Gun Control and Legislation - Resolution No. 1117 - November 17, 1975

RESOLUTION NO. 1117

A RESOLUTION SETTING FORTH THE POSITION OF THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS, ON FIREARMS ENFORCEMENT POLICY AND LEGISLATION.

WHEREAS, strict "gun control" legislation would be an infringement on the right of the citizens to keep and bear arms under the second amendment to the United States Constitution; and

WHEREAS, the misuse of firearms by a relatively small group of individuals should not result in constriction of the rights of the rest of the populace; and

WHEREAS, there are alternative courses of action to be explored and tried in an attempt to reduce the number of firearmrelated offenses; and

WHEREAS, increased and strengthened enforcement of existing or alternative legislation relating to the use of firearms in the commission of a crime is preferable to strict "gun control" legislation.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS:

1. That all levels of government should enact and strengthen laws relating to the use of firearms in the commission of a crime;

2. That such legislation impose mandatory, minimum jail sentences without eligibility for suspension, probation or parole for the use of a firearm in the commission of a crime.

3. That any person seeking to purchase a firearm be required to file an application for purchase with the seller and be required to wait at least five (5) days from filing of application before the actual purchase may be made;

4. That the alternative courses set forth above be explored and experimented with prior to the enactment of any strict "gun control" legislation.

ADOPTED by the Governing Body of the City of Overland Park, Kansas, this 17th day of November, 1975.
