Executive Summary

The Punjab Judicial Academy Act was passed by the Punjab Assembly on 5th October, 2007 and assented to by the Governor of Punjab on 29th October, 2007. Accordingly the Punjab Judicial Academy was established by the Punjab Government vide Notification No.Legis.13-7/2005 on 18th May, 2007 under section 3(1) of the Punjab Judicial Academy Ordinance, 2007.

A scheme for construction of Punjab Judicial Academy has been reflected in the Annual Development Programme (ADP) 2009-2010 by the Planning & Development Department. A piece of land measuring 393 Kanals 7 Marlas has been acquired at the cost of Rs.93.921 million and after taking possession of the same, the boundary wall is under construction.

At present the Punjab Judicial Academy is fully functional in the building situated at 15-Fane road, Lahore. The training courses for imparting necessary knowledge and professional skills are being conducted for the benefit of Additional District & Session Judges, Civil Judges cum Judicial Magistrates, Prosecutors and Jail Officers. The Hon’ble sitting Judges and Retired Judges of Superior Courts, senior members of District Judiciary, eminent lawyers and other p rofessionals are invited to impart knowledge and professional skills to the participants. The curricula consist of civil, criminal and Islamic laws, computer skills, medical jurisprudence, court & case management and many other allied topics with emphasis on applied knowledge. The training system is a blend of classroom instructions , c a se study, syndicate discussions, extension lectures, communication skills and mock trial etc. The participants are also provided opportunity to visit Police Training Institution, recently established Forensic L a boratory so as to apprise them of the modern 6 Punjab Judicial Academy

Annual Report 2013-2014 techniques in investigation and the assistance that these institutions can provide in resolution of the matters involved in judicial disputes. Special emphasis is also laid on the justice system as is envisioned in the Islamic Administration of Justice. The purpose is to prepare all the stakeholders in the justice system for providing even- handed, speedy and inexpensive justice without fear and favour to all the segments of society.

The effectiveness of the training received by the Judicial Officers at the Academy is reflected from the quality of work being performed after the training by the same Officers compared with the judicial work conducted earlier. The performance of these officers and other stakeholders will further improve by extending the period of training of each segment and also by holding programmes for court staff and lawyers. The Academy has offered the Punjab Bar Council to conduct programmes for improving the professional skills and legal knowledge of the members of the legal fraternity as also to hold Bar Examination for admission of lawyers to the profession. The Academy shall endeavor to develop itself as a a Center of Excellence so as to play its role in developing competent Judicial Officers and other segments of the judicial system.

Introduction

The Punjab Judicial Academy was established under The Punjab Judicial Academy Act, 2007 (Pb. Act XV of 2007) for imparting pre-service and in service training to the judicial officers and court personnel with a view to developing their capacity, professional competency and ethica l s tandards for efficient and even handed dispensation of justice. The functions of the Academy have been fully elaborated in Section-4 of the Act which states:  Impart pre-service and in-service training to the judicial officers and court personnel.  Develop the skills and techniques for court management, case management, delay reduction, alternate dispute resolution and judgment writing  Conduct examinations and award certificates and diplomas  Develop training courses relating to administration of justice including use of information technology  Hold conferences, seminars, lectures, workshops and symposia relating to court management, administration of justice, law and development and legislative drafting  Publish books, journals, research papers and reports on important topics relating to administration of justice  Promote research on case management, court management, trial skills and judicial reasoning  Encourage legal and constitutional research  Inculcate and promote ethical values and standards in judicial officers and court personnel

 Coordinate with other educational and training institutions including the Federal Judicial Academy  Conduct training and examinations of other officers and personnel on the direction of the Board  Perform such other functions as may be assigned to it by the Board

The needs of the time have necessitated promulgation, amendments of various new laws, legal concepts, new theories, the expertise of which is scarce in the Bench and the Bar. The Academy undertakes to impart such knowledge and training to all the stake-holders of the judicial system through experts, scholars, members of the superior judiciary, renowned lawyers, medical experts, sen i o r p olice officers, reputed scholars and professors. The Academy is committed to conduct a wide range of Research and Development Program on the improvement and implementation of laws, with collaboration of foreign institutions and their renowned experts in the fields of inter alia, electronic/cyber crimes, money laundering, environmental laws, intellectual property laws, consumer protection law, gender sensitization and human rights etc.

Programs Pre-Service Training In pre-service training emphasis is laid on the basic skills required by trainees in the field immediately after leaving the Academy. It includes judgment/order writing, management of the court staff and management of various types of cases. The laws used most frequently by subordinate courts are also taught in the Academy.

In-Service Training In-Service training is given when the trainees are either promoted or posted to different positions. For instance, in-service training is given to senior civil judges when they get promoted as Additional District & Sessions Judges. The training covers subjects such as administration of justice, accounts, case management and administration of courts. In-service training is also given when District & Sessions Judges are posted, for example, as Banking Judges, Judges of Accountability Courts, Judges of Terrorism Courts, Judges of Anti-Corruption Courts etc. Capacity Building Training The need for capacity building of judicial officers stems from the inadequate number of judges/courts as compared with the pendency of cases. A spe r international standards, there should be much greater number of courts for speedy disposal of cases than the existing ones. Unfortunately, due to financial constraints, this is not possibe. Hence capacity building training programs of the existing judicial officers have been initiated to increase efficiency. Short Specialized Courses Short specialized courses are offered by specialists in different laws and subjects such as Forensic Science,DNA, Communication Skills, Balistics, for which judicial officers and lawyers require greater expertise. Laws which are being taught in short specialized courses pertain to for e.g.money laundering, cyber crimes, intellectual property, environmental laws etc. Workshops & Seminars Workshops and seminars are held on specific topics/subjects which are need of the time. In the past, special workshops and seminars were held on court reporting to which members of the print and electronic media were invited. A

Annual Report 2013-2014 special seminar was also held on the topic of mens rea with particular reference to the mental health of the Pakistani society. Specialists from USA and Europe conducted a two-day workshop on this topic. Many such workshops take place in the Academy.

Teaching Methodology Lectures Lectures and class room instructions are aimed at preparing trainees for quick and proper dispensation of justice whether at the stage of investigation, prosecution, trial and/or the final judgment by teaching:-

 Law subjects which are not taught in law schools/colleges but are required for dispensation of justice. Instruction through case law is emphasized.  Judgment/ Order /Evidence Writing.  Consideration of pleadings and appreciation of evidence.  Case management.  Court staff management.

Mock Trial

Mock trials are organized and conducted by participants in pre-service training courses of different levels which give them confidence to handle cases when they are on the job.

In civil matters, the participants are involved right from drafting of pleadings, passing of interlocutory orders, framing of issues, recording of evidence and its evaluation and judgment writing. Similarly, in criminal cases, the participants are 11 Punjab Judicial Academy

Annual Report 2013-2014 actively involved in hypothetical cases to deal with physic a l r emands, taking of cognizance, bails, indictment, recording of evidence, statement of the accused, appraisal of evidence, conclusion of trial and judgment writing. Besides imparting related skills, the participants are also imparted instructions in mannerism and legal ethics.

Case Study

Landmark cases/judgments of superior courts are select e d f o r c l ass/group discussions and arguments for and against the issues.

Study Tours/Visits For the purpose of imparting MLT (Medico-Legal Training) and knowledge, the Academy arranges visits to renowned hospitals such as Mayo Hospital, King Edward Medical College University etc. The participants are shown the actual post mortem and various aspects are explained on the spot by the medical officers. It is also taught by the doctors how a Medical Report is prepared and what are the different stages of preparation of Medical Report. Furthermore, it is also explained as to how a judge should read a Medical Report. For Forensics, the participants are taken to Sihala P o l i c e T r a ining Centre, Islamabad and National Police Centre Chunng, Lahore for on th e spot training of various kinds of weapons/firearms. Trainees are also taken to visit Punjab Forensic Science Agency which is a state-of- the-art laboratory with regard to DNA tests and other related fields. Trainees are given lectures on the process of conducting DNA tests by senior professors of the Forensic Science Agency. In this regard, the services of Dr. Muhammad Ashraf Tahir Director G eneral, PFSA, are commendable.

Court visits are also arranged for the participants to see the working of the courts.

Initiative Taken

Service Rules

The Service Rules of the Academy are under the process of fi n a lization in consultation with the Service Rules Committee of S&GAD.

Performance Evaluation a. Trainee

The benchmark is two months disposal immediately before joining the Academy and two months disposal after rejoining on completion of the training. All the District & Sessions Judges in Punjab have been requested to supply the information.

The Judges are also requested to suggest the particular area/a r eas of substantive as well as procedural laws, both on the criminal and civil side in which difficulties are being faced by the young officers so that these areas could particularly be targeted.

The suggestions made by the District & Sessions Judges are given at page 123-130. b. Resource Person

The Academy has initiated evaluation of the Resource Persons by the trainee Judicial Officers on a proforma which is supplied to them on the last day of their training session to be received back the same day before they leave the Academy.

Concluding Ceremonies

It was decided by the Board that the frequency of concluding ceremonies should be regulated by restricting presence of Hon’ble Judge of Lahore High Court only if it involves training course/session of the duration of 8 weeks or above, and that Certificates of short courses should be awarded by the Director General ,PJA without any formal ceremony. 13 Punjab Judicial Academy

Remuneration of Resource Persons

It was resolved by the Board that the basic slab for lecture should be Rs. 5,000 for the District & Sessions Judges (serving or retired) and the member of legal profession; while for the serving/retired Judges of the High Co urts, Supreme Court, Lawyers, Jurists and Scholars of National repute, Officers of Executive of higher caliber and Professors of eminence, it should be Rs. 10,000 per lecture.

(ii) Holding of quiz competitions amongst judicial officers on law subjects, (iii) Movies on criminal trials were shown during training programmes, (iv) Distribution of Certificates of appreciation for participating in extra-curricular activities during training

AGENDA ITEM NO.1:

SANCTION OF THE POSTS OF THE PUNJAB JUDICIAL ACADEMY.

DECISION:

After discussion, the Board accorded ex post facto approval to the creation of the posts mentioned at serial No.5-19 of the Summary and in the Basic Scales shown against each, except that one post of Private Secretary to the Director General will be in BS-18 while one post of Private Secretary and four posts of P.As shall continue in BS-17 and 16 respectively. The post of Instructor (I.T) would be in BS-18, subject to the eligibility threshold of five years experience.

AGENDA ITEM NO.2:

PERFORMANCE OF THE FUNCTIONS AND DUTIES OF THE DIRECTOR GENERAL IN HIS TEMPORARY ABSENCE.

DECISION:

It was decided that the matter shall be re-examined by the Director General to find out whether the Hon’ble Chairperson has any delegated authority to appoint temporarily officer either of the Academy or one of the members of the Board to act as Director General and perform his functions and duties in the absence of the Director General or when the post is vacant. AGENDA ITEM NO. 3:

DELEGATION OF POWERS.

S.8(1)(b): THE POLICY AND PROGRAM FOR TRAINING AND APPROVAL OF COURSES.

DECISION:

The Board granted ex post facto approval of the courses so far conducted by the Academy and also delegated the power under section 8(1)(b) to the Chairperson.

S.8(1)(c): EVALUATION OF PERFORMANCE OF THEACADEMY.

DECISION:

After some discussion it was decided that other than the external evaluation, the power of internal evaluation under section 8(1)(c) is delegated to the Director General.

S.8(i)(g): CREATION, ABOLITION OR UPGRADATION OF POSTS

DECISION: After some discussion the Board agreed to delegate the power to the Chairperson. S.8(2)(a): POWERS OF THE BOARD TO PURCHASE, ACQUIRE, HIRE, DISPOSE OF OR CONSTRUCT ANYP ROPERTY FOR THE ACADEMY

DECISION: The Board was of the view that it should be clarified that powers already delegated to Director General to incur day to day expenditure for running of the Academy will remain unaffected by this provision.

S.8(2)(b): CONTROL AND ADMINISTRATION OF THE PROPERTY OF THE ACADEMY.

DECISION: The power under aforesaid provisions was delegated to the Director General.

S.13(1): APPOINTMENT OF CHARTERED ACCOUNTANT.

DECISION: It was decided that the matter shall be placed before the Board for appointment of a firm of Chartered Accountants after the current audit for the year 2012- 2013 was done. However, since audits have already been conducted, the Board granted ex post facto approval for the audits already conducted by S. Zafar Shah & Co. AGENDA ITEM NO.4:

ANNUAL AUDIT & PERFORMANCE REPORTS FOR THE YEARS 2009- 2010, 2010-2011 AND 2011-2012.

DECISION:

Ex post facto approval of the report for 2009-2010 and approval of the reports of the years 2010-2011 and 2011-2012 was granted by the Board. AGENDA ITEM NO.5:

RECOMMENDATIONS OF THE SUB-COMMITTEE CONSTITUTED BY THE HON’BLE BOARD OF MANAGEMENT TO BRING AT PAR THE SALARIES OF THE EMPLOYEES OF THE ACADEMY WITH THE EMPLOYEES OF THE LAHORE HIGH COURT.

DECISION:

It was decided that financial implication will first be worked out by the Academy and the matter then referred to the Committee comprising Mr. Khalid Mahmood, Additional Secretary (Regulations) Finance Department, Mr. Mohsin Abbas Syed, Director Legislation & Parliamentary Affairs of the Law Department and one officer to be nominated by the Chairperson to re-examine the proposal and to then place their recommendations before the Board.

(b) Detail of Examinations carried out by the Academy

Each Resource Person/Trainer undertakes the test and examination either objective type or narrative. This methodology is adopted because a teahcer is the best person who knows what he has taught and what the participants/trainees should know. He, thus, is also able to judge the extent of learning and absorption of the specified subject. This method of testing has succeeded in most of the western countries, as, it not only tests the participants/students, but also tests the ability of teacher/Instructor in imparting the knowledge.

(c) The Quality of training imparted at the Academy The quality of training in the Academy can be judged from the following factors:- (i) Syllabus/Topics taught at the Academy. (ii) The professional level of the resourse persons/instructors. (d) The Standard of the Students trained at the Academy

The standard of the trainees when they come to the Academy is average. However, it can be proudly stated that, after training, a tremendous improvement has been seen in the trainees. It can be verified by respective District & Sessions Judges and other superior officers of the trainees.

College, Sihala where they are taught modern techniques of investigation. They are also taken to Police Training School Chung, Lahore, where they learn about ballistics, fire arms, forensics & crime scene search methods.

The Punjab Judicial Academy Act, 2007 (XV of 2007) [30th October, 2007] An Act to provide for the establishment of Judicial Academy in the Province of the Punjab.

Preamble.– Whereas it is expedient to establish an academy for imparting training to the judicial officers and court personnel with a view to develop their capacity, professional competency and ethiacl standards for efficient dis pensation of justice and matters ancillary thereto; It is hereby enacted as follows:-

1. Short title, extent and commencement.— (1) This Act may be cited as the Punjab Judicial Academy Act, 2007. (2) It extends to the whole of the Punjab. (3) It shall come into force at once. 2. Definitions.— In this Act– (a) “Academy” means the Punjab Judicial Academy established under section 3; (b) “Board” means the Board of Management of the Academy; (c) “Chairperson” means the Chairperson of the Board; (d)“court personnel” means an employee of the establishment of the Lahore High Court, a court and a tribunal under the administrative control of the Lahore High Court; (e) “Director General” means the Director General of the Academy; 97 Punjab Judicial Academy

(f) “faculty” means members of the teaching staff of the Academy; (g) “Fund” means the Judicial Training Fund; (h) “Government” means the Government of the Punjab; (i) “judicial officer” means a District Judge, a Sessions Judge, an Additional District Judge, an Additional Sessions Judge, a Senior Civil Judge, a Ci vil Judge, a Judicial Magistrate, a Special Judicial Magistrate or a presiding officer of a court or a tribunal under the administrative control of the Lahore High Court; (j) “member” means a member of the Board; (k) “prescribed” means prescribed by the rules made under this Act; and (l) “staff” means staff of the Academy. 3. Establishment of the Academy.— (1) The Government shall, by notification, establish an Academy to be called the Punjab Judicial Academy. (2) The Academy shall be a body corporate having perpetual succession and a common seal with power to enter into contract and may sue or be sued by the said name. (3) The Academy shall be at Lahore. 4. Functions of the Academy.— The Academy shall– (a) impart pre-service and in-service training to the judicial officers and court personnel; (b) develop the skills and techniques for court management, case management, delay reduction, alternate dispute resolution and judgment writing; (c) conduct examinations and award certificates and diplomas; (d) develop training courses relating to administration of justice including use of information technology; (e) hold conferences, seminars, lectures, workshops and symposia relating to court management, administration of justice, law and development and legislative drafting; 98 Punjab Judicial Academy

(f) publish books, journals, research papers and reports on important topics relating to administration of justice; (g) promote research on case management, court management, trial skills and judicial reasoning; (h) encourage legal and constitutional research; (i) inculcate and promote ethica lvalues and standards in judicial officers and court personnel; (j) coordinate with other educational and training institutions including the Federal Judicial Academy; (k) conduct training and examinations of other officers and personnel on the direction of the Board; and (l) perform such other functions as may be assigned to it by the Board.

5. Manner of training.— (1) The Academy shall use all modern techniques for imparting judicial training. Teaching methods and evaluation system shall be at par with international standards. (2) The Academy may enter into arrangements with other recognized public and private institutions for imparting training. (3) The Academy shall institute a quality examination and evaluation system with regard to the training imparted 6 .Board o fManagement. — (1) The management and administration of the Academy shall vest in the Board. (2) The Board shall consist of– (a) Chief Justice, Lahore High Court; Chairperson (b) two judges of the Lahore High Court nominated by the Chairperson; members (c) Chairman, Planning & Development Board member of the Government; 99 Punjab Judicial Academy

(d) Registrar, Lahore High Court; member (e) Additional Chief Secretary of the Government member (f) Secretary to the Government, Finance Department member (g) Secretary to the Government, Law Parliamentary Affair s and Human Rights Department; member (h) Principal, Punjab University, Law College, University of the Punjab, Lahore; member (i) a District & Sessions Judge, member nominated by the Chairperson; and (j) Director General; member/Secretary

(3) The existence of a vacancy in the constitution of the Board shall not invalidate an act or proceedings of the Board.

7. Meetings of the Board.— (1) The Board shall meet at least thrice in a calendar year. (2) The Director General shall convene a meeting of the Board on the direction of Chairperson or written request of three or more members. (3) In the meeting of the Board,– (a) the Chairperson, or in his absence, a member nominated by the Chairperson shall preside; (b) five members shall constitute the quorum; (c) all decisions of the Board shall be taken by simple majority; (d) the Chairperson or a member presiding shall have a casting vote; and (e) the Director General shall record the minutes of the meeting.

8. Powers and functions of the Board.— (1) The Board shall– (a) exercise supervision a n d c o ntrol over the affairs of the Academy; (b) lay down the policy and program for training and approve courses of the Academy; (c) evaluate or cause to be evaluated the performance of the Academy; (d) approve the annual budget and revised budget estimates of the Academy; (e) cause proper books of a c c o u n ts to be maintained for all sums of money received and expenditures incurred by the Academy and arrange fo r th e audit of accounts; (f) determine the terms and conditions of service of the Director General and staff of the Academy; (g) create, abolish or upgrade a post; (h) appoint an officer in BS-16 or above; and (i) prescribe qualifications, conditions of service and other matters relating to faculty, officers and staff. (2) The Board may– (a) purchase, acquire, hire, dispose of or construct any property for the Academy; (b) hold, control and administer the property of the Academy; (c) receive grants-in-aid and donations from the Federal Government, the Government or any other organization, person or agency; (d) regulate, determine and administer all matters concerning the Academy; (e) appoint advisors, consultants and experts for assistance; (f) appoint or hire permanent or visiting faculty; (g) assign a specific power to a person or organization; and 101 Punjab Judicial Academy

(h) exercise any other power ancillary to the aims and objects of the Academy. (3) The Board may delegate all or any of its powers or functions to the Chairperson, a member or a committee of members.

9. Director General.— (1) The Chairperson shall appoint the Director General of the Academy for a term of four years on the recommendation of the Board. (2) The Director General may resign by tendering his resignation to the Chairperson and shall cease to hold office upon acceptance of his resignation. (3) The Chairperson on the recommendation of the Board may, after providing an opportunity of being heard, remove the Director General during the term of his office. (4) The Director General shall be a person who has been a Judge of the Lahore High Court or a District Judge of the Punjab. (5) The Director General shall be the chief executive officer of the Academy and shall be responsible for the affairs of the Academy before the Board. (6) The Director General shall be the principal accounting officer of the Academy. (7) The Director General may, with the approval of the Chairperson, appoint staff in BS-1 to 15. (8) The Director General shall, within two months of conclusion of each financial year, submit annual report to the Board containing performance and proposals for the improvement in the performance of the Academy.

10. Appointment of officers and staff. — (1) The Board or the Director General may appoint officers and staff of the Academy in accordance wit h the provisions of this Act by direct recruitment, deputation, promotion or on contract basis.

(2) The Board shall determine the manner and the terms and conditions of appointment of officers and staff of the Academy. (3) The Board shall prescribe qualification and experience of the teaching staff of the Academy taking into account, th equalification and experience p rescribed for such staff in the world renowned Judicial Academies. 11. Fund.— (1) There shall be a fund of the Academy to be known as the Judicial Training Fund. (2) The Director General shall ensure the deposit of the income of the Academy in the Fund and incurring of the expenditures of the Academy from the Fund. (3) The sources of income of the Fund shall be– (a) grants made by the Federal Government or the Government; (b) donations, endowments and grants from any individual, organization or agency, whether national or international; (c) sale proceeds of the property and publications of the Academy; and (d) any other sum received by the Academy from any lawful source. (2) The Fund shall be kept in such custody, utilized and regulated in the prescribed manner. 12. Budget and accounts.— (1) The Director General shall utilize the Budget and maintain the accounts of the Academy in the prescribed manner. (2) The Director General shall prepare the Budget of the Academy for each financial year. (3) The Director General shall not incur any expenditure from the Fund without the approval of the Board. 13. Audit.— (1) The Board shall appoint a chartered accountant or a firm of chartered accountants to audit the accounts of the Academy.

(2) The Director General, with the approval of the Board, within six months of the close of the financial year, shlal submit to the Government the annual statement of accounts of the Academy alongwith the report of the auditor. 14. Submission of report.— (1) The Director General shall, with the approval of the Board, within the period of six months, submit annual audit and performance reports to the Government which shall include the following:- (a) details of courses run and designed by the Academy; (b) details of examinations carried out by the Academy; (c) research work done by the Academy; (d) the quality of training imparted at the Academy; and (e) the standard of the students trained at the Academy. (2) The Government shall, within two months of the receipt of t he reports, submit the same before the Provincial Assembly of the Punjab. 15. Rules.— The Board may, with the approval of the Government, make rules for carrying out the purposes of this Act. 16. Repeal.— The Punjab Judicial Academy Ordinance 2007 (XV of 2007) is hereby repealed. This Act was passed by the Punjab Assembly on 5 October 2007; assented to by the Governor of the Punjab on 29 October 2007; and, was published in the Punjab Gazette (Extraordinary), dated 30 October 2007, pages 1463-67.
