  1. Subjecttoregulations14(2)and25,apartymayattendthehearingandmaybeassistedorrepresentedbyany personwhether or not that personislegallyqualified.

Representationsand supporting information

  1. At thehearingapartyshallbeentitledto—

(a) inresponsetoapointuponwhichtheauthorityhasgivennoticetoapartythatitwillwantclarificationunder regulation7(1)(d),givefurtherinformationinsupportoftheirapplication,representationsornotice(as applicable),

(b) if givenpermissionbytheauthority, questionanyother party; and

(c)addresstheauthority.

Failureof partiesto attend thehearing

20. ―(1)Ifapartyhasinformedtheauthoritythathedoesnotintendtoattendorberepresentedatahearing,the hearingmayproceedinhisabsence.

(2)If apartywhohasnot soindicatedfailstoattendor berepresentedat ahearingtheauthoritymay—

(a) whereit considersit tobenecessaryinthepublicinterest, adjournthehearingtoaspecifieddate, or

(b) holdthehearingintheparty'sabsence.

(3)Wheretheauthorityholdsthehearingintheabsenceofaparty,theauthorityshallconsideratthehearing theapplication, representationsor noticemadebythat party.

(4)Wheretheauthorityadjournsthehearingtoaspecifieddateitmustforthwithnotifythepartiesofthedate, timeandplacetowhichthehearinghasbeenadjourned.

Procedureat hearing

  1. SubjecttotheprovisionsoftheRegulations,theauthorityshalldeterminetheproceduretobefollowedatthe hearing.
  1. Atthebeginningofthehearing,theauthorityshallexplaintothepartiestheprocedurewhichitproposesto followatthehearingandshallconsideranyrequestmadebyapartyunderregulation8(2)forpermissionfor another persontoappear at thehearing, suchpermissionshallnot beunreasonablywithheld.
  1. Ahearingshalltaketheformofadiscussionledbytheauthorityandcross-examinationshallnotbepermitted unlessthe authorityconsiders thatcross-examination isrequired foritto considerthe representations, applicationor noticeasthecasemayrequire.
  1. Theauthoritymustallowthepartiesanequalmaximumperiodoftimeinwhichtoexercisetheirrightsprovided for aregulation16.
  1. Theauthoritymayrequireanypersonattendingthehearingwhointheiropinionisbehavinginadisruptive manner toleavethehearingandmay—

(a) refusetopermit that persontoreturn, or

(b) permit himtoreturnonlyonsuchconditionsastheauthoritymayspecify,

butsuchapersonmay,beforetheendofthehearing,submittotheauthorityinwritinganyinformationwhich theywouldhavebeenentitledtogiveorallyhadtheynot beenrequiredtoleave.
