For individualand exclusive use, space describedas: 10x10’booth, in the Merchant’sBuilding for the periodof time indicated above asfair dates(July10th-15th, 2017). The agreed rentalorleaseof thisspaceis supplied with no pipe and drape, you are not promised a wall, but you are allowed to bring dividers if you so choose ( see rules). Your booth does NOT have to be manned at all open hours but NCCFC is NOT liable for stolen merchandise.

**Thiscontractmustbe signedand returned to the NobleCountyCommunityFair Corporation at the contactaddresslisted above, along with your liability insurance, onor beforeJune 1,2017, or the space willbeconsideredreleased. Vendormust have both contract and insurance before set up will be allowed.

Merchant Building Rules-

-Shall you choose to NOT man your booth; NCCFC will not be responsible for stolen merchandise.

1.No sub-letting ispermittedwithout theapprovalof the Noble CountyCommunityFair Corporation (NCCFC).

2.The displayofallsigns, pictures, the distribution ofalladvertising matter andliterature ofanycharacter, theinstallationof all
decorationsand the alterationof the appearance of thespace herein leasedshallbe,at alltimes, subjectto thesupervision and ultimate controlof the NCCFC.

3.Allselling must be conducted frominside Lessee’sspace. Lessee’ssalesman andotheremployeesmust notblockaislesorsolicit from anyplace other thanthespacetheyrented (unlessapprovedbyNCCFC). The useofloudspeakersandotheramplified
equipmentshallbe subject tocontrolbythe NCCFC.

4.Totalenclosureof thepartitionsbetween boothsisnot permittedabove a standardized height of51”.Wings(fullheight) are
permissibleup to4’from thebackwall.

5. In theevent of amistakeinspacecontractedfor, the NCCFCreservesthe right tomake a change in space, as they deem
necessary.

6.EachExhibitorwillbe furnished one (1)weeklygate passfor each spaceleased. Any others needed, will have to be purchased.

7.We askthateach vendor not dismantle hisor herbooth untilthedismantletime (Saturday, July 15th after closing {10pm} or Sunday, July16th,10am-2pm).Ifyouchooseto dosoyou will forfeit your location and possible rental of abooth for next year. (If for some reason you wouldlike todismantleearly, please contact the Committee chairman at least 24 hoursin advance so that arrangementscan bemade.)

8.MERCHANT VENDORS- Allelectricalhook-upsand installationsmust beapprovedand acceptable tothe NCCFCelectrician andelectricalloadmustalso be approved and acceptable to the NCCFCelectrician. Anyadditionalwiring cost willbe charged asdetermined byhim.

9.Lessee agreesthat allexhibits, displays, materials, products, and salesshallbeconsistent with theadvancementof thepurposes of the Fair andif not,shallbe removed andsubject tosettlement at theexclusivedetermination of the Noble County Fair Corporation.

Vendors are NOT PERMITTEDto sell guns and knives including airsoft.

10.The NCCFCassumesnoliabilityfor lossto propertyor reason of anyclaimforpersonalinjury. The Lesseehereinreleasesand dischargesthe NCCFC, itsBoard, itscomponentmembersand theirsuccessors,fromliabilityofanycharacter and aggressindemnify said partiesfromanyand allliabilitybyreason of injuryto propertyand/or persons, including death,whichmayoccur withinor upon

the premiseshereindescribedin anymanner connected withuse thereof byLessee.

11.Certificateof Insurance ofliabilityand propertydamage in an amount acceptableto theNCCFCmust accompanythiscontract.

The Lessee herebyagreestostrictcompliance with I.C. 22-9-1-10 (Section 10 of theIndiana CivilRightsAct) and further agreesthat to complywith saidlaw willconstitute a materialbreach of thiscontractand that anyliabilityfor violation byyou, youragents,
employees, subcontractors, their agentsand/or employees,shallbeanswered for byyou.

Further, incompliance with I.C. 22-9-1-2, allgoods,servicesand/or facilitiesare tobe provided withoutregard to race, religion, color, sex, nationalorigin orancestry, and failure to complywith thisrequirementconstitutesan assumptionof anyandallliabilityfor failure to complybyyourself, your agents, employees, subcontractors, theiragentsand/or employees.

It isfurther understood andagreed byand between thepartieshereto thatintheevent thateither NCCFCor lesseeshalldefaultin anyof the Conventsbythem to be hereinkept, then in the event, the defaulting partyshallbe liabletothe non-defaultingpartyforall court costsincluding attorney’sfeesexpanded to enforce the termsof thisagreementbythe non-defaulting party.
