEOLOGY: CRITICAL EXPLORATIONS Rafał Mańko* Michał Stambulski** According to Polish legal theorist Marek Zirk-Sadowski, the philosophy of law as a discipline can be approached from two distinct directions: either from the direction moving ‘from law to philosophy’, whereby lawyers try to answer the fundamental questions of jurisprudence by theorising on the basis of legal experience, or, in the opposite direction, that is ‘from philosophy to law’, whereby a certain philosopher or philosophical school is ‘applied’ to the legal field.1 Within the second paradigm of legal philosophy, in recent years there has been a growing tendency to analyse the implications of postmodernism, posthumanism2, or postructuralism upon the legal domain. I plan to build the present paper around the implil:ations of this passage: In all lawgiving (Gesetzgebung) (whether it prescribes for internal or external actions, and whether it prescribes them a priori by reason alone or by the choice of another) there are two elements: first, a law, which represents an action that is to be done as objectively necessary, that is, which makes the action a duty; and second, an incentive, which connects a ground for determining choice to this action subjectively with the representation of the law. -

Introduction On recent prominent accounts, legal positivism and physicalism about the mind are viewed as making parallel claims about the metaphysical determinants or grounds of legal and mental facts respectively.1 On a first approximation, while physicalists claim that facts about consciousness, and mental phenomena more generally, are fully grounded in physical facts, positivists similarly maintain that facts about the content of the law (in a legal system, at a time) are fully grounded in descriptive social facts.2 Explanatory gap arguments have long played a central role in evaluating physicalist theories in the philosophy of mind, and as such have been widely discussed in the literature.3 Arguments of this kind typically move from a claim that an epistemic gap between physical and phenomenal facts implies a corresponding metaphysical gap, together with the claim that there is an epistemic gap between facts of these kinds, to the negation of physicalism. Such is the structure of, for instance, Chalmers’ (1996) conceivability argument, Levine’s (1983) intelligibility argument, and Jackson’s (1986) knowledge argument. Though less prominently than in the philosophy of mind, explanatory gap arguments have also played some role in legal philosophy. In this area, the most incisive and compelling use of an argument of this kind is constituted by Greenberg’s (2004, 2006a, 2006b) powerful attack on positivism. -

Hart made a famous claim that legal positivism somehow involves a “sepa- ration of law and morals.” This Article seeks to clarify and assess this claim, con- tending that Hart’s separability thesis should not be confused with the social thesis, the sources thesis, or a methodological thesis about jurisprudence. In contrast, Hart’s separability thesis denies the existence of any necessary conceptual connec- tions between law and morality. That thesis, however, is false: There are many necessary connections between law and morality, some of them conceptually signif- icant. Among them is an important negative connection: Law is, of its nature, morally fallible and morally risky. Lon Fuller emphasized what he called the “internal morality of law,” the “morality that makes law possible.” This Article argues that Hart’s most important message is that there is also an immorality that law makes possible. Law’s nature is seen not only in its internal virtues, in legality, but also in its internal vices, in legalism. INTRODUCTION H.L.A. Hart’s Holmes Lecture gave new expression to the old idea that legal systems comprise positive law only, a thesis usually labeled “legal positivism.” Hart did this in two ways. First, he disen- tangled the idea from the independent and distracting projects of the imperative theory of law, the analytic study of legal language, and non-cognitivist moral philosophies. Hart’s second move was to offer a fresh characterization of the thesis. -
Introduction to Philosophy of Science
INTRODUCTION TO PHILOSOPHY OF SCIENCE The aim of philosophy of science is to understand what scientists did and how they did it, where history of science shows that they performed basic research very well. Therefore to achieve this aim, philosophers look back to the great achievements in the evolution of modern science that started with the Copernicus with greater emphasis given to more recent accomplishments. The earliest philosophy of science in the last two hundred years is Romanticism, which started as a humanities discipline and was later adapted to science as a humanities specialty. The Romantics view the aim of science as interpretative understanding, which is a mentalistic ontology acquired by introspection. They call language containing this ontology “theory”. The most successful science sharing in the humanities aim is economics, but since the development of econometrics that enables forecasting and policy, the humanities aim is mixed with the natural science aim of prediction and control. Often, however, econometricians have found that successful forecasting by econometric models must be purchased at the price of rejecting equation specifications based on the interpretative understanding supplied by neoclassical macroeconomic and microeconomic theory. In this context the term “economic theory” means precisely such neoclassical equation specifications. Aside from economics Romanticism has little relevance to the great accomplishments in the history of science, because its concept of the aim of science has severed it from the benefits of the examination of the history of science. The Romantic philosophy of social science is still resolutely practiced in immature sciences such as sociology, where mentalistic description prevails, where quantification and prediction are seldom attempted, and where implementation in social policy is seldom effective and often counterproductive.
